AGREEMENT FOR CITY OF FEDERAL WAY
GATEWAY MONUMENT
This Agreement is dated effective the day of
, 1994 and is entered into by and between the City of
Fed al W y, Washington (hereinafter "City") ; the Federal Way Lions
Club (hereinafter "Club") ; the City of Federal Way Gateway Monument
Committee (hereinafter "Committee) ; and Federal Way Joint Venture,
doing business as Gateway Center (hereinafter "Center") .
WHEREAS, the Club and Committee in conjunction with Gateway
Center have proposed a Monument to welcome persons to the City of
Federal Way; and
WHEREAS, this "Gateway Monument" is proposed for the northwest
corner of Southwest 320th at the southbound I-5 off-ramp located
within the City of Federal Way; and
WHEREAS, this site is on property owned by the Washington
State Department of Transportation (hereinafter "DOT") and DOT has
issued General Permit No. 15077 to construct and maintain the City
Monument, a copy of which is attached hereto as Exhibit "1" and is
incorporated herein by reference; and
WHEREAS, a permit application has been reviewed and approved
by the Federal Way Department of Community Development Services and
by the City Parks Department; and
WHEREAS, the Gateway Monument proposal, attached hereto as
Exhibit "2", represents an example of the benefits of combined
efforts between the City, business and residential community; NOW,
THEREFORE,
The parties agree as follows:

I. RESPONSIBILITIES OF PARTIES
Based upon the mutual promises contained herein and other
valuable consideration, the responsibilities of the parties are as
follows:
1. The Lions Club shall:
A. Administer the funds for the construction of the Gateway
Monument project in a workmanlike manner, according to
plans and specifications on file with the City and DOT
and attached hereto as Exhibit "3".
B. The Club shall not disburse any Gateway Monument Project
funds for construction purposes, other than for the
permit fees, if any, until such time as the Committee has
obtained full funding for the project, and City approval
of the contractor has been obtained pursuant to paragraph
2.D herein.
2. The Committee shall:
A. Coordinate collection of donations for the Gateway
Monument Project.
B. Work with appropriate city officials to obtain all
necessary City and State of Washington permits, and
comply with all conditions thereof.
C. Warrant that in the event any Contractor is hired,
procured or designated by the Club to perform
construction of the Gateway Monument, the Contractor
shall have the requisite training skills and experience
necessary to provide said services and is appropriately
accredited and licensed by all applicable and

governmental entities. Any such Contractor shall have,
and retain during the work performed, such liability
insurance as the City shall require, with limits of
liability acceptable to the City, and such policies of
insurance shall name the City, the Committee, the Club
and the Center as Additional Insureds. In the event the
work is performed by a private club or non-profit
volunteer agency, such club or agency shall be similarly
required to have liability insurance acceptable to the
City, naming the parties as Additional Insureds.
D. Any Contractor hired, procured, or designated to perform
work, and the contract by which the services are to be
provided to fulfill this agreement, shall be approved by
the City prior to the commencement of any work. The
Committee shall not hire, procure, or officially
designate for this project, any contractor until such
time as Committee has obtained full funding for the
project and City approval has been obtained.
E. It is the intention and understanding of the parties
hereto that any Contractor hired for this project shall
be an independent contractor and that the City shall be
neither liable nor obligated to pay Contractor sick
leave, vacation pay or any other benefit of employment,
nor to pay any social security or other tax which may
arise as an incident of employment. The Contractor shall
pay all income and other taxes as due. Industrial or any
other insurance which is purchased for the benefit of the

