Guest: None Chair Honda called the meeting to order at 5:32p.m. Public Comment: None Commission Comment: None APPROVAL OF SUMMARY Committee member Kochmar moved to approve the October meeting summary. Committee member Freeman seconded.Motion passed. BUSINESS ITEMS Community Center Pool Chemical Vendor Contract Mr. Feldman reported that the cost for pool chemicals has risen 15%in the past year. King County has a contract with the same vendor that we are currently using for our pool chemicals. Staff has discussed this with the City's Finance and Legal Departments and was given the okay to"piggy back"onto King County's contract. This will be a savings of$4,000 over last year.Committee member Kochmar moved to forward the authorization of a Goods and Services Agreement with ORCA Pacific,Inc.with a total compensation of$38,000 and authorize the Mayor to execute the agreement,to the full Council November 20,2012 consent agenda for approval. 2013 Diversity Commission Work Plan Mr.Bennett provided the background information. This work plan is similar to last year's work plan with a few new items. One of the new activities is the creation and implementation of a 2013 Diversity Summit. Leaders from Federal Way's multi-cultural communities will come together and discuss a variety of things. There is currently a survey available on the City's website.The intent of the survey is to collect data for the commission so they could formulate work plans for the future based on the information they get from the survey results. Information gathered from the survey will also be used in the Diversity Summit. They would also like to create a partnership with the City of Federal Way's Advancing Leadership groups. Chair Honda stated that when she served on the Diversity Commission they were involved in the MLK Celebration. A former employee told the commission that due to an Ordinance,they were no longer allowed be able be involved in that Celebration. She is concerned about the MLK Celebration,and would like the Diversity Commission to be involved in the event. Mr.Bennett stated that he could bring the work plan back to the Commission and ask them if this is something they would like to add to their work plan. City Attorney Pearsall stated that she would look into whether or not the Commission can be involved in the event.Council member Burbidge added that there was also an issue of gathering sponsorships and the performance groups wanting to be paid; it was difficult to manage the funds. No action was taken,and Mr.Bennett will take the work plan back to the Commission to see if they would like to add the MLK Celebration to their work plan. This item will come back to the Committee. Renewal of Jail Services Contracts—King County Lt.Nelson stated that renewing this contract will extend the date from January 1,2013 through December 31,2020. There are no significant changes from the previous contract. This contract is important because the City has a work educational release program thru the jail. This is cost affective to have some inmates in this program as opposed to being housed. There are also some special needs inmates that need to be housed in the King County Jail as opposed to SCORE. The majority of the jail inmate population is taken to SCORE.A very small percentage of inmates are taken to King County. If Federal Way is unable to pick up that inmate before he/she is scheduled to be released,then he/she will be let go. Having a contract with King County would allow them to book the person back into the jail for that warrant,until arrangements can be made to go pick them up.Committee member Freeman is concerned with how much the jails are costing the City. Lt.Nelson explained that the SCORE Facility and King County Jail are two separate entities. This contract is set to expire at the end of 2012. This contract is a safety blanket to be used for the Special Needs inmates,and for those inmates that are placed on the Work Release Program. There is no minimum bed requirement. This contract would only be used if we needed it. Discussion was held on whether or not to move this item to the Full Council Consent Agenda,or the Full Council City Business Agenda. Committee member Freeman would like the full Council to be aware of the costs,and would like to have a discussion at the Council meeting. Committee member Freeman moved to forward the proposed Jail Services Agreements to the November 20,2012 full Council City Council Business agenda for approval. Further discussion was held regarding the importance of having this contract approved by the end of 2012. Committee member Kochmar seconded.Motion passed. Washington Traffic Safety Commission(WTSC)Grant—Target Zero Teams MOU Lt.Nelson stated that the Washington Traffic Safety Commission is giving the City a grant in the amount of $7,700.00.