Res 11-611RESOLUTION NO. 11-611 A RESOLUTION of the City Council of the City of Federal Way, Washington, declaring property located at 31600 20 Avenue South, Federal Way, WA 98003 as surplus and authorizing its disposal. WHEREAS, the City of Federal Way owns the property located at 31600 20 Avenue South, Federal Way, WA 98003 legally described as: The West %2 of the Southeast quarter of the Southwest quarter of Section 9, Township 21 North, Range 4 East, W.M., in King County, Washington, EXCEPT the South 825 feet thereof; AND EXCEPT portions thereof conveyed to King County for street purposes by Deed recorded under Auditor's File No. 7801200908 and 7801200911. SUBJECT TO a 10 foot wide easement far storm drainage lying 5 feet on each side of the following described centerline; COMMENCING at the SW corner of the above described parcel; THENCE N 00°ll'33" W, 36.06 feet along the Westerly line of said parcel to the TRUE POINT OF BEGINNING; THENCE N 47°49'36" E, 36.87 feet; THENCE S 86°54'44" E, 328.5 feet to the end of this center-line description WHEREAS, Resolution 07-514, passed by the Federal Way City Council on December 4, 2007, declared the above described property as surplus to the City's needs and directed disposal of the property pursuant to a Purchase and Sale Agreement with United Properties, LLC; and WHEREAS, the Purchase and Sale Agreement with United Properties, LLC expired January 30, 2011; and WHEREAS, the property remains surplus to the needs of the City of Federal Way; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, RESOLVES AS FOLLOWS: Section 1. Property Declared Surplus. The property described above is declared surplus to the needs of the City of Federal Way. Resolution No. 11-611 Page 1 of 3 Section 2. Disposition of Surplus Propert� Staff, under the direction of the Mayor, is instructed to negotiate a sale of the property for the best available price or transfer to another governmental agency in accordance with RCW 39.33.010 subject to final approval by the City Council. Section 3. Severabilitv. If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this resolution. Section 4. Corrections. The City Clerk and the codifiers of this resolution are authorized to make necessary corrections to this resolution including, but not limited to, the correction of scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any references thereto Section 5. Ratification. Any act consistent with the authority and prior to the effective date of this resolution is hereby ratified and affirmed. Section 6. Effective Date.
