The parties have signed the attached description of the premises. 2.2 Portions of Premises Not Included. The following portions of the premises are not included as part of this rental agreement: None 3. TERM. 3.1 The term of the Renters' tenancy is for a term of six (6) months beginning on the 1" day of June 2014 and ending on the 30th day of November, 2014. 3.2 Holdover Tenancy. If this Rental Agreement creates a tenancy for a specified term, and if a notice of termination is not given as per Section 13a, it will result in a Month -to -Month tenancy. If any rent check is returned to Landlord by bank for any reason, Landlord may, at his /her option, require that all future rent payments be made by money order or certified check. Tenant agrees to pay a penalty of $50.00 for each returned item given by Tenant to Landlord. Landlord shall have no obligation to re- deposit any item returned by bank. In addition to the foregoing penalties, Landlord may elect to terminate this Lease for nonpayment or rent. Landlord shall notify Tenant of late rent and returned check charges and the same must be paid within 5 days. 4.5 Rent Increases. If this Rental Agreement results in a month -to -month tenancy, then Landlord may increase the rental upon thirty (30) days written notice to Tenant. 5. UTILITIES. 5.1 Utilities Paid by Tenant: Tenant shall pay all utilities not specified in sec. 5.2. 5.2 Utilities Paid by City: City shall pay for Water, Sewer and Garbage Service including yard waste. 6. FUNDS RECEIVED. 6.1 Rents and Deposits. Landlord may apply the prepaid rent described above towards any default in the payment of rent, late or NSF charges. Tenant shall restore the premises, including all landscaped areas, to their on final condition at the beginning of the tenancy, except for normal wear and tear. Tenant shall reimburse Landlord for any damages or loss including leasing fees, advertising, or any other cost incurred by Landlord because of Tenant's failure to comply with a material term or condition of this Rental Agreement or a material obligation under the Residential Landlord- Tenant Act. 6.5 Termination /Tenant Breaking Lease. If Tenant terminates this Lease for whatever reason prior to the end of the full term of this Lease in Section 3(a), Tenant shall be responsible for all rent until a new qualified Tenant is secured. In addition, Tenant shall be responsible to pay the leasing fee and all associated costs to secure a new Tenant for the remaining term of this Lease. This amount shall be a minimum of $150.00 for each month remaining on the Lease. Tenant's deposit shall be held until Tenant is no longer responsible for the rent. 6.6 Statement Upon Withholding of Refund. Within 14 days after Tenant terminates the lease and vacates or Landlord learns that Tenant has abandoned the premises, Landlord shall either return Tenant's deposits or else give Tenant a full and specific written statement of the basis for retaining any portion of the deposits, together with payment of any refund due. No deductions shall be made for normal wear and tear to the premises resulting for ordinary use. 7. LANDLORD'S DUTY TO REPAIR AND MAINTAIN PREMISES. 7.1 Warranty of Fitness. Landlord warrants that the premises are clean and fit for human habitation and that Landlord will comply with all state and local laws regarding maintenance and repair of the premises. 7.2 Notice of Need for Repairs. Tenant shall immediately notify Landlord of any needed repairs by contacting Landlord's contact, Steve Ikerd, at 253- 835 - 6911; Jason Gerwen, at 253- 835 -6962 or designee of the City of Federal Way. If Tenant has an emergency situation, where damage is occurring and will continue to occur if action is not taken, and Mr. Ikerd or Mr. Gerwen does not respond within a reasonable time, Tenant shall call the appropriate repair person to stabilize the situation. Tenant is responsible for all damage caused by Tenant or by his or her inaction. Tenant shall inform Mr. Ikerd of any potential safety issues as soon as they arise. 7.3 Preoccupancy Repairs by Landlord. The following repairs shall be completed by Landlord by the dates indicated: Structural repairs to be made when contractor is selected (90 days). 7.4 Owner's Insurance. Owner to maintain general liability insurance. Owner assumes no responsibility for loss of personal property of Tenant resulting from fire, theft, exposure to elements, water damage or other cause whatsoever, nor to carry insurance to cover Tenant's personal property. Tenant is urged to obtain Renter's Insurance for his or her personal property. 8. TENANT'S DUTY TO MAINTAIN PREMISES. 8.1 Tenant's Duty. Tenant agrees to keep the premises as clean as the conditions of the premises permit, and to comply with all duties imposed on Tenant by state and local law and perform the services described in EXHIBIT "A ". 8.2 Tenant's Liability for Damage. Tenant shall be liable for any damage to the premises caused by Tenant's acts or neglect other than normal wear and tear. Tenant shall also be liable for any damage to the premises that Tenant permits to be caused by family member, invitee, licensee, or any person acting under Tenant's control. 