CALL MEETING TO ORDER Mayor Ferrell called the Regular Meeting to order at the hour of 7:04 p.m. City officials in attendance: Mayor Jim Ferrell, Deputy Mayor Jeanne Burbidge,Councilmember Lydia Assefa-Dawson, Councilmember Kelly Maloney, Councilmember Susan Honda,Councilmember Bob Celski, and Councilmember Martin Moore. City staff in attendance: City Attorney Amy Jo Pearsall and City Clerk Stephanie Courtney. 2. PLEDGE OF ALLEGIANCE Presentation of the Colors and Pledge of Allegiance was led by Boy Scout Troop#342. 3. PRESENTATIONS Mayor Ferrell spoke to express gratitude and appreciation to outgoing Councilmember Bob Celski. Throughout his term on the Council;which spans 2012-2015,the Mayor noted he has always been a calm voice of reason and has always been counted on for thoughtful discussion. As a friend and colleague, Mayor Ferrell stated he would miss Councilmember Celski and wishes him the best. Councilmember Duclos concurred with Mayor Ferrell and thanked Councilmember Celski for his"eye for detail" in reviewing financial reporting. She wished him the best in his future and to his family. Deputy Mayor Burbidge stated while somewhat in denial about losing Councilmember Celski on the Council; she has always appreciated working with him and took the time to review and make thoughtful decisions.Councilmember Honda reminded Councilmember Celski of the night four short years ago, they were both elected; she thanked him for his friendship and service and wished him well. Councilmember Maloney thanked Councilmember Celski from whom she has learned a lot and always appreciated the value in his wisdom. She feels this is a loss to the community; but is happy for him and wishes him and his family all the best in the future. Councilmember Assefa-Dawson thanked Councilmember Celski for being an amazing friend and colleague; he will be missed on the Council. Councilmember Moore reflected on the opportunity to work alongside a longtime friend and mentor such as Councilmember Celski. Mayor Ferrell presented Councilmember Bob Celski with a glass plaque memorializing his time in office. Councilmember Celski graciously thanked Mayor Ferrell and Council for the recognition. He spoke highly of his colleagues and of the amazing city staff and Directors. He recognized his supportive family,who were in the audience tonight. He noted is has been an honor to serve the community and will continue to give back. Personally he is looking forward to the birth of his first grandson; and will enjoy spending time with family. Councilmember Celski congratulated Councilmember Elect Mark Koppang who is a leader in the community and feels will be a great asset to the city. RECEPTION FOR OUTGOING COUNCILMEMBER BOB CELSKI a. Mayor's Emerging Issues and Report • Mayor's Veterans Advisory Committee Mayor Ferrell was pleased to announce the formation of the Mayor's Veterans Advisory Committee which will be chaired by Councilmember Bob Celski. One of the key elements of the new Town Square Park, which is slated to open next summer, will feature a Veterans Memorial. Councilmember Celski thanked Mayor Ferrell for asking him to lead this project. He further thanked the Council and Directors for planning space for this Memorial,which will become a"marquee"in the city honoring those who have served, and those who continue to serve our country. • Annual Holiday Tree Lighting Event at Wild Waves Theme Park— December 4th at 7:00 p.m. Parks Director John Hutton reported the Annual Holiday Tree Lighting Celebration will be held this Friday(December 4th) at 7:00 p.m. This year as the park is under construction, the city is partnering with Wild Waves Theme Park. The event will feature multiple school choirs; the Thomas Jefferson Drum Line and an appearance by Santa! He suggested everyone come at 7:00 p.m;the lighting will be promptly at 7:30 p.m. Wild Waves is granting free entry to families within the Federal Way School District boundaries. • Report on Open House—SeaTac Airport/FAA Meeting Mayor Ferrell reported on the SeaTac Airport Noise/FAA Open House on November 19th. He was pleased to report the Open House was well attended, and was video recorded for FWTV Channel 21. Top level representatives from the FAA and the Airport were in attendance and in the end it was a very productive meeting. Chief of Staff Brian Wilson is in follow up communications with the airport. Mayor Ferrell acknowledged residents feel home values and quality of life need to be preserved.State Representative Linda Kochmar has also offered assistance. • City Council Regular Meeting Cancellation on December 15th Mayor Ferrell reminded everyone this is the last Regular Council meeting of the year. Canceling the last meeting of the year is an annual tradition which allows staff and Councilmembers a break for holiday travel. Federal Way City Council Regular Minutes Page 2 of 9 December 1, 2015 • Year End Wrap Up Mayor Ferrell took a few moments to memorialize the accomplishments of the year. He is proud of work the Council and staff have completed in 2015. These accomplishments include: Work at Town Square Park, a re-negotiated Centerstage contract; Sound Transit Preferred Alignment vote; Economic Development in the Downtown; work on bringing a Branch Campus to our city; and the Performing Arts and Event Center Groundbreaking. He thanked the Council for being policy partners and for their hard work this year. 4. CITIZEN COMMENT Catherine North, spoke on allowing marijuana related businesses in the city. She does not believe prohibition of any kind works. She feels citizens will go spend their money in neighboring cities and feels it should be accessible to residents. Jim Stiles, reported on the election results of the advisory vote. He noted as a part of the Council selected "Con" Committee; he would like to see Council take action to ban marijuana related businesses as 60% of the voters do not want"pot shops"in the city. He is further concerned over the new"cooperatives". Joann Piquette, gave a brief update from FW Coalition of the Federal Way performing arts. She reported the seat campaign has kicked off and there will be an event at City Hall on December 10th in the lobby. Coalition is also preparing grant applications and contacting businesses for sponsorship. Current to date is $753,534.00 and have additional money they will be collecting in the beginning of the year. Ten-v Thomas, noted he was appointed by Council to represent the"Con"side of the Advisory Vote regarding Marijuana Related Businesses. He stated he and the fellow committee members took their roles seriously and worked hard. He expects the Council to act and honor the vote of the people and ban marijuana