In researching the proposal, staff identified that under the ADA, Subpart B of the General Requirements, Part 35, Section 130, Paragraph (b)(7), public entities may make reasonable modifications in policies, practices, or procedures where necessary to avoid discrimination on the basis of disability. A letter dated November 8, 2006 from Amos Shirman, MD PLLC, documenting the need for Ms. Gravitt's wheelchair lift was submitted to the City on November 21, 2006. It has been determined that the proposed vertical platform lift and associated porch and staircase which would intrude approximately four feet into the 20 -foot front yard setback area, will allow for reasonable accommodation in order for Ms. Gravitt to fully enjoy the rights and privileges of her property. Furthermore, the City has determined that the proposed vertical platform lift and associated porch and staircase 20 -foot attached garage addition will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the subject property is located. Final plans for the vertical platform lift and associated porch and staircase shall be designed so that the proposed improvements create the minimum necessary encroachment into the 20 -foot front yard setback area. When the proposed improvements are no longer necessary, the improvements into the 20 -foot front yard setback shall be removed or modified to comply with the required setbacks. Based on this decision, it is not necessary to process and obtain a variance for the proposed intrusion. Instead, you are only required to obtain a building and electrical permit from the City for the proposed construction. Contact the Development Services counter at 253- 835 -2607 regarding submittal requirements for building and electrical permits. Under Dutton, The City granted a Reasonable Accomodation. It seems this would be an appropriate route, but l would need to read up on what the ADA allows, and see if the same process and exemption applies as did a few years ago. The modification to the existing entryway would include the following: 1. Expanding the deck surface, in front of the entry door, to accommodate a wheelchair. 2. Install an exterior vertical platform lift to allow access to the residence. 3. Install new stairs to allow access to the residence for persons without disabilities. 4. Widen existing walkway to accommodate a wheelchair. Our client had initially contracted us to build a wheelchair ramp to allow access to her residence from the street. Upon further evaluation it was determined that a ramp would be unpractical due to the length of the run of the ramp. This is a mid -level entry residence which has elevation difference, from street to finished floor, of approximately 60 " -65 ". To meet ADA code requirements the ramp would need to be almost 90 feet in length and would take up the entire front yard. Our proposal provides the least amount of intrusion to the neighborhood while providing adequate access for our client. In addition, it minimizes the amount of encroachment into the designated setbacks. Attached you will find copies of the specifications for the vertical platform lift, vertical platform lift installation manual, an overhead view showing the location of property, a ramp configuration sketch, vw r ►1A and a vertical platform lift sketch.
