CALL MEETING TO ORDER Mayor Ferrell called the Special Meeting to order at the hour of 7:02 pm City officials in attendance: Mayor Jim Ferrell, Deputy Mayor Jeanne Burbidge, Councilmember Lydia Assefa- Dawson, Councilmember Kelly Maloney, Councilmember Susan Honda, Councilmember Bob Celski, Councilmember Martin Moore, and Councilmember Dini Duclos. City staff in attendance: Chief of Staff Brian Wilson, City Attorney Amy Jo Pearsall and City Clerk Stephanie Courtney. 2. PLEDGE OF ALLEGIANCE Dick Mayer led the flag salute. 3. PRESENTATIONS a. Ceremonial Swearing -In of New Police Officers Mayor Ferrell announced he was honored to administer the Oaths of Office to four new Federal Way Police Officers. Chief Hwang introduced Officer R.B. Blackshear; Officer William Lemmon; Officer Clint March; and Officer Andrew Sederberg. b. Proclamation: Buyer Beware /Human Trafficking Deputy Mayor Burbidge read and presented the Proclamation to Robert Beiser, Director of Seattle Against Slavery. He thanked the Mayor and Council for the proclamation and their support and acknowledgement of this public safety issue. c. Human Services Agency - Institute for Family Development Kimberly House, Clinical Supervisor for the Institute for Family Development spoke to update Council on the important programs which help families in Federal Way. The Institute for Family Development was founded in 1982 by Federal Way member Charlotte Booth, and has the mission of bringing Parents and Children together to build stronger families. She highlighted the program PACT (Parents and Children Together) and thanked the Council for their continued support and grant funding. d. Mayor's Emerging Issues and Report Mayor Ferrell was pleased to report on the "Raise the Flag" Event held on Veteran's Day. Parks Director John Hutton further reported and highlighted photographs from the event showing the flag raising, and those in attendance including Senator Patty Murray, and King County Councilman Pete von Reichbauer to dedicate both the flag and renaming of 320th Street to "Veteran's Way" (honorary). Federal Way City Council Regular Minutes Page 1 of 11 November 18, 2014 Mr. Hutton was pleased the event was flawless which included the support of staff, citizens, business owners, local band students and Jr. ROTC. Councilmembers were pleased with the event and thanked the Mayor and staff for all the tremendous work and collective effort to make this event happen. Parks Director Hutton further reported at the request of the Mayor on the upcoming Holiday events including the Tree Lighting at Town Square Park on December 6th and the Movie Night featuring the Disney movie "Frozen" on Friday, December 12th at the Federal Way Community Center. He invited citizens to attend a Park Planning meeting on November 22nd at the Federal Way Community Center. Mayor Ferrell reported on the final Neighborhood Connection meeting for 2014 which was located at Panther Lake. He stated these meetings have been a success in bringing City Hall to the neighborhoods and meetings will be scheduled for 2015 beginning in the Spring. He reported on his attendance at a recent Sound Alliance meeting where the homeless issue in our community was discussed. He stated he supports working on resources for essential services for those less fortunate. In connection he discussed the Sound Transit Alignment issues, which is also causing concern for a Multi- Service Veteran's facility which will house men and women. 4. CITIZEN COMMENT Gloria Larry, spoke to request the Mayor's Office establish an Accountability Commission. She feels she has been targeted both inside and outside the city. Abdirisak A. Hash, inquired to if he would be receiving a grant. Mayor Ferrell asked Community Services Manager Jeff Watson to follow up with Mr. Hash. Keith Livingston, spoke in support of supporting the Arts in the 2015 -2016 Budget. Mary Ellen Stone, asked Council to restore funding levels to support the King County Sexual Assault Resource Center at the level of the previous year; an additional $5,000. Battery Bob, asked if Council was willing to eliminate poverty in Federal Way. Norma Blanchard, spoke in concern over workers blowing leaves onto the street on 312th St. Jennie Hills, spoke to Council regarding searching for employment in the city and help for citizens with disabilities. She encouraged everyone to attend the memorial service for Representative Roger Freeman. 5. Councilmember Celski requested to clarify this was in addition to other funding not reallocation of any other awarded funds. Councilmember Duclos confirmed her motion is meant to add funds; not reallocate. Finance Director Ade Ariwoola noted he would work with staff to find the additional funds in the budget. PUBLIC HEARINGS a. 2015 -2016 Biennial Budget & Property Tax Levy (Continued from November 4, 2014) as required by RCW 35A.34 • Public Comment — 3 minutes • Council Discussion Mayor Ferrell opened the Public Hearing which had been continued from the November 4, 2014 Regular Meeting at 8:10pm. Councilmembers extended their thanks and kudos to Finance Director Ade Ariwoola for his guidance through this budget process and putting together a budget that is structurally sound. Mayor Ferrell then opened the Public Hearing for the 2015 Major Comprehensive Plan Update — Site Specific