related businesses within the city. Debbie Sabin,spoke to the results of the advisory votes(61%vote against the shops in the city).She is pleased our city will join 65 other cities in Washington which desire to preserve family friendly integrity of the city. She encouraged the Council to act the vote of the people and ban marijuana related businesses in Federal Way. 5. The motion passed 6-0 as follows (Burbidge recused): Deputy Mayor Burbidge recuse Councilmember Celski yes CouncilmemberAssefa-Dawson yes Councilmember Moore yes Councilmember Maloney yes Councilmember Duclos yes Councilmember Honda yes Consent Agenda Item (e)/ Resolution: 2016 Fee Schedule Federal Way Public Schools Assistant Superintendent Sally McLean gave a brief PowerPoint presentation regarding the 2016 School Impact Fees as reflected in the 2016 City Fee Schedule. Ms. McLean noted the fees are calculated annually based on a prescribed formula which contains more than a dozen variables. She noted it has come to the district's attention the calculations were incorrect and the School Board will need to pass a Resolution in the beginning of 2016 to correct the error. Ms. McLean requested the city approve the Resolution as presented and further consider an amendment to the fee schedule once the Multi-Family Fee has been corrected by the School Board. Councilmembers thanked Ms. McLean for the presentation and asked clarifying questions including the district's planning and vision for future larger multi-family developments currently in construction, including mitigation in currently over-crowed schools. Ms. McLean noted the district is re-evaluating based on the most recent large multi-family project impacts. They are working on facilitating space with portables and she noted Federal Way High School is being built to accommodate a higher number of students. In response to the question, Finance Director Ade Ariwoola stated the City Council cannot amend the school district's figure without a resolution from their board. He confirmed Ms. McLean's statement that as soon as their board makes a modification and submits a resolution to the city; the city can amend the adopted Fee Schedule. The city does not have the authority to adopt anything higher, although jurisdictions can adopt the submitted proposal or something lower. COUNCIL BUSINESS a. Authorization to Purchase Spray Park Equipment for Town Square Park Parks Director John Hutton gave a brief presentation on the Spray Park Equipment for Town Square Park. He displayed a brief overview of the park design and noted this purchase is a fiscally wise decision and keeps the project on time and on budget. Mr. Hutton also introduced Deputy Director Steve lkerd,who designed the park.All water features are computer controlled and will have multiple types of nozzles and features which kids love. Computer Controls will also monitor chemical and water quality verifying safety for users. He also discussed the plan for the large basalt columns as the centerpiece of the spray park. These columns will have high shooting nozzles(bored into the centers)which will create height of the water feature. He noted the Mayor's recommendation is to move forward with the purchase which is within previously approved project budget. Councilmembers asked various questions of Mr. Hutton and Mr. Ikerd including safety of the columns, and projected life of the columns and/or repair and maintenance concerns. Questions were also raised about staffing levels for the park, security issues, and the water park ground surface. Mr. Hutton will check with the supplier regarding maintenance and warranty of the stones.The valves and controllers are at the site, which are computer controlled. Staff will be checking and confirming the chemicals levels. Currently the staff levels are based on estimates and will be handled in-house until further assessment has been made. Parks Director Hutton noted the park will have security cameras and the Police Substation is very near. It is a high visibility area with parents who are always a helpful deterrent of unwanted activity. He noted there will also be security lighting at night and when the spray park is not in use it can be lit as a fountain. He noted the surface will be an industry standard, brushed concrete finish,which gives grip and is not harmful to feet. COUNCILMEMBER HONDA MOVED TO APPROVE THE PURCHASE OF THE SPRAY PARK MECHANICAL EQUIPMENT IN AN AMOUNT NOT TO EXCEED$179,496.00;COUNCILMEMBER DUCLOS SECOND. Council Bill#697/Ordinance Prohibiting Marijuana-Related Businesses APPROVED ORDINANCE#15-806 AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, RELATING TO PROHIBITING ALL MARIJUANA-RELATED BUSINESSES INCLUDING RETAIL, PRODUCTION,AND PROCESSING AND ENDING A MORATORIUM ON RECREATION MARIJUANA-RELATED BUSINESSES AND OTHER ACTIVITIES INVOLVED IN RETAIL, PRODUCTION, AND PROCESSING OF RECREATIONAL MARIJUANA, (REPEALING ORDINANCE NO. 15-788) Senior Planner Stacey Welsh briefed the Council on the Advisory Vote regarding Marijuana related businesses and other recent changes in State Law. She noted the Council authorized an Advisory Vote for the November General Election which is non-binding. A "Yes"vote meant the voter was in favor of marijuana-related businesses locating within the City of Federal Way; and "No"vote meant the voter was opposed. The Advisory Proposition No. 1 did not pass, with 61% voting "No". She reported on Senate Bill 5052 (Cannabis Patient Protection Act and House Bill 2136 Comprehensive Marijuana Market Reform). Ms. Welsh noted the proposed Ordinance on tonight's agenda will prohibit marijuana-related businesses and includes both recreational and medical businesses because these will be merged. She informed the Council on the Medical Marijuana Cooperatives, which are not considered a business will not be affected by the prohibition. This ordinance will repeal the recreational marijuana moratorium (Ordinance #15-788). The moratorium on medical marijuana and collective gardens will remain in place until its expiration in May 2016. Councilmember thanked Ms. Welsh for her presentation and asked clarifying questions of her regarding the cooperatives and marijuana taxes. COUNCIL REPORTS Councilmember Assefa-Dawson wished Councilmember Celski all the best and wished everyone a Happy 2016! Councilmember Maloney congratulated her newly elected and re-elected colleagues.She reported on recently attending a meeting at Todd Beamer High School and appreciated the participation of the student leaders. She thanked the Pro and Con committees who worked on the Advisory Vote. She wished everyone a Happy New Year, Merry Christmas and Happy Chanukah. Councilmember Honda