Mayor Priest called the meeting to order at 7:00 p.m.

3. PRESENTATIONS
a. Thomas Jefferson High School Bovs Soccer State Champions
Mayor Priest reported the Thomas Jefferson Raiders completed an undefeated season,
winning nineteen games, tying four games and recently won the state championship
match by a score of 3-0. The Raiders have won a total of eight state championships.
Mayor Priest presented the team members and coaches with Certificates ofAchievement
recognizing their accomplishments. Coach Dave Hanson reported he was very proud of
the players and noted the grade point average for the team members was a 3.5.

Municipai Court Student Art Contest Winners: - added item
Counciimember Honda reported this year's Municipal Court Art Contest received over 100
entries. Municipal Court Judges' Dave Larson and Rebecca Robertson recapped the
contest themed "Liberty and Justice for A!P' and presented the following winners with
certificates:

b. Proclamation: Relav for Life
Councilmember Celski reported Relay for Life is an annual event to raise fund and
awareness for the fight against cancer, and to remember those loved ones we have lost.
This year's event will be held at Saghalie Middle School. It starts at 6:00 p.m. on June 7th
and goes until noon on June 8th. Councilmember Celski read the proclamation into the
record and presented it to Relay for Life Event Chair Tarah Taggard and members of the
Relay Team. Ms. Taggard thanked the Council for the recognition and encouraged
individuals to participate in this year's event.
c. Proclamation: Amateur Radio Week
Councilmember Duclos stated she is pleased to present the Amateur Radio Week
proclamation this evening as she has an amateur radio license. Councilmember
Duclos read the proclamation into the record and presented it to Daniel Stevens. Mr.
Stevens provided information on the many activities the Federal Way Amateur Radio
Club performs and thanked the Council for the proclamation.
d. Ceremonial Swearinq in of Police Officer
Police Chief Brian Wilson introduced Federal Way Police Officer Shawn Warrick. City
Clerk McNeilly delivered the oath of office to Officer Warrick.
e. Police Department Awards Presentation
Police Chief Brian Wilson presented the following Police Department awards:
Police Chief's Citizen Commendation Award to Michael Born who assisted the Police after
he observed a vehicle that had been reported stolen. Mr. Born followed the vehicle and
reported its location to the Police who were able to arrest the driver.
Life-Saving Award to Officer Travis Loyd who responded to a call of CPR in progress
on an infant. Officer Loyd administered mouth-to-trachea tube CPR on the infant until
medics arrived to take over.

Life-Saving Awards to Officer Cole VanRuth and Officer Grant Bassett, the Officers
responded to Federal Way Dialysis for a CPR in progress call for a 72 year old client.
Once on the scene the officers recognized incorrect compressions and took over CPR.
The individual was resuscitated on scene and medics transported to an area hospital.
f. Sound Transit Update on Overflow Parking
City Traffic Engineer Rick Perez introduced the following Sound Transit representatives:
Chelsea Levy, Government and Community Relations Officer; Michael Miller, Manager of
Customer Facilities and Accessible Services; and Rachel Wilch, Associate Planner.
Ms. Levy stated her purpose tonight was to update Council and staff on Sound Transit's
ongoing efforts to address the overflow parking issue at the FW Transit Center. She was
pleased to announce Sound Transit will be leasing additional parking space in the next
coming weeks. Sound Transit is working on balancing needs vs. constrained resources in
Federal Way and surrounding areas.
Mr. Miller reviewed a Parking Utilization document noting the Federal Way Transit Center
is at 99% capacity with 1190 stalls. He further noted available parking and service routes
in the City as well as the ridership numbers and capacity levels for buses that service the
Federal Way Transit Center.
Ms. Wilch presented information on potential pilot programs (which are pending approval
by the Sound Transit Board) developed to manage parking resources for transit
customers. Programs include parking permits; rideshare management; and a parking
monitoring system. Councilmembers asked clarifying ques#ions of the representatives.
g. Mavor's Emerqinq Issues
Recvcle-Palooza Report: Mayor Priest recapped the 3rd annual Recycle-Palooza contest,
which was held on April 27�h at the Federal Way Community Center. Contest winners Peter
and Laura Johnson submitted written comments thanking the Mayor and Council for the
award. Laura Moser with Waste Management was in attendance with a$1,000.00 check
for Mr. and Mrs. Johnson. Mayor Priest thanked Recycling Project Manager Jeanette
Brizendine for her efforts with this event and noted that Ms. Brizendine was recently
awarded Washington's Outstanding Recycler of the Year by the Washington State
Recycting Association.
Mav 27, 2013 Police Traffic Stop: Chief Wilson reported on a traffic stop that occurred in
Federal Way on May 27, 2013 that has received a lot of inedia attention. He recapped the
incident and stated the King County Prosecutor's Office has filed charges against the
driver of the vehicle for assaulting an officer. Use of force was used to make the arrest.
An outside agency will conduct an investigation on of use of force by the Police.
4. CITIZEN COMMENT
Bettv Tavlor commented on a recent article in the Federal Way Mirror regarding a complaint
filed by a Councilmember. City Attorney Richardson interrupted Ms. Taylor and reviewed the
guidelines regarding campaigns and ballot propositions as provided by the Public Disclosure
Commission. Ms. Taylor stated she would like to see the City come together as a whole for
this year's National Night Out event.