8.3 Repairs by Tenant. Tenant agrees to perform the following repairs indicated below by the following dates: Painting interior (90 days). 8.4 Maintenance by Tenant. Tenant agrees to perform the routine maintenance listed below. I. Maintain interior and exterior in same condition as received, as noted in the Move -In Inspection, Exhibit B; 2. Protect exposed areas to keep pipes from freezing and keep gutters free of debris. 3. Professionally clean carpets at Tenant's expense upon vacating the premises and provide a receipt to Landlord. 4. Maintain in good working condition all appliances, including smoke detectors and also including Tenant -owned washer, dryer and refrigerator to prevent damage to the premises. 5. Tenant will perform mowing of grass immediately around structure. 9. ALTERATIONS. Tenant shall make no substantial alteration, addition, or improvement to the structure or surrounding grounds without prior written consent of Landlord, who shall not withhold consent unreasonably. 10. ENTRY BY LANDLORD. Landlord shall give Tenant at least 48 hours advance notice before entering Tenant's premises for purpose of inspecting the premises, making repairs or improvements, or supplying necessary or agreed services, and 24 hours advance notice for the purpose of showing the premises to prospective or actual purchasers, mortgagees, tenants, workers or contractors. Landlord need give no advance notice to Tenant before entering the premises in case of an emergency. Tenant shall not unreasonably withhold consent to Landlord's entry. Except in the case of any emergency, Landlord shall enter only at reasonable times. 11. SUBLETTING OR ASSIGNMENT. Tenant shall not assign this Rental Agreement or sublet the premises without prior written consent of Landlord. Landlord shall not unreasonably withhold consent. 12. DESTRUCTION OF PREMISES. If the premises are substantially destroyed or otherwise rendered uninhabitable by a third party's action or by an act of God, either party may terminate this Rental Agreement immediately, in which case rent shall be prorated as provided in Section 4, and deposits shall be returned as provided in Section 6. 13. NOTICE OF TERMINATION. 13.1 Notice. Either party may terminate this Rental Agreement by giving the other party written notice at least thirty (30) days before the end of the rental term stated in Section 3(a) or thirty (30) days before the date of the next rental payment due if the Rental Agreement is Month -to -Month or a Holdover Tenancy. If neither party gives timely written notice of termination, this Rental Agreement will revert to a Month -to -Month tenancy, to which all terms and conditions of this Rental Agreement shall apply. IF TENANT FAILS TO GIVE TIMELY NOTICE OF TERMINATION, TENANT WILL BE OBLIGATED TO PAY RENT THE FOLLOWING MONTH. For example, if a notice of termination is given on the 15th day of a rental month, Tenant will be obligated for the entire next month. The day on which the notice is given shall not be counted as part of the notice period. 13.2 No Retaliatory Termination. Landlord shall not terminate the tenancy to retaliate against Tenant for asserting or enforcing rights guaranteed by law or for reporting Landlord to any government agency. This paragraph shall not affect Landlord's rights under state or local law to terminate the tenancy if Tenant fails to pay rent, comply with a material term of this Rental Agreement, commits waste, or maintains a nuisance. 14. SERVICE OF NOTICES. 14.1 Notice to Landlord. All notices required by the Rental Agreement and applicable state or local law to be served by Tenant upon Landlord shall be mailed to the address set forth at the beginning of this Agreement. 14.2 Notice to Tenant. Notice to Tenant shall be served on Tenant as required by applicable statute or ordinance. VACATING THE PREMISES. CHANGES TO THIS RENTAL AGREEMENT. No provision of this Agreement, including this provision, may be amended or modified except by written agreement signed by the Parties. 17. DISPUTE ARISING FROM THIS RENTAL AGREEMENT. Landlord and Tenant may agree in writing to submit to mediation any dispute arising from this Rental Agreement or under the provision of the Washington Residential Landlord- Tenant Act, RCW Ch. 59.18. In the event either party employs an attorney to enforce any terms of this Agreement and is successful, the other party agrees to pay any reasonable attorney's fee and reasonable costs. In the event of trial, the amount shall be fixed by the Court. 18. WAIVER OF SUBROGATION. Landlord and Tenant hereby release and waive, for the duration of this Rental Agreement and any extension or renewal thereof, their respective rights of recovery against each other for any loss resulting from perils of fire and /or extended coverage as defined in fire insurance policies issued to either Landlord or Tenant in effect at the time of the loss PROVIDED THAT such waiver and release shall apply to the event such agreement does not prejudice the insurance afforded by such policies. 19. LEAD BASED PAINT. If the property was built before 1978, then the Addendum entitled "Disclosure of Information on Lead Based Paint and Lead Based Paint Hazards" must be attached to this Agreement. 20. SIGNATURE.