promoted the new Parks Brochure noting there are wonderful events and activities for all ages; and reminded everyone there are scholarships available. She further reported on another Habitat for Humanity House which was recently dedicated;she thanked Delta Airlines and its employees for their role in the Habitat program. She attended the AT&T Championship held at the Aquatics Center and also the 25th anniversary of the pool in our community.Group Health and the Boy Scouts are collecting sleeping bags, tents, tarps and mats; these items will be taken to the Multi Service Center and will be given to those in need. She thanked all those who have been working over the years on a Veterans Memorial for the City; she would like to see more included in the planning and more families of veterans included. She wished everyone Happy Holidays. Councilmember Celski thanked everyone for the kind comments. Federal Way is a neat city and we have great exciting things to offer our citizens. He feels the Town Center will be an amazing addition for our citizens and he is leaving Council at an exciting time; however feels good with the leadership and direction. He has one more meeting; the Land Use/Transportation Committee Meeting will be December 7th at 5:30 pm. He restated serving as a Councilmember has been and honor and a pleasure and thanked everyone for their support. Councilmember Moore reported on attending the Airport Noise/FAA Meeting recently and is confident representatives at the city,state and federal level will come together and advocate for the citizens. He also reported on attending the King County Aquatics Center 25th Anniversary Event. He specifically thanked Public Works Director Marwan Salloum for his help in working with constituent issues; Mr. Salloum's staff are quick to take care of issues. He recognized Boy Scout Troop#342 and its leaders who participated in tonight's meeting. He attended the recent informational meeting regarding a Federal Way City Council Regular Minutes Page 8 of 9 December 1, 2015 Telecare Mental Health Facility in the city; and thanked his colleagues for hearing his proposal regarding enhancements to make the city budget more user friendly and enhance transparency. He wished everyone Happy Holidays. Councilmember Duclos thanked the voters for her successful re-election to the Council and noted she will miss colleague Bob Celski. She was pleased to report she is headed to Hawaii for her 440th dive and will be celebrating her birthday on December 15t n. The next Finance/Economic Development/ Regional Affairs Committee will be in January. Deputy Mayor Burbidge reported on attending the SeaTac Airport Noise/FAA Open House at City Hall. She was impressed by the number of citizens in attendance and their passion for this issue.She is proud to say the city takes these concerns seriously and it was Federal Way who brought this to the airport officials to work together on a solution. She wished everyone a joyous holiday and extended her appreciation to Councilmember Celski and his dedication to the city . She thanked city staff, Management Team, Councilmembers,and the Mayor for leadership and management.She reminded everyone of local performances over the holidays and wished everyone a happy holiday. While it is the intent of the SWM utility to construct the SWM CIP Projects as scheduled, CIP projects will at times be removed, added or modified based on new information gathered through engineering studies, operational observations, permit monitoring and continual reevaluation of our community's needs. In 2015, proposed changes to the SWM CIP are as follows: PROJECT ADDITIONS • Project#14, Town Center Park LID Demonstration Project On Sept 15, 2015 Council approved a new SWM CIP project to integrate Low Impact Development techniques for storm water into the Town Center Park Project. This project will provide educational elements to the Park that will facilitate and support storm water education and outreach in area schools, summer programs, special interest groups and the general public. Estimated total project cost: $400,000. Scheduled completion: 2016. • Project#15, Regional Flow Control Facility Upgrade Study, This study will identify and evaluate alternative approaches to upgrading our existing regional flow control facilities that serve the Downtown Core and Frame from Level 1 flow control to Level 2 flow control. Estimated total study costs: $80,000. Schedule Completion: 2016 • Project#16, Conveyance System Restoration (Slip Line) Numerous blockages, caused by root incursion into the storm water conveyance system have been impacting the operation of the detention facility at 1 st Ave S. and SW 320 th street. This project will reline the pipes most susceptible to root incursion, eliminating the possibility of any future related impacts. Estimated total cost: $100,000. Scheduled completion: 2016. December 7,2015 Land Use and Transportation Committee Page 2 PROJECT DELETIONS • Project#9,LID Retrofit Preliminary geotechnical and engineering analyses show that none of the proposed retrofit locations would support Low Impact Development techniques. Grant funding was anticipated for construction of this project, however based on preliminary engineering design a competitive project cannot be developed. Removal of this project will reduce CIP costs by $507,000. PROJECT MODIFICATIONS • Project#6, Phase V Highway 99 Project—S 344th Street at Highway 99 Property acquisition costs associated with this project are expected to be higher than the $500,000 budgeted. It is recommended that an additional $250,000 be added to the project budget to ensure adequate funding is available for purchasing the target property. Estimated total cost: $1,454,180. Scheduled completion: 2016/2017. • Project#1 & #2, Conveyance System Restoration SWM has determined that there is adequate time and funding to combine these two restoration projects in the Marine Hills area into one project to be constructed in 2016. Combining these projects will address system deficiencies sooner and also allow for potential cost savings based on economies of scale. Estimated total cost: $1,838,000. Scheduled completion: 2016. • Project#10,West Hylebos Education Center and Trail It is recommended that the preliminary project scoping and design phase for this project be started in 2016 rather than 2017 in order to provide more time for identifying grant funding opportunities for construction. There is no anticipated cost impacts associated with this recommended change. • Project#9, Bridges Property Culvert Removal and Replacement It is recommended that this project be rescheduled to begin preliminary project scoping and design in 2016 