Mayor Priest called the meeting to order at 7:00 p.m.
City officials present: Mayor Skip Priest, Deputy Mayor Jim Ferrell, Councilmember Kelly
Maloney, Councilmember Susan Honda, Councilmember Jeanne Burbidge, Councilmember
Bob Celski, Councilmember Diana Noble-Gutliford and Councilmember Dini Duclos.
City staff present: City Attorney Pat Richardson and City Clerk Carol McNeilly.
2. PLEDGE OF ALLEGIANCE
Dick Mayer led the Pledge of Allegiance.
As public facilities cannot be used for campaign purposes, City Attorney Richardson reviewed
the guidelines regarding campaigns and ballot propositions as provided by the Public
Disclosure Commission.

3. PRESENTATIONS

Pro / Con Committee Members
Deputy Mayor Ferrell noted the Council has placed a ballot proposition on the November 2013
election concerning dates of elections for citizen initiatives. A press release seeking
City Council Minutes — July 2, 2013 Regular Meeting Page 1 of 6
volunteers to participate in writing the pro and con statements for the voter's pamphlet was
issued. So far no volunteers have expressed interest in participating. l'he deadline to apply is
July 8th. Deputy Mayor Ferrell encouraged citizens who are interested in participating to submit
their name and contact information to the City Clerk by the July 8'" deadline. At their July 16tn
meeting, the Council will appoint three volunteers to serve on the pro committee; and three
volunteers to serve on the con committee. If committees are not formed, the City Clerk will
notify King County Elections and they may attempt to appoint committee members.
Leqislative Uqdate
Mayor Priest announced the Legislature completed work on the State Budget. This was a
productive session for the City, the Performing Arts and Conference Center was awarded
$2M. HB 1253 passed which preserves cities abilities to invest local Lodging Tax Revenues in
events that generate tourism and boost the local economy — additionally, the issue of Liquor
Excise Taxes is another item that the City was concerned with. In 2012, the Legislature
suspended the Liquor Excise Revenues sharing with cities, costing the City $450K on an
annual basis. The Legislature restored approximately half of the revenues. The City will
continue to work with other jurisdictions in future legislative sessions to fully restore this
revenue. The Metal Theft Prevention Legislation passed which increases penalties forthieves
and provides police with tools such as forfeiture and seizure for property used in commission
of inetal theft and distribution. Funding to implement a statewide licensing and database
related to metal theft was not approved. The House passed a Transportation Revenue
Package that would have included $87M for the City's Triangle Project. However, the S�enate
did not vote on the package, there may be a special session in September or December to
pass a transportation revenue package. $1.75M was funded for Lakehaven Utility Districts
Critical Capacity project. City staff has been working with Lakehaven on this issue and will
continue to do so. Mayor Priest extended his thanks to the Deputy Mayor and
Councilmembers for their lobbying efforts throughout the session. He also thanked the 30�'
District Legislative Team; Senator Tracy Eide, and Representatives Roger Freeman and
Linda Kochmar.
Fireworks and Public Safetv
Police Chief Brian Wilson reviewed planning efforts to ensure safety forthis year's Red, White
and Blues Festival and enforcement of the City's fireworks ban. The Police Department has
identified and created specific plans for Celebration Park, Steel Lake Park and city-wide
enforcement of the fireworks ban to occur from June 28 through July 7. Chief Wilson
reiterated that fireworks are illegal in the City and reviewed fireworks restrictions in
neighboring communities. The Chief provided a map depicting Federal Way as being
bordered by jurisdictions in which fireworks are legal. However, in Federal Way, fireworks
violations will be enforced as one of three types of civil infractions. Chief Wilson provided
clarification on the three violations and penalties associated with each. Although enforcement
is difficult it is possible and will be accomplished through teams of officers dedicated to
locating fireworks violations/problem areas, and responding to complaints. Chief Wilson
advised citizens to report violations by calling 9-1-1 or the non-emergency Valley
Communications [police dispatch] line at 253-852-2121. Enhanced camera systems have
been installed at Cetebration Park as part of the Safe City Program. Chief Wilson identified
and thanked partner agencies, city departments and volunteers for their efforts to coordinate a
safe, fun Red White and Blues festival for the community. Media releases have been issued
addressing the importance of compliance with Federal Way's fireworks ban. In response to a
Council inquiry, Chief Wilson confirmed the cameras will be a permanent installation at
Celebration Park. He further remarked his goal is ensuring safety and getting information to
his officers as quickly as possible.

Councilmember Honda reported she and Councilmember Noble-Gulliford attended the AWC
Conference in Kennewick last week. She provided a recap of the sessions she attended. At
the conference Mayor Priest was awarded the Lights on After School Award. Mayor Priest
stated that as a legislator, he was able to work on funding after school programs for students.
4. CITIZEN COMMENT
Representative Roqer Freeman thanked the Mayor and Council for their lobbying efforts in
Olympia. He encouraged them to continue communicating their need to the Legislature.
Recently he encountered a woman at a bus shelter in Federal Way. He called 911 in an effort
to get her some resource information. He noted individuals in the City are in need of human
services. Deputy Mayor Ferrell noted that DAWN provides sheltering and other services to the
City.
Norma Blanchard spoke in opposition of developing a Performing Arts and Conference
Center. She would like to see this issue put to the voters of Federal Way.
Bettv Taylor would like to see the Council conduct public forums where citizens can express
their concerns and get their questions answered. The 3-minute public comment periods at
Council Meeting are not sufficient.
Michael Batchelor lives behind Wild Waves and stated traffic in that area is challenging every
weekend and parking overflows into the neighborhoods. He does not feel the police have
been responsive to these issues. He asked the Council to help residents in surrounding
neighborhoods. Chief Wilson stated Wild Waves hosted a reduced rate access to their park
last weekend which far exceeded anticipated turnout. The Police Department brought in
additional staff to manage traffic flow and the impact to neighborhoods. They worked
throughout the weekend to help accommodate high traffic volumes. Wild Waves staff has
been responsive in working with the City and residents to address problems in surrounding
neighborhoods. Police issued 29 citations to vehicles in surrounding neighborhoods. Deputy
Mayor Ferrell asked why the traffic signal was disabled at 348th during this high-traffic period.
Chief Wilson stated it was disabled because drivers were not complying with the signal and
this gave officers better control of the intersection. Councilmember Honda noted it is
important to preserve the quality of life for residents in their neighborhoods.