Norma Blanchard commented on a recent letter published in the Federal Way Mirror
regarding the Performing Arts and Conference Center. Ms. Blanchard inquired if any
Councilmembers or their family members are members of the Federal Way Coalition of the
Performing Arts. If so, she feels this is a conflict of interest.
Donald Barovic spoke about the continued need for coyote control in and around his property.
He complimented Waste Management for the superior service they provide to residents.

Deputy Mayor Ferrell noted the Council has historically canceled the second Council
meeting in August to allow for vacations. Given all the issues facing the City he wanted
to address this item early so staff could plan accordingly for scheduling items for
Council Meetings.

and cancel the August 20, 2013 City Council meeting. Councilmember Celski

voting members; and appoint Ryan Miller as an alternate member. All appointments

d. Resolution: To Establish a Ballot Proposition Restrictinq Votinq on Citizen Initiatives to
November Elections
In December 2012 the Council directed staff to return to Council with a proposed ballot
proposition for the November 2013 election to restrict the voting of citizen initiatives to
November election dates.
City Attorney Pat Richardson reviewed the current law relating to citizen initiatives. The
proposed ballot proposition before Council would restrict voting on citizen initiatives to
November General elections. Historically there is more voter participation in the General
election and restricting citizen initiatives to the November elections would save taxpayers
the costs associated with participating in a Special election. Ms. Richardson reviewed the
timeline associated with adding this item to the November 2013 election.

ballot proposition restricting voting on citizen initiatives to November elections
for the November 2013 election and notify King County Elections to publish it in

e. Resolution: Directinq the Citv Clerk to Advertise for Members of Pro or Con
Committees for the Proposition Restrictinq the Elections for Citizen Initiatives, with
A�pointment Date of Julv 16, 2013
City Attorney Pat Richardson stated the proposed resolution would direct the City Clerk to
solicit individuals to serve on the Pro and Con Committees and submit written statements
for the voter's pamphlet for the citizen initiative ballot measure. If Council approves this
resolution, staff will issue a press release on June 5, 2013 seeking volunteers for the
Committees. The deadline to apply for a Committee would be July 8, 2013; Council would
appoint three members to the Pro Committee and three members to the Con Committee
at their July 16, 2013 meeting.
Motion: Councilmember Duclos moved to adopt the resolution directing the City
Clerk to advertise by press release for members of the Pro and Con Committees
for the ballot proposition restricting voting of citizen initiatives to November

f. Publishing Developrnent Notices in the Newspaper
City Attorney Pat Richardson stated the Federal Way Revised Code requires publication
in the City's official newspaper for proposed development regulations and proposed
development projects. State law does not require publication for all notices in the official
newspaper rather it allows flexibility to notify citizens of development. Curren#ly the City's
official newspaper publishes once per week, this schedule may result in delays to some
development proposals. The proposal before Council is to forward the issue of potential
revisions to the Federal Way Revised Code relating to publishing development regulations
and developrnent project notices in the official newspaper to the Planning Commission's
Work Plan as a medium-priority.
The Council discussed the best ways to provide information to the public and asked
clarifying questions of Ms. Richardson and Planning Manager Isaac Conlen relating to
City Council Minutes — June 4, 2013 Regular Meeting Page 6 of 8
past delays for development projects due to publication schedules and current notification
practices.
Motion: Councilmember Duclos moved to direct staff to forward the issue of
potential revisions to the development regulations in the Federal Way Revised
Code to the Planning Commission, placing this item on their work plan as a
medium priority. Councilmember Celski second.

forwarded it to this meeting for second reading and enactment.

