Specifically, you propose to establish a business that molds and packages chocolate for retail and wholesale purchase in the vacant 11,000 square foot Rite Aid building. You propose to devote three- quarters of the proposed business to retail sales of the product. The Lake Crest Shopping Center is located in a Neighborhood Business (BN) zoning district. Permitted uses include a variety of retail and office uses under Federal Way City Code (FWCC) Section 22 -721, Office /Retail. FWCC section 22 -721, note #2 states The assembly or manufacture of goods on the subject property is permitted only if.• a. The assembly or manufacture is clearly secondary to an allowed use conducted on the subject property and is directly related to and dependent on this allowed use; and b. The assembled or manufactured goods are available for purchase and removal from the subject property and are for sale only to retail purchasers; and C. There are no outward appearance or impacts from the assembly or manufacture.. Based on a review of the code standards and the business as outlined in your letter, the proposed use is permitted within the BN zone as the manufacturing activity will be secondary to, directly related to, and dependent on the retail sales use. You indicated that retail sales comprise three /quarters of the business sales. In addition, there would be no outward appearance or impacts from the assembly or manufacturing processes as there are no changes to the existing building fagade or structure proposed. Please be advised that limited wholesaling can only be allowed as an incidental portion of the retail sales. Wholesale activity beyond that stated in the letter will not be permitted. Gosanko Chocolate Art is one of the most innocuous, low profile, and pleasant businesses that any neighborhood would be delighted to have. We do not pollute with noise, fumes, or materials. 10002 `j� Essentially, we take delivery of chocolate in 10 -pound blocks. The chocolate is received in shipments via truck once per month on average. We then melt chocolate, pour the liquid form into our molds, and package for retail and wholesale. We are not unlike a donut shop or bakery that makes product on site, and because of this, we are approved for zoning in a Neighborhood Convenience Commercial District (NCC) at our present location of five years. We currently utilize approximately 2,000 to 3,000 square feet devoted to retail sales.