6. COUNCIL BUSINESS
a. Kitts Corner Multifamily Rezone Request
Mayor Priest reviewed the format for addressing this item. He asked if any member of the
audience objected to any Councilmembers participating in this matter. Hearing no
objections; he asked if any of the Councilmembers had an interest in this property or
issue; stood to gain or lose any financial benefit as a result of the outcome of this item; if
they were able to consider this item in a fair and objective manor; and if they had
participated in any communication outside of this meeting with opponents or proponents
on the issue. No conflicts or outside communication were disclosed by the Council.
Staff Presentation: Principal Planner Margaret Clark stated the policy question before the
Council is whether they should adopt the Hearing Examiner's recommendation and
approve the quasi-judicial project-related rezone request. Ms. Clark reviewed the
procedural timeline for this request and provided background information for this 46-acre
property located south of S. 336th Street and west of Pacific Highway South. The Hearing
Examiner conducted a public hearing and issued a recommendation to approve the
rezone request with the conditions outlined in Exhibit B of the draft resolution in the
agenda packet. The applicant, DevCo Inc. has changed the project proposal from
townhouses to apartments and is requesting to change the designation of Road A from
public to private. DevCo Inc. representative Jack Hunder stated he supported the rezone
request and was available to answer any questions the Council may have.
Councilmember Celski inquired if a stoplight would be required where Road A exits the
development. Deputy Public Works Director Ken Miller responded Road A would not have
a traffic signal added.
Councilmember Noble-Gulliford asked it the 2009 Surface Water Standards were the
most current. Mr. Miller responded that the 2009 SurFace Water Manual is the most
current adopted manual and the 2013 Surface Water Standards have not been released
yet.

8. COUNCIL REPORTS
Councilmember Maloney responded to Betty Taylor's public comments. She would like the
Council to consider Ms. Taylor's recommendation and conduct meetings where the public has
an opportunity to provide input to the Council.
Councilmember Honda thanked the 30th District Legislators for their work this session. She
reviewed the upcoming City sponsored concert series at Steel Lake Park.
Deputy Mayor Ferrell supports the idea of the Council conducting Town Hall Meetings as a
way to reach out to the public. He encouraged individuals to attend the upcoming Red, White
and Blues Festival at Celebration Park.
Councilmember Burbidge stated the next Lodging Tax Advisory Committee meeting is July
24th. She recently attended two perFormances at the Knutzen Family Theatre. She is looking
forward to this year's Red, White and Blues Festival.
Councilmember Celski inquired if next week's Police Community meeting at the Waterbury
Apartment Complex was still scheduled. Chief Wilson confirmed it was occurring and is part of
a series of "Chiefs Call" community meetings being conducted. Councilmember Celski
recently had the opportunity to tour the SCORE Jail facility.
Councilmember Noble-Gulliford stated the AWC Conference she attended was a great
learning experience. She noted the City of Tacoma includes public art as part of their
Economic Development Program. She would like the City to explore this option. She would
like to see the Council address parking issues in the community and help the residents.
Councilmember Duclos reported on the Regional Policy Council meeting where they received

a presentation on the Enhanced 911 system. They also reviewed the budget and potential
sequestration impacts regarding the local and regional economy and the Seattle and Tacoma
Ports. Siting efforts for the South County Transfer Station continue; the Auburn site has raised
a lot of concerns from citizens. Site selection is estimated to occur in mid-2014. Both the
Algona and Factoria Transfer Stations are no longer meeting service levels. The County has
designated a replacement station and wants to begin the RFP process for construction.

SUBJECT: Participation in Law Enfo ement Support Office (LESO 1033) Program
The Police Department has a need for a mobile incident command post for critical incidents and
local community events such as:
• Unified Command/Critical Incident Investigations
• Major accident scenes
• City sponsored marathons
• Large Community Events (Aquatics Center Events, Red, White, & Blues)
The Police Department has had limited success borrowing a mobile command post when one is
available. This option is not feasible during unexpected events that require immediate response or if
there are simultaneous events taking place in other jurisdictions with command vehicles
A recent example that emphasizes the need occurred on April 21, 2013, when the City experienced
an active shooter situation where five people were killed in and around a multi-housing area. This
event created a collaborative effort with surrounding jurisdictions that came to assist with the
aftermath of the event. In order to conduct proper and efficient command responsibilities, there
needs to be a designated, centralized post where all the parties of a unified command can be in one
spot in order to make critical decisions. The command post also acts as the point of contact for
incoming units as well as for other Incident Command (IC) responsibilities.
The Law Enforcement Support Office (LESO) program exists as a means to supply government
surplus items to registered/approved participants who are in need of equipment at little or no cost.
The caveat to this resource is that the vehicles are generally in need of retro-fitting in order to make
them useable for the intended purpose. The cost of outfitting the vehicle is the responsibility of the
receiving agency. A new vehicle that would satisfy our needs would cost approximately $300K if
purchased from a dealer.
Other agencies that have taken advantage of this opportunity have used a variety of ways to pay for
the upgrades. Grants and seizure monies are the usual methods that are utilized. The cost of the retro-
fit would depend on the needs, along with the condition of the vehicle upon receipt. In the event we
are able to secure a vehicle through this program, we would following city policy regarding
maintenance and replacement reserve.
Therefore, the Police Department is requesting approval to participate in the LESO program in order

Background
The Washington Traffic Safety Commission (WTSC) and the City of Federal Way have an existing
partnership, focused on DUI and seatbelt enforcement. WTSC funding has allowed Federal Way
Police to strengthen enforcement efforts in these areas through overtime funded patrols. WTSC has
now added a Distracted Driving enforcement emphasis to address cell phone violations. The goal of
the Distracted Driving emphasis is to reduce traffic related deaths, serious injuries and collisions.
Officers will work distraction focused patrols in Federal Way as part of a multijurisdictional
approach, focusing on distracted driving violations.
Proposal
The City Of Federal Way accept a Memorandum of Understanding (MOU) for a term: April 1,
2013 through September 30, 2013. This will provide the City of Federal Way Police Department
$2,500.00 in funding to engage in multijurisdictional patrols focused on distracted driving

