Committee Chair Kochmar called the meeting to order at 6:01 PM.
2. PUBLIC COMMENT
There was one public comment:
Steve Kindell — He has concerns regarding the proposed speed humps for South 308"' Street. He has
communicated his concerns to the Mayor and heard back from the Mayor today and now has further
questions/concerns. The proposed placement for one of the speed humps would place it right next to a
curb. Has the city considered that this could be dangerous with snow and ice? These roads are only 38
feet wide, in the snow, a speed hump next to the curb could cause someone to slide into the curb. One
reason for the speed humps is to divert traffic, but where can traffic go? There is only one other east/west
street in the area. The area meets the criteria for speed humps because of one speeding vehicle that
skewed the results. Since we've had burglaries in the area, could this one car have been a police vehicle
going to a crime scene? I believe the speed humps will be a waste of money. Each is on a hill, which can
be a problem for drivers.
Mr. Perez responded that staff is in process of drafting a response to Mr. Kindell. Staff followed city process on this
issue. The city received a petition, a ballot was held, and the majority supported speed humps. Staff took into
consideration that the roads are hilly. In addition, diversion to other streets is not the primary goal; the primary goal is
to slow down the traffic.

Consent
City Traffic Engineer Rick Perez presented information on this item. Council Member Freeman
commented that he has been informed that speeding tickets have been written for drivers in that
area. Does staff have information on these tic�cets? Is the number of speeding tickets taken into
consideration when making a decision? Also, does staff know what day the Police radar count

was done? Mr. Perez replied that the staff does not know the number of tickets or when the radar
count was done, but he will find that information. The staff does not take speeding tickets into
consideration because they are done irregularly. The staff relies on tube counts because the tubes
can be in place all week. Council Member Freeman commented that if the city has proof of
speeding (speeding tickets), that should be taken into account when making a decision.
There were 18 public comments.
Andrea Shelley — She lives on 20` SW and drives the road a number of times each day.
She does not see any speeders. She feels it would be a waste of city funds to add stop
signs. She does not see a need from them.
Florence Hanson — She drives through the area every day. It is a north facing slope and
she is concerned about placing a stop sign at the bottom with snow and ice. People
already have problems with sliding, and having to stop will only make it worse.
Pamela Sommervile — She lives on 23` Avenue SW and has never seen an issue at that
intersection. She does not like the current speed humps because they are too high. She is
also concerned that the water from 304`" runs to 23` There needs to be a drainage
culvert.
Opal Gage — She also lives on 23` Avenue and agrees that a drainage culvert is needed.
She has never seen any congestion in this area.
Jean Koenigs — She lives on the corner of 2�` She is concerned that speed humps slow
down emergency vehicles and additional unneeded stop signs will slow them even more.
Robert Jones — He lives on 21 in the school zone. He has driven in the area over 46
years and has seen only one accident (when a car ran the stop sign). Additional stop signs
would be a waste of money.
Allen Boice — He lives on the intersection for 20 years. The current speed "mountains"
have slowed traffic in the area. He feels that a sidewalk would make it safer for kids.
Additional stop signs are not needed.
Nancy Combs — She lives on 21 Avenue SW. T'his has been an issue for many years. She
has tried a number of times to get the city to do something about the issue. She notes that
when the citizens in the area voted for two speed humps and two speed tables, the City
Council changed the vote. The area is very noisy with the school bus at 6:40 and lots of
cars. It gets so noisy she can not leave her windows open. She has witnessed two side-by-
side car races on the street. There is a four-way stop on the other side of the school, why
not on this side?
Steve Tolle — He lives across from Ms. Combs. Recently, his daughter was almost hit by a
car that blew through the stop sign. He does see a lot of speeders. If the city does not use
four-way stop signs to control speed, what are they used for?
Don Bunger — He has lived on 306` for 26 years. He supports the city's professional
opinion. He is concerned that ice does create a hazard and feels the road should be sanded
more often.
Maggie King — She lives on 24` Avenue SW. She would be impacted by congestion at a
four-way stop sign intersection. She does not want additional stop signs. T'hey already
have to deal with speed humps. The city can spend the money better elsewhere.
John Elting — He is surprised this issue has risen again. People are courteous at that
intersection. It is not a problem. The speed humps slow drivers down. Adding sidewalks
would increase safety in the area.

