(AMENDING ORDINANCE NO. 91 -93 AND ORDINANCE NO. 93 -186). WHEREAS, the Federal Way City Council recognizes that parks and recreation are vital to the community's quality of life, important in attracting visitors and tourists, valuable as a source of commerce and industry, and desired by businesses considering location in the City; and WHEREAS, by Ordinance No. 91 -93 the Federal Way City Council has provided for the establishment of the Parks and Recreation Commission (the "commission ") as amended by ordinance No. 93 -186; and WHEREAS, it is necessary to provide for annual appointments to fill vacancies on the commission and to provide for the removal of commission members who are not fulfilling their responsibilities; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Amendment. Section 11 -27 of Article II. Parks and Recreation Commission of the Federal Way City Code ( "FWCC ") shall be amended as follows: ORD # , PAGE 1 • • ARTICLE II. PARKS AND RECREATION COMMISSION* Sec. 11 -27. Membership. (a) The parks and recreation commission shall consist of nine (9) members appointed by the city council. (b) The parks and recreation commission shall serve without compensation. (c) Each member shall serve a term of three years.; except appointed for a tcrm ending Dcccmbcr 31, 1993, thrcc shall be appointed for a tcrm ending Dcccmbcr 31, 1994, and thrcc shall be filled for any unexpired term in thc same manncr as thc original appointment. The city council shall annually appoint new members to fill the expiring terms on the parks and recreation commission. If, for any reason, a vacancy occurs during the term of a parks and recreation commission member, the city council shall appoint a new member to fill the unexpired term of that member. The city council may remove a parks and recreation commission member at any time if the city council determines that member is not fulfilling his or her responsibilities to the satisfaction of city council. All members of the parks and recreation commission shall serve until their successors are duly appointed by city council. (d) Persons appointed to serve on the commission shall reside within the corporate limits of the city during the members' terms. The provisions of this ordinance are declared separate and severable. Section 3. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. Section 4. Effective Date. They are requesting to lease approximately 600 square feet of the park for the installation of a 75 to 120 foot cellular tower. I have enclosed a copy of a hand -drawn map that shows where in the park they are proposing to install the tower. I have walked the site with Mr. Dan Menser from the Walter Group. The proposed location is next to a treed area of the site, east of the tennis court and north of the picnic area. The proposed tower site would not eliminate access to the park trails nor use of the other improvements that we have in place. Cellular towers fall under the definition of public utility in the Federal Way Zoning Code. Public utilities located in a residential zoning district (RS 9.6 in this case) must be approved through Land Use Review Process III. This, of course, involves going to the Federal Way Hearing Examiner before which a public hearing would be held. Given the fact that up to four months of process could be involved from the point the Walter Group makes a permit application and proceeds through the Process III, staff must first receive the Council Committee's direction on whether Adelaide Park could be considered for this purpose. Dan Menser of the Walter Group will be present at the Committee's November 12 meeting. At that time, he will be available to answer any questions. I have included a conceptual picture of the cellular tower for your use. The City agreed to have the Parks and Recreation Council Committee review the District's request to establish a property line division of French Lake Park that provides the City with 50% ownership with the remaining 50 % ownership for the District to assume after buying out the Fire District's original interest in the property. Enclosed for your review is a copy of the "Agreement Principles" presented by the District, along with a map that identifies the Lakehaven and Fire Districts existing parcels that are contiguous to the French Lake Park parcel that is listed as "Parcel A". I would like to go over these documents with Council Committee at the November 12 meeting. City and Lakehaven each own 50% of property; Lakehaven will buy out FD 39. 2. Lakehaven will be able to use its portion for water wells, water facilities and other utility purposes. Before taking possession and making use of any of the property now used as a park, Lakehaven will provide reasonable notice to the City. 3. Lakehaven will own Lakehaven Center and the storage shed. 4. The parking lot will be joint use. Lakehaven will provide notice to the City if Lakehaven events will require intensive use of the parking lot. 5. Subject to additional negotiations, Lakehaven will either relocate the existing fence so that it is much closer to Lakehaven Center or the fence separating Lakehaven Center from the park will be eliminated. Lakehaven's exclusive property will consist of Lakehaven Center, the Conservation Garden, the existing property between Lakehaven and the Conservation Garden and additonal property on the west end of the land now used as a park. 6. The Conservation Garden will remain fenced off from the park; Lakehaven will provide a gate directly from the park to the garden. 