8. COUNCIL REPORTS
Councilmember Maloney reported she attended the EarthCorps/Friends of the Hylebos picnic.
She also attended the City sponsored community meeting on the Performing Arts and
Conference Center (PACC) which was held at the Commons Mall. She thanked those who
attended the meeting on the PACC and provided public input on the proposed project.
Councilmember Honda reported this coming Saturday is the Flag Day Celebration at the King
City Council Minutes — June 4, 2013 Regular Meeting Page 7 of 8
County Weyerhaeuser Aquatic Center. The event is co-sponsored by the Soroptomists Club
of Federal Way and King County Councilmember Pete von Reichbauer. She reminded
everyone, June 9th Park Pais is having a fundraising event at French Lake Dog Park to raise
money to build a rain shelter at the park.
Deputy Mayor Ferrell stated he will be attending the Flag Day Celebration at the King County
Weyerhaeuser Aquatic Center on June 9th. He feels the meeting that was held to discuss the
Performing Arts and Conference Center was a successful event. He attended the
EarthCorps/Friends of the Hylebos Picnic which he noted was a wonderful event and well
attended by many including regional representatives.
Councilmember Burbidge reported on upcoming community events including the Truman
Garden Dedication on June 9th. She further noted the next LTAC meeting is June 12, 2013.
This weekend is the Relay for Life event which includes many city staff members who will be
volunteering for the event. She was pleased to report on the many volunteer activities the staff
engages in forthe community benefit, ranging from holding silent auctions, chili cook offs, and
events like the recent RollerMania; she thanked staff for giving back to the community they
work for.
Councilmember Celski thanked the many volunteers from EarthCorps/Friends of the Hylebos
for their efforts with their recent picnic. He echoed the comments by fellow Councilmembers;
the event was well attended and very successful. He is personally looking forward to the
upcoming Flag Day Event; which he will be attending.
Councilmember Noble-Gulliford stated the Denny and Barker cabins will be open this
weekend on June 8'h for touring. She reported on her attendance at a Chamber meeting with
Adam Smith; the topic of discussion centered on small business. She noted June 15�' the
Korean Youth Symphony will be performing locally.
Councilmember Duclos reported last Wednesday she attended the monthly SCA Board
meeting where they voted to support the Market Place Fairness Act which would close tax
loopholes and level the marketplace for brick and mortar stores. She also attended the
Regional Policy Committee Meeting where a new King County Veterans Initiative was
discussed.

Mayor Priest noted pursuant to the Council Rules of Procedure, Council assumed
responsibility for the appointments to volunteer Board and Commissions; therefore Deputy
Mayor Ferrell would preside over the meeting.
Deputy Mayor Ferrell reviewed the guidelines for public comment and stated comments
should be limited to the issue before Council.
2. PUBLIC COMMENT
Terrv Thomas, member of the North Lake Management District, referred to the email he sent
on June 4, 2013 which addressed his concerns with Mr. Summer's lack of stewardship forthe
Lake. Mr. Summers has placed structures in the Lake with no regard to neighbors. Mr.
Thomas submitted a photo to the Council of one of the structures.
Councilmembers asked clarifying questions of Mr. Thomas regarding the structures and if Mr.
Summers had shared his vision for the Lake with lake residents.
Jerrv Galland stated he is not a resident of the City, however; he lives on a lake and they are
considering the formation of a management district. Mr. Galland inquired if Mr. Summers had
made any improvements to the structures recently in an effort to improve stewardship.

3. CONSIDER APPOINTMENT TO THE NORTH LAKE MANAGEMENT DISTRICT
ADVISORY COMMITTEE
Deputy Mayor Ferrell stated he did not have the opportunity to read Mr. Thomas's email prior
to Council interviewing Mr. Summers. Upon learning new information regarding Mr. Summers
he contacted his colleagues to schedule a meeting to consider their recent appointment. He
inquired if Mr. Summers was notified of this meeting. Staff confirmed they provided notification
to Mr. Summers. Deputy Mayor Ferrell feels there was a lack of candor by Mr. Summers
regarding his chiropractic career on his application and during his interview.
Motion: Deputy Mayor Ferrell moved to rescind the appointment of Greg Summers
to the North Lake Management District Advisory Committee. Councilmember
Maloney second.
Councilmember Noble-Gulliford stated she supports the motion based on the input Terry
Thomas provided.
Councilmember Maloney stated the allegations facing Mr. Summers are not a factor in her
supporting the motion. The omissions on Mr. Summer's application and during the interview
are what she is considering.
Councilmember Honda asked if staff was aware of Mr. Thomas's email at the time Council
interviewed Mr. Summers.
Councilmember Burbidge spoke in support of the motion. She stated she received a phone
message from a resident of North Lake expressing their concern over the appointment of Mr.
Summers. She would like to see procedures relating to the interviews and appointment
process reviewed.
It was noted that application procedures for Boards and Commission will be discussed at
the July 9, 2013 Parks, Recreation, Human Services and Public Safety Council Committee
meeting.

BACKGROUND
Six (6) bids were received and opened on May 20, 2013, for the South 356`h Street Regional Detention Facility
(RDF) Retrofit Project. See attached Bid Tabulation Summary. The lowest responsive, responsible bidder is
Lloyd Enterprises, Inc. with a total bid of $775,191.07 (sales tax included). The low bid received was (29%)
below the engineer estimate. •
Reference checks on Lloyd Enterprises, Inc. indicate that the contractor has performed similar work. As a result,
City staff believes Lloyd Enterprises, Inc. can successfully complete this project to the City's satisfaction.
Therefore, the lowest responsive, responsible bidder is Lloyd Enterprises, Inc. in the amount of $775,191.07
(sales tax included).

