PUBLIC COMMENT There was one public comment: Nancy Combs, 30441 21" Ave SW, Federal Way — Ms. Combs shared how unhappy she with the City Councilmembers for not supporting her NTS petition. Ms. Combs shared a letter of support for the petition from the principal of Adelaide Elementary School. 3. BUSINESS ITEMS Forward Topic Title/Description to Council A. S 356`h Street Regional Detention Facility Retrofit Project — Preliminary Design Status Surface Water Project Engineer Fei Tang presented information on this item. There was no public comment. Mr. Tang clarified that there are no estimated property costs associated with this project because the City already owns the land. Chair Celski asked if having the pond adjacent to the road would have any negative effects to the road or the pond. Mr. Tang stated that the pond will be designed to filter pollutants from either the road or the infiltration system. Committee forwarded Option #1 as presented. Neighborhood Traffic Safety (NTS) Project Bid Award June 19, 201, Consent City Traffic Engineer Rick Perez presented information on this item. There was no public comment. Committee member Honda asked if the increase contract amount (in addition to the budgeted amount) was to pay for locations that have already been chosen. Mr. Perez answered that the request was to error on the side of caution and to be able to accommodate additional qualifying requests that staff may receive beyond the allotted budged amount. Staff has no currently approved installations. Committee member Burbidge asked if staff had any prior work experience with Northwest Asphalt, Inc. Mr. Perez stated that the City has not yet worked with Northwest Asphalt, Inc., but that their references were appropriate. Committee forwarded Option #1 as presented. There was no public comment. Committee Member Honda asked if the project began the day after the last day of school in 2013, would the project be done before the start of the following school year. Mr. Mulkey responded that the majority of the project work would be complete. By chance the project was not complete; the road would have been widened and would be able to accommodate the traffic needs until the project was finalized. Moved: Burbidge Seconded: Honda Passed: Unanimously; 3-0 Grant Funding for Transportation Improvement Projects — Authorization to Submit an June 19, 201, Application Consent City Traffic Engineer Rick Perez presented information on this item. There was no public comment. Committee member Burbidge asked if this would be the first traversable roundabout in Federal Way. Mr. Perez said that yes, this would be the first roundabout of this design in our city. The design is such that it can accommodate very large vehicles, garbage trucks, etc. that would use this route. The design has performed very well in other applications. Committee member Honda asked if staff had talked to the school district about installing this type of roundabout. Mr. Perez said the school district thought that this particular roundabout had the most forgiving design. The purpose of the project is to improve traffic safety and capacity and reduce accidents by eliminating conflicts. The following provides a brief synopsis of the progress on this project to date. Currently, the project design is 100% complete. Tasks Not Completed: • Right of Way acquisition and/or dedication agreement for partial take on two parcels. Right of way acquisition was not attained due to a property owner (Weyerhaeuser) objection to the timing of the project. The WSDOT has approved three of the four applications which were submitted per City Council authorization at the October 18, 2011 City Council meeting. The projects consist of conversions to flashing yellow arrow displays, installation of reflective backplates, installation of overhead lane use control signs over drop lanes, and installation of programmed visibility heads where driver confusion has been observed. A RESOLUTION of the City Council of the City of Federal Way, Washington, authorizing execution of Local Agency Agreement with Washington State Department of Transportation regarding improvement of the 2012 City Safety Program in the city of Federal Way, Washington.... WHEREAS, the City of Federal Way applied for several 2012 City Safety Program grants from the Washington State Department of Transportation for the purpose of design and construction of Safety Improvements Projects within the City; and WHEREAS, the Washington State Department of Transportation agrees to grant the City of Federal Way estimated federal funds in three separate grants in the total amount of Seven Hundred Eighty -Two Thousand Six Hundred and no/100 Dollars ($782,600) provided that the City Council authorizes the Mayor to enter into the Local Agency Agreements; and WHEREAS, by accepting said grant the City of Federal Way agrees to execute the Local Agency Agreements; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, RESOLVES AS FOLLOWS: Section 1. Execution of Acceptance of the Local Agency Agreement. If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this resolution. Section 5. Corrections. The City Clerk and the codifiers of this resolution are authorized to make necessary corrections to this resolution including, but not limited to, the correction of scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any references thereto. Section 6. Ratification. Any act consistent with the authority and prior to the effective date of this resolution is hereby ratified and affirmed. Section 7. Effective Date. This resolution shall be effective immediately upon passage by the Federal Way City Council. Background: The Federal Way Revised Code (FWRC) requires the city to accept applications for amendments to the FWRC on an annual basis. The city received one request in February 2012, which was after the September 306' deadline for accepting applications. However, pursuant to FWRC 19.08.050, the City Council may, at its discretion, accept requests at any time of the year. Per FWRC 19.80.080, after consideration by the LUTC, the City Council shall hold a public hearing and select those docketed amendment requests it wishes to move to the Planning Commission for further consideration. BACKGROUND The Federal Way Revised Code (FWRC) requires the city to accept applications for amendments to the FWRC on an annual basis. The city received one request in February 2012, which was after the September 30`' deadline for accepting applications. However, pursuant to FWRC 19.08.050, the City Council may, at its discretion, accept requests at any time of the