B. S 320`h Street at 201h Ave S Intersection Improvement Project — 30% Design Status Report
Streets Systems Project Engineer Brian Roberts presented information on this item. There was
no public comment.
Committee member Burbidge is pleased that this project will include sidewalks and street
lighting. Committee member Burbidge asked if there was any right of way acquisition needed
for this project. Mr. Roberts said that there was no right of way acquisition. The City has
acquired a tract from The Commons mall. A statutory warranty deed will be executed prior to
project construction. The Commons' high profile sign on 20'' Ave S lies within the tract and
will be relocated prior to construction as well.
Chair Celski asked if this project will be able to handle all future growth and development in the
City core. Mr. Roberts said that traffic modeling reports suggest that this project will be able to
handle future development and growth.

Conservation Property Acquisition
Surface Water Manager Will Appleton delivered a thorough PowerPoint presentation on the
City's vision as it relates to the West Hylebos Basin Open Space, property acquisition history,
remaining program activities and funding status. There was no public comment.
Committee member Honda asked what the zoning was for the highlighted properties to be
purchased. Is the intent to develop these properties? And, if developed, how would that impact
the stream recovery process? Mr. Appleton explained that there is some form of development
that could occur on all of these properties. There are setbacks and restrictions in place, designed
to protect the land. By owning these identified parcels, the City would control the level of
protection and restoration of the property. Committee Member Honda asked if there are any
structures on these parcels. Mr. Appleton said that there are structures on most of the properties;
however, as part of the Conservation Futures funding, all structures would have to be removed
as a requirement of the funding. Mr. Appleton added that the City will only acquire properties
through willing sellers. In some cases, the City may purchase a conservation easement and not
the property from outright.
Committee member Burbidge thanked staff for a complete presentation.
Chair Celski is very supportive of the vision and asked how Federal Way compares to other
cities when it comes to receiving Conservation Futures funding. Mr. Appleton explained that it
is a competitive process to receive funding and that funding is allocated on an annual basis.
Thus far, the City has been successful in obtaining funding. The City Of Federal Way will be
receiving the average amount being awarded in 2012 (approx. $300K). At present, the City has
$1.2M available for Conservation Futures projects: $640K from Conservation Futures Funding
after being awarded and accepting 2012 funds of $300K; and, $640K from the SWM Utility
Fund (matching funds). The Conservation Futures funding has to be matched by the City.
Council member Kochar questioned when our existing surface water utility rate will need to be
increased to meet the demand of our projects. Mr. Appleton stated that the surface water utility
fee will need to be increased regardless of moving forward with acquiring conservation
properties or not. Not continuing with the Conservation Property Acquisition Program will only
prolong not increasing the utility rate for approximately one year longer. Mr. Appleton stated
that the major flooding problems have been resolved. Any remaining projects are more
"nuisance" flooding issues and are on a much smaller scale.
Conversation continued around a future surface water rate increase and the City's ability to
handle (fund) our surface water management program. Committee members wanted to know
what kind of increase was anticipated. Mr. Appleton responded that a future rate increase will
depend on the inspection program and evaluation of capital improvement projects resulting from
the inspection process as it relates to the Comprehensive Plan. The SWM utility takes in approx.
$3 million annually yet spends just over $3.4 million annually. The committee asked Mr.
Appleton if SWM has a 6 -year CIP. Mr. Appleton stated he would have a CIP list in place for
the upcoming City Council meeting as well as information on the King Co. flood control
program. Committee member Burbidge suggested presenting this topic for the full Council.

Contract Senior Planner Jim Harris presented information on this item. There was no public
comment. Committee member Burbidge stated she supports staff's vision of making the
permitting process more efficient and streamlined. Mr. Hams provided clarification on non-
conforming issues with a change of use and the differences between single tenant and multiple
tenant buildings. Planning Manager Isaac Conlen provided further clarification on what triggers
bringing non-conformance issues into compliance and how the proposed code amendment will
make positive changes.
The committee members complimented staff on their work on this issue.

Proposed Zoning Compliance Review Fee May 15, 201,

Contract Senior Planner Jim Harris presented information on this item. There was no public
comment.
Committee member Burbidge stated that she supports the proposed zoning compliance review
fee and feels that it makes sense to establish a lower fee.
Committee member Honda asked how the proposed fee compares to similar fees in other cities.
Mr. Harris responded that similar fees vary a great deal, depending on the city. It has been
difficult to find where Federal Way fits as far as a fee goes, because the fee serves a broad range
of development/change of use from one city to another.
There was input from all committee members and council members present on how best to get
information on this new fee out to the public. Mr. Conlen will be looking into the various ways
to promote the new fee.

2012 Planning Communication and Long Range Planning Work Program May 15, 201:

Principal Planner Margaret Clark presented information on this item. There was no public
comment.
Committee member Honda asked about historic preservation and could that topic be added to the
low priority work plan. Committee member Burbidge stated that she also supports historic
preservation and adding this item to the work plan.

to add an ordinance addressing historic preservation to the 2012 Work Plan low priority
list.

