A RESOLUTION of the City Council of the City of Federal Way,
Washington, Repealing Resolution No. 08-539 and Authorizing the
Mayor or Designee to Settle Claims up to $25,000.
WHEREAS, effective November 2010, the form of government will change to a Mayor-
Council form pursuant to RCW 35A.12, et seq.; and
WHEREAS, Resolution No. 08-539 needs to be repealed because the position of city
manager will no longer exist after November 2010, and the Chief Executive Officer will be the
elected Mayor; and
WHEREAS, pursuant to RCW 35A.12.100, the City of Federal Way Mayor is authorized to
organize and regulate the internal affairs of the City of Federal Way; and
WHEREAS, the Mayor is authorized, pursuant to RCW 35A.12.100, to supervise the
administrative affairs of the City; and
WHEREAS, the City is insured by Washington Cities Authority Association ("WCIA"); and
WHEREAS, the insurance agreement with WCIA provides WCIA the discretion to settle
claims as part of their business; and
WHEREAS, the city manager has historically had the discretion to settle claims and authorize
payments up to $25,000; and
WHEREAS, it is in the best interest of the City for the Mayor or designee to continue to have
discretion to settle certain claims in an expedited manner in accordance with the insurance
agreement;

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
RESOLVES AS FOLLOWS:
Section 1. Authorization. The Mayor or designee is hereby authorized to settle claims
against the City up to twenty-five thousand dollars ($25,000). Any claims exceeding said sum will
be brought to the City Council.
Section 2. Severabilitv. If any section, sentence, clause or phrase of this resolution should be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause or phrase of this resolution.
Section 3. Corrections. The City Clerk and the codifiers of this resolution are authorized to
make necessary corrections to this resolution including, but not limited to, the correction of
scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any
references thereto.
Section 4. Ratification. Any act consistent with the authority and prior to the effective date
of this resolution is hereby ratified and affirmed.
Section 5 . Effective Date This resolution shall become effective after the certification of the
mayor election in November 2010 when the form of government changes to Mayor-Council.