SUBJECT: 2013/2014 Surface Water Infrastructure Maintenance and Services — Rebid
BACKGROUND•
Four bids were received and opened on October 16, 2012 for the 2013 Surface Water Infrastructure Maintenance
and Services Contract. The lowest responsive, responsible bidder was Action Service Corporation with a total bid
of $199,990.00.
On January 10, 2013, the City of Federal Way and Action Services Corporation entered into an
agreement for surface water infrastructure maintenance and service (Request for Bid #13-101). Since
this time, Action Services Corporation has been non-responsive to requests for information on disposal
of vactor solids and liquids, has failed to file a timely affidavit of intent to pay prevailing wages (filed on
5/20/13), has utilized equipment within the City that is in poor working condition on multiple occasions,
and has provided personnel with questionable experience/qualifications.
The City is terminating the contract with cause and has provided Action Services Corporation with thirty
(30) days written notice. Staff is requesting to rebid this work in order to obtain a more responsive and
responsible contractor to provide this critical service.

Background: The City recently replaced the synthetic turf and improved the drainage on the Sacajawea soccer
field. The Federal Way School District has agreed to invest over $200,000 into converting the old cinder running
track to a rubber surface. This will be a great improvement and will help extend the life of the soccer field by

THIS MEMORANDUM OF i7NDERSTANDING ("MOU") is made this day of
2013 by and between the undersigned representatives of the City of Federal Way ("City"), a
Washington municipal corporation, and the Federal Way School District ("District").
WHEREAS, the City is the owner of certain real property and improvements located at 1401 S. Dash
Point Road, Federal Way, Washington ("Sacajawea Park"); and
WHEREAS, the City and District have joint use of the running track and associated adjacent soccer field
located at Sacajawea Park;
WHEREAS, the City and the District have agreed to jointly maintain the running track and association
adjacent soccer fiel located at Sacajawea Park; and
WHEREAS, the City and District agree that the running track at Sacajawea Park is in need of
improvements; and
WHEREAS, the City and District have agreed that since the City took the lead on a recent adjacent
soccer field improvement, that the District would take the lead on the running track improvement;
NOW, THEREFORE, in consideration of the mutual agreements and covenarrts contained herein and for
other good and valuable consideration, the receipt and sufficiency of which hereby are acknowledged, it
is mutually agreed and covenanted, by and between the parties to this Agreement, as follows:
1. Improvement Details. The Sacajawea Park running track will be converted from a red cinder track
to a new rubber surface. The project will included installing a new drain system around the two radius
ends, removing the old red cinder, installing a new base with asphalt and installing a new L-2000
rubber surface with painted lines.
2. Distnct's Responsibilities:
a. The District shall design and manage all associated running track improvements.
b. The District shall meet all State and Local requirements.
c. The District shall coordinate all work with the City to reduce the impact of team sports on the
soccer field. The work cannot impact a City wide soccer tournament known as `Blast Off' which
will use the facility the first two weekends in August (Aug. 2— 4& Aug. 9— 11) or a
soecer camp in June (June 24 — 28).
3. City's ResponsibiliNes:
a. The City o€ Federal Way will provide access to the work site.
b. The City of Federal Way will pay a portion of the project not to exceed $40,546.60.
4. Term. The term of this MOU shall commence upon the effective date written above and shall
continue until the completion of all obligation under this MOU, but in any event, no later than
December 31, 2013. ("Term")
5. Entire Agreement. This MOU contains all of the agreements of the City and the District with
respect to any matter covered or mentioned in this MOU.

as of the day and year first written above by their duly authorized representatives.

BACKGROUND:
In accordance with the requirements of Chapters 35.77 and 47.26 of the Revised Code of Washington, the
City of Federal Way adopted its original TII' and ASIP on July 23, 1991. The City is also required to
adopt a revised TIP and ASIP on an annual basis reflecting the City's current and future street and arterial
needs. These plans identify capital projects that the City intends to construct over the next six years. In
order to be eligible for grant funding, projects are required to be listed in the City's TIP.
The City is required to hold a minimum of one public hearing on the revised plan, which is proposed for
the June 18, 2013 Council meeting. Once the revised plans have been adopted by Resolution, a copy of
the respective plans must be filed with the Washington State Secretary of Transportation and the
Washington State Transportation Improvement Board.
Attached for your review and comment are the proposed 2014-2019 TIP and ASIP (Exhibit A), a location
map (Exhibit B), and a draft resolution for adoption (Eachibit C). The six-year TIP and ASIl' respond to
the Growth Management Act concurrency requirements as well as other emerging needs. Projects are
selected based on criteria adopted in the City's Comprehensive Plan TP81, which reads, "Prioritize
transportation projects considering concurrency, safety, and support for non-SOV modes, environmental
impacts, and cost effectiveness." Each project was ranked using the scoring criteria established for
Transportation TIP/CIP Prioritization. Staff also reviewed and analyzed available grant-eligible programs
suitable for project programming.