City, regardless of whether such may provide a secondary
or incidental benefit to the Contractor, shall not be
deemed to convert this Agreement to an employment
contract. It is recognized that Contractor may or will
be performing services during the term of this Agreement
for other parties and that the City is not the exclusive
user of the services Contractor will provide.
3. The Gateway Center shall:
A. Provide a license for nonexclusive access to and parking
upon an adjacent Center lot for the City Monument
maintenance crew. Center reserves the right to relocate
the parking area on said lot.
B. This executed document shall provide license to the City
for necessary, nonexclusive ingress and egress for City
Monument maintenance crew over and upon the Center
parking lot by such route and at such times as said crew
reasonably requires, provided that Center may require
specific routes (including access from the Center parking
lot to the Gateway Monument via S. 320 sidewalk) and
times by submitting the written license provided for
hereinabove at Paragraph 3.A to City.
C. Construct and install irrigation supply water system to
the Monument area which may, at Center's option, include
a separate meter for the Monument system and a tap into
the watermain along 320th, and which shall allow water
hook-up for the Monument irrigation system, at the
Center's sole cost and expense.

D. At the Center's sole cost and expense, pay all water
charges associated with the Monument water system,
provided that: this payment is conditioned upon the City
fulfilling its maintenance obligation as stated herein,
and provided further: that the cost of the water for the
Monument area shall not increase by more than one hundred
percent (100%) in any ten (10) year period. If the cost
of water increases by more than one hundred percent
(100%) in any ten (10) year period, the City shall pay
the cost over and above the one hundred percent (100%)
increase, and the Center shall pay the balance. A new
base cost/rate will be established not later than the
beginning of each subsequent ten (10) year period.
E. At the Center's sole cost and expense, pay all costs of
electrical power for the Monument; provided that: this
payment is conditioned upon the City fulfilling its
maintenance obligation as stated herein; and provided
further that: the cost of electricity does not increase
by more than one hundred percent (100%) in any ten (10)
year period. If electricity costs increase by more than
one hundred percent (100%) in any ten (10) year period
then the City shall pay the increase costs over and above
such increase, and the Center shall pay the balance. A
new base cost/rate will be established not later than the
beginning of each subsequent ten (10) year period. If
the Monument electricity is not separately metered, the
payment of electrical charges allocated to the Gateway

Monument shall be determined by calculating fixture and
bulb ratings prorated for the Monument lighting cost
relative to the total circuit. In the event the City is
required to pay a portion of the electrical costs
pursuant to this paragraph, all information necessary to
calculate that portion of the electrical power allocated
for the Monument shall be made available to the City upon
request.
F. The Center agrees to indemnify and hold the City, its
elected officials, officers, employees and agents
harmless from any and all claims, demands, losses,
actions and liabilities (including costs and all attorney
fees) to or by any and all persons or entities,
including, without limitation, the respective agents,
licensees, representatives, arising from, resulting from,
or connected with this Agreement to the extent caused by
the negligent acts, errors or omissions of the Center,
its partners, shareholders, agents, employees,
contractors or by Center's breach of this Contract.
The City agrees to indemnify and hold the Center, its
officers, directors, shareholders, partners, employees,
and agents harmless from any and all claims, demands,
losses, actions and liabilities (including costs and
attorney fees) to or by any and all persons or entities,
including without limitation, their respective agents,
licensees, or representatives, arising from, resulting
from or connected with this Agreement to the extent

caused by the negligent acts, errors, or omissions of the
City, its employees, agents or contractors.
The provisions of this paragraph shall survive the
expiration or termination of this contract with respect
to any event occurring prior to such expiration or
termination.
4. The City shall:
A. Have a City representative present during the
construction of the Gateway Monument at all times unless
otherwise agreed to by the DOT representative, pursuant
to condition No. 28 of DOT Permit 15077.
B. Pay for removal of the Gateway Monument if the Right of
Way is needed for future road expansion pursuant to
condition No. 30 of DOT Permit 15077.
C. Comply with all maintenance standards for the Gateway
Monument area. The maintenance standards shall be as
contained in Exhibit "5" attached hereto.
D. Pay such electrical and water costs as required pursuant
to the provisions of Paragraph 3.D and 3.E of this
Agreement.
II. Parties Approval of Plans
1. The City indicates its approval of Exhibit "3", Monument Plans
and Specifications, and Exhibit "4", Landscaping Plan, as
evidenced by City review and issuance of Building Permit
approval attached hereto as Exhibit "6".