MEMORANDUM OF UNDERSTANDING
WASHINGTON TRAFFIC SAFETY COMMISSION
THIS AGREEMENT, pursuant to Chapter 39.34 RCW, is made and entered into by and
between the Federal Way Police Department (Agency) and the Washington Traffic
Safety Commission (WTSC).
IT IS THE PURPOSE OF THIS AGREEMENT to provide overtime funding to law
enforcement agencies to conduct multijurisdictional, high visibility enforcement (HVE),
traffic safety emphasis patrols, in support of Target Zero priorities. The Target Zero
Managers and Law Enforcement Liaisons assigned to your county shall
coordinate the Scope of Work as outlined below:

IT IS, THEREFORE, MUTUALLY AGREED THAT:
1. GOAL: To reduce traffic related deaths and serious injuries by engaging in
multijurisdictional HVE patrols in the areas of distracted driving.
2. SCOPE OF WORK:
Distracted Driving:
Agency will engage in multijurisdictional HVE cell phone distraction-focused patrols
on some or all of the following dates:
Primary Campaign: June 10 - 28, 2013; Funds permitting (not guaranteed), the
TZM may coordinate patrols from August 5— 23, 2013. These shall occur where the
highest rates of cell phone use among drivers occur in your geographic area of King
County. Agency agrees to take a zero tolerance approach to cell phone and
distraction violations.
Law enforcement officers will complete the Emphasis Patrol Activity Logs and
forward to their Target Zero Manager within 48 hours of the completion of the cell
phone distraction patrols.

3. CONDITIONS:
Agency will deploy highly skilled officers in coordination with other King County law
enforcement agencies and the King County Target Zero Task Force to generate the
highest amount of deterrence possible.
These are enforcement activities intended to apprehend cell phone distracted
drivers. It is expected that Notices of Infraction/Citation (NOI/C's) will be issued at
contact unless circumstances dictate otherwise.
All of these patrols are conducted as part of highly publicized efforts. As such,
publicity campaigns about these patrols are planned to alert the public to the fact
that extra patrols are targeting these violations. Therefore, Agency must assist
Target Zero Managers with media requests and questions.
4. PAYMENT FOR LAW ENFORCEMENT: Agency will provide commissioned law
enforcement with appropriate equipment (vehicle, radar, etc.) and on an overtime
basis (not to exceed 1.5 times their normal salary and benefits) to participate in
these emphasis patrols.
5. SHIFT LENGTH: Agency will not schedule individual officer shifts for longer than
eight hours. (WTSC understands there may be instances when more than eight
hours are billed because of DUI or other arrest processing, etc.)
6. RESERVE OFFICERS: Agency certifies that any reserve officer for whom
reimbursement is claimed has exceeded his/her normal monthly working hours when
participating in this emphasis patrol and is authorized to be paid the amount
requested. Agency understands that reserve officers are not eligible for overtime for
this project.
7. DISPATCH: WTSC will reimburse communications officers/dispatch personnel for
work on this project providing Agency has received prior approval from the WTSC
Program Manager.
8. GRANT AMOUNT: WTSC will reimburse Agency for overtime salary and benefits.
The total cost of overtime and benefits shall not be exceeded in any one campaign
area and funds may not be commingled between campaign areas.
Upon agreement by the Agency and the local Target Zero Manager, the distraction
allocation may be increased or decreased without amending this agreement
PROVIDED THAT the increase in the allocation does not exceed 50% of the original
agreed amount for the specific emphasis area. Any increase in allocation exceeding
50% will require an amendment to this document.

9. PERFORMANCE STANDARDS:
a. Participating law enforcement officers are required to have a minimum of 3
self-initiated contacts per hour of enforcement.
b. Some violator contacts may result in related, time-consuming activity. This
activity is reimbursable.
c. Other activities, such as collision investigation or emergency response that
are not initiated through emphasis patrol contact WILL NOT be reimbursed.
10. REIMBURSEMENT OF CLAIMS: Claims for reimbursement must include:
a. Invoice Voucher (A19-1A Form).
1) Agency identified as the "Claimant"
2) Statewide Vendor Number (bottom of Claimant box)
3) A Federal Tax ID #,
4) Original signature of the agency head, command officer or
contracting officer.
b. Payroll support documents (signed overtime slips, payroll documents, etc.).
c. Emphasis Patrol Activity Logs showing 3 or more self-initiated contacts per hour.
Emphasis Patrol Activity Logs cannot be modified.
Payment cannot be made unless these activity logs are included.
The Invoice Voucher (A19-1A Form), payroll supporting documents, and Emphasis
Patrol Activity Logs shall be submitted to your Target Zero Manager for review. The
Target Zero Manager will forward these documents to WTSC for processing and
payment.
11. DEADLINES FOR CLAIMS
All claims must be approved by your Target Zero Manager, please allow
adequate time for processing in order to meet the following deadlines:
a. First Deadline: All claims for reimbursement for emphasis conducted from
October 1, to June 30, must be received by WTSC no later than August 15,
2013.
b. Second Deadline: All claims for reimbursement for emphasis conducted
befinreen July 1 and September 30 must be received by WTSC no later than
November 15, 2013.

12. DISPUTES: Disputes arising under this Memorandum shall be resolved by a panel
consisting of one representative of the WTSC, one representative from Agency, and a

mutually agreed upon third party. The dispute panel shall decide the dispute by majority
vote.
13. TERMINATION: Either party may terminate this agreement upon 30 days written
notice to the other party. In the event of termination of this Agreement, the terminating
party shall be liable for the performance rendered prior to the effective date of
termination.
14. SUPPLANTING DISCLAIMER: I certify that none of the funds for this project
supplant the normally budgeted funds of this agency nor do these funds pay for routine
tra�c enforcement normally provided by this agency.

