II. Guests: Gary Gillespie, Arts Commission Chair Honda called the meeting to order at 5:30p.m. Public Comment: None Commission Comment: None Committee member Duclos moved amend the agenda, and put items G and H after item A, and to add the Arts Commission Contract for Services as item J. Committee member Moore seconded. Motion passed. APPROVAL OF MINUTES Committee member Duclos moved to approve the November minutes. Committee member Moore seconded. Motion passed. BUSINESS ITEMS Washington Traffic Safety Commission (WTSC) Grant – Amendment #1 – Information Only Lt. Sumpter stated that through the WTSC they receive a grant for impaired driving enforcement, seatbelt enforcement and distracted driving enforcement. This allows for special patrol emphasis on these violations. The WTSC is requiring an additional document to be signed. This document adds technical language ; it does not change the funding or anything operationally. Amendment to FWRC 6.35.030 Related to Pedestrian Interference and Aggressive Begging Lt. Sumpter stated that aggressive begging remains an issue of concern in Federal Way. It is one of the most frequent calls for service that they receive. The proposed ordinance amend ment will amend the code to clarify that begging that intimidates the public or interferes with pedestrian or vehicular traffic is prohibited. One of the most frequent calls that they receive is about panhandlers in the median of the road. They have not been able to legally remove somebody that isn’t willing to comply with persuasion. This new version of the ordinance specifically disallows begging in a median. This amendment will also identify aggressive behaviors. Some of those behaviors are touching a person or repeatedly asking the person for money. Chair Honda asked if other cities had enacted a similar ordinance. Mr. Call replied that he took language from other jurisdictions where it has already been upheld at the appeal level. Begging is constitutionally protected. The Supreme Court has ruled that it is Free Speech. Committee member Duclos asked how the Police Department would inform the panhandlers of the changes. Lt. Sumpter answered that the first round of enforcement will be educating them on what the changes are. Council member Maloney asked if there would also be an educational campaign for the community. Lt. Sumpter replied that they would do a news release with the Federal Way Mirror. The committee would like cards made that have the boundaries on one side and community resources available on the other side for the police to hand out. Committee member Duclos moved to forward the proposed ordinance to First Reading on January 20, 2015. Committee member Moore seconded. Motion passed. King County Regional Hazard Mitigation Plan Volume 1 and Chapter 10 City of Federal Way Update Annex Mr. Gross stated that they have been working with King County to updating the Regional Hazard Mitigation Plan and the City’s Annex to it. This plan focuses on natural disasters in detail as well as their primary and secondary impacts to King County and the jurisdictions within King County. The Mitigation develops strategies on how to lessen the primary and secondary impacts. In order to receive a hazard miti gation grant funding the city must be a PARKS, RECREATION, HUMAN SERVICES & PUBLIC SAFETY COUNCIL COMMITTEE Tuesday, January 13, 2015 Summary Page 2 part of this plan. All jurisdictions applying for grant funding must have some form of a mitigation plan. Committee member Duclos moved for forward the adoption of the King County Regional Hazard Mitigation Plan Volume 1 and Chapter 10 City of Federal Way Update Annex to the January 20 th, 2015 City Council consent agenda for approval. Committee Moore seconded. Motion passed. 2015 Parks Commission Work Plan Mr. Ikerd presented the Parks Commission Work Plan. There are seven items on the plan. One of the items on that plan is Lakota Park. They would like to improve the soccer field and track. Sufficient funding for this project is not available, but they are still working towards that goal. It remains on the work plan to keep the project alive. Other projects include improving the playground equipment at Adelaide Park, Panther Lake Master Plan and Town Square Park. Chair Honda asked how the discussions are going for the funding of the Lakota project. Ikerd answered that the city has funding set aside, and they are waiting to hear if the Federal Way School District will have money to put towards the project. There will also be another grant opportunity available in two years. Mr. Hutton added that Superintendent McClean wanted to wait and see what happens in the Legislature and to see if there is any leftover money from the Federal Way High School project, to see what they can contribute. Committee member Moore asked if there was a plan in place, if the school district is unable to come up with funding. Mr. Hutton answered that staff would have to make the improvements that they could within their budget. Committee member Duclos stated that if the district is unable to provide any funding, then they need to be prevented from using the field and track during the day. Committee member Moore asked if the Parks Commission discussed ADA compatibility equipment. He would like all of the Parks to have equipment for people with disabilities. Ikerd answered that all of the playgrounds will have an ADA feature. Committee member Moore moved to forward the 2015 Parks and Recreation Commission Work Plan to the January 20, 2015 consent agenda for approval. Committee member Duclos seconded. Motion passed. First Amendment for Parking Lot Vacuuming This contract will be extended for another two years with an increase in compensation of $20,956.28. No discussion was held. Committee member Duclos moved to forward the proposed Agreement to the January 20, 2015 consent agenda for approval. Committee member Moore seconded. Motion passed. Third Amendment for Tree Services This contract will be extended for another two years with an increased compensation of $36,900.00. No discussion was held. Committee member Duclos moved to forward the proposed Agreement to the January 20, 2015 consent agenda for approval. Committee member Moore seconded. Motion passed. First Amendment for Landscape Maintenance Services This contract will be extended for another two years with an increased compensation of $112,404.91. No discussion was held. Committee member Duclos moved to forward the proposed Agreement to the January 20, 2015 consent agenda for approval. Committee member Moore seconded. Motion passed. Puget Sound Emergency Radio Network (PSERN) Interlocal Agreement Mr. Call stated that the PSERN project is a county led project to replace the King County radio system as well as the EPSCA radio system and Vallycom. This agreement will establish a board with four voting members and the county will chair as a non-voting member to help guide the process. There are some issues on which entity will run the network after it has been built that still needs to be solved. They are setting that issue aside, and t his agreement states that they are going to agree to agree later, and agree to a voting structure. This agreement is just for the immediate future, while it is being built. The risk for the city to participate in this is low. Currently, there are gaps in the city’s radio coverage for Federal Way, and they are phasing out the radio network, and there should not be the gaps that there are right now. This will be a technological improvement. Committee member Duclos moved to forward option number one to the January 20, 2015 consent agenda for approval. Committee member Moore seconded. Ryan Call, Assistant City Attorney introduced himself; he will now be attending these meetings in place of Amy Jo Pearsall, who is now the City Attorney. 2015 Arts Commission Contract for Services Mr. Geddes stated that the Arts Commission is asking for an increase of $4,000 in funding. This would be achieved by producing one printed newsletter per year instead of two. There would still be two newsletters produced; the first would be printed and mailed, the second newsletter would be electronic, and emailed through the FWCC list serve. The cost savings would enable them to fund more non-profit art groups in the city of Federal Way, and also increase PARKS, RECREATION, HUMAN SERVICES & PUBLIC SAFETY COUNCIL COMMITTEE Tuesday, January 13, 2015 Summary Page 3 funding to art groups that are currently receiving funding. Arts Commissioner Gillespie stated that the Arts Commission increased the funding, because they feel that the groups are valuable assets to the community, and worth the additional funding. Committee member Duclos moved to forward the 2015 Arts Commission Contract for Services funding recommendations to the February 3, 2015 agenda for approval. Committee member Moore seconded. OTHER BUSINESS The PRHSPS Committee meeting will now start at 5:00pm Mr. Hutton reported that the Federal Way Community Center will now be p roviding a 25% discount to disabled Veterans.