Rich Lesly — He has lived on 25` Avenue3SW for 15 years. He agrees with the majority
of the comments. This is a non-issue. He has not seen any problems at the intersection.

Paul Levy — He complimented Mr. Perez on his work. There was a major speeding
problem in the area years ago, but the city has responded appropriately with the speed
humps. It is a delight to walk along 21 Avenue SW. From what he has heard, this seems
to be more of a noise issue as opposed to a speed issue.
Lance Maitland — He lives on 305` The problem revolves around one person. This is a
waste of time, effort, and money.
Nancy McEleny — She has lived in the area for 45 years. Where she lives she is not
directly impacted by the issue, but she is empathetic. Those who rarely travel the area
may miss the stop signs. She suggests painting a white line on the road where people
should stop.
Brian Walker — He has lived on 17` Avenue for ten years and travels through the
intersection twice a day. He has not seen any problems. He walks along the street without
worrying about speeders.
Gary Gr ffn — He has traveled through the intersection thousands of times. It is only a
problem if people do not stop at the stop sign.
Mr. Perez explained that the city uses all-way stops as per the federal manual, which states that
an intersection should have a significant volume of vehicles and preventable accidents in order
to put in an all-way stop (the intersection in question does not meet this standard). These
numbers should be roughly even for all the streets. If there is a small volume of vehicles, people
will get used to not seeing traffic and will tend to "roll-through" the stop signs. People will
comply if they see the value. The city can put in rumble strips before the intersection, but they
are very noisy. Another thing that may help (as suggested earlier) is to paint a white line on the
street before the intersection.
Mr. Perez will talk to the Surface Water Management staff about the water runoff on 304`�' and
23` and the need for a drainage culvert. Mr. Perez said that a number of years ago city staff
researched the issue of installing sidewalks and concluded it would cost about a million dollars a
mile to install new sidewalks.

MGB559@comcast.net — Would like to know the number of complaints in regards to this
intersection. Is a resident of the neighborhood and does not find an issue with the
intersection. Is supportive if there are a number of residents who have a problem with the
intersection.
Frank Greer — A resident of the neighborhood who uses the intersection regularly. Does
not have an issue with the intersection, but would like to raise another issue. He would
like the city to install a flashing left turn light at the intersection of Dash Point Road and
312 There are numerous times when people desiring to turn left on 312` from the
northbound and southbound lanes have to wait unnecessarily for the green arrow.
Wohlwendl@aol.com — Reside at the bottom of 21 and pass the intersection several
times a day. They do not want a four-way stop at the intersection. Putting a stop sign on
21 will not solve the problem of people not stopping at the stop sign on 304`". A solution
may be to put speed humps on 304`
J048@aol.com — Why is it necessary to make this an all-way stop?
SLBLucy@aol.com — Lives in View Cliff and drives through the intersection daily. The
area of the city is calm, friendly, and safe. There is very little traffic in the area with the
exception of school times. We have speed humps and the one at this intersection makes it
difficult to make a turn into my neighborhood. A four-way stop would give people a false
sense of security and give drivers an increa�ed likelihood of accidents. Please concentrate
on more heavily trafficked areas.

MGB559@comcast.net — Suggests a traffic circle at the intersection of 21 Avenue SW
and 305` Street in order to deal with issues raised by one individual.
Julie Gillespie — A resident of View Cliff. Turns at the intersection in question are
awkward because of the unnecessary speed bumps, and more stop signs would make it
worse. There is little pedestrian traffic and we have never seen problems with vehicles
there.
Listentothemusic@comcast.net — Have lived in the area 26+ years. Are confident that the
area is safe and secure. Would like the city to focus on more concerning issues with
respect to Federal Way priorities.
Mr. Perez commented that speed humps on 304`�' may help the issue of cars ruruiing the stop
signs. The city has not received a received a request for speed humps on 304"'. Committee
Member Ferrell thanked the audience for attending and expressing their concerns. He thanked
the staff for their work. Chair Kochmar commented that we want to be as responsive as possible
to our citizens.