BACKGROUND:
At the May 21, 2013, City Council meeting, the Council expressed strong interest in having
improvEments at Sacajawea Middle School implemented in the first round of school zone enhancement
improvements, and directed staff to place this topic on the July 9, 2013, Parks, Recreation, Human
Services and Public Safety Committee agenda. In addition, staff was directed to pursue having
Washington State Department of Transportation (WSDOT) lower the speed limit on SR 509 from 40 mph
to 35 mph.
Staff received notice on June 18, 2013, that our grant request from the Washington Traffic Safety
Commission (WTSC) to install school zone flashers on SR 509 at Sacajawea was approved. The WTSC
grant provides $7500 towards this effort, roughly a 50% match. The remaining element that would then
be completely city-funded is the variable speed limit signs.
Staff has also sent a letter to Lorena Eng, Regional Administrator at WSDOT, requesting to reduce the
speed limit on SR 509 from 40 mph to 35 mph, which is attached.
On May 21, 2013, Council approved for implementation of Phase I School Zone Enhancements which
include the following, for a total estimated cost of $227,000:
1. Saghalie Middle School on 21St Avenue SW between SW 337`�' Place and SW 338`� Street:
a. Replace existing span wire mounted pedestrian-actuated crosswalk flashing yellow
beacon system with rectangular rapid-flashing beacon system ($40,000)
b. Install advance school speed zone warning signs ($500)
c. Replace existing school speed zone signs with larger signs ($6500)
d. Install additional variable speed limit signs ($30,000)
2. Spring Valley Montessori School on SR 99 between S 359`h Street and S 373'� Street:
a. Replace existing school speed zone signs with larger signs ($4000)
3. Saghalie Middle School on SW Campus Drive between 17t" Avenue SW and 19`�' Avenue SW:

The Federal Way City Council is considering improvements to enhance safety at school zones city-wide,
including Sacajawea Middle School located on State Route (SR) 509 at 11`h Place S(Milepost 13.96). As
part of their revi�w the City Council is requesting the State Department of Transportation lower the speed
limit on the subject segment of SR 509 from 40 mph to 35 mph.
We collected speed data in 2012 (attached) showing the 85`h percentile speed is near 40 mph. However,
several locations have collision rates in excess of the state average for state highways and there are
numerous curves with posted advisory speeds of 25 mph.
Adjacent land uses are alrnost exclusively residential, with one retail node between SW 312`� Street and
16th Avenue SW; neighborhood commercial between 11`�' Place S and SR 99; several churches, and two
middle schools. Sidewalks exist on only 2,100 lineal feet of the frontage out of the more than 32,000
lineal feet. A 35-mph speed limit would also be consistent with other arterials within Federal Way,
including the remainder of SR 509 in the City, which has similar geometry and lower traffic volumes.

FEDERAL WAY, WASHINGTON, APPOINTING A CON
COMMITTEE IN OPPISITION OF THE BALLOT
PROPOSITION RESTRICTING THE ELECTIONS FOR
CITIZEN INIATIVES TO WRITE AN ARGUMENT IN THE
KING COUNTY VOTERS' PAMPHLET.
WHEREAS, the City Council of the City of Federal Way, Washington, passed Resolution
No. 13-638 to place the ballot proposition restricting the elections for citizen initiatives on the
November 5, 2013, for the voters to decide; and
WHEREAS, RCW 29A.32.280 requires the City Council formally appoint a Committee of
not more than three individuals to write an argument in opposition of the proposed ballot proposition
for the Voters' Pamphlet; and
WHEREAS, the City Council is required to take formal action to appoint committee
members for writing arguments for the voters' pamphlet by 4:30 p. m. August 9, 2013; and
WHEREAS, the arguments must be submitted to King County no later than 4:30 p.m. on
August I5, 2013; and
WHEREAS, the following individuals have indicated their willingness to serve on the con
committee to write an argument in support of the petition to change the form of government:
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
HEREBY RESOLVES AS FOLLOWS:
Section 1. O�posing Committee A�pointment. The City Council appoints to the following
listed individuals to serve on the Committee to write the argument in opposition of the ballot

Section 2. Certify Committee. T'he City Clerk is hereby directed to submit this resolution to
King County Elections no later than August 9, 2013.
Section 3. Severabilitv. If any section, sentence, clause or phrase of this resolution should be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality sha11 not affect the validity or constitutionality of any other section, sentence,
clause or phrase of this resolution.
Section 4. Corrections. The City Clerk and the codifiers of this ordinance are authorized to
make necessary corrections to this ordinance including, but not limited to, the correction of
scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any
references thereto.
Section 5. Ratification. Any act consistent with the authority and prior to the effective date of
this resolution is hereby ratified and �rmed.
Section 6. Effective Date. This resoiution shall be effective immediately upon passage by the
Federal Way City Council.

On 3/19/13 the City Council authorized and approved expenditure for schematic design development work and
pro forma analysis for the proposed Performing Arts and Conference Center. In the Professional Services
Agreement with Lorax Partners, the City's design/development partner on the project, a mid-term presentation
was called for in the scope of services. The 7/16/13 presentation by Lorax Partners is precisely that mid-term
presentation, which is intended to illustrate progress on the PACC's schematic design development process,
identify any issues for discussion or consideration, allow for public and City Council comment, and pave the way
for completion of the schematic design development process.
After this presentation and upon completion of the schematic design, Lorax will return to the City Council in
September with presentations on both 9/3 and 9/17. In addition, at that time the results of the operational pro
forma analysis of the facility will be presented.
In parallel with the, funding for which was approved by City Council at its 3/19/13 meeting, City staff and
members of the nonprofit Federal Way Coalition of the PerForming Arts (FWCPA) have begun work on the
capital campaign to raise funds towards construction of the project. While the nonprofit FWCPA is the
appropriate entity to seek grants and other contributions which are normally and customarily sought by nonprofit
organizations, the City has expertise in financial management and other technical and logistical elements that can
assist the effort. The attached proposed Memorandum of Understanding (MOi� spells out the responsibilities of
the City and the FWCPA in this joint collaboration.

amendments to the city's comprehensive plan, comprehensive plan map, and
zoning map. (Amending ordinance no's. 90-43, 95-248, 9(�270, 9&330, 00-372, Ol-