year. Per FWRC 19.80.080, after consideration by the Land Use Transportation Committee (LUTC), the City Council shall hold a public hearing and select those docketed amendment requests it wishes to move to the Planning Commission for further consideration. III. DESCRIPTION OF REQUEST Ron Mitchell with Safety Senior contacted city staff about locating a senior housing project consisting of 50 to 70 units on property zoned Professional Office (PO) located at 31919 6'' Avenue South. Senior housing is not an allowable use in this zone. Staff considered whether this site was a candidate for a comprehensive plan amendment and rezone to Office Park (OP), which does allow senior housing. However, since the OP zone allows a wide range of uses as shown in Exhibit A, the OP zone designation did not appear to be an appropriate one for this location due to its proximity to single family residential zoning. IV. PROCEDURAL SUMMARY FOR CODE AMENDMENT SELECTION PROCESS July 2, 2012 LUTC Meeting The request will be presented to the LUTC for a recommendation on whether it should be considered further. July 17 2012 City Council Public Hearing — The City Council shall determine whether the request should be considered further. SELECTION CRITERIA FWRC 19.80.080 contains criteria for selecting amendments for further consideration. A. Criterion #1— Whether the same area or issue was studied during the last amendment process and conditions in the immediate vicinity have significantly changed so as to make the requested change within the public interest. Response to Criterion #1— A request to allow senior housing in the PO zone was not studied during the last amendment process, or during any previous amendment cycle. B. Criterion #2 — The proposed amendment is consistent with the overall vision of the comprehensive plan. Response to Criterion #2 — The request to allow senior housing in the PO zone is consistent with the city's economic development policy to work with the private sector to actively bring in new development, businesses, and jobs to the community (EDP10). In addition, senior housing would be compatible with already allowable uses such as office, schools, and governmental facilities in the PO zone. C. Criterion #3 — Whether the proposed amendment meets the existing state and local laws, including the GMA. Response to Criterion #3 — The proposed amendment to allow senior housing in the PO zone is not in conflict with local or state laws and meets the Growth Management Act's mandate to make adequate provisions for existing and projected needs of all economic segments of the community (RCW 36.70A.070[2][d]). Additional senior housing will fill the need generated by the aging baby boomers that are presently turning 65 at the rate of approximately 10,000 per day nationwide. D. Criterion #4 — In the case of text amendments, or other amendments to goals or policies, whether the request benefits the city as a whole versus a selected group. Response to Criterion #4 — A code amendment to allow senior housing in the PO zone would benefit the city as a whole as it may allow development of vacant land in the PO zone for senior housing as there does not presently appear to be a high demand for additional office space. As of June 2010, the City of Federal Way had approximately 750,000 square feet of vacant office space out of a total of approximately three million square feet.' If the request meets the criteria set forth in subsections above, it shall be further evaluated according to the following criteria: E. Criterion #1— Whether the proposed amendment can be incorporated into planned or active projects. Response to Criterion #1— This request can be incorporated into the 2012 Planning Commission Work Program. G. Criterion #3 — Volume of requests received. A large volume of requests may necessitate that some requests be reviewed in a subsequent year. Response to Criterion #3 — This was the only citizen -initiated request received for this year's work program. H. Criterion #4 — Order of requests received. Response to Criterion #4 — This was the only request received. VI. COUNCIL ACTION Pursuant to FWRC 19.80.080(4), the City Council shall determine whether this request should be further considered, and if so, shall forward it to the Planning Commission for review and recommendation. The council's decision whether to consider a proposed amendment shall not constitute a decision or recommendation that the proposed amendment should be adopted, nor does it preclude later council action to add an amendment for consideration. VII. MAYOR'S RECOMMENDATION The Mayor recommends that the LUTC forward the proposed amendment request to the City Council for further consideration. VIII. LAND USE/TRANSPORTATION COMMITTEE RECOMMENDATION The LUTC forwards the recommendation to the full Council as follows: a) That the request go forward for further consideration. b) That the request not go forward for further consideration. Th Hildebrandt two parcels to the north, which are also owned by the applicants, were rezoned from Commercial Enterprise (CE) to Multi -Family (RM 2400) as part of the 2010 Comprehensive Plan Amendment Process. B. Criterion #2 — The proposed amendment is consistent with the overall vision of the comprehensive plan. Response to Criterion #2 — Request Response Site Specific Request #1— Changing the designation of this parcel from Suburban Estates Hoit (SE) to Single Family — High Density Residential (RS 15.0) would not be consistent with the overall vision of the comprehensive plan. The existing SE designation for the subject parcel is consistent with the vision of the comprehensive plan to retain larger urban lots on or near critical areas in order to avoid development pressure. The comprehensive plan states that there are two notable locations that meet this criterion: Spring Valley, located in the southern portion of the city; and along Puget Sound near Dumas Bay in the vicinity of Camp Kilworth and the Palisades Retreat property. This property is west of and abuts Dumas Bay Park. Site Specific Request # 2 — Designating this parcel as multi -family is consistent with Land Use Barrett Policy LUP23, which is supportive of locating multiple -family development where transportation and capital facilities improvements are available. All utilities are available to the site. In addition, the parcel is adjacent to South 308`h Street, a minor collector, which is intended to connect higher density areas to the arterial system. The proposed amendment would also allow development of the site to be consistent with adjacent land uses.