Background: T'he City adopted Ordinance 07-556 on November 6, 2007, which authorized the City to adopt the
process for eliminating unfit structures as authorized by Chapter 35.80 RCW. The City is proposing amendments
to add a section to clarify what constitutes a dangerous or unfit premise, and change who is designated as the
City's improvement officer and appeals commission.

AN ORDINANCE of the City of Federal Way, Washington, relating to
Unfit Premises; amending FWRC 1.15.140;1.15.160;1.15.180;1.15.190;
1.15.250; and adding new section to FWRC Chapter 1.15. (Amending
Ordinance No. 07-566)
WHEREAS, the City recognizes the need to periodically modify Title 1, General
Provisions of the Federal Way Revised Code (FWRC), in order to clarify and update regulations as
deemed necessary, and improve the efficiency of the regulations; and
WHEREAS, there exists within the City premises that are unfit for human habitation,
or other uses, due to conditions increasing the hazards of fire, accidents, or other calamities,
inadequate drainage, rodent harborage or other conditions harmful to the health and welfare of the
residents of Federal Way; and
WHEREAS, the City recognizes the detrimental effects on public health, safety, and
welfare stemming from unfit premises at various locations throughout the City;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Chapter 1.15 of the Federal Way Revised Code is hereby amended to add
a new section to read as follows:
1.15.175 Dangerous or unfit uremises.
Premises which have any of the following conditions shall be deemed dan�erous or
unfit:
(l) Premises that contain trash ��ba�e junk old wood, buildin� materials,
��liances brush tree limbs or other items that mav attract rats or other vermin due to a food source

or rodent harbora�e;
(2) Premises that have any number of unsecured vehicles cars, trucks, bikes, farm
eQUipment construction eguipment boats trailers snowmobiles jet skis or other machinerv or
implements that are unused and apparently ino�erable that are an attractive nuisance and dan�erous;
(3) Premises that are unsecured and unsafe due to conditions that pose a hazard or
attractive nuisance such as but not limited to sink holes• exposed under�round vaults, pipes or wires;
trenches; unstable slopes; or hazardous materials.
(4) Premises that have dilapidated fences sheds carports or other such structures that
pose a hazard or attractive nuisance; or
�51 Developed Qremises that have over 50 percent of the area covered in blackberries
or other noxious weeds.
Section 2. FWRC 1.15.140 is hereby amended to read as follows:
1.15.140 Findings.
It is found that there exist, in the city of Federal Way, dwellings and other buildings,
structures, and premises which are unfit for human habitation and which are unfit for other uses due
to dilapidation, disrepair, structural defects, defects increasing the hazards of fire,
accidents, or other ca.lamities, inadequate drainage, overcrowding, or due to other conditions which
are detrimental to the health and welfare of the residents of the city. Dangerous or unfit buildings or
structures as defined by FWRC 1.15.170 and dangerous or unfit premises as defined bv FWRC
1.15.175 are declared to be public nuisances.
Section 3. FWRC 1.15.160 is hereby amended to read as follows:
1.15.160 Improvement officer and appeals commission designated.

(1) The city of Federal Way � building official, or his or her desi�nee,
is designated as the city's improvement officer, and shall have the full scope of authority granted to

(2) The city of Federal Way �hearing; examiner, ��� �� a°�:� ; is
designated as the city's appeals commission, and shall have the full scope of authority granted to that
commission under Chapter 35.80 RCW.
Section 4. FWRC 1.15.180 is hereby amended to read as follows:
1.15.180 Standards for repair, vacation, or demolition.
The following standards shall be followed in substance by the improvement officer
and the appeals commission in ordering repair, remediation, vacation or demolition of buildings e�
structures or premises:
(1) If the dangerous or unfit building, e�-structure or premises can reasonably be
repaired or remedied so that it will no longer exist in violation of the terms of this
chapter, it sha11 be ordered repaired or remedied by the improvement officer or by the appeals
commission, on appeal.
(2) If the dangerous or unfit building, e�-structure or premises is 50 percent or more
damaged or decayed or deteriorated in value, it shall be demolished. "Value " as used herein shall be
the valuation placed upon the building or structure for purposes of general t�ation.
(3) If the dangerous or unfit building e�-structure or premises cannot be repaired or