$6,500.00 is for DUI patrols,and$1,200.00 is for seatbelt enforcement. The seatbelt enforcement will occur in the month of May,and DUI patrols will occur throughout the various holiday's. This grant will pay for overtime. Committee member Freeman moved to forward the WTSC Target Zero Team MOU Agreement to the November 20,2012 Council consent agenda for approval. Committee member Kochmar seconded. Motion passed. Other Discussion was held on the recent legalization of Marijuana,and how that is going to affect the city and the Federal Way Police Department. It is still illegal under the age of 21. There are still many unknowns at this time. Committee member Freeman commented on the pool table equipment and basketballs at the Federal Way Community Center. Pending Items A brief discussion was held on the importance of the Veterans Memorial.They are still looking at the site by Truman High School. Wilson,Chief of Police SUBJECT: FBI-STAB Team(Nuclear Stabilization Team) Background The Federal Way Police department has had a certified Bomb Disposal Unit since the year 2000. There are only 450 bomb squads in the US and our agency is fortunate to be one of those very few units. We currently have three certified technicians and one certified bomb squad commander/technician on the team. One of the aspects of the mission of these FBI certified and supported teams,is to respond to regional issues and to be a participant in collaborative efforts that ensure the safety and security of those we serve. The FBI in association with the Department of Defense (DOD) has developed a new regional team Nuclear Stabilization Team (STAB) whose mission is to prepare for and be able to respond to nuclear incidents in the event that they occur.The Federal Way Bomb Disposal Unit has been granted a spot on this twelve person team,if we choose to accept it. Funding and Training The funding for this program will be shouldered by the Federal Government. The fiscal impact on the department would be limited to training time,which would require one week per month for the first four months of the program beginning in April of 2013. After the initial training there will be approximately three days per quarter of additional training required to maintain proficiency and receive updates as needed. Any additional equipment or gear necessary would be provided by the government as needed. The technician would be required to upgrade their government clearance from Secret to Top Secret and they would also need a Q Clearance through the DOD. The cost for these clearances would also be shouldered by the government. Summary • Participation in this undertaking would promote the regionalization of a specialized response to occurrences that would pose a threat to our citizens. • The Federal Way Police Department has and maintains a certified bomb squad that has the capability to provide a highly trained technician to this new program. • The fiscal impact on the agency would be minimal since the government would be providing the training and equipment needed to implement the program. • The training time needed to prepare and maintain the technician can be managed in order to satisfy the commitment. 1 6 COUNCIL MEETING DATE:January 2,2013 ITEM#: CITY OF FEDERAL WAY CITY COUNCIL AGENDA BILL SUBJECT:PARKS,RECREATION&CULTURAL SERVICES COMMISSION 2013 WORK PLAN POLICY QUESTION: Should the Council approve the Parks,Recreation&Cultural Services Commission 2013 Work Plan? Roe, P.E., Director of Parks, Public Works & Emergency Mgmt.e Subject: 2012 Parks, Recreation & Open Space Plan Update The City is required to update our Parks, Recreation and Open Space Plan (PROS) every six years. This is necessary to meet the GMA requirements and to be eligible for certain Grants. Our current approved 2006 PROS Plan expired in June 2012. Staff has been working to update the current plan from a house keeping standpoint. This means we would leave the fundamental plan intact that was developed through an in depth public process. All the goals stayed the same but clarifying language was added and content that is no longer applicable changed such as: • Revise Park Classifications to: Community, Neighborhood &Open Spaces. • Text referring to Camp Kilworth, Kenneth Jones Pool and Klahanee Lake Community Center would be deleted since they are no longer in the City inventory. • Acquisitions of Laurelwood Park and many Open Space properties are now included. Acreage of all Park properties were reviewed and adjusted as needed. • Updated the demographic pages and charts. • Updated maps and corresponding tables to reflect current inventory. The approval process for this housekeeping update included; a SEPA process as well as a public hearing held in conjunction with the November 1st Park Commission meeting. Following the public hearing, staff edited the DRAFT plan to reflect the comments that were applicable. The Park Commission discussed the updates and recommend forwarding the updated plan to the PRHSPS Committee for their recommendation. The PROS Plan would then be forwarded to Full Council in which two readings would be required for adoption of an Ordinance. The goal is to complete the City process by January 2013 to be able to have an updated version ready for future grant application opportunities. 