AN ORDINANCF, of the City of Federal Way, Washington, relating to
the Con�ii Process of Mayoral Appointments for ldentified
Appointive Positions; amending FWRC 2.10.13. (.Amending Ordinance
No. 10-643)
WHER_EAS, the City C'ouncil of I,ederal Way adopted Ordinance No. 10-643 establishing
the Mayor's authority and the. c:�nfirmation process in preparation for the change of governmcnt to
the May�r-C'ouncil form of government; and
WHEREAS, in reviewing the language �f the confirmation process the City C-uuncil desireci
to mo�lify the i-:mguage to c:arify the time frame for Council action and to defin� short term
appointments.
NOW, 'I'HEREFORF�; THE CITY COUNCIL OF THE CITY OF FEDE2AL JVA�',
WASHTNGTG?�T, DC) rJRD�IN AS FOLLOWS:
Section 1. F`vVRC' 2.1O 13 is hereny amended to read as follows:
2.1Q.13 Ruies for Appointir�g Officers.
The Uepartment off�cers and administrators identifie� by the City Council shall be appointed r;y
t�ie Mayflr and subject to �on��rmation b;i � majority of the members of the Cit�r Cour��il. If the
Co�ancil shall refuse to �onfirrn any such i�omination of the Mayor, then the Mayo� shall appoin�
another person to fill the office, and the �;;ayor may continue to a��oint until the ap�iaintee is
confirmed. The Mayor shall �resent information of the proposed appointment seeking
confirmation at a regularly scheduled co�.�ncil meeting. Following the Mayor's presentation the
Council shall have up to two regularly scheduled council meetings to act upon the Mayor's
appointment, but shouid the Council fail ta act within that period of time, the appointment w�ll b�
deemed confirmed. The Mayor shall hav� the ability to make +��er+�► short term app�intments
those for up to six months ir duration v��ithout Council confirmation. Authorization the City
Council is required for extensions of the short term appointments.
Section 2. Severabilitv_ Shauld any secti�n, subsection, paragraph, sentence, clause, or
phrase of this chapter, or its application ti� any person or situation, be declared unconstitutional or
invalid for any reason, such decision shall not affect the validity of the remaining portions of this

chapter or its application to any other person or situation. The City Council of the City of Federal
Way hereby declares that it would have adopted this chapter and each section, subsection,
sentence, clauses, phrase, or portion thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses, phrases, or portions be declared invalid or
unconstitutional.
Section 3. Corrections. The City Clerk and the codifiers of this ordinance are authorized
to make necessary corrections to this ordinance including, but not limited to, the correction of
scrivener/clerical errors, references, ordinance riumbering, section/subsection numbers and any
references thereto.
Section 4. Ratification. Any act consistent with the authority and prior to the effective
date of this ordinance is hereby ratified and affirmed.
Section 5. Effective Date. This ordinance shall take effect when the elected mayor assumes
office pursuant to RCW 35A.02.050 as provided by law.