WHEREAS, the Federal Way City Council further updated its Transportation Improvement
Program on June 21, 2011 (Resolution No. 11-609); and
WHEREAS, the Federal Way City Council further updated its Transportation Improvement
Program on July 3, 2012 (Resolution No. 12-622); and
WHEREAS, the City Council of the City of Federal Way has reviewed the work
accomplished under the existing Program and has reviewed work scheduled to be accomplished
according to the updated Program; and
WHEREAS, a public hearing was held on the revised Transportation Improvement Program
on June 18, 2013, in compliance with the requirements of State laws; and
WHEREAS, the City Council has determined current and future City street and arterial
needs, and based upon these findings has prepared a revised and extended Transportation
Improvement Program and an Arterial Street Improvement Plan for the ensuing six calendar years;
and
WHEREAS, pursuant to RCW 35.77 and 47.26, the City Council is required to annually
revise and adopt an extended Transportation Improvement Program and an Arterial Street
Improvement Plan; and
WHEREAS, the City's SEPA Responsible Official has adopted the DNS Federal Way File
12-101810-00-SE issued for the City's 2014-2019 Transportation Improvement Plan (TIP) and
Resolution No. 12- Page 3 of 6

Arterial Street Improvement Plan (ASIP) which includes the extended and revised projects contained
in the TIP adopted herein; and
WHEREAS, adoption of the City's 2414-2019 Transportation Improvement Plan (TIP) and
Arterial Street Improvement Plan (ASIP) DNS reflects the fact that there will be no significant
adverse environmental impacts as a result of adoption or implementation of the extended and revised
Transportation Improvement Plan (TIP) and Arterial Street Improvement Plan (ASIP) adopted
herein;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
RESOLVES AS FOLLOWS:
Section 1. Program Adopted. The extended and revised Transportation Improvement
Program and Arterial Street Improvement Plan far the City of Federal Way for the ensuing six (6)
calendar years (2014-2019 inclusive), a copy of which is attached hereto as Exhibit A and
incorporated herein by this reference, which sets forth the City's transportation project locations,
types of improvements and the estimated costs thereof, is hereby approved and adopted.
Section 2. Filin og f Prog�. Pursuant to Chapter 35.77 RCW, the City Clerk is hereby
authorized and directed to file a copy of this Resolution, together with Exhibit A, with the
Washington State Secretary of Transportation and a copy with the Washington State Transportation
Improvement Board.
Section 3. Severabilitv. If any section, sentence, clause or phrase of this resolution should be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause or phrase of this resolution.

Section 4. Corrections. The City Clerk and the codifiers of this resolution are authorized to
make necessary corrections to this resolution including, but not limited to, the correction of

Section 5. Ratification. Any act consistent with the authority and prior to the effective date
of this resolution is hereby ratified and affirmed.
Section 6. Effective Date. This resolution shall be effective immediately upon passage by
the Federal Way City Council.

Background: The City Council approved the 2013 Planning Commission's work prograxn on April 16, 2013.
Subsequently, the City has received applications for several large multi-family complexes. In addirion, the City is
planning some new civic projects. It has been 17 years since the Design Guidelines were first adopted. Based on staff's
experience with development review of land use applicarions, we have concluded that the Community Design
Guidelines are often unplemented as code rather than guidelines, given the exisring code language. Consequently,
implementation often does not recognize the uniqueness of individual sites and, therefore, may not be flexible enough
to result in the desired outcome for larger or more complex buildings or developments.
Options Considered: 1) Concur with the Mayor's recommendation; 2) Do not concur with the Mayor's
recommendation.
MAYOR'S RECOMMENDATION: Addition of a housekeeping code amendment related to the Community Design
Guidelines, as a high priority, to the 2013 Planning Commission Work Program.

SUBJECT: Lakota Middle School Safe Routes to School Project — Bid Award
BACKGROUND
This project was bid in April of this year. The bid results were sent to WSDOT for approval due to grant
funding. It was determined the lowest bid was considered irregular based on the requirements for DBE
participation and documentation of a good faith effort. The second low bidder was considered irregular
based on omission of costs for bid items in the Bid Schedule. Based on this, Razz Construction, Inc., the
third lowest bidder, was the lowest responsive responsible bidder.
Due to the fact that the lowest responsive bid was 25% above the engineers estixnate, staff recomxnended
and Council authorized the rejection of all bids and authorization to re-bid the project. Staff re-bid the
project and also requested reconsideration from WSDOT to provide additional funding for this project
which was granted in the amount of $180,000.
Four (4) bids were received and opened on June 12, 2013, for the Lakota Middle School Safe Routes to
School Project. See attached Bid Tabulation Summary. The lowest responsive, responsible bidder is
Tucci and Sons, Inc., with a total bid of $1,809,266.25.
Reference checks on Tucci and Sons, Inc., by City staff indicate that the contractor has performed
similar work. As a result, City staff believes Tucci and Sons, Inc., can successfully complete this
project to the City's satisfaction. Therefore, the lowest responsive, responsible bidder is Tucci and
Sons, Inc., in the amount of $1,809,266.25.