There was brief discussion amongst committee members and staff deliberating whether or not a second May LUTC
meeting was needed. Chair Celski suggested the next LUTC not be until the first meeting in June, as the agenda
topics thus far are not time sensitive.

SUBJECT: South 35e Street Regional Detention Facility Retrofit Project — Preliminary Design Status
Report
BACKGROUND:
On June 21s`, 2011, City Council authorized staff to accept a $1,000,000 grant from Washington State Department of
Ecology (DOE) and to add the S 356t` Street Regional Detention Facility (RDF) Retrofit Project to the SWM CIP.
This project consists of a new combined treatment wetland and detention pond, two bioretention areas, an emergency
bypass system retrofitted to the existing RDF, removal of impervious roadway surface, and extensive native
plantings.
The following provides a brief synopsis of the progress on this project to date. Currently, the project design is
approximately 35% complete, which includes the following completed tasks:

• State Department of Archaeology and Historic Preservation's Project Historic and Cultural Review
Submittal and Approval
• Received SEPA Determination of Nonsignificance (DNS)
• City's Landuse Application Submittals

BACKGROUND:
On April 16, 2012, staff sent a request for a unit price quote (RFQ) to a short list of contractors on the
MSRC Small Works Roster who have the capabilities of executing the installation of neighborhood traffic
calming devices within pre -determined deadlines. Four (4) quotes were received and opened on
May 9, 2012. See the attached Exhibit A, Quote Tabulation Summary. Northwest Asphalt, Inc.
submitted the lowest quote.
Exact quantities and locations for this small project will be determined throughout the work year(s).
Funding for such discretionary work is included in the 2012 operating budget at $30,000 per year.

SUBJECT: Setting Public Hearing for 2013-2018 Transportation Improvement Plan
BACKGROUND:
In accordance with the requirements of Chapters 35.77 and 47.26 of the Revised Code of Washington (RCW), the
City of Federal Way adopted its original Transportation Improvement Plan (TIP) and Arterial Street Improvement
Plan (ASID) on July 23, 1991. The City is also required to adopt a revised TIP and ASID on an annual basis to
reflect the City's current and future street and arterial needs.
The City is required to hold a minimum of one public hearing on the revised plans. Staff proposes that this occur
at the July 3, 2012 City Council meeting. Once the revised plans have been adopted by Resolution, a copy of the
respective plans must be filed with the Washington State Secretary of Transportation and the Washington State
Transportation Improvement Board. The attached Resolution sets the public hearing date for the July 3, 2012
City Council meeting. The TIP will also be presented to the Land Use and Transportation Committee
on June 4, 2012.

RESOLUTION NO.
A RESOLUTION of the City Council of the City of Federal Way,
Washington, setting a Public Hearing date of Tuesday, July 3, 2012 for
adoption of a revised Six -Year Transportation Improvement Program
and Arterial Street Improvement Plan.
WHEREAS, pursuant to the requirements of Chapters 35.77 and 47.26 RCW, the City
Council of the City of Federal Way must adopt a revised and extended Six-year Transportation
Improvement Program ("TIP") and Arterial Street Improvement Plan ("ASIP") annually; and
WHEREAS, the City of Federal Way's SEPA Responsible Official reviewed the TIP and
ASIP under the State Environmental Policy Act, RCW 43.21C, and issued a Determination of
Nonsignificance on May 18, 2012; and
WHEREAS, a public hearing must be held prior to the adoption of the revised and extended
Six-year Transportation Improvement Program and Arterial Street Improvement Plan;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
RESOLVES AS FOLLOWS:
Section 1. Public Hearing. A public hearing shall be held on the 2013-2018 Federal Way
Transportation Improvement Plan and Arterial Street Improvement Plan at 7:00 p.m. on Tuesday,
July 3, 2012, at the Federal Way City Hall Council Chambers.
Section 2. Severability. If any section, sentence, clause or phrase of this resolution should
be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause or phrase of this resolution.
Section 3. Corrections. The City Clerk and the codifiers of this resolution are authorized to

BACKGROUND:
In accordance with the requirements of Chapters 35.77 and 47.26 of the Revised Code of Washington, the
City of Federal Way adopted its original TIP and ASIP on July 23, 1991. The City is also required to
adopt a revised TIP and ASID on an annual basis reflecting the City's current and future street and arterial
needs. These plans identify capital projects that the City intends to construct over the next six years. In
order to be eligible for grant funding, projects are required to be listed in the City's TIP.
The City is required to hold a minimum of one public hearing on the revised plan, which is proposed for
the July 3, 2012 Council meeting. Once the revised plans have been adopted by Resolution, a copy of the
respective plans must be filed with the Washington State Secretary of Transportation and the Washington
State Transportation Improvement Board.
REVISED PLAN:
Attached for your review and comment are the proposed 2013-2018 TIP and ASIP (Exhibit A), a location
map (Exhibit B), and a draft resolution for adoption (Exhibit Q. The six-year TIP and ASID respond to
the Growth Management Act concurrency requirements as well as other emerging needs. Projects are
selected based on criteria adopted in the City's Comprehensive Plan TP81, which reads, "Prioritize
transportation projects considering concurrency, safety, and support for non -SOV modes, environmental
impacts, and cost effectiveness." Each project was ranked using the scoring criteria established for
Transportation TIP/CIP Prioritization. Staff also reviewed and analyzed available grant -eligible programs
suitable for project programming.