2. The Club, Committee, and Center evidence their approval of
Exhibit "3", Monument Plans and Specifications, and Exhibit
"4", Landscaping Plan, by their signature hereto.
3. The City, Committee, and Center evidence their approval of
Exhibit "5", Maintenance Standards, by their signature hereto.
III. General Terms and Conditions
1. This Agreement contains all of the agreements of the parties
hereto with respect to any matter covered or mentioned in this
Agreement and no prior agreements or understandings pertaining
to any such matters shall be effective for any purpose.
2. No provision of this Agreement may be amended or added to
except by agreement in writing signed by the parties hereto or
their respective successors in interest.
3. Any provision of this Agreement which is declared invalid,
void or illegal shall in no way affect, impair, or invalidate
any other provision hereof and such other provisions shall
remain in full force and effect.
4. No party hereto shall have the right to transfer or assign, in
whole or in part, any or all of its obligations and rights
hereunder without the prior written consent of all other
parties, which consent shall not be unreasonably withheld or
delayed.
5. This Agreement shall be made in and shall be governed by and
interpreted in accordance with the laws of the State of
Washington. Venue for all matters related to this Agreement
shall be King County, Washington.

6. Each individual executing this Agreement on behalf of a party
hereto represents and warrants that such individuals are duly
authorized to execute and deliver this contract on behalf of
that party.
IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be executed on the dates below indicated.

construct and maintain a city monument centered west of and opposite
approximate Milepost 143.82 located in the SW 'h of the SE of Section 9,
Township 21, North, Range 4 East, W.M.
on a portion of State Route No. 5 In King County, Washington, the Washington
State Department of Transportation or its designee, hereinafter referred to as the "Department", hereby orders

".GENERAL PROVISIONS
1. The Grantee, its successors and assigns, agrees to protectthe State of Washington and save it harmless from all claims,
actions or damages of every kind and description which may accrue to or be suffered by any person,persons,or property
by reason of the performance of any such work, character of materials used or manner of installation, maintenance and
operation,or by the occupancy of right of way by the Grantee;in case any suit or action is brought against the Department
for damages arising out of or by reason of any of the above causes,the petitioner,its successors or assigns will,upon notice
of commencement of such action,defend the same at its sole cost and expense and satisfy any judgment arising therefrom
if determined adverse to the State of Washington.
2. During the progress of the work such barriers shall be erected and maintained as may be necessary or as may be directed
for the protection of the traveling public;the barriers shall be properly lighted at night.
3. Except as herein authorized, no excavation shall be made or obstacle placed within the limits of the State highway in
such a manner as to interfere with the travel over said road.
4. If the work done under this permit interferes in any way with the drainage of the State highway,the Grantee shall wholly
and at its own expense make such provision as the Department may direct to take care of said drainage.
5. On completion of said work herein contemplated all rubbish and debris shall be immediately removed and the roadway •
and roadside shall be left neat and presentable and satisfactory to the Department.
6. All of the work herein contemplated shall be done under the supervision and to the satisfaction of the Department and
the entire expense of said supervision shall be borne by the party or parties to whom this permit is issued.
7. The Department hereby reserves the right to order the change of location or the removal of any structure or structures
authorized by this permit at any time, said change or removal to be made at the sole expense of the party or parties to
whom this permit is issued,or their successors and assigns.
8. All such changes, reconstruction or relocation by the Grantee shall be done in such manner as will cause the least inter-
ference with any of the Department's work and the Department shall in no wise be held liable for any damage to the
Grantee by reason of any such work by the Department,its agents or representatives,or by the exercise of any rights
by The Department upon roads,streets,public places or structures in question.
9. This permit or privilege shall not be deemed or held to be an exclusive one and shall not prohibit the Department from
granting other permits or franchise rights of like or other nature to other public or private companies or individuals,nor
shall it prevent the Department from using any of its roads,streets, or public places,or affect its right to full supervision
and control over all or any part of them,none of which is hereby surrendered.
10. The Department may revoke, amend or cancel this permit or any of the provisions thereof at any time by giving written
notice to the Grantee. The Grantee shall immediately remove all facilities from the right of way.Any facilities remaining
upon the right of way 30 days after written notice of cancellation shall be removed by the Department at the expense
of the Grantee.
11. The party or parties to whom this permit is issued shall maintain at its or their sole expense the structure or object for
which this permit is granted in a condition satisfactory to the Department.
12. If the Grantee enters into a contract or agreement with a contractor to perform the work provided herein to be performed
by the Grantee, the Grantee for itself, its assigns and its successors in interest, agrees that it will not discriminate on the
basis of race, color,sex, or national origin in its choice of contractors and will include all of the nondiscrimination pro-
visions set forth in Appendix "A" from Title VI of the Civil Rights Act of 1964 and Section 162(a) of the Federal Aid
Act of 1973 (23 U.S.C. 324), and as said Regulations may be amended. Breach of any of the above nondiscrimination
covenants shall be cause for cancellation as herein provided.
13. Any breach of any of the condition's and requirements herein made,or failure on the part of the'Grantee of this permit to
proceed with due diligence and in good faith after its acceptance, with construction work hereunder, shall subject this
permit to cancellation as herein provided.
14. This permit is subject to all applicable provisions of Chapter 47.32 RCW and/or Chapter 47.44 RCW and