The project budget has a funding shortfall of $54,200. Staff are requesting the Council to
authorize the transfer of $55,000 from Traffic Impact Fee Fund to the SW 312�' St — 14th Ave
SW to Dash Point Road Improvement Project (project # 142). The SW 312t1i St — 14�' Ave SW
to Dash Point Road Improvement Project was included in the bid for the Lakota Middle School
Safe Routes to School project as part of a tied bid to allow for both projects to be constructed at
the same time by one contractor.
PROJECT SCHEDULE:
With Council approval to award the project, the Contractor should be able to start construction in
early July. Due to having to rebid the project, the project will not be completed prior to school
starting next September, as originally planned. In an attempt to minimize impacts, hours for lane
closures have been limited to prohibit lane closures during the times of peak traffic and typical
transportation times for the school, when school is in session.

$1,039,080 through two separate programs: Safe Routes to School (SRTS) $859,080

The NW GlobalFest is a multicultural, international festival scheduled for June 20-23, 2013, organized by the Fiji
Multi-Cultural Association of Washington (FMCAW). The City Council approved a$9,000 Tourism
Enhancement Grant (TEG) to the FMCAW for G1obalFest in its Spring 2013 TEG award round.
In early May of this year FMCAW representatives secured a letter of permission by the local Sears General
Manager to use the southern parking lot area of the Sears property at The Coxnmons Mall. On Wednesday, June
12, 2013 the Chicago Sears headquarters off'ice rescinded that approval.
In their last-ditch efforts to find a new site for the event, the FMCAW approached the City about potentially using
the vacant, former Toys R Us site. They agreed to pay $100 for the short-term lease and also indicate that they
have a$5 million insurance policy to indemnify the City.
This site has been previously used for the Sand Sculpture event pursuant to a similar lease, and the City was a
sponsor. The short term lease with FMCAW is similar.

LEASE AGREEMENT
This Lease Agreement ("Agreement") is dated effective this day of June, 2013.
The parties ("Parties") to this Agreement are the City of Federal Way, a Washington municipal
corporation, ("City") and the FIJI MULTICULTURAL ASSOCIATION OF WASHINGTON; a
Washington nonprofit corporation ("Association").
RECITALS
A. The Association is sponsoring a Northwest Global Fest in Federal Way beginning
June 20, 2013 through June 23, 2013.
B. The Federal Way City Council approved the recommendation from the Lodging Tax
Advisory Committee to appropriate $9,000 as a Tourism Enhancement Grant for the
Northwest Global Fest because the event is related to tourism.
C. On June 12, 2013, the Association iearned that the site, previously made available to
them for the Northwest Global Fest, was no longer available.
D. The Association was unable to timely secure another Iocation within the City of
Federal Way.
E. Lorax has a contract with the City of Federal Way to design the Performing Arts and
Conference Center on the site, but does not object to the Association's temporary use.
F. The Federal Way City Council determined that it is in the best interest of the citizens
to allow the Northwest Global Fest to occur in June 2013, and approved the terms as
outlined below.
NOW, THEREFORE, the Parties agree as follows:
1. Premises.
The City, as fee owner of certain real property described in Exhibit "A", dces hereby
agree to lease to the Association and the Association does hereby agree to lease from the City,
the Premises described in E�ibit "A" attached hereto and incorporated herein by this reference,
constituting :a vacant lot in Federal Way, WA 98003, commonly known as the former Toys "R"
Us site. The Association agrees to use the Premises for the purpose of the Northwest Global Fest
open to the public.
2. Term.
This Agreement shall be for the June 19, 2013 through June 25, 2013.
3. Rent.
During the Term of the Agreement, the Association shall pay to the City as rent for the
use of the Premises One Hundred and Nol200 ( 100.00 . The payment shall be due June 21,
2013.
4. Possession.
Beginning on June 19, 2013, the Association shall be entitied to possession of the
Premises for the event from June 19, 2013 through June 25, 2013.
5. Taxes.
The Association is responsible for all applicable taxes.
6. Indemnitv/Insurance.
(a) The City shall not be liable for any injury to any person, or for any loss of or
damage to any property (including property of the Association, occurring in or about the
Premises from any cause whatsoever. The Association shall hold and save the City harmless
from any and all losses, damages, liabilities, or expenses (including attorneys' fees and other
expenses of litigation) resulting from any actual or alleged injury to any person, and/or from any
actual or alleged loss of or damage to any property, occurring in or about the Premises from any
cause whatsoever.
(b) The Association shall, at its own expense, maintain proper liability insurance with
a reputable insurance company or companies in the minimum amount of One Million and
No/100 Dollars ($1,000,000.00) per incident and in the minimum amount of Two Million and
No/100 Dollars ($2,000,000.00} annual aggregate to indemnify both the City and the Association
against any such claims, demands, losses, damages, liabiiities, or expenses. Funtastic Rides
Company, Inc. an Oregon Corporation agrees at its own expense to maintain proper liability
insurance with a reputable insurance company or companies in the minimum amount of One
Million and No/100 Dollars ($1,000,000.00) per incident and in the minimum amount of Four
Million and No/100 ($4,000,000.00) annuaI aggregate to indemnify both the City and the
Company against any such claims, demands, losses, damages, liabilities, or expenses. The City
shall be named as additional insured on both policies and shall be furnished with a copy of the
certificate of insurance, which shall bear an endorsement that the same shall not be canceled
except upon 30 days prior written notice to the City.
{c) The Association agrees that it will not do nor permit to be done in or about the
Premises any act or thing which will invalidate any insurance thereon.
7. Insuection.
The City shall inspect the Premises at the close of the event.
8. Attornev Fees.
In the event either of the Parties defaults on the performance of any terms of this
Agreement or either Party places the enforcement of this Agreement in the hands of an attorney,
or files a lawsuit, each Party shall pay all its own attorneys' fees, costs and expenses. The venue
for any dispute related to this Agreement shall be King County, Washington.
9. lYotices.
All notices herein provided or permitted to be given by either the City or the Fanners
Market to the other may be given by enclosing the same in a sealed envelope properly addressed
to the other and depositing the same, registered with postage prepaid thereon, in the United
States Post Office, and service shall be deemed complete at the time of such deposit. For the
purpose of this section, the address of the Association shall be 30403 24�' Ave. SW, Federal
Way, WA 98023, and the address of the City shall be 33325 8�' Ave. S., Federal Way, WA
98003, subject to the right of either party to designate by notice in writing to the other a new
address to which said notice shall be sent.
10. Signature Authoritv.
It is hereby acknowledged that the Association's signatory of this Agreement has the
authority to so sign and bind the Farmers Market in its entirety.
11. General Provisions.
This Agreement contains all of the Agreements between the City and the Association
with respect to any matter covered or mentioned in this Agreement. No provision of this
Agreement, including this provision, may be amended or modified except by written agreement
signed by the Parties.
12. Headin�s.
The headings herein contained are inserted only as a matter of convenience and for
reference and in no way define, lirnit, or describe the scope of intent of this Agreement or in any
way affect the terrns and provisions hereof.
13. Severabilitv.
If any provision of this Agreement is held invalid for any reason whatsoever, such
invalidity shall not affect any other provisian which can be given effect without the invalid
provision, and to that end, provisions of this Agreement are declared to be severable.

