We appreciate your patience as staff researched and finalized a response. Description of Proposal You have asked for zoning information in order to establish an equipment rental business at the above referenced address. As described in your letter and clarified by phone, your business includes rental of storage containers, fencing, and portable toilets for off site use, generally at construction sites. Fabrication and assembly of fencing panels, including welding. activities, will take place within the existing enclosed shop structure. The rental items will be stored permanently out of doors, adjacent to the building and also within the existing large gravel parking area on the eastern portion of the site. Approximately eleven (11) company trucks will be used to transport the rental items to and from off site locations. These trucks will also be parked in the gravel parking area adjacent to equipment storage. Approximately 30 employees will park on the existing asphalt parking area adjacent to the office. You indicated that no exterior site improvements or alterations are anticipated at this time, with the exception of painting the building(s). You also indicated by telephone that you have not determined whether or not the accessory structures would be retained. No preliminary site plan was submitted with the zoning request. Existing Development and Improvements The subject site is comprised of 2.18 acres on two adjoining tax lots and is currently occupied by Lloyd Enterprises, Inc. Based on a site visit by staff, and discussion with Bob Cooper, of Lloyd's, the existing site improvements include a 4,500 square foot shop, 1,900 square foot office, paved parking area for customers and employees, and large exterior gravel parking area on the easterly portion of the site. A number of detached accessory structures are also located behind and adjacent to the office building, including a fueling station, two storage containers and a trailer. Current use of the site includes large amounts of exterior storage of construction- related items, located throughout the site. Site operation, including number of employees and hours of operation, is consistent with the proposed use. Also FILE • Lori Michaelson Page 2 July 23, 2002 40 according to Mr. Cooper, the existing development was approved by King County in 1979, with no major site changes made since that time. Zoning Analysis and Conclusions The current comprehensive plan and zoning designation for the site is Business Park (BP). As you have described it, the proposed rental business is permitted in this district pursuant to FWCC 22 -864, Rental Facilities (enclosed). Also, based on yours and Mr. Cooper's descriptions, the rental business does not constitute a change of use as defined by City code'. In addition, although many aspects of the existing development are nonconforming under current code regulations and standards, these are legal nonconformances and may continue unchanged, unless a particular threshold is exceeded under FWCC Article IV, Nonconformance (enclosed). As noted above, the proposal as described would not trigger the change of use nonconformance threshold. It also does not appear to exceed thresholds related to abandonment, gross floor area expansion 2, cessation of existing use, or cost -to -value ratio. However, although none of nonconformances thresholds appear to apply to the current proposal, as a potential property owner, you should familiarize yourself with the Nonconformance chapter for a clear understanding of when and under what circumstances nonconforming aspects of the development must be corrected. Also, as discussed by telephone, the site is subject to correction of an existing water quality violation previously issued by the City. Lloyd's has submitted a land use application for a storm water drainage retrofit and stream buffer planting plan in order to remediate this violation. This application is subject to environmental review; Process IV hearing examiner's approval; and all related conditions of approval and engineering design standards. Unless and until this or other approval is granted by the City and which corrects the violation, the violation remains active and must be corrected by the current or future property owner to avoid applicable penalties. This letter is to inquire about the zoning to ensure that all actives of National Construction Rental will be permitted with in the current zoning. Hours of Operation: 6:00 AM to 6:00 PM Required Parking: 30 Traffic Generation: Customers do not come to our location so traffic would be limited to employee's (30) and Company Trucks (11). Activities include storage of our rental products, which consist of storage containers, fencing and portable toilets. We also need to be able to weld. My understanding of the land use by LLOYD Enterprises is that they generated more traffic than we would, with a higher volume of employee's. They used the property to store trucks and perform maintenance, including welding.
