ORD 15-798 ORDINANCE NO. #15-798 AN ORDINANCE of the City of Federal Way, Washington, relating to amendments to the Federal Way Comprehensive Plan, amending the Federal Way Comprehensive Plan, approving changes in Comprehensive Plan Designations and Zoning of Site Specific Rezone No. 1 -- 4.63 acres located at 36027 and 36005 6th Avenue SW from Single-Family Medium Density Residential (RS15.0) to Single-Family High Density Residential (RS9.6); Site Specific Rezone No.2--1.82 acres,located at 33061 15th Avenue South and 1411 South 330th Street from Office Park (OP) to Community Business (BC); Site Specific Rezone No. 3 -- 0.18 acres, located at 1443 South 308th Street from Multiple Family (RM1800) to Community Business (BC); and Site Specific Rezone No. 4-- 1.97 acres located at 32020 1st Avenue South from Professional Office(PO) to Office Park(OP) (Amending Ordinance Nos. 90-43,95-248,96- 270,98-330,00-372,01-405,03-442,04-460,04-461,04-462,05-490,05-491,05- 492, 07-558, 09-614, 10-671, 11-683, 13-736, and 13-745). WHEREAS,the Growth Management Act of 1990 as amended("Chapter 36.70A RCW"or "GMA"),requires the City of Federal Way to adopt a comprehensive plan which includes a land use element(including a land use map),housing element,capital facilities plan element,utilities element, economic development element,and transportation element(including transportation system maps) and a parks and recreation element; and WHEREAS, the GMA also requires the City of Federal Way to adopt development regulations implementing its comprehensive plan; and WHEREAS,the Federal Way City Council adopted its comprehensive plan with a land use map (the "Plan") on November 21, 1995, and adopted development regulations and a zoning map implementing the Plan on July 2, 1996; and WHEREAS,the Federal Way City Council subsequently amended the comprehensive plan, land use map, and zoning map on: December 23, 1998; September 14, 2000;November 1, 2001; March 27, 2003; July 20, 2004; June 16, 2005; July 16, 2007; June 11, 2009; October 28, 2010; January 27, 2011; January 23, 2013; and August 14, 2013; and Ordinance No. 15-798 Page 1 of 12 WHEREAS,the City may consider plan and development regulation amendments pursuant to Process VI, under Title 19 (Zoning and Development Code) of the Federal Way Revised Code ("FWRC"), Chapter 19.80 FWRC,pursuant to Chapter 19.35 FWRC; and WHEREAS,under RCW 36.70A.130,the plan and development regulations are subject to continuing review and evaluation,but the plan may be amended no more than one time per year;and WHEREAS, the Council shall be considering two separate actions to amend the comprehensive plan, both of which will be acted on simultaneously and concurrently in order to comply with RCW 36.70A.130; and WHEREAS,these actions include this Ordinance,Ordinance No. 15-798,approving changes in the comprehensive plan designation and zoning of: • 4.63 acres located at 36027 and 36005 6th Avenue SW from Single-Family Medium Density Residential (RS 15.0) to Single-Family High Density Residential (RS9.6) ("Site Specific Rezone No. 1 . ( p ) • 1.82 acres, located at 33061 15th Avenue South and 1411 South 330th Street from Office Park (OP)to Community Business (BC) ("Site Specific Rezone No. 2"). • 0.18 acres, located at 1443 South 308th Street from Multiple Family (RM1800) to Community Business (BC) ("Site Specific Rezone No. 3"). • 1.97 acres located at 32020 1St Avenue South from Professional Office(PO)to Office Park (OP) ("Site Specific Rezone No. 4"). WHEREAS,these actions include Ordinance No. 15-796,amendments to the Federal Way Comprehensive Plan,amending Chapters 1 through 10 of the Federal Way Comprehensive Plan;and WHEREAS,in January 2014,the City of Federal Way accepted a request from Mr.and Mrs. Lee, and Mr. and Mrs. Princen for Site Specific Rezone No. 1; and Ordinance No. 15-798 Page 2 of 12 WHEREAS, in March 2014, the City of Federal Way accepted a request from Dave Frankovich, on behalf of A& R Development LLC for Site Specific Rezone No. 2; and � p A WHEREAS,in March 2014,the City of Federal Way accepted a request from Hui Ok Paek for Site Specific Rezone No. 3; and WHEREAS, in September 2014, the City of Federal Way accepted a request from Rob Reuber on behalf of Oceanview Partners, LLC for Site Specific Rezone No. 4; and WHEREAS,on May 1,2015,the City's SEPA Responsible Official issued a Determination ofNonsignificance on Site Specific Rezone No. 1, Site Specific Rezone No.2,Site Specific Rezone No. 3, and Site Specific Rezone No. 4; and WHEREAS,the City's Planning Commission held a public hearing on May 20,2015,at the close of which it recommended to the Council approval of Site Specific Rezone No. 1, Site Specific Rezone No. 2, Site Specific Rezone No. 3, and Site Specific Rezone No. 4; and WHEREAS, the Land Use/Transportation Committee of the Federal Way City Council considered Site Specific Rezone No. 1, Site Specific Rezone No.2, Site Specific Rezone No. 3,and Site Specific Rezone No. 4, on June 1, 2015, and recommended approval of the same; and WHEREAS, the City Council, through its staff, Planning Commission, Land Use/ Transportation Committee, received, discussed, and considered the testimony, written comments, and material from the public,and considered Site Specific Rezone No. 1,Site Specific Rezone No.2, Site Specific Rezone No. 3, and Site Specific Rezone No.4 at its City Council meeting on June 16, 2015; and WHEREAS, the City Council desires to approve the change in comprehensive plan designation and zoning of Site Specific Rezone No. 1, Site Specific Rezone No. 2, Site Specific Rezone No. 3, and Site Specific Rezone No. 4. Ordinance No. 15-798 Page 3 of 12 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Findings and Conclusions. (a) The proposed amendments to the comprehensive