4. A copy of the permit must be on the job site,and protected from the elements,at all times during any of the construction authorized by said permit
within the Department's right of way.
S. This permit does not-give the Grantee;or any agent;or contractor of the Grantee any rights to cut, spray,retard,remove,destroy, damage,
disfigure or in any way modify the physical condition of any vegetative material located on the highway right of way,except by written permission
from the Department. All restoration shall be done to the satisfaction of the Department at the sole expense of the Grantee.
.14' 6. If•necessary to increase sight distance,brush shall be removed from both sides of the approach and stumps shall be removed.The indiscriminate
cutting Of merchantable timber or disfiguring of any feature of scenic value shall not be permitted.

❑ T. The approach(es) shall be constructed in accordance with the attached . Sufficient length of
inches diameter culvert pipe shall be placed in ditch and laid to a true line and grade. The approach(es) shall be sur-
faced to the limits as shown on the plan with a 6 inch minimum compacted depth of gravel base material and a 3 inch compacted depth of crushed
surfacing top course.Asphalt paving will not be required.Finished grade of the approach shall be in accordance with the profile control as shown
on the attached plan. Directing of surface water from private property to Department right of way will not be permitted.
❑ 8. The approach(es) (intersection) shall be constructed in accordance with the attached . Sufficient
length of inch diameter culvert pipe shall be placed in ditch and laid to a true line and grade. The approach(es) (intersection)
shall be surfaced to the limits as shown on the plan with a 6 inch minimum compacted depth of gravel base material,a 3 inch minimum compacted
depth of crushed surfacing top course and paved with a 3 inch minimum compacted depth of Asphaltic Concrete Class "B" unless otherwise
specified by the Department.Any existing oil mat on shoulder or roadway shall be removed and new pavement laid to a butt joint with existing
pavement.Finished grade of new pavement shall be in accordance with the profile control as shown on attached plan.Directing of surface water
from private property onto Department right of way will not be permitted.
❑ 9. All buildings and appurtenances shall be so located at a distance from the right of way line of any State Highway that none of the right of way
therefore is required for use of the patrons or customers of any such establishment.Grantee shall comply with county building codes.Set-back
requirements for the location of buildings in relation to the right of way line are a function of local authorities and they should be Consulted
regarding requirements that must be adhered to.
❑ 10. The Grantee agrees to schedule the work herein referred to and perform said work in such a manner as not to delay the Department's contractor
in the performance of his contract. -
❑ 11. Work shall be restricted to the hours between a.m. and p.m. and no work shall be allowed on the right
of way Saturdays, Sundays or Holidays: unless otherwise authorized by the Department.
❑ 12. The shoulders, where disturbed, shall be surfaced with crushed surfacing top course inches minimum compacted
depth, or as directed by the Department. The surface of the finished shoulder shall slope down from the edge of pavement at the rate of ',
inch per foot unless otherwise directed.The restored shoulder must not have any strips or sections less than 2 feet wide.The restored shoulder