with construction in 2017. Given unanticipated work load, staff were unable to begin this project in 2015 as originally planned. There is no anticipated cost impacts associated with this recommended change. The proposed changes to the SWM CIP are estimated to add an additional $323,000 of project costs in FY 2016, these added costs will be paid for with funds from the SWM unallocated reserves. Two (2) quotes were received and opened on November 18, 2015. See the attached Exhibit A, Quote Tabulation Summary. AA Asphalting, LLC of Sumner submitted the lowest quote. However, the unit prices quoted for comparable bid items are much higher than the winning quotes received for previous NTS program contracts for 2014-2015, 2012-2013, and 2009-2010. A comparison to previous contracts is attached as Exhibit B — Previous Contract Unit Price Comparison. As Exhibit B indicates the current unit prices are substantially higher than previous contracts, representing an average unit price increase ranging from 162% to 555% for comparable unit prices on comparable work items. There are no known market factors that would explain the sudden jump in pricing. The City has requested WSDOT to provide the estimated overlay funding that WSDOT would have to spend for the overlay of the limit of Pacific Highway S HOV Lanes Phase V project. The Attached State Participating Agreement provide that the City, on behalf of the State, agrees to perform the required pavement Work by incorporating the design, plans and specifications for the required work into the Pacific Highway S HOV Lanes Phase V project. Northwest Region This Agreement is made and entered into between the WASHINGTON STATE DEPARTMENT OF TRANSPORTATION,hereinafter the"STATE,"and the CITY OF FEDERAL WAY, 33325 8th Ave S., Federal Way,WA. 98003,hereinafter the"CITY." WHEREAS,the CITY is planning the design and construction of a paving project on SR 99 within the CITY limits, and in connection therewith,the STATE has agreed to partner with the CITY pursuant to the above Description of Work,hereinafter"Work,"and Exhibit A, Plans, and WHEREAS, it is deemed to be in the best public interest for the STATE to include specific items of Work in the CITY's design and construction contract,and WHEREAS,the STATE is obligated for the cost of the Work described herein, NOW,THEREFORE,pursuant to RCW 47.28.140 and RCW 47.24.020,the above recitals that are incorporated herein as if fully set forth below, and in consideration of the terms,conditions,covenants,and performances contained herein,and Exhibits A and B, which are attached and made a part hereof, IT IS MUTUALLY AGREED AS FOLLOWS: PS&E, BID,Construction 1.1 The CITY,on behalf of the STATE, agrees to perform the above Work. Plans, specifications and cost estimates(PS&E) for the Work shall be prepared by the CITY in accordance with the current State of Washington Standard Specifications for Road,Bridge,and Municipal Construction,and amendments thereto, (Standard Specifications) and adopted design standards, unless otherwise noted.The CITY will incorporate the plans and specifications for the Work into the CITY's project only after STATE review and prior written approval, prior to advertising the project, and thereafter, advertise the resulting project for bid and, assuming bids are received and a contract is awarded, administer the contract. 1.2 The CITY shall provide the STATE with written notification of the bid price for the Work. The GCB 2168 Page 1 STATE shall have five(5) working days from the date of written notification to provide the CITY written approval of the bid price for the Work, or request the Work be deleted from the Project. The STATE may request an extension of time in writing,provided that the CITY receives the written request not later than five(5)working days after the STATE has received the written notification. The CITY shall provide a written response indicating the number of working days extended, if any. 1.3 The STATE may,if it desires, furnish an inspector for the Work.Any costs for such inspection will be borne solely by the STATE. All contact between said inspector and the CITY's contractor shall be through the CITY's representative. 2.0 CONTRACT CHANGES 2.1 Changes to the Work shall be documented by change order in accordance with the Standard Specifications. The CITY shall process change orders for all changes affecting the Work in the manner set forth in subsection 1-2.4C (3), Approval of Changes/Checklist, STATE Construction Manual,current edition. 2.2 Required changes involve changes in quantities for or alterations to the Work as are necessary to satisfactorily complete the Work. All other changes affecting the Work shall be considered elective changes. 2.3 The CITY shall submit proposed change orders for the Work to the STATE for review and written approval prior to issuance of a Work change order to the contractor. The STATE agrees to pay for the increases in cost, if any, for the STATE-approved required Work changes, in accordance with Section 4. 2.4 CITY shall advise the STATE of any proposed required changes affecting the Work as soon as possible and provide the STATE with an opportunity to review and approve the change in accordance with Section 2.3 before implementation. The CITY will determine the length of the review time based upon the need to expedite the change to avoid delay to the contractor. 2.5 STATE may request in writing changes to the Work through the CITY.The CITY agrees to implement the requested changes,provided that a change does not negatively impact the roadway, and complies with the Standard Specifications, Project permits, state and/or federal law, applicable rules and/or regulations, and/or STATE design policies, and does not unreasonably delay critically scheduled Project contract activities. All elective changes to the Work shall be approved in writing by the STATE before the CITY directs the contractor to implement the changes,even if an executed change order is not required by the Project contract. The STATE agrees to pay for the increases in cost, if any, for such elective changes in accordance with Section 4. 2.6 The CITY will make available to the STATE all change order documentation related to the Work. 2.7 In the event it is determined that the STATE does not have sufficient funds to complete the Work, the CITY and the STATE shall negotiate to determine the future of the Work. If it is determined that the Work cannot proceed,the Work shall be brought to a level that is safe for public use and the CITY will terminate the remainder of the Work from the Project contract. In the event the Work is terminated, Section 3 shall apply for that portion of the Work completed up to the time of termination. The STATE agrees to pay all costs associated with termination, including contractor claims, in accordance with Section 4. 