SUBJECT: Renewal of the Steel Lake Management Dutrict No. 1
BACKGROUND:
After 10-years of successful lake management, 2013 will bring to a close the existing Steel Lake,
Lake Management District (LMD) (2004-2013). The LMD provided an organizational structure
and funding mechanism that allowed for proactive lake management focusing on the protection
and enhancement of water quality, recreational use and aesthetic value of Steel Lake. Citizens
involved in the formation and operations of this LMD submitted a signed petition to the City of
Federal Way City Council to renew the Lake Management District No. 1, beginning in 2014
through 2023.
At the January 15, 2013 City Council meeting, both a public hearing date concerning the
reformation of the SLMD was set for February 19, 2013 and a resolution of intent to reform the
SLDM was adopted. Following the public hearing, Council adopted a resolution calling for the
reformation of the Steel Lake Management District No.l, calling for a vote by the affected
public. Voting is completed and the results are in favor of the reformation of the Steel Lake
LMD.
The next step in the process of reforming the Steel Lake LMD is the adoption of an Ordinance
reforming the Steel Lake LMD, which is attached. Following adoption of the Ordinance, an
assessment roll will be created, published and sent to the affected parties.
A public hearing, the date of which has been set by the attached Ordinance as August 6, 2013
will be held, after which resolutions establishing the assessment role and Steel Lake Advisory
Committee will be brought before City Council for consideration. The adoption of an Ordinance
establishing the time of payment, interest and penalties wi11 then be brought before Council for
consideration. The final step in the reformation process is the selection and appointment of the
Steel Lake Management Advisory Committee.

AN ORDINANCE OF THE CITY OF FEDERAL WAY,
WASHINGTON, RENEWING LAKE MANAGEMENT
DISTRICT NUMBER 1 FOR STEEL LAKE AND SETTING
A PUBLIC HEARING ON THE ASSESSMENT ROLL FOR
THE DISTRICT.
WHEREAS, on January 7, 2013, the City of Federal Way received a petition for the
renewal of La.ke Management District Number 1 for Steel Lake pursuant to RCWs 35.21.403 and
36.61; and
WHEREAS, Lake Management District Number 1 for Steel Lake is created for the
purpose of generating revenue to provide ongoing aquatic vegetation management, water quality
monitoring, community education, and other related projects; and
WHEREAS, on February 19, 2013, the City of Federal Way City Council passed
Resolution Number 13-631, declaring its intent to renew Lake Management District Number 1
for Steel Lake, calling for a vote by the affected property owners on the renewal of the proposed
district; and
WHEREAS, the City of Federal Way City Council conducted a public hearing on
February 19, 2013, for the purpose of accepting testimony in support of and in opposition to the
renewal of Steel Lake Management District Number 1. At the public hearing, testimony was
provided by Steel Lake Advisory Committee members; and
WHEREAS, under RCW 36.61.090, a simple majority of the votes cast shall determine
whether the proposed lake management district shall be approved or rejected; and