remedied so that it will no longer exist in violation of the terms of this chapter, it shall be
demolished.
(4) If the dangerous or unfit building e�-structure or premises is a fire hazard, e�sting
or erected in violation of the terms of this chapter or any other ordinance of the city of Federal Way
or the laws of the state of Washington, it shall be demolished or abated, provided the fire hazard is
not eliminated by the owner within a reasonable time.
Section 5. FWRC 1.15.190 is hereby amended to read as follows:
1.15.190 Issuance of complaint.
If, after a preliminary investigation of any dwelling, building, structure or premises,
the ^���'^���'a�~�- ���^�°' improvement officer, or his or her designee, finds that it is unfit for human
habitation or other use, the'�•��'a�r�- ���^;�,, �r'�;� ^°'�°r a°" improvement officer, may issue a
complaint conforming to the provisions of RCW 35.80.030, stating in what respects such dwelling,
building, structure or premises is unfit for human habitation or other use. In determining whether a
dwelling, building, stxucture or premises should be repaired or demolished, the building official sha11
be guided by the Federal Way Revised Code, specifically FWRC 1.15.170 and .175
and such other codes adopted pursuant to the Federal Way Revised Code as the improvement officer
�•���a� �����^' deems applicable, in particular the most recent edition ofthe International Property
Maintenance Code.
Section 6. FWRC 1.15.250 is hereby amended to read as follows:
1.15.250 Remediation — Penalties.
If a party, following exhaustion of the party's rights to appeal, fails to comply with the
determination, findings of fact, and order, the '. improvement officer, ��'�:� ��'�°�

�es�ee may direct or cause the subject dwelling, building, structure or premises to be repaired,
remedied, altered, improved, vacated and/or closed, removed, or demolished pursuant to Chapter
35.80 RCW.
Section 7. Severabilitv. Should any section, subsection, paragraph, sentence, clause,
or phrase of this chapter, or its application to any person or situation, be declared unconstitutional or
invalid for any reason, such decision shall not affect the validity of the remaining portions of this
chapter or its application to any other person or situation. The City Council of the City of Federal
Way hereby declares that it would have adopted this chapter and each section, subsection, sentence,
clauses, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections,
sentences, clauses, phrases, or portions be declared invalid or unconstitutional.
Section 8. Corrections. The City Clerk and the codifiers of this ordinance are
authorized to make necessary corrections to this ordinance including, but not limited to, the
correction of scrivener/clerical errors, references, ordinance numbering, section/subsection numbers
and any refezences thereto.
Section 9. Ratification. Any act consistent with the authority and prior to the
effective date of this ordinance is hereby ratified and affirmed.
Section 10. Effective Date This ordinance sha11 take effect and be in force thirty
(30) days from and after its passage and publication, as provided by law.

BACKGROUND
Six (6) bids were received and opened on April 12, 2011, for the South 320 Street at I-5 Southbound
Off-Ramp Channelization Project. See attached Bid Tabulation Summary. The lowest responsive,
responsible bidder is ICON Materials with a total bid of $2,639,427.42. The low bid received was (11%)
below the engineer's estimate.
Reference checks on ICON Materials by City and WSDOT staff indicate that the contractor has
performed similar work. As a result, City staff believes Icon Materials can successfully complete this
project to the City's and WSDOT's satisfaction. Therefore, the lowest responsive, responsible bidder is
ICON Materials in the amount of $2,639,427.42.

WSDOT Traffic Busters — Fiber Optic Cable Connection — Authorization to Bid
BACKGROUND:
Washington State I�epartment of Transportation has initiated a project to share traffic condition data
between the State and local agencies, called "Traffic Busters". As currently scoped, the project connects
with 22 cities and counties in the region, including Federal Way.
The scope of the project within Federal Way capitalizes on existing fiber optic cable installed by both the
City for traffic signal interconnect and citywide Wi-Fi and King County Metro in support of Transit
Signal Priority for the RapidRide Line A Bus Rapid Transit project. The Traffic Busters project would
eliminate a gap in our otherwise continuous run of 24 strands of fiber between City Hall and I-5, where it
connects WSDOT's fiber trunk on I-5 to their Traffic Systems Management Center in Shoreline. The gap
is on S 320` Street between 8`" Avenue S and SR 99.
WSDOT proposes to complete this gap with 24 strands, of which 2 would be reserved for the purpose of
sharing traffic data under the Traffic Busters program. The City would be free to use the remaining 22
strands however we choose. Preliminarily, these would be used for traffic signal interconnect, Safe City,
and citywide Wi-Fi.
For construction of the project, WSDOT and the City entered into an Interlocal Agreement authorized at
the October 5, 2010 City Council meeting. Under the agreement, WSDOT will compensate the City for
actual costs up to $80,000. WSDOT will also provide additional hardware and software in City Hall to
provide functionality with these project components to be defined in the future under a separate
agreement for consideration by City Council.