❑ 13. The Grantee shall be responsible for constructing and maintaining the road approach(es)and appurtenances between the shoulder line of the
highway and the right of way line inclusive of surfacing and drainage.The Department has the right to inspect all installations at the time of
construction and at any time afterward and to require that necessary changes and repairs be made.Unsatisfactory work will be corrected by the
Department,at the Grantee's expense,or access may be removed at the Grantee's expense.Directing of surface water from private properly
onto Department right of way will not be permitted.
❑ 14. The approach shall be sufficiently surfaced back an adequate distance from the edge of the pavement to prevent any mud tracking onto the
highway. Any mud tracked onto the highway shall be immediately cleaned up by the Grantee or his agent.
❑ 15. Standard highway warning signs designated as"Truck Crossing"sign,plate W11-8,shall be placed and maintained at Grantee's expense on
each side of the approach.Signs shall be in evidence only when access is actually being used.If necessary flagman shall be provided.Sufficient
parking space shall be provided by the Grantee outside Department. right of way so no vehicles will be parked on said right of way.
❑ 16. All manholes,valve covers,and like appurtenances shall be constructed at such an elevation to conform to the shoulder slope from the edge of
( pavement or as directed by the Department.
i17. All slopes,slope treatment,top soil,ditches,pipes,etc.,disturbed by this operation shall be restored to their original cross section and condition.
All hazards shall be marked by warning signs,barricades and lights.If necessary,flagmen shall be employed for the purpose of protecting the
traveling public.
lir 18. During the construction and/or maintenance of this facility,the Grantee shall comply with the"Manual on.Uniform Traffic Control Devices for
Streets and Highways." .
❑ 19. Bond coverage required to insure proper compliance with all terms and conditions of said permit will be furnished by a Blanket Surety Bond held
at Headquarters in Olympia.
❑ 20. A surety bond in the amount of,S written by a surety company authorized to do business in the State of Washington.
shall be furnished to ensure compliance with any and all of the terms and conditions of this permit andahall remain in force until all work under this
permit has been completed and approved by the Department.
❑ 21. Before any log hauling operations begin, a surety bond in the amount of S shall be furnishedl by the Grantee to protect
the Department against any damage to the highway and to ensure complete removal of the approach and cleaning up of the right of way to the
satisfaction of the Department. Approval of all clean up work shall be secured before the bond will be released. -
❑ 22. This permit is subject to the terms and conditions of Agreement No. . in case anything contained herein is inconsistent
with said agreement, the agreement shall govern.
❑ 23. This section of highway is ON the master plan for limited access highways.At such time as this plan is implemented,jour access will be subject
to review.
❑ 24. Relative to advertising adjacent to all State highways,we wish to call your attention to the Scenic Vistas Act of 1971,Chapter 47.42 RCW and
State Transportation Commission ruling Chapter 468-66 WAC.Violation of this section of the statutes will be sufficient cause for cancellation of
this permit. On-Premise signs are allowed.
Ar 25. The Grantee shall notify the Department's representative upon completion of the work under this permit or franchise so that•final inspection can
be made.