671,11-683, and 13-736.)
WHEREAS, the Growth Management Act (GMA) of 1990 as amended (Chapter 36.70A RCW or
"GMA'�, requires the City of Federal Way to adopt a comprehensive plan that includes a land use element
(including a land use map), housing element, capital facilities plan element, utilities element, economic
development element, pazk and recreation element, and transportation element (including transportation system
�P[sl); and
WHEREAS, the GMA also requires the City of Federal Way to adopt development re�ulations
implementin� its comprehensive plan; and
WI�REAS, the Federal Way City Council adopted its comprehensive plan with a land use map (the
"Plan'� on November 21, 1995, and adopted development regulations and a zoning map implementing the
Plan on July 2, 1996; and subsequently amended the comprehensive plan, land use map, and zoning map on
December 23,1998, September 14, 2000, November 1, 2001, March 27, 2003, July 20, 2004, June 16, 2005,
July 16, 2007, June 11, 2009, October 28, 2010, January 27, 2011, and January 23, 2013; and
WHEREAS, the city may consider Plan and development regulation amendments pursuant to Process VI,
under Title 19 ("Zonin� and Development Code") of the Federal Way Revised Code (FWRC), Chapter 19.80
FWRC, pursuant to Chapter 19.35 FWRC; and
WHEREAS, under RCW 36.70A.130, the Plan and development regulations are subject to continuing
review and evaluation, but the Plan may be amended no more than one time per year; and
WHEREAS, the Council has considered amendments to the comprehensive plan map and the zoning ma�
specifically in relationship to three citizen-initiated requests, Request #1 Federal Way High School, Request
#2 -Lakeside Professional Building, and Request #3 - Summers, for changes to the comprehensive plan and
zoning map designations; and

WHEREAS, on May 10, 2013, the city's SEPA Responsible Official issued a Determination of
Nonsignificance on the 2013 Comprehensive Plan Amendments; and
WHEREAS, the city's Planning Commission held a public hearing on June 24, 2013, at the close of which
they recommended to the Council approval of the three citizen-initiated requests, Request #1 Federal Way

comprehensive plan and zoning map designations; and
WHEREAS, the Land Use/Transportation Committee of the Federal Way City Council considered the
comprehensive plan amendments on July 1, 2013, following which it recommended approval of the Planning
Commission's recommendations; and
WHEREAS, the City Council, through its staff, Planning Commission, and City Council committee,
received, discussed, and considered the testimony, written comments, and material from the public, and
considered the matter at its City Council meetings on July 16, 2013, and August 6, 2013; and
WHEREAS, the City Council desires to approve the three citizen-initiated requests for changes to the
comprehensive plan and zoning map designations;
NOW, Ti�REFORE, TI� CITY COUNCII. OF TI� CTfY OF FEDERAL WAY, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Findings and Conclusions.
(a) The proposed amendments to the comprehensive plan map as set forth in Exhibit A, attached hereto,
are consistent with the Council vision for the City of Federal Wa� , will allow development which is compatible
with the surrounding neighborhoods, including adjacent single-family uses; and therefore bear a substantial
relationship to public health, safety, and welfare; are in the best interest of the residents of the city; and are
consistent with the requirements of RC W 36.70A, the King County Countywide Planning Policies, and the un-
atnended portion of the Plan.
(b) The proposed amendments to the comprehensive plan map as set forth in Exhibit A, attached hereto,
will not negatively affect open space, streams, lakes, or wetlands, or the physical environment in general. The

amendments will allow for growth and development consistent with the Plan's overall vision and with the
Plan's land use element household and job targets, and will allow reasonable use of property subject to
constraints necessary to protect environmentally sensitive areas. The amendments, therefore, bear a substantial
relationship to public health, safety, and welfare; are in the best interest of the residents of the city; and are

amended portion of the Plan.
(c) The proposed am�ndments to the zoning map, set forth in Exhibit A attached hereto, are consistent
with the applicable pmvisions of the comprehensive plan and the comprehensive plan land use map proposed
to be amended in Section 2 below, bear a substantial retatioa to pubiic health, safety, auc� we�fare, and are in
the best interest of the public and the residents of the city.
(d) The proposed amendments have complied with the appropriate process under state law and the FWRC.
Section 2 Comprehensive Plan Comprehensive Plan Maps and ZoningMap Amendments Adoption.
The 1995 City of Federal Way Comprehensive Plan, as thereafter amended in 1998, 2000, 2001, 2003, 2004,
2005, 2007, 2009, 2010, 2011, and 2013, copies of which aze on file with the Office of the City Clerk, the
comprehensive plan map, and the zoning map are amended as set forth in Exhibit A attached hereto.
Section 3. Amendment Authoritv. The adoption of plan and map amendments in Secrion 2 above is
pursuant to the authority granted by Chapters 36.70A and 35A.63 RCW, and pursuant to Chapter 19.80

Section 4. Severabilitv. The provisions of this ordinance are declared separate and severable. The
invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance, or the invalidity
of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the
ordinance, or the validity of its application to other persons or circumstances.
Section 5. Savings Clause. The 1995 City of Federal Way Comprehensive Plan, as thereafter amended in
1998, 2000, 2001, 2003, 2004, 2005, 2007, 2009, 2010, 2011, and 2013 shall remain in full force and effect
until these amendments become operative upon the effective date of this ordinance.

SUBJECT: 2013 Comprehensive Plan Amendments

I. BACKGROUND
Pursuant to RCW 36.70A.130(4), the City of Federal Way must update its comprehensive plan
every eight years. The deadline for the next major update is June 2015. However, per Federal Way
Revised Code (FWRC) 19.80.050, the city has elect� to review citizen-initiated requests on an
annual basis. As part of the annual review, the city may also make changes to chapters and maps of
the comprehensive plan.
Federal Way adopted its comprehensive plan in 1995 and updated it in December 1998, I�cember
2000, November 2001, March 2003, July 2004, June 2005, July 2007, June 2009, October 2010,
January 2011, and January 2013'. The Growth Management Act (GMA, RCW 36.70A.130[2][a])
limits plan updates to no more than once per year, except under the following circumstances:
1. The initial adoption of a subarea plan that dces not modify the comprehensive plan
policies and designations applicable to the subarea.
2. The adoption or amendment of a shoreline master program.
3. The amendment of the capital facilities element of a comprehensive plan that occurs
concurrently with the adoption or amendment of a county or city budget.