10 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,AMENDING THE CITY'S,PARKS,RECREATION,AND OPEN SPACE PLAN(AMENDING ORDINANCE NO'S.90-43,91-114,95-247,95-248,96- 270,98-330,00-372,01-405,03-442,04-460,04-461,04-462,06-528). WHEREAS, the Growth Management Act of 1990 as amended (Chapter 36.70A RCW or"GMA"), requires the City of Federal Way to adopt a comprehensive plan which includes a land use element(including a land use map), housing element, capital facilities plan element, utilities element, economic development element,park and recreation element,and transportation element; and WHEREAS,the Federal Way City Council adopted a Parks,Recreation,and Open Space Plan on December 3, 1991,and subsequently amended this plan on November 21, 1995,September 14,2000,and June 29,2006; and WHEREAS the Parks, Recreation, and Open Space Plan is adopted by reference into the comprehensive plan;and WHEREAS the Parks, Recreation, and Open Space Plan is consistent with the City of Federal Way's existing land use policies contained in the Federal Way Comprehensive Plan,the Federal Way Revised City Code,and the Zoning Map;and WHEREAS the Parks, Recreation, and Open Space Plan is consistent with the GMA as it contains the following components:(a)an inventory showing the location and capacity of existing capital facilities;(b)a forecast of future needs per capital facility;(c)the location and capacity of proposed new or expanded capital facilities; and (d) a six-year capital improvement plan identifying sources of public money to fund these improvements;and WHEREAS, on October 12, 2012, the City's SEPA Responsible Official issued a Determination of Nonsignificance on the 2012 Parks,Recreation,and Open Space Plan;and WHEREAS,the City of Federal Way,through its staff,Parks Commission,Parks Committee,and full City Council has received, discussed, and considered the testimony, written comments, and material from the Ordinance No. 13- Page 1 of 4 Rev 1/10 CP 11 public,as follows: 1. The City's Parks/Recreation Commission held a public hearing on the proposed amendments to the Parks,Recreation,and Open Space Plan on November 1,2012,after which it recommended approval of the proposed amendments;and 2. The Parks/Recreation/Human Services and Public Safety Committee of the Federal Way City Council considered the proposed amendments on December 11, 2012, following which it recommended approval to the full City Council;and 3. The full City Council considered the matter at its meetings on January 2,2013 and January 15, 2013;and WHEREAS,the City Council desires to approve the proposed amendments to the Parks,Recreation,and Open Space Plan. Now, THEREFORE, the City Council of the City of Federal Way, Washington, does hereby ordain as follows: Section 1. Findings. A. The proposed amendments to the Parks,Recreation,and Open Space Plan,as set forth in Exhibit A attached hereto, is an update to the 2006 Plan that has updated both the text and maps of the Plan. This includes accomplishments since 2006 and future planned projects. It also updates the population profile of Federal Way and the parks inventory,and reclassifies some of the parks to better reflect their function.The Level of Service for all parks by category has been recalculated and the Six-year Capital Improvement Plan has been revised to cover the 2006-2012 period.This process has included briefings and working sessions with the Parks/Recreation Commission and the Parks/Recreation/Human Services and Public Safety Committee of the Federal Way City Council. The proposed amendments will, therefore, benefit the neighborhood, City, and region,and bear a substantial relationship to public health,safety,and welfare;are in the best interest of the residents of the City;and are consistent with the requirements of RCW 36.70A and the unamended portion of the Federal Way Comprehensive Plan. B. Parks and recreation facilities are essential to maintaining and enhancing quality of life in the City. The new and improved facilities recommended by the 2012 Parks,Recreation,and Open Space Plan provide Ordinance No. 13- Page 2 of 4 Rev 1/10 CP 12 a basic service for residents of the City and surrounding areas and should be treated as such by the City of Federal Way in its policy and resource commitments. C. Implementation of the"core values"of the 2012 Parks, Recreation, and Open Space Plan, such as retaining and improving existing open spaces and facilities; encouraging walking and biking through an integrated trail and sidewalk network;providing areas for friends and neighbors to gather,meet,and socialize; and providing a balance of services for a diverse population will benefit the neighborhood,City,and region. Section 2. Parks, Recreation and Open Space Plan Adoption. The Parks, Recreation,and Open Space Plan,as thereafter amended in 1991, 1995,2000,and 2006,copies of which are on file with the Office of the City Clerk,hereby are and shall be amended as set forth in Exhibit A attached hereto. Section 3. Amendment Authority. The adoption of the Parks, Recreation, and Open Space Plan amendments in Section 2 above is pursuant to the authority granted by Chapters 36.70A and 35A.63 RCW. Section 4. Severability. The provisions of this ordinance are declared separate and severable. The invalidity of any clause,sentence,paragraph,subdivision,section,or portion of this ordinance,or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the ordinance,or the validity of its application to other persons or circumstances. Section 5. Savings Clause. The City of Federal Way Parks, Recreation, and Open Space Plan, as thereafter amended in 1991, 1995, 2000, and 2006 shall remain in force and effect until the amendments thereto become operative upon the effective date of this ordinance. Section 6. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. Section 7. Effective Date.
