Itwas m/s/c tochangetheorderofsection4,BusinessItems,oftheagendatoB,D,F,G,H,I,E,C,andA. 2.APPROVALOFMINUTES ThesummaryminutesoftheApril19,2004,meetingwasapprovedaspresented. 3.PUBLICCOMMENT None. 4.BUSINESSITEMS B.RFB04-110;SewerExtensionBellacarinoWoods –BidRejection/RequesttoRe-Bid –Theapparentlowbidder hasrequestedauthorizationtowithdrawtheirbidclaimingthatitdidnotincludeWashingtonStatesalestaxinaccordance withthecontractspecifications.Staffis not recommendingawardingtheprojecttoanyotherbiddersbecause:thesecond lowestbidderincorrectlyaddedsalestaxasalumpsum;thethirdbidderdidnotenteratotalbidamountonthebidform; and the fourth bidder’s total amount exceeded the authorized construction budget. The LUTC would like staff to include clarifyinglanguageregardingthesalestaxrequirementsinfuturerequestforbidsdocuments.TheLUTC m/s/c toplacethe followingprojectrecommendationsontheMay18,2004,CityCouncilConsentAgenda:1)rejectallbidsreceivedonApril 5,2004,fortheRFB04-110BellacarinoWoodsSewerExtensionProject(locatedinthevicinityofSW356th Streetand6th AvenueSW);and2)authorizeSWMstafftore-bidtheprojectandreturntotheCityCouncilforauthorizationtoawardthe projecttothelowestresponsive,responsiblebidderwithinavailablefunding. D.KittsCornerDevelopmentPlan&DevelopmentAgreementUpdate –Staffhasapreliminarysiteplanandis bringingthisissuetotheLUTCtomakesuretheyaremovingintherightdirectionandforinitialfeedbackontheproposal. LenSchaadt –Heistheowneroftwoofthepropertiesforthisproposalandrepresentstherest.Theybegan this process in 1999. It started as a rezone, but with the City’s request for a village concept, became much more.Theownershiredanarchitectandsomeonetoprepareamarketstudyontheproposal.Astheproject developed,theyhiredadditionalexperts(transportationengineer,landuseattorney,etc.)inordertodevelopa preliminarysiteplanacceptabletotheCity.Theprojecthasbeenscaled backfromtheoriginalideaandwill haveasofterimpact.Theownersarenotdevelopersanddonotplantodotheactualdevelopment;therefore thepreliminarysiteplanisaconceptualdesign. LUTCfeelsthepreliminarysiteplanisverywelldone.It wasstatedthatthemarketstudypreparedforthisproposalshows ademandfortownhousesandnotapartments.Thereisaparceltothesouththatwouldmakesensetoinclude.Theowner hadbeenapproachedinthepastandhasshownnointerestinbeingapartofthisproposal,butthiswasalongtimeago. CouncilmemberFaisonsuggestedthisowneragainbeapproachedtoseeifhemaynowbeinterestedinparticipating. F.Overviewof2003ComprehensivePlanAmendments –Ms.Clarkpresentedanoverviewbecausetherearea numberofcomponentstothe2003ComprehensivePlanAmendments. CityofFederalWay CityCouncil LandUse/TransportationCommittee May3,2004 CityHall 5:30p.m.CouncilChambers G:\LUTC\LUTCAgendasandSummaries2004\May3,2004,LUTCMinutes.doc G.PAASubareaPlan –Thisisacomponentofthe2003ComprehensivePlanAmendments.ThePotentialAnnexation Area(PAA)SubareaPlanassignsFederalWayZoningtoparcelsinthe City’s PAA, in anticipation of a time the area is annexed.TheFederalWayZoningwouldnottakeeffectuntiltheareaisannexedandannexationwouldoccuronlyifthe citizensofthearearequestit. SteveMcNey,AllAmericanHomes –HerepresentstheJacksonrequest.Theywantacommercialtypezoning andhaverequestedBusinessCommercialzoningfromKingCounty.TheyhadoriginallysupportedFreeway Commercialzoningforthesite,buttheydiscoveredthatcardealershipshavenointerestinthesite.They