SPECIAL PROVISIONS FOR HIGHWAY ENCROACHMENTS
x26. This special provision supersedes Franchise General
Provision No. 4, Utility Permit Provision No. 3 and
General Permit General Provision No. 1.
The Utility/Grantee, its successors and assigns, agrees
to protect the State of Washington, its officers and
employees and save them harmless from all claims, actions
or damages of every kind and description which may accrue
to or be suffered by any person, persons, or property by
reason of the acts or omissions of the Utility/Grantee,
its assigns, agents, contractors, licensees, employees or
any person whomsoever, in connection with
Utility's/Grantee's, its assigns' , agents' , contractors' ,
licensees' or employees' construction, installation,
maintenance operation, use or occupancy of the right of
way or in the exercise of this permit/franchise. In case
any suit or action is brought against the State of
Washington, its officers and employees arising out of or
by reason of any of the above causes, the
Utility/Grantee, its successors or assigns will, upon
notice of such action, defend the same at its sole cost
and expense and satisfy any judgement against the State
of Washington, its officers, or employees: PROVIDED, .
that if the claims or damages are caused by or result
from the concurrent negligence of (a) the State of
Washington's agents or employees and (b) the
Utility/Grantee or Utility's/Grantee's agents or
employees, and involves those actions covered by RCW
4.24.115, this indemnity provision shall be valid and
enforceable only to the extent of the negligence of the
Utility/Grantee or the Utility's/ Grantee's agents or
employees.
The Utility/Grantee, and on behalf of its assigns,
agents, licensees, contractors and employees agrees to
waive any claims for losses, expenses, damages or lost
revenues incurred by it or its agent, contractors,
licensees, employees or customers in connection with
Utility's/ Grantee's, its assigns' , agents' ,
contractors' , licensees' or employees' construction,
installation, maintenance, operation, use or occupancy of
the right of way or in the exercise of this agreement
against the State of Washington, its agents or employees
except the reasonable costs of repair to property
resulting from the negligent injury or damage to
Utility's/Grantee's property by the State of Washington,
its agents, contractors or employees.

SPECIAL PROVISIONS FOR HIGHWAY ENCROACHMENTS
x27. Construction of this facility will not be permitted from
the through traffic roadways, shoulders or ramps of SR 5.
All access during construction shall be from outside the
State right of way.
x28. Should the Grantee/Utility choose to perform the work
outlined herein with other than its own forces, a
representative of the Grantee/Utility shall be present at
all times unless otherwise agreed to by the District
Representative. All contact between the Department and
the Grantee/Utility's contractor shall be through the
representative of the Grantee/Utility. Where the
Grantee/Utility chooses to perform the work with its own
forces, it may elect to appoint one of its own employees
engaged in the construction as its representative.
Failure to comply with this provision shall be grounds
for restricting any further work by the Grantee/Utility
within the State right of way, until said requirement is
met. The Grantee/Utility, at its own expense, shall
adequately police and supervise all work on the above
described project by itself, its contractor,
subcontractor, agent and others, so as not to endanger or
injure any person or property.
x29. The responsibility of the Grantee/Utility for proper
performance, safe conduct and adequate policing and
• supervision of the project shall not be lessened or
•
otherwise affected by Department approval of plans,
specifications or work, or by the presence at the
worksite of Department representatives, or by compliance
by the Grantee/Utility with any requests or
recommendations made by such representatives.
x30. If the right of way is needed for future road expansion,
the city of Federal Way will remove sign at no cost to
the State of Washington or the DOT.
x31. Maintenance workers shall wear a hard hat and vest while
working on right of way.

Dear Mr. Wicks:
Thank you for faxing General Permit 15077, signed in 1992 by Federal Way City Manager
Brent McFall, approved as to content by City Attorney Carolyn A. Lake, and by Gerald
Mallum, Department of Transportation Utilities/Developer Services Engineer. During our
telephone conversation of May 18, we discussed the current status of this permit.
In December of 1991, the Federal Way City Council approved the Gateway Monument
project subject to the condition that full funding for the project be secured prior to
construction. The City obtained General Permit 15077, which authorized the construction of
the project within the Washington State Department of Transportation (WSDOT) Interstate-5
right-of-way. The City, as the Grantee of General Permit 15077, returned the signed permit
to WSDOT on March 2, 1992.
Complete funding for the Gateway Monument project was achieved on May 5, 1994. As of
this date, it is the intent of the City to activate General Permit 15077 for the purpose of
construction of the Gateway Monument project.

In addition, an extension of the General Permit 15077 permit is requested. Construction of
the Gateway Monument shall be completed no later than May 31, 1995. In my May 18
telephone conversation with you, you indicated that General Permit 15077 would be
automatically renewed and extended by the City's written request. Based on your verbal
assurance, we assume that this letter will operate to extend the life of said permit as herein
requested.