3. ACCEPTANCE 3.1 Prior to Work acceptance, the STATE and CITY will perform a joint final inspection. The STATE GCB 2168 Page 2 agrees,upon satisfactory completion of the Work and receipt of a Notice of Physical Completion of the Work,as determined by the CITY,to deliver a letter of acceptance to the CITY which shall include a release of the CITY from future claims or demands resulting from the performance of the Work and CITY administration thereof; except, such release shall not waive or release the CITY from any potential claims for defective work or materials. 3.2 If a letter of acceptance is not received by the CITY within ninety(90)calendar days following delivery of a Notice of Physical Completion of the Work to the STATE,the Work and CITY administration thereof shall be considered accepted by the STATE,and the CITY shall be released from future claims and demands resulting from the performance of the Work and the CITY's administration thereof;except, such release shall not waive or release the CITY from any potential claims for defective work or materials. 3.3 The STATE may withhold its acceptance of the Work by submitting written notification to the CITY within thirty(30)calendar days following delivery of a Notice of Physical Completion of the Work. This notification shall include the reason(s) for withholding acceptance. 4 PAYMENT 4.1 The STATE,in consideration of the faithful performance of the Work to be done by the CITY, agrees to reimburse the CITY for the actual direct and related indirect cost of the Work. 4.2 The STATE shall be obligated for the actual direct and related indirect costs not to exceed One Hundred and Eleven Thousand Two Hundred and Thirty Eight Dollars($111,238.00) for design work and the actual direct and related indirect costs not to exceed One Million One Hundred Nine Thousand One Hundred Eighty Six Dollars ($1,109,186.00) for construction as shown on Exhibit B. 4.3 The CITY shall provide to the STATE detailed invoices, including documentation for all costs and materials, for the actual direct and related indirect costs incurred for the Work performed by the CITY and/or its contractor.The STATE agrees to make payment to the CITY within thirty(30)calendar days after the invoice date. Invoices and payments shall be no more frequent than one(1)per month. It is agreed that any such partial payment will not constitute agreement as to the appropriateness of any item and that,at the time of the final payment all required adjustments will be made and reflected in a final payment. 5.0 CLAIMS 5.1 Claims for Additional Payment 5.1.1 In the event the CITY's contractor makes claims for additional payment associated with the Work, the CITY will immediately notify the STATE of such claims. The CITY shall require its contractor to make such claims in the manner and form as provided for in the Standard Specifications. 5.1.2 The STATE shall not be obligated to pay such claims or their cost of defense to the extent that the claims are caused by the negligent acts or omissions of the CITY in administering the Work. 5.1.3 The STATE shall have the right to review and comment on any settlement for claims associated with the Work. However,the CITY shall have the ultimate right to settle such claims. In the event the STATE does not agree with the claim settlement as negotiated by the CITY, the STATE shall reserve the right to not financially participate in the negotiated claim settlement. If agreement cannot be reached between the STATE and the CITY on a claim settlement, the Parties agree to follow the dispute resolution procedure in Section 8. GCB 2168 Page 3 • 5.1.4 If the CITY agrees,the STATE may defend contractor claims associated with the Work at its own cost,and in doing so,the STATE agrees to pay any resulting settlement,court judgment or arbitration award. The CITY will cooperate with the STATE in the STATE's defense of the claims. The STATE agrees to reimburse any CITY costs, including attorney's fees, incurred in for providing such assistance in accordance with Section 4. 6. TERMINATION • 6.1 Either Party may terminate this Agreement with or without cause upon thirty(30) calendar days' written notice. Any work performed by the CITY associated with the Work up to the date of termination shall be compensated in the manner provided for as follows: If it is determined that the Work cannot proceed,the Work shall be brought to a level that is safe for public use, and the CITY will terminate the remainder of the Work from the Project contract. In the event the Work is terminated, Section 3 shall apply for that portion of the Work completed up to the time of termination. The terminating Party will pay for the costs associated with the termination. 7.0 INDEMNIFICATION 7.1 The CITY shall protect,defend, indemnify, and hold harmless the STATE, its officers,officials, employees, and agents, while acting within the scope of their employment as such, from any and all costs, claims,judgments, and/or awards of damages(both to persons and/or property), arising out of,or in any way resulting from the Work to be performed pursuant to the provisions of this Agreement. The CITY will not be required to indemnify, defend or save harmless the STATE if the claim, suit, or action for injuries, death,or damages(both to persons and/or property)is caused by the sole negligence of the STATE. Where such claims, suits, or actions result from the concurrent negligence of both Parties,or involves those actions covered by RCW 4.24.115,the indemnity provisions provided herein shall be valid and enforceable only to the extent of each Party's own negligence. 8.0 DISPUTES 8.1 In the event that a dispute arises under this Agreement, it shall be resolved as follows: The STATE and the CITY shall each appoint a member to a disputes board, these two members shall select a third board member not affiliated with either Party. The three-member board shall conduct a dispute resolution hearing that shall be informal and unrecorded. An attempt at such dispute resolution in compliance with aforesaid process shall be a prerequisite to the filing of any litigation concerning the dispute.The Parties shall equally share in the cost of the third disputes board member; however, each Party shall be responsible for its own costs and fees. 9.0 VENUE 9.1 In the event that either Party deems it necessary to institute legal action or proceedings to enforce any right or obligation under this Agreement,the Parties agree that any such action or proceedings shall be brought in Thurston County Superior Court. Further, the Parties agree that each will be solely responsible for payment of its own attorney's fees, witness fees, and costs. 