The FWPS is requesting the comprehensive plan designation and rezone in preparation to
rebuild Federal Way High School. The existing school, built in 1953, is outdated and needs to
be rebuilt to better accommodate the needs of the students. Both the existing RS 7.2 zone and
the requested BC zoning allow schools; however, the BC zone allows more flexibility in terms
of development standards, e.g., setbacks from property lines.

Easter Lake is located approximately 170 feet to the south of the site and there is a Class II
wetland that borders the western shore of the lake. This wetland is approximately 375 feet
south of the site. Redevelopment is not expected to affect either the lake or wetlands.

The request for a change in comprehensive plan and zoning designation is to facilitate the
rebuilding of Federal Way High School. The site is located within the Lower Puget Sound
Basin and Conservation Flow Control Area. This site drains either partially or completely to
the Easter Lake Basin and is subject to the Enhanced Basic Water Quality (WQ) menu.3 Any
water-related impacts associated with future development must be mitigated in compliance
with the city-adopted 2009 King County Surface Water Manual (KCSWM) and the City of
Federal Way Addendum to the manual.

As shown on Exhibits B and C, this parcel fronts on South 304'� Street to the south, South
308`� Street to the north and 16`� Avenue South and Pacific Highway South to the east. The
site is presently accessed from both South 304�' Street and South 308"' Street.
Potential Traffic Impacts
This is a non-project action associated with changing the comprehensive plan designation and
zoning from Single-Family — High Density Residential and Single-Family Residential (RS)
7.2 (one unit per 7,200 square feet) to Community Business (BC). The non-project action by
itself does not affect traffic. However, at the time that an application for a development peimit
is submitted, the Traffic Division will conduct a Transportation Concurnency Analysis, which
will analyze peak hour impacts of the project to assure that there is adequate capacity to
accommodate the proposed development. Supplemental mitigation may be requireci if the

At the time that the city incorporated in February 1990, these parcels were zoned RS 7200
pursuant to King County Zoning, Title 21. This was a single family dwelling classification
with a minimum required lot area of 7,200 square feet. These parcels were part of a larger area
annexed into the city in September 1994 with a zoning designation of CP-1 pursuant to a
Concomitant Pre-Annexation Zoning Agreement between Weyerhaeuser, who owned the
pmperty at that time, and the City of Federal Way. The CP-1 zone was intended for property
that could be used as corporate headquarters. However, terms of the concomitant agre;ement
also stated that the Community and Economic Development Director could determine other
compatible uses in addition to those specifically permitted in that zone. The director did make
a finding that single family residential is a permitted use in the CP-1 zone in a March 26,
2012, correspondence (Exhibit G). The Summers have since purchased these two parcels for
residential purposes and would like the property to be rezoned to RS 9.6, which is consistent
with the existing adjacent zoning to the east.

may consider, but is not limited tq the following factors when considering a proposed
amendment to the comprehensive plan.

Request #1— Federal This site is already developed with Federal Way High School and no
Way High School critical areas will be affected by its redevelopment. Community
Business zoning will allow the buildings to be placed closer to Pacific
Highway South. Redevelopment of the site must comply with city
regulations related W clearing, grading, drainage, and water quality.
Request #2 — Lakeview This site is already developed with an office building, which is ased
Professional Building as a church. A multi-family designation would allow redevelopment
as aparcments. No criticai areas wonid be affected by redevelopmeat,
which would have to comply with city regulations related to clearing,
grading, drainage, and water quality.
Request #3 — Summers The site is comprised of two vacant parcels on the south end of North
Lake. There is a Class I Wetland with an associated 100-foot buffer
on the northeastern portion of the site. In addition, the parcels are
located within a Shoreline Residential Enviro�ent, which does not

Request #1— Federal There are single family residences adjacent to the Federal Way High
Way High School School on the west. The BC zoning regulations limits building height
to 30 feet if located within 100 feet of a residential zone. In addition, a
20-foot building setback is required from a residential zone. Under the
existing RS 7.2 zone, a 40.foot tall building could be built within 50
feet of the single family residences. Based on a conceptual plan
submitted for the rebuilding of the high school, the existing stadium,
which sits between the single family residences to the west and the
high school building, will be retained (Exhibit.n. Moreovtr, the school
is proposed to be rebuilt in essentially the same location but closer W
the eastern property line (Exhibit l�. As a result, there should be no
impact on the adjacent land uses and surrounding neighborhoods.
Request #2 — Lakeview A multi-family building on this parcel would be compari'ble with the
Professional Building adjacent land uses and surrounding neighborhoods as there are existing
multi-family buildings to the east, west, and further to the south.4 In
addition, there should be no impacts on adjacent land uses and
surrounding neighborhoods as any redevelopment of the site would be
subject to future review for compliance with all codes, including the
Community Design Guidelines.
Request #3 — Summers The applicant is requesting the same comprehensive plan designation
and zoning as the parcels to the east; therefore, the request for RS 9.6
zoning, if granted, would allow single family residences, which would
be compatible with the existing single family uses. The parcels to the
west are vacant and are zoned CP-1. The CP-1 designation is intended
for property that could be used as corporate headquazters. However,
terms of the concomitant agreement, which granted the CP-1 zoning
designation, state that the Community and Economic Development
Director can determine other compatible uses in addition to those
specifically permitted in that zone. The director did make a finding that
single family residential is a permitted use in the CP-1 zone in a March

in the vicinity and robuilding the high school will have a positive
impact on schools by replacing an outdated facility with a modern one.
Request #2 — Lakeview The site is developed and all utilities are available to the site. The
Professional Building parcel has two frontages, South 308'� Street to the north and 14t6
Avenue South to the east, with its access off of 14'� Avenue South. All

available along Pacific Highway South, which is one block to the east.