New Projects:
Citywide City Safety: This project is contingent on and would be funded by a WSDOT grant to
improve intersection safety by modifications to signalization, signing, and striping. Locations
would be ranked by benefit/cost ratio for improvements identified. The number of locations
improved would be dependent on funding levels.
• 13th Avenue SW: SW 314" Street — SW 316th Street: This project is contingent on and would be
funded by a WSDOT Safe Routes to Schools grant. It would add sidewalk to connect to Lakota
Middle School.
• 16th Avenue SW: SW 3046h Street — SW 306th Street: This project is contingent on and would be
funded by a WSDOT Safe Routes to Schools grant. It would add sidewalk to connect to Adelaide
Elementary School.
• S 288th Street: 19th Avenue S — I-5: This project is contingent on and would be funded by a
WSDOT Bicycle and Pedestrian Safety grant. It would restripe this roadway to three lanes with
bike lanes and add two pedestrian refuge islands with Rectangular Rapid Flashing Beacons.
• 140h Avenue S: S 308`h Street — S 312th Street: This project is contingent on and would be funded
by a WSDOT Bicycle and Pedestrian Safety grant. It would extend sidewalks on 14th Avenue S
to connect retail areas to senior housing and Federal Way High School, and construct a mini -
roundabout at the intersection of 14`h Avenue S at S 308th Street to improve intersection safety for
pedestrians and motorists.

WHEREAS, pursuant to the requirements of RCW Chapters 35.77 and 47.26, the City
Council of the City of Federal Way adopted its original Transportation Improvement Program on
July 23, 1991 (Resolution No. 91-67); and
WHEREAS, the Federal Way City Council further updated its Transportation Improvement

WHEREAS, the Federal Way City Council further updated its Transportation Improvement
Program on August 7, 2009 (Resolution No. 09-550); and
WHEREAS, the Federal Way City Council further updated its Transportation Improvement
Program on July 6, 2010 (Resolution No. 10-558); and
WHEREAS, the Federal Way City Council further updated its Transportation Improvement
Program on June 21, 2011 (Resolution No. 11-609); and
WHEREAS, the City Council of the City of Federal Way has reviewed the work
accomplished under the existing Program and has reviewed work scheduled to be accomplished
according to the updated Program; and
WHEREAS, a public hearing was held on the revised Transportation Improvement Program
on July 3, 2012, in compliance with the requirements of State laws; and
WHEREAS, the City Council has determined current and future City street and arterial
needs, and based upon these findings has prepared a revised and extended Transportation
Improvement Program and an Arterial Street Improvement Plan for the ensuing six calendar years;
and
WHEREAS, pursuant to RCW 35.77 and 47.26, the City Council is required to annually
revise and adopt an extended Transportation Improvement Program and an Arterial Street
Improvement Plan; and
WHEREAS, the City's SEPA Responsible Official has adopted the DNS Federal Way File
12 -101810 -00 -SE issued for the City's 2013-2018 Transportation Improvement Plan (TIP) and
Arterial Street Improvement Plan (ASID) which includes the extended and revised projects contained
in the TIP adopted herein; and

WHEREAS, adoption of the City's 2013-2018 Transportation Improvement Plan (TIP) and
Arterial Street Improvement Plan (ASIP) DNS reflects the fact that there will be no significant
adverse environmental impacts as a result of adoption or implementation of the extended and revised
Transportation Improvement Plan (TIP) and Arterial Street Improvement Plan (ASIP) adopted
herein;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
RESOLVES AS FOLLOWS:
Section 1. Program Adopted. The extended and revised Transportation Improvement
Program and Arterial Street Improvement Plan for the City of Federal Way for the ensuing six (6)
calendar years (2013-2018 inclusive), a copy of which is attached hereto as Exhibit A and
incorporated herein by this reference, which sets forth the City's transportation project locations,
types of improvements and the estimated costs thereof, is hereby approved and adopted.
Section 2. Filingof f Program. Pursuant to Chapter 35.77 RCW, the City Clerk is hereby
authorized and directed to file a copy of this Resolution, together with Exhibit A, with the
Washington State Secretary of Transportation and a copy with the Washington State Transportation
Improvement Board.
Section 3 . Severability. If any section, sentence, clause or phrase of this resolution should be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause or phrase of this resolution.
Section 4. Corrections. The City Clerk and the codifiers of this resolution are authorized to
make necessary corrections to this resolution including, but not limited to, the correction of

scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any
references thereto.
Section 5. Ratification. Any act consistent with the authority and prior to the effective date
of this resolution is hereby ratified and affirmed.
Section 6. Effective Date. This resolution shall be effective immediately upon passage by
the Federal Way City Council.
