Dear Mr. Principe:
This letter responds to your request to remove a swimming pool, spa, and wader from the Park at
Dash Point Apartment Complex and replace those amenities with landscaped open space. As
noted in your request letter, Federal Way City Code (FWCC) Section 22 -667, note 2, requires a
minimum of 400 square feet of common open space per dwelling unit.
Given your safety concerns regarding proximity of the water features to the day care building,
removal of these features seems prudent. Provided you replace these features with useable common
open space, as you have proposed, the City does not object to removal of the water features.
Please provide the City with a conceptual drawing of the proposed improvements so we can
verify that required open space on the site is maintained. Once we have approved your plan, you
may proceed with the project. Alternately, if you would prefer to proceed without an informal
review by the City, you may complete the project and then contact me for an inspection. My
inspection will be limited to confirming that the area has been converted to a usable open space
area. In either case, no permits are required for the actions you have described.
