We are in receipt of your November 28, 2005, letter request for a rebuild letter for the property located at
3516 SW 339"h Place, Federal Way.
Pursuant to FWCC Section 22 -338 "Special provisions for residential uses," if the subject property
contains a residential use that became nonconforming as to use or density as a result of the adoption of the
FWCC, then the structure may be rebuilt if the following conditions are followed (enclosed):
1. No additional dwelling units are created during the rebuilding process.
2. The gross floor area in and on the subject property may not be increased from which existed
immediately prior to the damage or destruction.
3. No new nonconformities are created during rebuilding process.
4. Previous provisions are only available if applicant applies for a building permit within 12 months
after the sudden damage. or destruction and construction is commenced and completed under that
permit.