plan maps, as set forth in Exhibit A, attached hereto,to change the comprehensive plan and zoning designation of 4.63 acres located at 36027 and 36005 6th Avenue SW from Single-Family Medium Density Residential (RS15.0) to Single-Family High Density Residential(RS9.6)(Site Specific Rezone No. 1)are consistent with the overall vision of the comprehensive plan, which states that the demand for and development of single-family housing is expected to continue for the foreseeable future. Single-family development will occur as in-fill development of vacant lots scattered throughout existing neighborhoods and as subdivisions on vacant tracts of land depending on the availability of utilities. Water is available along 6th Avenue South to the east and sewer is available along 8th Avenue South to the west; (b) The proposed amendments to the comprehensive plan maps, as set forth in Exhibit A, attached hereto,to change the comprehensive plan and zoning designation of 1.82 acres, located at 33061 15th Avenue South and 1411 South 330th Street from Office Park (OP) to Community Business (BC) (Site Specific Rezone No. 2) is consistent with the overall vision of the comprehensive plan,which states that the Community Business designation encompasses two major retail/commercial areas along the SR 99 corridor,including the segment between South 324th Street and approximately South 339th Street; (c) The proposed amendments to the comprehensive plan maps, as set forth in Exhibit A, attached hereto,to change the comprehensive plan and zoning designation of 0.18 acres,located at 1443 South 308th Street from Multiple Family (RM1800) to Community Business (BC) (Site Specific Rezone No. 3)is consistent with the overall vision of the comprehensive plan,which states Ordinance No. 15-798 Page 4 of 12 that the Community Business designation encompasses two major retail/commercial areas along the SR 99 corridor,including the segment between South 272nd Street and South 312th Street.The site is already developed with a legal nonconforming commercial use.The change in designation would make the use conforming and would allow for the ability to make structural changes to the building or increase its floor area,resulting in an improved look to the structure; (d) The proposed amendments to the comprehensive plan maps, as set forth in Exhibit A, attached hereto,to change the comprehensive plan and zoning designation of 1.97 acres located at 32020 1st Avenue South from Professional Office (PO)to Office Park(OP) (Site Specific Rezone No. 4) is consistent with the overall vision of the comprehensive plan for creating new retail and service employment opportunities and the provision of community and commercial services to residential communities.The requested Office Park zone would be appropriate at this location given the high volume of traffic moving along South 320th Street and 1st Avenue South; (e) The proposed amendments to the comprehensive plan maps, as set forth in Exhibit A, attached hereto, are consistent with the Council vision for the City of Federal Way, and will allow development which is compatible with the surrounding land uses; (f) The proposed amendments to the comprehensive plan maps, as set forth in Exhibit A, attached hereto, will allow for growth and development consistent with the comprehensive plan's overall vision and with the comprehensive plan's land use element and household and job projections, and will allow reasonable use of property subject to constraints necessary to protect environmentally sensitive areas; (g) The proposed amendments to the comprehensive plan maps, as set forth in Exhibit A, attached hereto, have complied with the appropriate process under state law and the FWRC; and (h) The proposed amendments to the comprehensive plan maps, as set forth in Exhibit A, Ordinance No. 15-798 Page 5 of 12 attached hereto,bear a substantial relationship to the public health,safety,and welfare;are in the best interest of the residents of the City; and are consistent with the requirements of Chapter 36.70A RCW, VISION 2040, the Countywide Planning Policies, and the unamended portion of the comprehensive plan. Section 2. Comprehensive Plan Maps and Zoning Map Amendments Adoption. The 1995 Federal Way Comprehensive Plan, as thereafter amended in 1998, 2000, 2001, 2003, 2004, 2005, 2007,2009,2010, 2011, and 2013, copies of which are on file with the Office of the City Clerk, is amended as set forth in Exhibit A, attached hereto. Section 3.Amendment Authority.The adoption of comprehensive plan map amendments in Section 2 above is pursuant to the authority granted by Chapters 36.70A and 35A.63 RCW, and pursuant to Chapter 19.80 FWRC. Section 4. Severability.The provisions of this ordinance are declared separate and severable. The invalidity of any clause,sentence,paragraph, subdivision,section,or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance,shall not affect the validity of the remainder of the ordinance,or the validity of its application to other persons or circumstances. Section 5. Savings Clause. The 1995 Federal Way Comprehensive Plan, as thereafter amended in 1998,2000,2001,2003,2004,2005,2007,2009,2010,2011,and 2013 shall remain in full force and effect until these amendments become operative upon the effective date of this ordinance. Section 6. Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of scrivener/clerical errors, references, ordinance numbering, section/subsection numbers, and any references thereto. Ordinance No. 15-798 Page 6 of 12 Section 7.Ratification.Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. Section 8. Effective Date. This ordinance shall take effect and be in force after its passage and publication, on July 29, 2015, as provided by law and upon passage of Ordinance No. 15-796.