Way area and if this site is developed as multi-family, it will be

Request #3 — Summers The subject site is comprised of two parcels and is presently vacan�

Lake. If the site is developed with single family homes in the future,

Request #1— Federal Federal Way High School was constructed in 1953. The School
Way High School District states that the building is severely outdated and rebuilding of
the school is necessary to continue to provide a high-quality learning
envisonmc�t for Federal Way students. The requested BC zoning
designation would provide more flexibility in terms of setbacks and
height for the new high school as discussed under S�tion VI(1)(3).
The Federal Way voters approved a bond specifically for the purpose
of rebuilding the high school in 2012. Therefore, granting the BC
designation would benefit the neighborhood, city, and region.
Request #2 — Lakeview � Designation of the site as multiple-family would allow redevelopment

would be of benefit to the neighborhood, as well as adding to the city's
housing options and tax base.
Development, these two parcels could be developed for single-family
residential uses under the CP-1 zoning. However, changing the
designation to single-family residential would preclude any non-
residential development on these parcels and would protect the
existing residential single-family aeighborhood from iacompatible uses
locating adjacent to them. Therefore, changing the designation W
single-family residential would benefit the neighborhood.

the demand for such land.

Request #1— Federal Appmval of the requested BC comprehensive plan designation and
Way High School zoning would allow the rebuildiag of the high school and would not
affect the land use or density of the site. As shown in Exhibit I� the
school is proposed W be rebuilt in essentially the same location.
Request #2 — Lakeview Recent trends in housing reveal that many baby boomers (between 46
Professional Building and 54 years of age) are looking to downsize from larger homes and
echo boomers (children of baby boomers, between 17 and 31 years of
age) are entering the housing market mostly as renters. Many want a
green, carefree lifestyle, while having the convenience of public transit
and being close to friends and activities. Therefore, there appears W be
a demand for multi-family housing in urbanized areas such as this.
Development of the site as multi-family would be consistent with this
trend.
Request #3 — Summers The request to have these parcels designated residential would result in
an additiona11.05 acres of residentially zoned land. Although four
units could be built on the site based on RS 9.6 zoning, it is likely that
only two units could be built due to the presence of wetlands and
location within the shoreline jurisdicrion (Exhibit n. Because of its
frontage on North Lake, the lots should be desirable for development
of single family residential uses
(7) The current and projected population density in the area.

Request #1— Federal The redevelopment of the site as a high school will not affect current

Request #2 — Lakeview Changing the designarion of this site from Pmfessional Office to multi-

wetlands and being located within the shoreline jurisdiction (Exhibit �.

building code issues that may exist without any detrimental impact to
nearby residents. Therefore, it bears a substantial relationship to public
health, safety, or welfare.
Request #2 — Lakeview Designating these parcels as multiple-family complies with the
Professional Building comprehensive plan goal LUG4 of providing a wide range of housing
types and densities commensurate with the community's needs and
preferences, and thus bears a substantial relationship to public health,
safety, and welfare.
Request #3 — Summers Changing the designation from CP-1 to Single Family Residential does
not affect public health, safety, or welfare as residential uses are
allowed under either the CP-1, or RS 9.6 zoning. Having the RS 9.6
zoning does, however, give predictability to the future development of
the lots related to bulk and dimensional standards.
(2) The proposed amendment is in the best interest of the residents of the city.

(u) Reduce sprawl. Reduce the inappropriate conversion of undeveloped land
into sprawling, low-density development.
(iii) Housing. Encourage the availability of affordable housing to all economic
segments of the population of this state, promote a variety of residential
densities and housing types, and encourage preservarion of existing
housing stock."
The amendments are also consistent with goals and policies of the land use, housing, and
economic development chapters of the city's comprehensive plan.

Site-specific requests are also required to be evaluated for compliance with this section.
1) The city may appmve the application only if it finds that:
a. The proposed request is in the best interests of the residents of the city.

b. The proposed request is appropriate because either:
(i) Conditions in the immediate vicinity of the subject property have so significantly
changed since the property was given its present zoning that, under those changed
conditions, a change in designation is within the public interest; or
(ii) The change in designation will correct a designation that was inappropriate when
established.
Request Response
Request #1— Federal The school was built in 1953 under King County zoning. Prior W
Way High School the city's incorporation in February 1990, this site was zoned RS-
7200, which was single--family residential. Upon incorporation,
the city adopted similar zoning for this parcel. It is unknown how
the 1953 King County Zoning Code regulated schools. However,
the existing Federal Way Single-Family Zoning regulations are not
flexible enough to allow a seamless rebuild of the high school.
Thus, the amendment may correct an inappropriate designation.
Request #2 — Lakeview This building was built in 1971 pursuant to the King County code
Professional Building in effect at that time. At the time of incorporation, the King
County zoning for this parcel was RM-900. In addition to multi-
family uses, the RM-900 designation allowed professional offices,
such as medical and dental. Upon incorporation, the city adopted
the Professional Office (PO) designarion for this parcel and those

to the south, which were developed as offices. The PO designation
does not allow multi-family uses. Although, the PO designation
was not inappropriate when established, it does not allow for the
wider range of uses as the previous King County RM-900 zoning.
Request #3 — Summers These two lots were designated CP-1 when annexed as part of the
larger Weyerhaeuser annexation in 1994. Conditions may have
changed since Weyerhaeuser no longer wished to retain ownership
of these parcels for corporate use. The Summers purchased the
lots from Weyerhaeuser in October 2012 with the intent of future
residential use.
c. It is consistent with the comprehensive plan.

Request #1—Federal Way Changing the designarion of this parcel to BC would be consistent
High School with the overall vision of the comprehensive plan, which states that
the BC designation encompasses two major retail/comxnercial areas
along the SR-99 corridor, iacluding the segment between South
272°� Street and South 312'� Street, and the segment between South
324`� Street and approximately South 339�` Street This parcel lies
between South 272°d Street and South 312�' Stree�
Request #2 — Lakeview Changing the designation of this parcel to multi-family would be
Professional Building consistent with the overall vision of the comprehensive plan, which
states that the multi-family residential land use designation
represents an opportunity W provide a range of housing types W
accommodate anticipated residential growth. The increase in
population, decline in average family size, and increased cost of
single-family homes have created heavy demand for new housing
types.
Request #3 — Summers Changing the designation of this parcel w single—faznily would be
consistent with the overall vision of the comprehensive plan, wluch
states that the demand for and development of single-family housing
is expected to continue for the foreseeable future. Single-fauuly
development will occur as in-fill development of vacant lots
scattered throughout existing neighborhoods and as subdivisions on
vacant tracts of land.
d. It is consistent with all applicable provisions of the chapter, including those adopted by
reference from the comprehensive plan.
Stafj`'Response The redevelopment of the Federal Way High School and the Lakeview
Professional Building sites, and development of the Summers' parcels would be required
to comply with all city regulations, including those adopted by reference from the
comprehensive plan.