10.0 AUDITS/RECORDS 10.1 All Project records for the Work in support of all costs incurred shall be maintained by the CITY for a period of six(6) years. The STATE shall have full access to and right to examine said records,during normal business hours and as often as it deems necessary. Should the STATE require copies of any GCB 2168 Page 4 records,it agrees to pay the costs thereof. The Parties agree that the Work performed herein is subject to audit by either or both Parties and/or their designated representatives, and/or state of Washington and/or the federal government. 11.0 TERM OF AGREEMENT 11.1 Unless otherwise provided herein,the term of this Agreement shall commence as of the date this Agreement is fully executed and shall continue until the Work is accepted by the STATE pursuant to Section 3,or as otherwise provided herein, and all obligation for payment have been met. On February 2015, the City Council passed a one year temporary suspension of transportation impact fees charged for changes in use that do not add new square footage. The temporarily suspension was intended to help attract new businesses to fill vacant buildings and generate additional tax revenue for the City. The temporary suspension of impact fee for change in use is set to expire December 31,2015. At the January 5th, 2015 LUTC meeting, the Council committee directed staff to report to the committee on the status of the program at the end of the year. City Traffic Division staff has reviewed approximately 77 permit applications related to tenant improvement from January to November 2015. Five (5) permit applications are benefiting from the temporary suspension resulting in approximately $392,542 in traffic mitigation that the City is not collecting. The Table below provides a breakdown of the development savings and associate traffic impact fees and credits. Please see attached map for project locations. Four specific criteria need to be met in order to obtain variance approval. The Community Development Department currently processes variances via the City's contracted Hearing Examiner. This process requires a public hearing,two notice periods, and up to 10-business days following the hearing for a decision. This type of decision-making process adds additional time and costs to applicants and the City compared to the administrative land use review procedure. Update—During the November 2,2015, LUTC meeting,the committee requested that staff amend the ordinance to provide additional opportunity for citizen comment. MAYOR'S RECOMMENDATION: The proposed text amendment allows administrative variances issued by the Community Development Director for variances up to 25 percent from code requirements. For example,a single-family homeowner who applies for a variance to reduce their 20-foot front yard setback to a 15-foot setback due to hardship would qualify for an administrative review process. No changes to the approval criteria are proposed. The text amendment is procedural only.The existing public hearing and Hearing Examiner approval procedure would remain in place for variance requests exceeding the 25 percent threshold. Update — The Mayor's recommendation now provides an additional notice period prior to issuing an administrative variance decision. A Notice of Impending Decision will be issued at least 15-days prior to an administrative variance decision. The amended recommendation now provides two notice periods (Notice of Application and Notice of Impending Decision)that will follow administrative land use permit distribution methods. The Mayor recommends the proposed code amendment be adopted by City Council. ORDINANCE NO. AN ORDINANCE of the City of Federal Way, Washington, relating to variances; amending FWRC 19.45.010 and 19.45.020; and adding a new section to Chapter 19.45 FWRC. (Amending Ordinance Nos. 90- 43 and 97-291) WHEREAS, the City recognizes the need to periodically modify Title 19 of the Federal Way Revised Code (FWRC), "Zoning and Development Code," in order to conform to state and federal law, codify administrative practices, clarify and update zoning regulations as deemed necessary, and improve the efficiency of the regulations and the development review process; and WHEREAS, this ordinance, containing amendments to development regulations and the text of Title 19 FWRC, has complied with Process VI review, Chapter 19.80 FWRC, pursuant to Chapter 19.35 FWRC; and WHEREAS, it is in the public interest for the City Council to adopt a new administrative variance procedure for proposals that do not exceed 25 percent of the measurable zoning standard within the City of Federal Way; and WHEREAS, the proposed amendments provide an efficient and timely decision making process; and WHEREAS, the proposed amendments relate to governmental procedures containing no substantive standards respecting use or modification of the environment; therefore, the proposed amendments are categorically exempt from environmental threshold determination requirements delineated in WAC 197-11-800(19); and Ordinance No. 15- Page 1 of 5 Rev 1/15 LU WHEREAS, the Planning Commission properly conducted a duly noticed public hearing on these code amendments on October 7, 2015, and forwarded a recommendation of approval to the City Council; and WHEREAS, the Land Use/Transportation Committee of the Federal Way City Council considered these code amendments on November 2, 2015 and requested staff include provisions for a second notice period prior to issuing an administrative variance decision; and WHEREAS, the Land Use/Transportation Committee of the Federal Way City Council considered these code amendments on December 7, 2015, and recommended adoption of the text amendments. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Findings. The City Council of the City of Federal Way makes the following findings with respect to the proposed amendments. (a) These code amendments are in the best interest of the residents of the City and will benefit the City as a whole by making the variance process more efficient. (b) These code amendments comply with Chapter 36.70A RCW, Growth Management. (c) These code amendments are consistent with the intent and purpose of Title 19 FWRC and will implement and are consistent with the applicable provisions of the Federal Way Comprehensive Plan. (d) These code amendments bear a substantial relationship to, and will protect and not adversely affect, the public health, safety, and welfare. Pursuant to chapter 19.80 FWRC and Chapter 19.35 FWRC, and based upon the recitals and the findings set forth in Section 1, the Federal Way City Council makes the following Conclusions of Law with respect to the decisional criteria necessary for the adoption of the proposed amendments: (a) The proposed FWRC amendments are consistent with, and substantially implement,the following Federal Way Comprehensive Plan goals and policies: LUG2 Develop an efficient and timely development review process based on a public/private partnership. LUP4 Maximize efficiency of the development review process. LUP6 Conduct regular reviews of development regulations to determine how to improve upon the permit review process. EDP2 Periodically monitor local and regional trends to be able to adjust plans, policies, and programs. (b) The proposed FWRC amendment bears a substantial relationship to the public health, safety, and welfare because it provides timely decision-making for applicants who may • have unique hardships in developing a particular property. (c) The proposed amendment is in the best interest of the public and the residents of the City of Federal Way because it streamlines decision-making and reduces costs for applicants and the city. Section 3. FWRC 19.45.010 is hereby amended to read as follows: 19.45.010 Procedure generally. Ordinance No. 15- Page 3 of 5 Rev 1/15 LU The city will use process IV, Chapter 19.70 FWRC, to review and decide upon an application for a variance:, with the exception of an administrative variance pursuant to FWRC 19.45.015 in which case the city will use process III, Chapter 19.65 FWRC. Section 4. Chapter 19.45 of the Federal Way Revised Code is hereby amended to add a new section"Administrative variance"to read as follows: 19.45.015 Administrative variance (1) Scope. The community development director may grant a variance that does not exceed 25 percent of the measurable standard. (2) Additional notice. A notice of impending decision shall be issued with content items and distribution methods set forth in FWRC 19.65.070 at least 15-days prior to the director's decision. Section 5. FWRC 19.45.020 is hereby amended to read as follows: 19.45.020 Application information. In addition to the application materials required in Chapter 19.65 FWRC or Chapter 19.70 FWRC, the applicant shall submit a completed application on the form provided by the department of community development department, along with all of the information listed on that form. Section 6. Severability. The provisions of this ordinance are declared separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the ordinance, or the validity of its application to any other persons or circumstances. Section 7. Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. E. ANALYSIS OF RECOMMENDATION Current Practice Cities that administer zoning regulations provide a mechanism to allow relief from those regulations when they cause an undue hardship or the inability for a property owner to build improvements that are typical for that property.The City of Federal Way administers this relief by way of a variance. The city may grant a variance if all of the following four criteria can be met: 1. That the variance will not constitute a grant of special privilege inconsistent with the limitations upon uses of other properties in the vicinity and zone in which the subject property is located. 2. That the variance is necessary because of special circumstances relating to the size, shape,topography, location or surroundings of the subject property to provide it with use rights and privileges permitted to other properties in the vicinity and zone in which the subject property is located. 3. That the granting of the variance will not be materially detrimental to the public welfare,or injurious to the property or improvements in the vicinity and zone in which the subject property is located. 4. That the special circumstances of the subject property are not the result of the actions of the owner of the subject property. The city's permitting database indicates that most variance applications have been associated with single-family residential improvements.Examples of variances that have been granted are instances related to lot coverage,' setbacks, lot size,and height. The current process to review variances is for staff to review the application and then provide an analysis and recommendation for approval or denial to the city's contracted Hearing Examiner.A public hearing is then scheduled where the Hearing Examiner presides and hears testimony. Following the hearing,the examiner is allowed 10-working days to issue a decision. Proposed Changes The purpose of this text amendment is to allow an administrative decision by the Community Development Director for variance applications that request up to 25 percent relief of code requirements.All variance applications that exceed the above-referenced thresholds would remain Hearing Examiner decisions.This text amendment does not propose to amend any substantive decision-making criteria. If approved as presented,the text amendment only changes the decision- maker for those applications that are below the aforementioned thresholds. 1 Lot coverage is the amount of impervious surfaces the are allowed on a property. Planning Commission Staff Report October 7,2015 Variance Procedures Text Amendment Page 2 The Community Development Department requested this item for Planning Commission consideration as a streamline and cost-saving measure.Processing time for applications that require a public hearing and Hearing Examiner decision is longer than administrative decisions,which are issued by the Community Development Director.This is due to additional noticing requirements, scheduling the public hearing with the Hearing Examiner,and the standard 10-working day allowance provided to the examiner to issue the decision following the hearing.Additionally,the cost for public hearings is considerable. Staff resources to review and provide a recommendation along with the g P g hourly rate and reimbursable for the Hearing Examiner to preside over the hearing and then issue a decision can exceed the permit fee the city takes in for a variance. The text amendment would allow an applicant to receive a decision on a variance application in a shorter time period with a cost savings to the city.Also,the proposal requires similar public notice requirements as the public hearing requires.The ability for citizens and neighbors to provide comments to the decision-maker for an administrative variance would remain under the proposed amendments.Existing public hearing and Hearing Examiner decision requirements would continue for significant variance requests(those over the thresholds)and any variance