Requests /Selection Process at 8:14pm. b. Selection Process — 2015 Major Comprehensive Plan Update (Site Specific Requests) Staff Presentation • Public Comment — 3 minutes • Council Discussion Margaret Clark, Principal Planner gave a brief PowerPoint presentation to Council on the six requests before them tonight. She noted five requests are site - specific requests to change the Comprehensive Plan designations and zoning; one request is a request to amend the text of the Comp Plan to allow senior housing, including assisted living and nursing homes in the Commercial Enterprise zone. Ms. Clark noted the Mayor has reviewed these requests and the Land Use/Transportation Committee has reviewed the requests and both concur to move all six requests further. Site Specific Request #1 — Bellmore Mobile Home Park: 6 acres located S of S 324th St between I- 5 and Pacific Highway. Existing Use is Mobile Home Park; Designation: Multiple Family (RM 3600). Applicants are requesting City Center Frame (CC -F) to provide multi- tiered senior facility including nursing and convalescent home. This request is consistent with the overall vision of the Comp Plan. Site Specific Request #2- Bishop /Lee /Princen: 6.14 acres located S of SW 356th St between 6th Ave SW & 8th Ave SW. Existing Use is 3 single family residence and 2 vacant parcels with existing designation of SF Medium Density Residential (RS 15.0). Applicants are requesting SF High Density Residential (RS 9.6 or RS 7.2). This request is consistent with the overall vision of the Comp Plan. Site Specific Request #3 — A &R Development LLC: 1.82 acres located between Celebration Park RD and 15th Ave S. Existing Use is vacant land on designation of Office Park (OP). Applicant is requesting a designation of Community Business (BC). This request is consistent with the overall vision of the Comp Plan. Site Specific Request #4 — Hiu Ok Paek: 0.18 acres located W of Pacific Hwy S & S of 308th Street. Existing Use is Beauty Shop — designation Multiple Family (RM 1800). Applicant is requesting Community business. This request is consistent with the overall vision of the Comp Plan. Site Specific Request #5 — 32020 Professional Building: 1.97 acres located S of S 320th St and E of 1 st Ave S. Existing Use is Office with Professional Office (PO) designation. Citizen Comment: Rob Rueber — Spoke in support of two requests (Request #5 and Request #6) Brian Edgar, DDS — spoke in support of Request #5. Councilmembers thanked Ms. Clark for the presentation and updated maps for a much more clear idea of the requests. Resolution: Request Federal Funding Assistance for PACC Construction APPROVED RESOLUTION #14 -672 Government Affairs and Grants Coordinator Chris Carrel reported on the Resolution before Council where the city is formally requesting Federal Funding Assistance for the Performing Arts and Conference Center construction. He noted this is a required part of the process in obtaining new markets tax credits. DEPUTY MAYOR BURBIDGE MOVED APPROVAL OF THE PROPOSED RESOLUTION REQUESTING FEDERAL FUNDING ASSISTANCE FOR THE CONSTRUCTION OF THE PERFORMING ARTS AND CONFERENCE CENTER; COUNCILMEMBER DUCLOS SECOND. Purchase of Vacant Retail Space • "The How ": Financing of the Purchase • "The Why ": Controlling our own Destiny — Downtown Development • "What's Possible ": The Vision for Town Center Mayor Ferrell announced the city has been researching the vacant area adjacent to the PACC site for a possible development of "Town Center". He stated the current property is the old Target building which has been vacant for years and is unsightly. This area will have surrounding development of the Performing Arts and Conference Center and Town Square Park. He asked Finance Director Ade Ariwoola; Economic Development Director Tim Johnson and Architect Scott Clark to each address the Council with the "How ", "Why" and "What's Possible" for this purchase. Finance Director Ade Ariwoola gave a brief overview of the financing of the property including the purchase price and related costs totaling $8,209,960. He noted the term would be 3 years at an interest rate of 1.51 %. He stated the city's budget has a Strategic Reserve which would be utilized on a portion of this purchase. The total interest cost for 3 years is $371,911.20 and the 3 year term would Federal Way City Council Regular Minutes Page 6 of 11 November 18, 2014 give the city an opportunity to determine and finalize the use and the long term financing of the property. Economic Development Director Tim Johnson noted the key question to ask is regarding the vacant space is the opportunity cost. He stated this proposed "Town Center" is a tremendous opportunity to change this area and the opportunity costs are low for potential of the return on investment. Councilmember Moore stated he supports this purchase and believes this is the right step forward for the city and its vision for a vibrant downtown. Architect Scott Clark (Clark Design Group), displayed visual renderings of potential development on this site including multiple buildings with possibilities of retail, commercial and residential units. He reminded Council these renderings are very hypothetical and showjust a few options for the potential site. He highlighted how the space compliments the Town Square Park and the Performing Arts