Moved: Dovey Seconded: Ferrell Passed: Unanimously, 3-0 Approval of Department of Ecology Pass-Through Grant Eapenditures SWM Manager Will Appleton presented informarion on this item. There was no public comment. Committee Member povey asked if staff plans to train residents on rain gardens, are there grants available to residents who wish to build one. Mr. Appleton explained that to avoid the use of public funds to construct a rain garden on private properiy, staff is looking at the possibility of allowing residents to be trained on rain gazdens, use public funds and help build the rain gardens on public property. An example might be to build a rain garden on school district property. A school site would be highly visible and would draw lots of attention. Committee forwarded Option #1 as presented. King County Conservation Futures Funds update, AuthorizaHon to Transfer Matching Funds From the SWM unallocated into the SWM 2010 Budget Upon Receiving Notice of Additional Conservation Futures Allocation and to Pursue Acquisition of the Bridges Property SWM Manager Will Appleton presented information on this item. There was no public comment. Mr. Appleton highlighted the cost of acquiring the Bridges property. Mayor Kochmar asked about how the property would be used once acquired. Mr. Appleton answered that the City's matching funds portion will come from the SWM unallocated funds account. There are sufficient funds to purchase this property. The subject land will be used to potentially develop and tie into the existing parks/trails and may also be used from an educational outreach standpoint. Mr. Appleton added that the properties shown on the map in red are pazcels of interest; staff is interested in purchasing these in the future for conservation purposes. Friends of the Hylebos have and will continue to parhier with the City in this restoration project. Staffwill be looking into the future connectivity of pazks and trails with the Parks Department as well as how such a project could be funded. Committee forwarded Option #1 as presented. Moved: Dovey Seconded: Ferrell Passed: Unanimously, 3-0 Amendment to Exhibit A to the City Center Planned Action Ordinance Senior Planner Janet Shull presented information on this item. There was no public comment. Committee Member povey asked why the area on the map was not taken all the way to the freeway. Ms. Shull responded that staff evaluated that area and felt there would likely be no proposed redevelopment activity of any significance within the additional area prior to 2014, which is when the Planned Action EIS expires. Staff could always amend the ordinance at a later date should there be interest in developing any of the land closer to the freeway. Deputy PW Director Miller also stated that the size of the area in the Planned Action EIS was such that adding the additional land may trigger the need for analysis to determine impact that development may have. 5/4/2010 Ordinance 1" Reading F. Chair Duclos invited Mr. Garrett Huflinan to make public comment: Garrett Hu,�man, Master Builders Association of King and Snohomish Counties — Encouraged the Committee to approve Option 2. Mr. Hu�`'man also thanked stafJ; the Committee and Council for their ef,�'orts in seeing this issue through. Committee Member povey asked what would happen if the developer goes bankrupt. Who is responsible for paying these fees? Mr. Herrera explained that a covenant would be recorded against the property once the home had been built. Fees would be paid at the point of sales transaction. Chair Duclos thanked staff and all outside representatives involved, who have worked on this topic and have found a solution that everyone is happy with. Committee forwarded Option #2 as presented. OTHER Mayor Kochmar provided positive feedback from a new Subway. Owning multiple Subways in multiple jurisdictions, the Subway owners complimented Mayor Kochmar on how nice it was to work with Federal Way staff in regard to permitting and the entire process. 5. DECISIONAL CRITERIA FWRC 19.80.130 provides criteria for development regulation amendments. The proposed amendment is consistent with the applicable provisions of the comprehensive plan. LUP6 — Conduct regular reviews of the develapment regulations to determine how to irnprove upon the permit review process. TP L— Integrate land use and transportarion plan decisions to support the land use vision and plan. TPS — Protect neighborhoods from traffic impacts. TP 14 — Provide access between ma.jor development areas idenrified in the recommended alternative, while improving business access and protecting City neighborhoods. TP20 — Take advantage of opportunities to open new road connections to cre�ate route alternatives, especially in areas with few access choices. TP21 — Enhance traffic circularion and access with closer spacing of through streets, unless geographical constraints do not permit. Commissioners absent: Hope Elder (not excused). Staff present: Senior Planner Margaret Clark, Senior