WHEREAS, the ballots were tabulated on March 20, 2013, and the proposal to renew
Lake Management District Number 1 for Steel Lake has been approved by at least a simple
majority of the votes cast; and
WHEREAS, the ballots cast are available for public inspection at City of Federal Way,
33325 8th Avenue South, Federal Way, Washington;
WHEREAS, the City of Federal Way desires to renew Lake Management District
Number 1 for Steel Lake and proceed with special assessments and performing lake
improvement activities;
WHEREAS, the City of Federal Way has established the 2014-2023 Steel Lake
Management District Management Plan (SLMDP) forming the basis for the annual Lake
Management District work plan and Lake Management District management goals; and
WHEREAS, the hearing notice requirements of RCW 36.61 will provide an opportunity
to evaluate the assessment role for each property within the district.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY
DOES ORDAIN AS FOLLOWS:
Section 1. Renewal of District. Lake Management District Number 1 for Steel Lake is
hereby renewed. The boundaries of Lake Management District Number 1 for Steel Lake are
represented in Exhibit A, incorporated by this reference. The duration of the district shall be for
ten (10) years, from January l, 2014 through December 31, 2023. Special assessments totaling
$15,232 will be collected annually to finance the District activities, with the total amount to be
collected during the life of the District estimated at being $152,320, which includes an automatic
inflation increase based upon the Seattle Consumer Price Index not to exceed five percent in any
given year. The special assessments will be imposed based on equal chaxges for similaz parcels.

Single family residential (RS7.2) lakefront developed properties will be charged $95 per year.
Single family residential (RS7.2, RS5.0) lakefront vacant properties will be charged $33 per
year. The multi-residential lakefront property (RM1800) will be charged $306 per year. The
Steel Lake Park parcel will be charged $2,279 per year. The Department of Fish and Wildlife
public boat launch parcel will be charged $3,895 per year. Unallocated funds left in the current
Steel Lake Management District Number 1(estimated to be $15,000 at the end of 2013) will roll
over into the renewed Steel Lake Management District Number 1.
Section 2. Publication. Within ten (10) days of adoption of this Ordinance, the City of
Federal Way shall publish in a newspaper of general circulation in Lake Management District
Number 1 for Steel Lake a notice indicating that this Ordinance has been adopted.
Section 3. Creation of District Limitations on A�peals. Pursuant to RCW 36.61.110, no
lawsuit may be maintained challenging the jurisdiction of authority of the City of Federal Way's
legislative authority to proceed with lake improvement and maintenance activities and creating
the lake management district, or in any way challenging the validity of the actions or decisions or
any proceedings relating to the actions or decision unless the lawsuit is served and filed no later
than forty (40) days after publication of a notice that the ordinance has been adopted ordering the
lake improvement and maintenance activities and creating the lake management district. Written
notice of the appeal shall be filed with the City Council and clerk of the Superior Court in King
County.
Section 4. Special Assessment Roll to be Prepared. Upon passage of this Ordinance, the
City of Federal Way shall cause to be prepared a proposed special assessment roll in accordance
with RCW Chapter 36.61.

Section 5. Public Hearin�. A public hearing will be held by the Federal Way City Council
on August 6, 2013 at 7:00 PM or shortly thereafter at the City of Federal Way City Hall, 33325
8`n Avenue South, Federal Way, Washington. At the public hearing, the City of Federal Way
City Council will consider the objections to the special assessment roll of the district, shall act as
a board of equalization, and may correct, revise, raise, lower, change, or modify the special
assessment roll or any part thereof, or set the proposed special assessment roll aside and order a
new proposed special assessment role be prepared. The City of Federal Way City Council shall
confirm and approve a special assessment roll by adoption of a resolution. Notice of the
proposed special assessment, the procedure for filing written objections thereto, and notice of the
public hearing shall be mailed to the taxpayers of record of all property within the district by the
City of Federal Way pursuant to RCW 36.61.140.
Section 6. Severabilitv. If any section, sentence, clause or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 7. Corrections. The City Clerk and the codifiers of this ordinance are authorized
to make necessary corrections to this ordinance including, but not limited to, the correction of
scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any
references thereto.
Section 8. Ratification. Any act consistent with the authority and prior to the effective
date of the ordinance is hereby ratified anci affirmed.
Section 9. Effective Date. This ordinance shall be effective five days after passage and
publication, as provided by law.