wouldlikeCityzoningofCommunityBusiness(BC)sothattheycanbuildagrocerystore.Theydonotsupport thePlanningCommissionrecommendationofasplitofOfficeParkandresidentialzoning.Theyfeelitwould reducethevalueofthepropertyandwouldmeanasmalleramountofthepropertycouldbedevelopeddueto thelargewetlandbuffer.Theyproposetohaveagrocerystorenear320th Streetwithparkingunderthepower linesandapublicparkclosetotheneighborhood.Theywanttobea partofFederalWayandintendtoannex. LouiseDavis –SheistheowneroftheDavisproperty.Thisisathrivingbusiness.SheworkedwithKing Countytohavethepropertyzonedcommercialandtohaveitrezonedbacktoresidentialwouldbeatragedy. Mr.DohrndeliveredapresentationonthebackgroundofthisprojectandMs.Grueterdeliveredapresentationonthe process,purpose,keyelements,andtheplanitself.Mr.Youngdeliveredapresentationonthefinancialaspectsoftheplan andofannexingthePAA.Theoverallpictureisnegativefromsimplyacashoutlook,buthestatedthatthedecisionto annexisaboutmorethanjustthefinancialissues.TheCityshouldaskifitisimportanttotheCitytobeacohesivewhole byincludingthePAA.TherearethreeassumptionscriticalforunderstandingthePAAFeasibilityStudy:1)thelevelof serviceinthePAAwouldbethesameascurrentlyintheCity;2)thelevelofserviceinthefuturewouldremainthesameas now;and3)thestudyisbasedon currentstatelawandCitypractices.TherearesixstrategiesinthePAAFeasibilityStudy forhowtoaddressthenegativefiscalimpacts Ms.Greuterwentoverthesite-specificrequestsandexplainedthestaffandPlanningCommissionrecommendations. Discussionwasheldoneachoftherequests.Itwas m/s/c torecommendNeighborhoodBusiness(BN)zoningforthe DavisSite-SpecificRequest.Itwas m/s/c torecommendSingle-FamilyHighDensityzoning(RS9.6)fortheNorthLake Site-SpecificRequest.Itwas m/s/c (twoyes,oneno)torecommendBNzoningfortheRabieSite-SpecificRequest. TheJacksonSite-SpecificrequestwastableduntilthenextLUTCmeeting.Itwasfeltthisrequestcouldnotbeadequately addressedwithoutanunderstandingoftheproposedFreewayCommercial(FC)zone;therefore,Ms.Shulldelivereda presentationontheproposedFCzone.Theintentisthatthiszonewouldcaptureretailmarketsnotcurrentlylocatingin Federal Way, and would thereby increase the City’s tax base. SteveMcNey –HelikestheFCzone.AtfirsttheywereconsideringacardealershipfortheJacksonproperty, but car dealerships are not interested in the Jackson area. We don’t want to negatively affect the neighborhood,whichiswhyweareproposingapark,andmayberesidential,tothenorthandagrocerystore tothesouth.WefeelastoreinthisareawouldlessenthetrafficcongestiongoingintoFederalWay. CindyCope –ShelivesintheneighborhoodneartheJacksonrequestandhassignedaneighborhoodpetition thatthenorthernpartoftheJacksonrequestshouldbezonedresidential.Anythingelsewouldnegatively affect property values and the quality of life for the neighborhood. W e don’t need additional retail space in FederalWay;thereareanumberofspacesthatarecurrentlyvacant,suchastheformertheater.Currently, theneighborhoodissafeforchildrenandtheirbikes,butthatwouldchangewithcommercialzoning.She commentedthattheneighborhoodthoughtthePlanningCommissiondecision/recommendation was a “done deal” and didn’t realize there would be further meetings on the matter. TheLUTCwouldliketoseeacomparisonoftheproposedFCzonewithcomparablezonesinothercities.Theywouldlike toseeacomparisonoftheproposed FC zone with the City’s Community Business (BC) zone. The LUTC asked staff