Dear Deb,
As of May 5th we have exceeded the necessary funds, materials,
and in-kind services needed to start the construction of the
monument. Cash in the bank is $7 , 586 . 99. Attached are lists of
materials and services needed. Items with individuals names to
the right of the dollar amounts have been donated by those
parties named.
Home Depot, the contributor who put us over the top, is
requesting a meeting at the site this Friday, May 13, at 7 :00 AM,
Meeting notices are going out to Home Depot, Lloyd' s Enterprises,
Ed Rosedin Electric, Gateway Center, Hovland Architects, Roper
Company, PEI/Barrett Consulting Group, Lou Kachlic, Tom Shank,
Boy Scout Troop #336, Steve Erickson, Enchanted Parks, Federal
Way Water & Sewer, and Joe Carlo. Please consider this letter as
your notice of the meeting.

in concrete because the exact requirements have not bee-II—defined .
The following is on the basis that the sign is backlighted
by fluorescent fixtures install vertically on the back wall
of the cavity . Two additional fixtures are utilized behind
the monument to provide a Halo effect .

"GATEWAY MONUMENT"
Maintenance Standards
I. LAWN MOWING
1. Weekly starting March 1, through October 31.
2. Twice a month during November and February.
3. Monthly during January and December if necessary.
4. Grass to be cut from 1.5 to 2 inches in length.
5. All grass cuttings to be collected and removed.
6. All clippings to be blown from hard surfaces
surrounding walks, patios, driveways, etc.
II. EDGING AND TRIMMING
1. Edging and fishline trimming to be provided with each
mowing to maintain good definition.
2. Mechanical edging and fishline trimming will be
provided around trees and fences, as well as for all
walks, patios, drives and garden edges.
3. Edging operation includes debris clean-up from
services.
4. All clippings to be blown from hard surfaces
surrounding walks, patios, driveways.
III. BED AREA MAINTENANCE
1. Weed control will be provided using selective broadleaf
herbicides by the spot spray method. Weed spraying
will be provided at the same four-time-per-year
intervals as fertilization. Insecticides available for
additional charge.
2. Weeding as required each visit, including haul away.
3. Debris and litter to be removed from beds each visit,
bark raking (fluffing) done when needed to maintain a
fresh appearance.
IV. IRRIGATION MAINTENANCE
1. A complete sprinkler system diagram is needed.
2 . Make adjustments of automatic controller, adjust heads,
make sure system is operating properly and lawn is
adequately watered.
3. Sprinkler system repair and parts are incurred by City
of Federal Way.
4. Repair and replace any equipment damaged as a result of
maintenance operations, at the expense of the City.
5. Damage not resulting from the City's negligence to be
reported promptly to Jennifer Schroder.

V. TURF FERTILIZATION
1. Provided four (4) times per year in early spring,
summer, fall and winter. All application amounts to be
per product and manufacturer specifications.
2. Aerating and insecticides will be as needed.
3. Tree and shrub fertilization to be provided once per
year. Flowering plant material to be fertilized once
per year. All application amounts to be product and
manufacturer specifications.
4. All clippings to be blown from hard surfaces
surrounding walks, patios, driveways, etc.
VI. PRUNING
1. Pruning and shaping of existing trees and shrubs to be
included.
2. Removal of dead wood and sucker growth and trimming of
ground cover to keep within bed boundaries and
debudding of flowering shrubs after bloom.
3. Pruning and replanting as required, shall be undertaken
so as not to block the westbound view of the Center's
pylon sign.
VII. MONUMENT
The City shall be responsible for all costs of repair
or replacement of the Monument, and the fixtures,
utilities, and emplacements appurtenant thereto, during
the life of the Monument. The parties hereto shall
render full cooperation to the City in the event
repairs or replacement become necessary.
VIII. OTHER
Swales, rockery walls, rock outcroppings and other site
features shall be maintained on a regular basis to keep
the site looking clean, neat and attractive.
