Dear Ms. Bratlie:
The City of Federal Way is in receipt of your October 31, 2006 letter. The current building, which was
built in 1987, is likely legally nonconforming. Pursuant to Federal Way City Code (FWCC) Chapter 22,
Article IV "Nonconformance," normal maintenance or repairs may be done to the establishment, per
FWCC Section 22 -334.
FWCC Section 22 -342 establishes special provisions for reconstruction of a nonconforming improvement
that is destroyed or damaged. If a nonconforming improvement is damaged by sudden accidental cause, it
may be reconstructed if the cost of reconstruction does not exceed 75 percent of the assessed or appraised
value of that improvement before the damage. The reconstructed improvement may not be any more
nonconforming than it was immediately before the damage. The applicant must also apply for a building
permit to reconstruct the damaged improvement within six months of the date of the damage, and
reconstruct the improvement pursuant to that building permit.
