Guest: Susan Honda, Chair Arts Commission Chair Burbidge called the meeting to order at 5:33p.m. Public Comment: None. Commission Comment: Ms. Honda stated that the Arts Commission is co- sponsoring the Arts in the Gardens event at the Rhododendron Species Botanical Garden on September 17 The event will feature performances by local groups and a presentation by the Historical Society. APPROVAL OF SUMMARY Council member Park moved to approve the July meeting summary. Council member Burbidge seconded. Motion passed. BUSINESS ITEMS 2011 Emergency Management Performance Grant Award Mr. Gross presented the background information. Mr. Gross reported that they applied for the Grant and were awarded $37,072.00. The Emergency Management Performance Grant (EMPG) is a federal Grant to help fund local Emergency Management Departments. There are matching funds to match the grant. The EMPG funds will be used to support the Emergency Management Specialist position in the year 2011 and three months in 2012. The grant will also provide funding for the mass notification system CodeRed. The funding cycle is 1.5 years. Council member Freeman arrived. Council member Park moved to forward the 2011 Emergency Management Performance Grant award to the September 20 City Council consent agenda for approval. Council member Freeman seconded. Motion passed. First Amendment to the Thundering Oak Enterprises Agreement Mr. Ikerd presented the background information. Mr. Ikerd reported that Thundering Oak Enterprises is used for tree assessments, hazardous tree mitigation and storm cleanup. The Parks Department is seeking authorization to extend the contract for two more years. Thundering Oak Enterprises has agreed to maintain the 2010 rate. The total amount of the contract would be $66,610.00. Services are provided on an as needed basis. Council member Freeman moved to forward the authorization of a first amendment to the Thundering Oak Enterprises Agreement by extending their term an additional two years and increase the compensation by $46,900, and authorize the Mayor to move said authorization to the full Council September 20, 2011 consent agenda for approval. Council member Park seconded. Motion passed. Consolidation Plan — Information Only City Attorney Richardson presented. Federal Way has become a Direct Entitlement city for CDBG. A consultant was hired to develop a Five -Year plan that is required by the Department of Housing and Urban Development (HUD). Ms. Richardson reviewed the calendar. The plan is very aggressive, and staff has been working very hard. 3 PARKS, RECREATION, HUMAN SERVICES & PUBLIC SAFETY COUNCIL COMMITTEE Tuesday September 13, 2011 Summary Page 2 School Resource Officer Contract Chief Wilson presented. The term of this Agreement is from September 1, 2011 to August 31, 2014. For a School Resource Officer (SRO) the Federal Way School District pays .7349% of a full time Police Officer. The balance is paid for by the City. An additional SRO position was added, and that officer will be at Thomas Jefferson High School. The SRO's are part of the staff, and train with the staff within the school district. Council member Park moved approval of the Interlocal Agreement between the City of Federal Way and Federal Way School District No. 210 for School Resource Officers, effective September 1, 2011 through August 31, 2014 with a total compensation of $402,965.00, and authorize the Mayor to sign said agreement. Council member Freeman seconded. Motion passed. MOA between FWPD and Homeland Security, allowing permission to utilize certain Federal Wav Police radio frequencies on a limited basis for emergency preparedness Chief Wilson presented. The Department of Homeland Security's Western Command office is located in Federal Way. This agency has a very large mobile command vehicle that has communication and emergency operations capabilities. By entering into this agreement, this will allow them to install the Federal Way Police Departments radio frequencies into the mobile command vehicle. This will assist Federal Way with communications between agencies. This agreement will continue until it is terminated. Council member Freeman moved to forward this request for radio frequency sharing with Homeland Security, to the September 20, 2011 City Council meeting consent agenda for approval. Council member Park seconded. Motion passed. DEA — State and Local HIDTA Task Force Agreement — Information Only Chief Wilson presented. The Federal Way Police Department (FWPD) has a commissioned officer that has been assigned to the Drug Enforcement Administration (DEA) Task Force. Their focus is to address upper level drug traffickers in the South County and Puget Sound region. This agreement will enable the FWPD to reimburse the officer's overtime expense up to an amount of $17,202.25. This agreement is in effect from October 1, 2011 thru September 30, 2012. Create FWRC 6.40.025 of the Federal Wav Revised Code Regarding Identity Theft Ms. Pearsall presented. Currently the City of Federal Way does not have a crime to deal with identity theft. It is currently a felony, and left to the King County Prosecutors. Due to limited resources, the Prosecutors prioritize which crimes they move forward with. Some of the smaller identity theft crimes have been declined, and there is not an option to charge them as a misdemeanor. This amendment creates a code that will allow the City to do that if the Prosecutor felt it was appropriate. Council member Park moved to forward the proposed ordinance to First Reading on September 20, 2011 City Council meeting. Council member Freeman seconded. Motion passed. Amend Sections of the Federal Wav Revised Code to Comply with Senate Bill 5168 Ms. Pearsall presented. Senate Bill 5168 was approved and went into effect this year. This Senate Bill reduces the maximum sentence for a gross misdemeanor from 365 days to 364 days. There were two provisions in the code that still referred to the maximum penalty as one year. This will clarify that it is 364 days and not one year. Council member Freeman moved to forward the proposed ordinance to First Reading on September 20, 2011 City Council meeting. Background At our request, the Washington Traffic Safety Commission (WTSC) sent the City Of Federal Way $4,200.00, via an Electronic Funds Transfer, to fund the purchase of inclement weather, motorcycle riding gear, (WaterShed brand). This alternative riding gear will enable Traffic Officers to maintain a sustained presence within our school zones to enforce speeding violations. This funding will cover six individualized wet - weather uniform riding gear, consisting of bibs and jackets for each of the six motorcycle officers in the Traffic Unit. Proposal We are requesting that the City Of Federal Way accept this grant money from the WTSC, to fund the purchase of this described inclement weather motorcycle riding gear. G\ Subject: Lakota Fencing Bids Background: Staff recently solicited fencing improvement bids for Lakota Park, which included replacing and upgrading two backstops and wing fences on the north end of the Park. The existing backstops and fences are very old and will be removed soon due to their unsafe condition. This fencing upgrade is part of an overall plan to increase the ability to program this under utilized portion of the Park. We currently have approved mitigation funds programmed to implement additional improvements including; restroom upgrades, turf renovation, irrigation upgrade, vehicle access control, and add new amenities like bleachers and garbage can holders. Two companies out of six from the Municipal Research and Service Center (MRSC) roster responded to a Request for Quotes (RFQ). Following are the bid results: All Around Fence Company - $40405.50 Olympic Fence Company - $41,856.38 Owl Fencing — no bid Quality Fencing — no bid Secoma Fence — no bid White River Fencing — no bid Contract award recommendations: All Around Fence Company - $40405.50 4040.50 — 10% contingency • $44,446.00 — total contract amount Budget: This fencing upgrade project will be paid out of collected mitigation funds that must be used in the planning area which includes Lakota Park. There is currently $81,465.00 remaining in this fund. The balance of the funds, after the fence project, will be used to implement the other improvements mentioned above. 8