that is appealed. Providing a procedure for administrative variances is typical for local jurisdictions.As provided in the attached South King County City Comparison,five of the six surveyed cities provide administrative variances,with Renton and Burien processing all variances administratively. F. PROCEDURAL SUMMARY The proposed text amendment is a procedural amendment to the zoning and development code and therefore exempt from an environmental threshold determination pursuant to State Environmental Policy Act Rules 197-11-800(19)(a). Public notice of the Planning Commission hearing was published in the Federal Way Mirror and posted on the city designated bulletin boards September 18,2015.This staff report was issued on September 30,2015,and emailed to members of the Planning Commission and department stakeholders. G. BASIS FOR PLANNING COMMISSION ACTION FWRC Title 19, "Zoning and Development Code,"Chapter 19.80,"Process VI Review,"establishes a process and criteria for development regulation amendments.Consistent with Process VI review, the role of the Planning Commission is as follows: 1. Allowing such encroachments into the right-of-way would enhance the aesthetics of new development in the City and improve weather protection for citizens on public sidewalks. The proposed amendment will create a new right-of-way encroachment permit and permitting process for such encroachments. Options Considered: (1)Approve the proposed ordinance and forward to City Council for first reading; or (2)Decline to adopt the ordinance as proposed and provide direction to staff. AN ORDINANCE of the City of Federal Way, Washington, adding a new section to Chapter 4.25 FWRC relating to permits for encroachments into the public right-of-way. WHEREAS,the City of Federal Way regulates activities and uses in the public right-of-way in order to protect the use of the public right-of-way, regulate traffic, and promote public health, p p safety, and welfare; and WHEREAS, the Federal Way Revised Code does not currently allow for removable, nonpermanent additions to buildings to encroach into the right-of-way; and WHEREAS,allowing removable,nonpermanent additions to buildings,such as awnings and canopies,to encroach into the right-of-way would enhance the aesthetics of new development in the City; and WHEREAS,removable,nonpermanent additions to buildings that extend into the right-of- way improve the pedestrian experience by providing weather protection for citizens on public sidewalks; and WHEREAS,the City Council wishes to modify the regulation of the public right-of-way and finds it reasonable to permit removable, nonpermanent additions to buildings to encroach into the right-of-way under certain circumstances; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Chapter 4.25 of the Federal Way Revised Code is hereby amended to add a new section 4.25.105 to read as follows: Ordinance No. 15- Page 1 of 4 Rev 1/15 4.25.105 Encroachments into public right-of-way (1) The public works director, or designee, is authorized to issue a permit for removable., nonpermanent additions to buildings to encroach into the public right-of-way at the property owner's risk and subject to the following conditions: (a) The applicant shall file a completed application with the public works department on the form provided by the department. (b) With the application, the applicant shall submit the fee established by resolution of the City Council. The application shall not be accepted unless it is accompanied by the required fee. (c) Proper plans and specifications for the proposed encroachment are submitted to the public works department. (d) The encroachment complies with the applicable sections of the Federal Way Revised Code with regard to structural safety, traffic, sanitation, fire safety requirements, and any other criteria deemed necessary by the public works director or designee. (e) The request shall be evaluated by the public works director, or designee, in regard to any adverse effect on adjoining property. (f) There shall be no interference with the use of the public street for roadways sidewalk, existing or proposed utilities, and other authorized uses. (g) The applicant shall provide any information or material that the public works director, or designee, determines is reasonably necessary to evaluate the request. (h) The encroachment will be maintained in good order. (i) The encroachment must be removable so that when requested to do so by the public works director, designee, or other public authority having jurisdiction, the owner will remove the encroachment from the right-of-way at his or her expense. (j) No permanent encroachment into the right-of-way will be allowed under this section. (k) The permit shall be revocable for failure to comply with this chapter by the director of public works or designee. (1) The owner will hold the City of Federal Way and all its elected officials, officers, employees, agents, representatives, and volunteers harmless on account of the encroachment and will provide the City with a certificate of insurance for the encroachment into the right-of-way in an amount approved by the director of public works. (m)The requirements of this Section shall not supersede or act in lieu of permitting requirements under other Sections of the Code. Regardless of any review, approval, inspection, or other actions of the City, it is the responsibility of the applicant to ensure that all work, actions, or conditions on the subject property comply with this title, any permits or approvals granted under this title, and all other applicable laws or permits. Ordinance No. 15- Page 2 of 4 Rev 1/15 Section 2.The permit fee shall be set at the rate for the right-of-way use permit as prescribed in the City's Fee resolution. Section 3. Severability. Should any section,subsection,paragraph,sentence,clause,or phrase of this chapter, or its application to any person or situation, be declared unconstitutional or invalid for any reason,such decision shall not affect the validity of the remaining portions of this chapter or its application to any other person or situation. The City Council of the City of Federal Way hereby declares that it would have adopted this chapter and each section, subsection, sentence, clauses, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses,phrases, or portions be declared invalid or unconstitutional. Section 4. Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. Section 5.Ratification.Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. Section 6. Effective Date. This ordinance shall take effect and be in force thirty (30) days from and after its passage and publication, as provided by law.
