Approval of Minutes: April 4, 2016 Committee approved the April 4, 2016, LUTC minutes as presented. Moved: Koppang Seconded: Assefa-Dawson Passed: Unanimously, 3-0 S 320th St and Marine Hills Way Pipe Repairs -85% Design Update and Authorization to Bid Mr. Doucette provided background on this project noting due to significant rainfall in November; it exposed a blocked outlet pipe at the pond on the SW corner of S 320th Street and 1st Ave South. City staff inspected the outlet pipe and found significant blockage due to sediment and tree roots. A Cured-in-Place Pipe (OPP) repair project was added to Surface Water Capital Improvement Plan in January 2106. Then on S Marine Hills Way a sinkhole was found and repaired by the Surface Water Maintenance Crew. Deteriorated corrugated metal pipe was found to be the cause. This pipe repair was also included in the Marine Hills Conveyance Restoration Project. In March of this year, another sinkhole required emergency repair. Staff found deteriorated pipe to be the cause and to avoid risk of another sinkhole developing, staff aligned this project with the S 320th Street Project this year. Mr. Doucette summarized completed tasks, ongoing tasks, estimated project expenditures and available funding. Committee forwarded Option #1 as presented. Pacific Highway South HOV Lanes Phase V (S 340th St to S 359th St Project -100% Design Status Report and Authorization to Bid Mr. Mulkey stated this project will construct northbound and southbound HOV lanes on SR99 between S 340th Street and S 359th Street. This project will include access control along SR99 and also install a new traffic signal at S 344th Street and replace signals at S 340th Street and S 348th Street as well as include utility undergrounding and relocation, storm drainage, paving, curb, gutter, sidewalk, street lighting, signing, channelization, and landscaping. The project will improve aesthetics, traffic flow and reduce accidents by eliminating conflicts and to promote transit and carpool use. He outlined estimated expenditures and available funding sources. A brief discussion was held regarding estimated expenditures, parking restrictions, and condemnation. Moved: Assefa-Dawson Seconded: Koppang Passed: Unanimously, 3-0 Resolution: Setting a Public Hearing Date for the 2017-2022 Transportation Improvement Plan Mr. Perez informed the Committee that the City is required to adopt a Transportation Improvement Plan by July 1st of each year. Staff is proposing to have that on June 21, 2016. This resolution sets that public hearing date. Staff plans to present the draft transportation improvement plan on that first meeting in June. Moved: Ko ppang Seconded: Assefa-Dawson Passed: Unanimously, 3-0 Authorization to Apply for the King County Flood Control District Flood Reduction Grant Ms. Thurlow stated the Flood Reduction grant is awarded annually. This grant is targeted for small to medium flood reduction projects. She provided a few examples of the types of projects that could be addressed by the grant. The Marine Hills Conveyance System Stormwater grant meets all the qualifications. This project will repair deteriorated stormwater pipes and structures in the Marine Hills subdivision. Pipe condition has resulted in an increase in sinkhole development, asphalt repairs, and potential flooding risk in recent years. This grant would be in addition to the King County Flood Control District Sub-Regional Opportunity fund award that the City received last year. Staff proposes that if the grant is awarded, the funds be reallocated to the stormwater management unallocated funding for CIP for future flood control repair project. The City is also required to adopt a revised TIP and ASIP on an annual basis reflecting the City's current and future street and arterial needs. These plans identify capital projects that the City intends to construct over the next six years. In order to be eligible for grant funding, projects are required to be listed in the City's TIP. The City is required to hold a minimum of one public hearing on the revised plan, which is proposed for the June 21, 2016 Council meeting. Once the revised plans have been adopted by Resolution, a copy of the respective plans must be filed with the Washington State Secretary of Transportation and the Washington State Transportation Improvement Board. Attached for your review and comment are the proposed 2016-2022 TIP and ASIP (Exhibit A), a location map (Exhibit B), and a draft resolution for adoption (Exhibit C). The six-year TIP and ASIP respond to the Growth Management Act concurrency requirements as well as other emerging needs. Projects are selected based on criteria adopted in the City's Comprehensive Plan policy TP2.3, which reads, "Prioritize transportation projects considering concurrency, safety, multimodal enhancements, environmental impacts, and cost effectiveness." Each project was ranked using the scoring criteria established for Transportation TIP/CIP Prioritization. Staff also reviewed and analyzed available grant-eligible programs suitable for project programming. WHEREAS, pursuant to the requirements of Chapters 35.77 and 47.26 RCW, the Federal Way City Council adopted an original Transportation hnprovement Program (''TIP") on July 23, 1991 (Resolution No. 91-67); and WHEREAS, the Federal Way City Council updated a TIP annually thereafter; and WHEREAS, the Federal Way City Council held a public hearing on the revised TIP on June 21, 2016, in compliance with the requirements of State laws; and WHEREAS, the City Council has detennined current and future City street and arterial needs, and based upon thes~ findings has prepared a revised and extended TIP and an Arterial Street hnprovement Plan ("ASIP") for the ensuing six calendar years; and WHEREAS, pursuant to Chapters 35.77 and 47.26 RCW, the City Council is required annually to revise and adopt an extended TIP and ASIP; and WHEREAS, the City's SEP A Responsible Official has adopted the Determination of Non- Significance ("DNS"), Federal Way File 16-101835-00-SE, issued for the City's 2017-22 TIP and ASIP, which includes the extended and revised projects contained in the TIP adopted herein; and WHEREAS, adoption of the City's 2017-22 TIP and ASIP DNS reflects the fact that there Resolution No. 16-__ 11 Page 1 of3 Rev 1/15 will be no significant adverse environmental impacts as a result of adoption or implementation of the extended and revised TIP and ASIP adopted herein; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, RESOLVES AS FOLLOWS: Section 1. Program Adopted. The extended and revised Transportation hnprovement Program and Arterial Street Improvement Plan for the City of Federal Way, a copy of which is attached hereto as Exhibit A and incorporated herein by this reference, which sets forth the City's transportation project locations, types of improvements, and the estimated costs thereof, is hereby approved and adopted for the ensuing six (6) calendar years (2017-22 inclusive). If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this resolution. Section 4. Corrections. The City Clerk and the codifiers of this resolution are authorized to make necessary corrections to this resolution including, but not limited to, the correction of scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any references thereto. The property is located in the Spring Valley along the North Fork of West Hylebos Creek with approximately 130 feet of the Creek crossing the property. The 2.0 acre site is immediately south of the former Bridges Property and former Enticknap Property, both now owned by the City. The City's plan for the property is to demolish and remove all structures onsite, including removing the septic tank, two underground fuel storage tanks (one cooking oil tank and one diesel fuel tank), existing well and pump house. There are six buildings on the property in various stages of decay, including the single family farm house, two sheds, a cistern house, barn and pump house, and at least two of the structures have already partially collapsed. The City completed a Hazardous Building Materials Survey in March of this year to identify asbestos containing materials, lead paint and PCBs in lighting fixtures. The survey also inspected for signs of mold and water damage and collected samples from areas of obvious mold growth. The estimated demolition expenditures below include abatement of hazardous materials. Following demolition and separate from this project, SWM will work with volunteers and non-profit groups to establish native plantings and restore the site. The ultimate goal is to tum the property into a trailhead as part of a trail system in the Spring Valley similar to the West Hylebos Wetlands Park. SWM staff are aware the single family house has some historical significance, however the current condition and anticipated renovation and restoration costs would be prohibitive. The City reached out to the Historical Society of Federal Way and provided a tour of the property, after which the Historical Society wrote a letter recommending future signage to highlight the history of the Spring Valley at the future trailhead. CPPs are broad policies that King County and the local jurisdictions within King County are expected to comply with. On March 14, 2016, the Metropolitan King County Council adopted Ordinance 18256, which approved and ratified the amendments on behalf of unincorporated King County. Amendments to the CPPs become effective when ratified by at least 30% of the city and county governments representing 70% of the population of King County. A city is deemed to have ratified the amendments if it either sends a letter in support of the amendments or does nothing. If a city opposes the amendments, it must take legislative action (typically adoption of a resolution) within 90 days of adoption by King County. The 90-day deadline for responding on this proposed amendment is June '25, 2015. The ordinance amends CPP H-8 as shown below (new language shown underlined): "H-8 Tailor housing policies and strategies to local needs, conditions and opportunities, recognizing the unique strengths and challenges of different cities and sub regions. Jurisdictions may consider a full range of programs. from optional to mandatmy. that will assist in meeting the jurisdiction 's share of the countywide need for affordable housing." ANALYSIS OF AMENDED POLICY This is an improvement to CPP H-8 from the city's perspective. The new policy recognizes the unique circumstances of each city and allows local decision makers to determine how best to address the issue of affordable housing. The following paraphrased language from King County's staff report on this issue summarizes the effect . of the amended policy: The proposed ordinance would amend policy H-8 in the King County Countywide Planning Policies (CPPs) to more clearly state the existing range of programs, from optional to mandatory, available for jurisdictions to consider using to address affordable housing needs. WHEREAS, The Qrowt:h Management Planning Council (GMPC) developed polic~es for the Countywide Planning .Policies (CP~s) that revised the method.for defining· housing need 'in the county and for allocating responsibility among jurisdictions to identify and address local housing needs; and 1 • WHEREAS, recent, -rapid growth in the county has exacerbated the shortage of affordable -housing; and . . . There have been no proposals to change the countywide approach since its adoption. GMPC action On November 6, 2015, the GMPC adopted Motion 15-2, which is a non-binding recommendation to the County Council to adopt an amendment to policy H-8. Consistent with cpp· adoption requirements, Proposed Ordinance 2016-0101 forwards this GMPC recommendation to the County Council for considerat ion and poss i~l.e approva l. If adopted by the Council, the ordinance would ra ti fy the change on behalf of the population of unincorporated King County and begin the. ratification process by the cities.
