Box 9718 Federal Way, WA 96063 -9718 Re: Park at Dashpoint; File # 05- 102206- 000- 00 -AD; Request to Abandon Swimming Pool Dear Mr. Fewins, As discussed, please accept this request to abandon one swimming pool, one spa and one wader as shown on the attached plan. The immediate proximity of the daycare building, (separated only from the water features by a wrought iron fence) became a serious concern to FIRE Properties earlier this year. As a result we had the features immediately drained as a safety procedure. These features still pose some accident risk therefore the area is always locked as a further safety measure. In its current condition this area is unsightly and unusable to the residents and they will benefit greatly once it is converted to a useable landscaped area. In accordance with your requirement for compliance to FWCC Section 22 -667, Note #2, we are now proposing to remove the patio surrounding the pool, spa, and wader up to the existing "covered porch area" at the daycare building and to return this area to a natural "park like" setting with a small meandering path connecting the existing path from the street in front of the daycare with the path running immediately behind the daycare building. Upon receipt of your approval for this maintenance and restoration plan, I will prepare a detailed specification for abandoning the pool and a landscape plan showing intended restoration for your approval. Your letter describes a proposal to fill an existing swimming pool, hot tub, and wading pool at the above referenced location. The filled pool areas would then be capped with an aggregate patio surface. I would consider this type of project to be maintenance, and therefore exempt from the need for land use approval pursuant to Federal Way City Code (FWCC) Section 22- 32(2). In addition, I have verified with the building and engineering divisions that no building permit is required for the work and the proposal does not trigger surface water requirements, since there is no expansion of impervious surface. However, before you proceed with this project, there is one issue that must be addressed to avoid creating a new or additional nonconformance as prohibited by FWCC Section 22 -340. FWCC Section 22 -667, Note #2, requires that at least 400 square feet of common recreational open space in a usable form for many activities be provided per each dwelling unit within multiple family development projects. At least ten percent of this required open space must be developed and maintained with children's play equipment. I would consider the existing pool areas to meet part of the overall open space requirement and some, or all, of the children's play equipment requirement, depending on the amount of play area required in relationship to the amount of play area provided. Although I would consider the proposed patio area to continue to meet overall open space requirements, I would not consider a patio surface by itself to qualify as area meeting the children's play equipment requirement. If the complex does not currently provide children's play equipment areas in the amount prescribed by code, the site would be considered nonconforming. Therefore, removal of the pool areas would potentially increase this nonconformance on the site. If this is a problem, a potential solution is to replace the lost area with new children's play equipment in an equivalent amount. File M05- 102206. 000-00 -IA DDc. I.D. 31637 0 Mr. Paul Norem Page 2 May 12, 2005 CJ Before you start work on this project, I would encourage you to determine the site's conformance with this open space and recreational requirement. Failure to do so could result in a code violation and enforcement action by the City. I would be happy to work with you to verify the open space and play area requirements. Information that is needed to address this issue includes: 1) total number of existing dwelling units; 2) amount of required open space; 3) amount of required children's play equipment area; and 4) amount of open space and children's play equipment currently existing on site. From this information, we can then determine if the site is in conformance or if additional children's play equipment must be provided in conjunction with decommissioning the pool areas.
