Dear Hai jinder Atwal:
The City of Federal Way received a letter from you inquiring about what is required for you to establish a
drive - through espresso on the south side of the convenience store. The site is located at 28806 Pacific
Highway South and is developed with a Shell gas station and convenience store. I am enclosing the chart
for the BC zone.
I have reviewed your proposal to see what is required by the Federal Way City Code (FWCC). The
required review process is Process II. (The Process II checklist is enclosed.) You must turn in a site plan
of the existing conditions, a site plan of the proposal, building elevations of the proposal, photographs of
the site, and a landscape plan (if the landscaping is going to change significantly). The site plan must
accurately depict the property lines and exact location of structures on the site.
Zoning and Use Classification. The site is located in a Community Business (BC) Zone. The primary
use of the site would fall into the category of "vehicle service station or car wash" per the zoning
chart in FWCC 22 -754. A drive- through espresso window would fall into the category of "fast food
restaurant' per the zoning chart in FWCC 22 -753. The drive - through proposal is subject to Process
II, Site Plan Approval.
2. Process. A master land use application form and a Process II handout are enclosed. There is no
public notice for Process II. The Director of Community Development Services will.make the land
use decision. The decision may be appealed to the Hearing Examiner.
3. Fees. The 2006 fee for land use Process His $1,824. This includes review by the Planning Division,
Public Works Department, and Fire Department. The building permit fee is separate.
4. Nonconformance. Your site is nonconforming, at least in regard to landscaping. However, it does not
appear that your proposed espresso window triggers improvements due to nonconforming
development, per FWCC 22 -334.
Landscaping. In the BC zone, a five- foot -wide strip of Type III landscaping (trees, shrubs, and
groundcover) would normally be required along the right -of -way and along all perimeter lot lines.
However, as mentioned, you are not required to install these landscaping strips, since your proposal
is not enough to trigger significant improvements, per the nonconformance article of the code.

6. Traffic Flow. Access to and from the drive - through facility must be approved by the Public Works
Department. I have checked with Maryanne Zukowski, a traffic engineer in the Public Works
Department, to see what that department will require. You must submit a Traffic Impact Analysis
(TIA) which addresses circulation, queuing, and PM peak hour trips. If you have questions about
traffic issues, please contact Maryanne Zukowski at 253- 835 -2742.
7. Parking Count. You must provide parking calculations on the site plan. Pursuant to the development
regulations of FWCC 22 -753, fast food restaurants require one parking space for each 80 square feet
of building. This would apply to the portion of the building dedicated to espresso service. For the
main portion of the building, which is considered vehicle service station, the zoning chart in FWCC
22 -754 states that the required number of parking spaces is determined on a case -by -case basis.
Therefore, you will need to submit a parking study prepared by a traffic engineer, in order to
determine the overall parking needs for the site and proposal, and to determine if the site is currently
conforming or nonconforming in regard to parking standards. If you have questions about preparing
a parking study, please contact Maryanne Zukowski at 253- 835 -2742.
8. Accessible Parking Spaces. If not already provided on the site, one handicap accessible space is
required by the International Building Code. Please refer to the enclosed requirements for handicap
accessible parking spaces.
9. Community Design Guidelines. Your site is subject to FWCC Chapter 22, Article XIX, Community
Design Guidelines. However, the Code states, "Subject applications for remodeling or expansion of
existing developments shall meet only those provisions of this article that are determined by the
Director to be reasonably related and applicable to the area of expansion or remodeling." [FWCC 22-
1632.]
10. Building Design. Please provide elevation drawings of all four sides of the building, as well as a
floor plan that clearly indicates the floor area which is devoted to the espresso service. Please keep in
mind that the Community Design Guidelines (FWCC Section 22, Article XIX) state, "Project
designers shall strive for overall design continuity by using similar elements throughout the project
such as architectural style and features, materials, colors, and textures." Please provide color
photographs of the existing site, including all four sides of the building.
In addition to the items mentioned above, please make sure that all required zoning information and
dimensions are provided on the plans you submit. Please submit six full -size sets of the plans and four
sets reduced to 11 x 17 inches.

I am writing to you to request for your approval of a new proposal concerning the
amenities of the premises. I would like to establish a drive through espresso services on
the south side of the convenience store. I have enclosed a map illustrating the layout of
the convenience store; pump islands, three entrance /exits and the dimensions of the
premises. Entrance would be from the 288th street entrance /exit, and the proposed
arrangement would be that customers would drive around the back of the convenience
store building going south, and after utilizing the service, exit on to Pacific Hwy S.
I am grateful for your time and effort in considering this proposal and if successful may
you inform me of the details that are required to process the planning of the espresso
service.