Traffic Engineering Maryanne Zukowski, Assistant City Attorney Peter Beckwith, and Administrative Assistant Tina Piety. Chair Pfeifer called the meeting to order at 7:00 p.m. APPROVAL OF MINUTES The minutes of February 17, 2010, were approved as written. AUDIENCE COMMENT None ADMI1vISTRATIVE REPORT Ms. Clark reminded the Commissioners of the City of Federal Way Volunteer Dinner to be held this Friday, Apri123`� and encouraged them to attend. Based on City Council direction, staff will be applying for a grant from King County Health. The funds are for health related issues and South King County is a focus area. Staff plans to apply for $300,000 to prepare a Pedestrian and Bicycle Plan that will be incorporated by reference into the Federal Way Comprehensive Plan. In addition, staff will be asking the City Council to consider a subarea plan for the area near Fred Meyer. CONIMISSION BUSINESS PUBLIC HEARING — Block Perimeter Ms. Zukowski delivered the staff presentation. Presently, the city regulates the size of block perimeters to no gi`eater than 2,640 feet, as measured on centerlines, unless a modification is granted. However, although this language is contained only within the Federal Way Revised Code (FWRC) Subdivision Title, it is applied to all development. The proposed code amendment is intended to delete the language from the Subdivision Title 18 and add it to the Zoning and Development Code Title 19, with a cross reference in the Subdivision Title 18 to the Zoning and Development Code Title 19. Commissioner O'Neil asked what advantage is there to breaking up superblocks. Ms. Zukowski responded that one of the advantages is that it makes the area more accessible, to both foot and vehicle traffic. Commissioner Long asked which department (Community Development or Public Works) will have authority to allow modifications. Ms. Clark replied she assumes it will be Public Works, since the amendment deals with streets. Should the word be changed to "shall"? Commissioner Carlson commented that the word should be "shall: ' Since that particular regulation was not reviewed as part of the proposed amendments, staff will research this issue. As part of the staff presentation, Ms. Zukowski showed a conceptual map plan of the city center with the superblocks broken up into smaller blocks. Commissioners asked how the city plans to achieve this conceptual design, given that many of the proposed streets run though buildings. Ms. Zukowski explained that the city does not have an"official plan" to achieve this conceptual map. Rather, as an area is redeveloped, the developer is asked to consider this concept (in addition to the block perimeter regulations) when planning the redevelopment. Sara Cardson, out-of-town visitor — Will it not cost the city a lot of money to create these streets? Chair Pfeifer explained that developers are required to mitigate, or pay, for road improvements. Commissioner Bronson moved (and it was secondea� to recommend the City Council adopt the FWRC text amendments as proposed. The motion carried unanimously. The public hearing was closed. ADDITIONAL BUSINESS Staff anticipates there will be no meetings in May. They are working on items from the Planning Commission Work Plan that will be presented once they are ready. AN ORDINANCE of the City of Federal Way, Washington, relating to Subdivision Improvements amending FWRC section 18.60.050 Streets and rights-of-way and adding a new section to FWRC 19.135 amending Ordinance Ord. No. 09-630, Ord. No. 07-554, Ord. No. 98-330, Ord. No. 97-291 and Ord. No.90-41. � WHEREAS, the City recognizes the need to periodically modify Title 18 of the Federal Way Revised Code (FWRC), "Subdivisions" and Title 19 of the FWRC, "Zoning and Development Code," in order to conform to state and federal law, codify administrative practices, clarify and update zoning regulations as deemed necessary, and improve the efficiency of the regulations and the development review process; and WHEREAS, this ordinance, containing amendments to development regulations and the text of Title 18 FWRC and Title 19 FWRC, has complied with Process VI review, chapter 19.80 FWRC, pursuant to chapter 19.35 FWRC; and WHEREAS, it is in the public interest for the City Council to adopt new amendments to the FWRC which establish and clarify development regulations for Block Perimeter Standards within the City of Federal Way; and WHEREAS, it is in the public interest for the City Council to adopt new housekeeping amendments to the FWRC which clarify how the code is to be implemented; and WHEREAS, an Environmental Threshold Determination was not necessary as the amendment is related solely to governmental procedures and therefore, categorically exempt from the State Environmental Policy Act; and WHEREAS, the Planning Commission properly conducted a duly noticed public hearing on these code amendments on Apri121, 2010, and forwarded a recommendation of approval; and Ordinance No. 10— Page 1 of 6 Rev 1/10 LU 13 WHEREAS, the Land Use/Transportation Committee of the Federal Way City Council considered these code amendments on May 3, 2010, and recommended adoption of the text amendments as recommended by the Planning Commission. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Findin�s. T'he City Council of the City of Federal Way makes the following findings with respect to the proposed amendment. (a) These code amendments are in the best interest of the residents of the City and will benefit the City as a whole by providing clarification for Streets and rights-of way pertaining to Block Perimeter Standards. (b) These code amendments comply with Chapter 36.70A RCW, Growth Management. (c) These code amendments are consistent with the intent and purpose of Title 19 FWRC, will implement, and are consistent with the applicable provisions of the Federal Way Comprehensive Plan. (dj These code amendments bear a substantial relationship to, and will protect and not adversely affect, the public health, safety, and welfare. (e) These code amendments have followed the proper procedure required under the FWRC. Section 2. Conclusions. Pursuant to chapter 19.80 FWRC and chapter 19.35 FWRC, and based upon the recitals and the findings set forth in Section 1, the Federal Way City Council makes the following Conclusions of Law with respect to the decisional criteria necessary for the adoption of the proposed amendments: Ordinance No. 10-- Page 2 of 6 Rev 1/10 LU 14 (a) The proposed FWRC amendments are consistent with, and substantially implement, the following Federal Way Comprehensive Plan goals and policies: LUP4 — Maximize efficiency of the development review process. LUP6 — Conduct regular reviews of the development regulations to determine how to improve upon the permit review process. TP 1- Integrate land use and transportation plan decisions to support the land use vision and plan. TPS - Protect neighborhoods from traffic impacts. TP14 - Provide access between major development areas identified in the recommended alternative, while improving business access and protecting City neighborhoods. TP20 - Take advantage of opportunities to open new road connections to create route alternatives, especially in areas with few access choices. TP21 - Enhance traffic circulation and access with closer spacing of through streets, unless geographical constraints do not permit. Limit the area to be served by a single access point commensurate with planned density. Ordinance No. 10-- Page 3 of 6 Rev 1/10 LU 15 (b) T'he proposed FWRC amendment bears a substantial relationship to the public health, safety, and welfare because it will clarify that block perimeter standards apply to all development and not just subdivisions (c) The proposed amendment is in the best interest of the public and the residents of the City of Federal Way because it provides clarity to an existing code provision. Section 3. FWRC 18.60.OSU is hereby amended to read as follows: 18.60.050 Streets and rights-of-way. (1) Streets within an approved land division shall be within a dedicated public right-of-way. Private tracts may be used in short subdivisions and cluster subdivisions using cross-section type "Y" as described in FWRC 19.135.250. Ingress/egress and utilities easements and alleys may be utilized when certain conditions established in the city of Federal Way public works development standaxds are met. (2) All streets within the public rights-of-way shall be improved to the standards specified in Chapter 19.135 FWRC, regarding required improvements to rights-of-way. Improvements to private tracts, alleys, and ingress/egress and utilities easements shall comply with the city of Federal Way public works department development standards. (3) All streets abutting a land division shall be improved in accordance with Chapter 19.135 FWRC, and the city of Federal Way public works development standards regarding required improvements. Section 4. Chapter 19.135 is hereby amended to add a new section 19.135.251to read as follows: Ordinance No. 10-- Page 4 of 6 Rev 1/10 LU 16 19.135.251 Block Perimeters Streets shall be provided to develop a street network with a block perimeter of no �reater than 2,640 feet as measured on centerlines This requirement may be modified if connections cannot be made due to: �a) Topo�raphical constraints. �) Environmentally sensitive areas. �c) Adjacent development not being conducive. Section S.�,Severabilitv. The provisions of this ordinance are declared separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the ordinance, or the validity of its application to any other persons or circumstances. Section 6. Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. Section 7. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. Section 8. Effective Date. This ordinance shall be effective five (5) days after passage and publication as provided by law. This is $1,396,977.84 below the $16,574,810.00 (including contingency) budget that was approved by the City Council on Apri13, 2007.