to research whethertoallowpolesignsintheFCzoneandwhethera25-foottallsignwouldbetallenoughtobevisiblefrom thefreeway.TheLUTC m/s/c torecommendtheCityCounciladoptthePAASubareaPlanwiththeDavis,NorthLake,and RabieSite-SpecificRequestsasmodified,andtotabletheJacksonSite-SpecificRequesttothenextLUTCmeeting. H.ProposedNewFreewayCommercialZone –Thisisacomponentofthe2003ComprehensivePlanAmendments. TheissuewastabledtothenextLUTCmeeting. I.QuadrantSite-SpecificRequest –Thisisacomponentofthe2003ComprehensivePlanAmendments.Thisisa requesttodeletetheplannedextensionofWeyerhaeuserWaySouth,northofSouth320th Street,asshownonMapIII-27B (2003-2020RegionalCapitalImprovementPlan[CIP])fromthe FederalWayComprehensivePlan (FWCP)andtodelete thisprojectfromFWCPTableIII-19(RegionalCIPProjectList).Itwas m/s/w toapprovethe staffrecommendationinorder toallowpublictestimony. Mr.PerezcommentedthattheFWCPsupportsthroughroadsbecauseFederalWaydoesnothaveenough.Thereisa plannedextensionof312th overI-5andwesttoAuburn,andtheextensionfor32nd wouldbeneededforalink(thiswillnot happenformanyyears,butitisplannedintheFWCP).Thisisalong-termproject.TheLUTCm/s/ctorecommendthatthe full Council accept the Planning Commission’s recommendation and adopt an ordinance approving the request by QuadranttodeletetheplannedextensionofWeyerhaeuserWaySouth,northofSouth320th Street,shownonFWCPMap III-27B(2003-2020RegionalCIP);deletetheprojectfromFWCPTableIII-19(RegionalCIPProjectList),replacingitwith 32nd AvenueSouth;andamend(perthePlanningCommissionRecommendation)FWCPMapsIII-5,III-6,andIII-27Bas setforthintheApril27,2004,LUTCMemorandum. E.AmendmentstoCountywidePlanningPoliciestoDesignateDowntownAuburnasanUrbanCenter –The LUTC m/s/c thestaffrecommendationtomoveforwardtothefullCouncilapprovaloftheamendmenttotheCountywide PlanningPoliciestodesignateDowntownAuburnasanUrbanCenter. C.TripReductionPerformanceIncentiveforFederalWayEmployers –WashingtonState’s Commute Trip Reduction (CTR)Lawisintendedtoimproveairqualityandreducefuelconsumptionandtrafficcongestionthroughemployer-based programsencouragingtheuseofalternativestosingleoccupantvehicles(SOV)forthecommutetrip.Thetripreduction performanceincentiveprogramisasix-monthdemonstrationprogramdesignedtoreducecommutetrafficwithintheCity byconvertingSOVcommuterstoothercommutingoptions.Theprogramintroducestrip-reductionstrategiestosmaller employers not affected by the CTR program. Staff proposes to use the Traffic Division’s operating fund to support this project.TheLUTC m/s/c placingthefollowingprojectrecommendationsontheMay18,2004,CityCouncilConsent Agenda:1)authorizestafftoproceedwiththeTripReductionPerformanceIncentiveProgramforFederalWayEmployers; 2)authorizestafftoincorporatetheincentiveprogramintothenextCTRcontractwithKingCountyMetro(theexisting contractwillexpireJune30,2004);and3)authorize staff to use the Traffic Division’s operating funds of $5,050 as a match towardtheproject. A.PotentialAnnexationAreaExpansion –TheCityCouncilrequestedstafftolookintothefeasibilityofannexingan unincorporatedareainPierceCountythat is located within Tacoma’s Urban Growth Area (UGA). The LUTC m/s/c directing stafftoinitiateaPierceCountyComprehensivePlanAmendmentandtogatherdataandacquireGeographicInformation Systemslayers. 5.FUTUREMEETING Thenextscheduledmeeting isMay17,2004. 6.ADJOURN Themeetingadjournedat8:30p.m.
