This is in response to your April 23, 2003, letter regarding the addition of one -man rocks to an
existing rockery bulkhead, or revetment, located along the shoreline of Lake Easter. The
additional rocks are intended to rebuild the existing revetment to its original condition. Your
letter inquired about the required land use permits to add the additional rocks. The following will
provide you with a response to your inquiry. For reference, pursuant to the Federal Way City
Code (FWCC), Lake Easter is considered a regulated lake. Development activities within or near
regulated lakes are subject to the requirements specified in FWCC Chapter 22, Article XIV,
Division 6 (enclosed).
Pursuant to FWCC 22 -1336 (enclosed), the land use process to reconstruct the Lake Easter
Estates revetment (as proposed) is a Process III Project Approval.' Your proposal would also be
required to undergo State Environmental Policy Act (SEPA) environmental review.2 Prior to
submitting any formal applications for your proposed project, you would need to participate in a
preapplication conference. Please refer to the enclosed handout on the preapplication conference
submittal requirements.
An alternative to reconstructing the above bulkhead and avoiding a Process III land use
application is to rehabilitate the Lake Easter shoreline. This process would involve
deconstructing/removing the existing revetment around the subject area and rehabilitating the
lake shoreline with native, erosion - protecting vegetation.3 Lake rehabilitation can be processed as
an Administrative Decision (AD). There is no fee for an AD. However, the removal of the
existing bulkhead and the revegetation of the shoreline would require SEPA environmental
review. The fee for a non - project related environmental review is $1,486.00 (plus an additional
$125 noticing fee). I have enclosed a copy of a SEPA environmental checklist that would need to
be completed as part of the environmental review.

In order to undertake lake rehabilitation, you would need to submit a letter to the Community
Development Services Director (Kathy McClung), requesting permission to rehabilitate the Lake
Easter shoreline. A rehabilitation plan, subject to City approval and prepared by a qualified
professional, would need to accompany the rehabilitation request. A completed SEPA application
would also need to accompany your request to rehabilitate the Lake Easter shoreline.

Question: Do we need a permit to do the following?
The rockery was placed on the shoreline of Lake Faster 20 plus years ago. Over
the past years some of the rocks on the South side of lake have slipped /fallen into
the water. What we want to do is to replace the rocks that have fallen and to
return the rockery to its original state.
Enclosed is a picture that shows the area that we want to work on.
The process that we would use is as follows: the rocks would be the size that is
know as "one man rocks" meaning that we would not have any heavy equipment
doing the work. We are not using cement, sand or other substance to secure the
rocks. We are placing the rocks one on top of another. The maximum height
would be approximately 3 feet as was the original bulkhead.
The work would not be done until August or September when the Lake is at a low
level.
