CALL TO ORDER Committee Chair Kochmar called the meeting to order at 5:30 PM. 2. PUBLIC COMMENT There was no public comment. 3. BUSINESS ITEMS Forward Topic Title/Description to Council A. Approval of the June 1, 2009, LUTC Minutes Committee approved June 1, 2009 LUTC minutes as presented. Moved: Duclos Seconded: Ferrell Passed: Unanimously, 3-0 N/A B. Pacific Highway South HOV Lanes Phase IV Condemnation Ordinance There was no public comment. Brian Roberts presented information on this item. Committee Member Duclos had concern over approving a blanket approval to move forward to condemnation. Committee Member Ferrell was concerned with if the approval to move forward with condemnation would prejudice any settlement negotiations. Mr. Salloum offered to have staff present Council with a list of parcels for which no agreement has been made. Discussion would take place during a future executive session regarding only those parcels where all attempts to reach an agreement has been exhausted. Mr. Roberts explained that if the project is to keep to its timeline of getting possession and use of parcels needed for this project; staff and outside council must file the condemnation by July 22, 2009. At present, there are five parcels where attempts to negotiate for possession and use between the parcel owners and the City are not able to proceed any further. Mr. Salloum noted that this topic had been discussed in the past, prompting an ordinance for condemnation. Committee forwarded Option #1 as presented provided that prior to any parcel moving forward to condemnation, staff will brief the full Council in Executive Session on the number of parcels moving forward to condemnation and the specifics involved with each parcel. Rick Perez presented information on this item. Chair Kochmar inquired about what the status was with the reminder of the City Center Access Project (CCAP) and will anything be happening with S 312th Street. Mr. Perez commented that with the close of the CCAP, staff will be bringing forth any possible future plans, projects and Comprehensive Plan Amendments to the LUTC and Council within the next year. Committee Member Duclos asked that for future projects, staff involves the public prior to involving any other agencies. Committee forwarded Option #1 as presented. Moved: Duclos Seconded: Ferrell Passed: Unanimously, 3-0 Public Hearing D. NPDES Code Amendments and Manual Adoption There was no public comment. Will Appleton presented information on this item. Mr. Appleton also added the following handouts into record: May 20, 2009 Planning Commission Meeting Minutes Staff Report to the Planning Commission for the May 20, 2009 Public Hearing (including Exhibit A, “NPDES Code Amendments”) Planning Commission comments, past public comment and staff evaluations of the topic were addressed in the presentation. Committee Member Ferrell asked how staff becomes aware of illicit discharges into the stormwater system. Mr. Appleton explained that most incidents are either reported by a third party or are observed by staff when they are out in the field. Committee Member Duclos asked if single family car washes were allowable. Mr. Appleton answered that single family car washes, taking place on an impervious surface (ie. concrete driveway or street) where car wash runoff enters the storm system are not allowed under the NPDES permit or our existing regulations. Soapy water from washing your car is considered an illicit discharge and is considered a code violation. To date, staff has had great success in curbing residential car washes by making citizens aware of water quality through public education and outreach. It has rarely become necessary to have any illicit discharge taken to a code violation level, although that is an option when corrections are not made in a timely manner. Chair Kochmar asked if there are plans to treat stormwater in the future. Mr. Appleton commented that treating stormwater is very cost prohibitive. Staff’s approach has been to treat the issue at the source. Committee Member Duclos expressed concern for residents that may not be able to wash their cars if they can’t wash their cars in their driveways. Mr. Robinett explained that there a few options to car washing that are very affordable (ie. wash car on lawn or gravel, or at a coin operated car wash). Mr. Appleton went through the lists of Prohibited (16.50.020) and Allowable (16.50.030) Discharges being amended in the Revised City Code. Mr. Appleton also further explained that staff has offered to meet further with other groups, ie. Master Builders in attempt to give complete information and answer as many questions as possible as to how these code amendments will affect future development/redevelopment in Federal Way.
