RES 15-695 - Authorizing LAA with WSDOT - Sacajawea Middle School Safe Route RESOLUTION NO. 15-695 A RESOLUTION of the City Council of the City of Federal Way, Washington, authorizing execution of a Local Agency Agreement with the Washington State Department of Transportation regarding improvement to Sacajawea Middle School Safe Route to School Project in the City of Federal Way, Washington. WHEREAS,the City of Federal Way applied to the Safe Routes to School("SRTS")Grant Program from the Washington State Department of Transportation for the purpose of design and construction of a SRTS Project for Sacajawea Middle School within the City; and WHEREAS,the Washington State Department of Transportation agrees to grant the City of Federal Way federal funds in the total amount of One Million Two Hundred Thousand and No/100 Dollars($1,200,000.00)provided that the City Council authorize the Mayor to enter into the Local Agency Agreement; and WHEREAS, by accepting said grant the City of Federal Way agrees to execute the Local Agency Agreement; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, RESOLVES AS FOLLOWS: Section 1. Execution of Acceptance of the Local Agency Agreement. The Mayor or his designee is hereby authorized to execute the Local Agency Agreement regarding improvements to the Sacajawea Middle School SRTS Project in the City of Federal Way. Section 2. Receipt of Federal Funds. The Mayor or his designee is hereby authorized to accept and receive the state and federal funds estimated to be One Million Two Hundred Thousand and No/100 Dollars ($1,200,000.00). Resolution No. 15-695 Page 1 of 3 Section 3. Matching Funds. Pursuant to the terms of the Local Agency Agreement,the City is required to commit matching funds in the amount of Three Hundred Thousand and No/100 Dollars ($300,000.00). The Mayor is authorized to commit and match the funds as required. Section 4. Severability. If any section,sentence,clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this resolution. Section 5. Corrections. The City Clerk and the codifiers of this resolution are authorized to make necessary corrections to this resolution including, but not limited to, the correction of scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any references thereto. Section 6. Ratification. Any act consistent with the authority and prior to the effective date of this resolution is hereby ratified and affirmed. Section 7. Effective Date.