Federal Way High School, located at 31031 Pacific Highway South, from Single-Family High-
Density Residential and RS 7.2 (one unit per 7,200 square feet) to Community Business (BC).
Mayor's Recommendation — The Mayor recommends that the request be approved.
B. Site-Specific Request #2 — Request from Joshua Alhadeff for a comprehensiye plan amendment
and rezone of parce1082104-9139 (0.93 acres), located at 30819 14'� Avenue South, from
Professional Office (PO) to Multiple Family Residential and RM 1800 (one unit per 1,800
square feet).
Mayor's Recommendation — The Mayor recommends that the request be approved.
C. Site-Specific Request #3 — Request from Dr. Greg and Leanne Summers for a comprehensive
plan amendment and rezone of parcels 442060-0025 and 4420600-0030 (totaling 1.05 acres),
located south of North Lake between 30�' Avenue South, South 337"' Street, and 33'� Place
South, from Corporate Park (CP-1) to Single-Family High--Density Residential and RS 9.6 (one
unit per 9,600 square feet).
Mayor's Recommendation — The Mayor recommends that the request be approved.
IX. PLANNING CONIlVIISSION ACTION
Consistent with the provisions of FWRC 19.80.240, the Planning Commission may take the
following actions regarding each proposed comprehensive plan amendment:
1 Recommend to City Council adoption of the proposed comprehensive plan
amendment as proposed;
2. Recommend to City Council that the proposed comprehensive plan amendment not
be adopted;
3. Forward the proposed comprehensive plan aznendment to City Council without a
recommendation; or
4. Modify the proposed comprehensive plan amendment and recommend to City
Council adoption of the amendment as modified.

This letter is a fo(low up to our meeting of January 12, 2012, regarding parcel numbers 4420600030 &
442060002�. These parcels are zoned Corporate Park t(CP-t ). You have expressed an interest in
purchasing these parceis from the Weyerhaeuser Corporation with the intent of potentially using them for
residential purposes. You further indicated your interest in completing a Compcehensive Plan amendment
to change the Comprehensive Plan designation and zoning of the property to Single-Eamily High-Density
and RS9.6 respectively. �
The ciry is supportive of your request. In that you would like to purchase the property soon and amending
the Comprehensive Plan and zoning map is a lengthy process, we discussed an alternative that would give
you confidence to move forward with the real estate transaction in the near future. That a(ternative is for
the city to find that single-family residentia( use is a permitted use in the CP-1 zoning district.
Pursuant to the Corporate Park Zone Concomitant A�reement, Exhibit C, Section VII(A)(14),1 find that
single-family residential use is a permitted use in the CP-1 aoning district. The use is compatible with
other uses permitted in the CP-1 zone, especially ;iven the location of the subject parcels abutting single-
family zoning and uses to the east, abutting a clubhouse building slightly to the west, and the lake to the
north.

The minutes of March 6, 2013, were approved as presented.

Commission Long moved (and it was secondean to nominate Tom Medhurst as Vice-Chair. There was no
further discussion and the motion carried. Commission Bronson moved (and it was secondec� to
nominate Merle Pfeifer as Chair. There was no further discussion and the motion carried.
PuBLIC HEARING — 2013 Comprehensive Plan Amendments
Principal Planner Clark delivered the staff report. There are no proposed changes to the text of the
Federal Way Comprehensive Plan. The Planning Commission will make a recommendation to the City
Council on three citizen-initiated site-specific requests. Site-Specific Request #1 is for the Federal Way
High School, to change the zoning from Single-Family Residential (RS) 7.2 to Community Business
(BC). Site-Specific Request #2 is for the Lakeview Professional Building, to change the zoning from
Professional Office (PO) to Multi-Family Residential (RM) 1800. Site-Specific Request #�3 is for the
Summers property, to change the zoning from Corporate Pazk (CP-1) to RS 9.6. The city has not received
any public comment on the requests. The meeting was opened for public testimony.
Kate Baumann, Greene Gasaway Architects — She is here representing the Federal Way
School District. Her comments are in response to questions asked by Chair Pfeifer. The
district is anticipating building part of the new school up to three stories, and therefore, needs

to have a higher height allowance. It is possible the theater will also need to be three stories.
They also do not have a specific plan yet for how close the school will be to Pacific Highway
South, but they feel it is important for the school to be close in order to establish a presence
on this important road.
Commissioner Long asked in regazds to the Summers (site #3) request if the city had spoken to anyone
from the Lake Management group. Principal Planner Clazk replied the only comment they heard from

made in eazly 2012 and asked why has it taken so long to appeaz before the Commission. Principal Planner
Clark replied that by state law, the city may consider changes to the comprehensive plan only once a year
and the Summers' request missed the deadline for 2012 (the deadline was September 30, 2011, for the
coming year). She further explained that the city has only 1.5 FTE to work on Long Range Planning. In
eazly 2013 she worked on finishing up the 2012 comprehensive plan amendments. There are a number of
reports that must be made to the state that she also worked on in early 2013. The comprehensive plan
amendments must go first go to the City Council to be selected, and then through the SEPA process.
Commissioner Bronson noted that the parcels along the lake to the west_�f the subject site are zoned CP-1
and are not pazt of this request and asked if the city has considered adding them. Principal Planner Clark
replied they are still owned by Weyerhaeuser, who has not expressed any interest in changing the zoning.
Commission O'Neil moved (and it was secondean to recommend adoption of the three site-specific
requests for amendments to the Federal Way Comprehensive Plan as written. There was no fiuther
discussion and the motion carried.