WA State Traffic Safety Committee — School Zone Flasher Grants
BACKGROUND:
The Washington Traffic Safety Commission (WTSC) has concluded from their own studies, that collision
rates and driver compliance with the 20 mile per hour school speed limit are improved when drivers are
given clear direction of when a school speed limit is in effect. The most effective way to accomplish this
consistent notification is with the installation of school zone flashing beacons ("Speed Limit 20 When
Flashing") assemblies rather than the subjective "Speed Limit 20 When Children Are Present". To help
road agencies adopt this change, the Commission created a grant program that provides up to $7,500 per
school zone for flashing beacon hardware components that are installed at elementary schools. The grants
also require that the City provide education materials and targeted enforcement at the added locations.
City staff has had a similar goal, and currently all but three elementary schools have school zone flashing
beacons installed. Silver Lake Elementary School was awarded a WTSC grant in December of 2010 with
installation forthcoming soon. With funds from the same WTSC grant program in 2009, school zone
flashing beacons were installed at Sherwood Forest Elementary School and the completed follow-up
study shows a significant speed reduction at all hours but especially during the flashing beacon operation.
The remaining four schools are all located on low volume residential streets:
Adelaide (SW 304' St & 16` Ave SW)
Nautilus (S 289 St & 11�' Ave S)
Wildwood (S 300` St & 26` Ave S)
Staff is currently evaluating the highest priority and most feasible school zones based upon traffic
conditions and power source availability for each location. Staff proposes to only submit one grant
application for the highest scoring, cost feasible location.
Total installation per school zone consisting of two beacons would cost between $15,000 and $20,000
with up to $7,500 reimbursable for flashing beacon hardware components. The adopted budget allocates
$20,000 for school safety improvements in the Neighborhood Traffic Safety Program of which the WTSC
Silver Lake Grant will also be funded, thus limiting the number of installations for which the City could
provide the matching funds.
In addition, at this time all School Zone Flashing Beacons installed within the City of Federal Way are
operating on a pager system. The Silver Lake SZ Flashing Beacons to be installed soon will be a system
utilizing cell phone internet technology. As technology advances, eventually older technology is replaced
by the new. This appears to be the case with pagers as cell phone and wireless technology are rendering
pager services obsolete. With the declining use of pagers, the continued operation and maintenance of the
existing City owned units is becoming more difficult and service seems to be more problematic. Thus, a
need exists to analyze the available funding options to continue school zone flashing beacon operation in

a reliable and cost effective manner. Traffic staff has inquired of the WTSC, whether retrofit of existing
school zone flashing beacons is eligible for the school zone flashing beacon grant funding. WTSC's grant
program manager has confirmed that such retrofits are eligible for funding.
Ten existing elementary schools have school zone flashing beacons currently operating on pager systems
with one to four pagers per school. Estimated cost to retrofit school zone flashing beacon pager systems
is $1,600 per pager for the hardware components plus an estimated $150 in labor costs. Labor could be
performed during typical summer preventative maintenance/school zone schedule updates with an
insignificant one time cost increase and future savings. Retrofit Hardware costs would be 100%
reimbursable. The table below summarizes estimated reimbursabl� retrofit costs for eligible elementary

Staff is proposing to submit grant proposals for each elementary school with the goal of obtaining funds
to retrofit as many pager systems as the WTSC will grant. In preliminary conversations, WTSC has
stated that while school zones yet to have flashing beacons will have priority, in past years adequate grant
funding has been available to award more projects than grant requests.
The deadline for submittal of the grant applications is May 20, 2011 with successful applicants being
notified on June 17, 2011. Installations must be completed within 120 calendar days of grant approval.