and Conference Center. Mayor Ferrell reiterated these are ideas and no decisions have been made regarding residential or other development of this site. DEPUTY MAYOR BURBIDGE MOVED TO AUTHORIZE THE USE OF CITY FUNDS NOT TO EXCEED $8,209,960 TO PURCHASE THE PROPERTY LOCATED AT 2141 s. 314TH AND AUTHORIZE THE MAYOR TO EXECUTE ALL NECESSARY DOCUMENTS FOR SAID PURCHASE; COUNCILMEMBER DUCLOS SECOND. Councilmember Honda stated this has been a difficult decision; however she feels the city currently has other financial obligations including Parks, the Performing Arts and Conference Center, Dumas Bay upgrades, and the Brooklake Center. COUNCILMEMBER DUCLOS CALLED THE QUESTION. Councilmembers indicated they would like to continue discussion. The motion failed 2 -5 as follows. He believes this purchase is similar to these past issues and we need to develop and construct our vision. Councilmember Maloney noted she appreciates the Council's open dialogue on these issues. She also is excited for this opportunity and to utilize the strategic funds set aside for the right project and an opportunity such as this. Deputy Mayor Burbidge agrees with fellow Councilmembers on the opportunity this purchase gives the city. She stated this will give Federal Way a downtown with the amenities families while building our revenue base. Councilmember Assefa- Dawson believes making this decision and moving forward is long overdue. Council Bill #662/ General Obligation Bond to purchase land/ APPROVED ORDINANCE #14 -777 AN ORDINANCE of the City of Federal Way, Washington establishing a term loan and providing for the issuance and sale of a limited tax general obligation bond anticipation note in the principal amount of not to exceed $8,500,000 to evidence the loan to be used to purchase land for city purposes; and fixing the form, covenants and terms of the note. Councilmembers thanked Mr. Conlen for the presentation and asked for clarification of non- conforming uses. Finance Director Ade Ariwoola gave a brief presentation regarding the current property tax collected Federal Way City Council Regular Minutes Page 9 of 11 November 18, 2014 and how the city compares regionally to other jurisdictions. He also highlighted the other taxing districts which use the tax collected from Federal Way residents including the State, Fire Department, Library, EMS, and the School District. He noted Federal Way is the lowest rate among cities including Kent, Auburn, Burien, Renton, Seattle, and Seatac. City Clerk Stephanie Courtney read the Ordinance title into the record. COUNCIL REPORTS Councilmember Celski yes Councilmember Moore yes Councilmember Duclos yes Councilmember Assefa- Dawson stated she is excited about the Youth Commission interviews and appointments tonight. She further noted she attended the Sound Alliance meeting and appreciates the Mayor's commitment on this issue of taking care of people less fortunate. Councilmember Maloney attended the Veteran's Day activities on 320th and at Todd Beamer High School. She also attended the Communities is Schools fundraiser which supports mentors in the schools. Although she was unable to attend the Sound Alliance meeting due to the wind storm, she is pleased the city is engaged on this important issue and wished everyone a happy Thanksgiving holiday. Councilmember Honda reported she attended the Chamber of Commerce annual auction and gala and was a great event which recognized two individuals in the city including Jeff Stock and Peggy LaPorte. She thanked the Human Services Commission for their funding recommendations and appreciates all the volunteer time they put in on this process. She also briefly explained the difference between a voting member and alternate member appointments to commissions. Councilmember Celski was proud of the community events for Veteran's Day. He stated all the events he attended were incredibly moving; and he additionally thanked the Todd Beamer Band which supported three separate events. He reported on a Federal Way High School victory at Memorial Stadium and noted the next meeting of the Land Use/Transportation Committee will be Monday, December 1St at 5:00 pm in Council Chambers. Councilmember Moore attended the King County Mental Health forum and continues to advocate for Mental Health. He agreed with fellow Councilmembers on the significance of the Veteran's Day events. He also attended the Sound Alliance meeting and looks forward to ending homelessness. He reminded everyone of Representative Roger Freeman's Celebration of Life this Saturday at 1:00 pm at Our Savior's Baptist Church on 320tH Councilmember Duclos attended the Policy Issues Committee of the Sound Cities Association and reported discussions regarding lifting the 1 % property taxes lid which funds school, local government, public libraries, and fire suppression. The second issue is regarding parks and recreational liability for local jurisdictions in the parks. Federal Way City Council Regular Minutes Page 10 of 11 November 18, 2014 Deputy Mayor Burbidge noted she attended the Lodging Tax Advisory committee last week; where they discussed the tourism website. She also attended the South County Area Transportation Board where the maintenance of bridges in the state was discussed. She extended her warmest wishes on a wonderful Thanksgiving to all.