7. If necessary, Lakehaven will plant ivy along the cyclone fence separating the park from the utility. 8. Until such time as Lakehaven takes possession and makes use of the property owned by Lakehaven, the City will maintain such property and use it as a park. 9. Lakehaven will establish an access road running north -south along the western boundary of the property. 10. Lakehaven's compost distribution activities will take place at the Lakota Wastewater Treatment Plant. 11. If Lakehaven's Comprehensive Water System Plan determines there is a need for additional property for water utility purposes, and that the City's exclusive property is optimal for such uses, the City will negotiate easements to permit such uses within the park. The cost estimate for Alternative "C" is approximately $6,583,606. At that meeting, the Committee asked the consultant to identify the costs to make the existing fields playable. Attached is a memo from Marty Lyon that outlines his estimate to make the existing fields playable. In addition, I instructed Mr. Lyon to include the costs for demolition of the existing restroom and the installation of a new restroom with concession space. The summary cost for upgrading the existing turf fields with a new restroom /concession building is approximately $552,972. JLS:scf • Marty A. These improvements would generally be classified as maintenance. Currently the soccer fields and baseball field west of the track have a relatively new and operational irrigation system, the fields east of the track do not. Maintenance improvement would be limited to installing an irrigation system to the east side of the track and renovating all the turf, which includes thatching, aerating, top dressing with top sand mix and overseeding all of the fields. This technique has generally proven to be successful if the turf is allowed to germinate and become fully established before the fields are used by the athletic clubs. However, this does not address the water and drainage problems which exist on the site. The previous cost estimates which I prepared did include minor grading of the existing field, building up the field with cut materials from site construction as well as importing 12" of a sandy growing medium. Additionally there would be a complete sub - surface drainage system, a new automatic irrigation system and newly seeded fields. This process will assure year `round use, after the turf becomes fully established. Our recommendation is to keep people off a newly seeded field for one full year from date of seeding. An example would be the new fields are seeded by Labor Day, after summer construction, and opened up for use the following Labor Day after school begins. Following is an itemized cost estimate for the maintenance improvements. As you can see this is substantially less than our cost estimate for new construction. All of our recommendations assumes complete reconstruction of park improvements, therefore their costs would be similar to B and C, about $6,000.000 to $6,500,000. They were extremely cooperative, professional, and put in a lot of effort. I had a scheduled field maintenance time at mid - afternoon on Saturday, to which they utilized only hand tools to upgrade the fields' condition and added chalk lines. Their hard work helped me to continue with the games. Sunday morning Y ames. day's Sunda mornin they made an extreme effort to prepare the fields for the final few games of the tournament. Again, they used mainly hand tools, and later some small machinery to get the fields at Steele Lake in near - perfect condition for the day's games. Later on Sunday they put in an excellent effort with machinery and hand tools to prepare the fields for the championship game. Their attention to detail made me proud of the fields. I have been involved in twenty itch softball for over years as a Player, Coach, Umpire, P tY Y ave seen the full spectrum Director, and Tournament Director. I have ectrum of situations that includes p fields, field maintenance, and weather. In my opinion, if your field maintenance staff had not been cooperative, knowledgeable, ble � and very hard workers, I would have had to cancel my tournament due to P wet weather conditions on Saturday. Their outstanding aggressive effort made it possible to complete the games and helped the schedule to stay on time. Many coaches and players made mention to me of their amazement of completing the tournament and of how well the fields were maintained. I personally extend my applause and appreciation to you and your staff for a job well done.
