Stream Channel Maintenance for Bingaman Creek, 3001 S. 288'h Street, Federal Way
Dear Ms. Ficken:
I am responding in writing to your September 25, 2008, request to perform ongoing maintenance of the
stream channel of Bingaman Creek. I conducted a site visit some time ago and, with the guidance of your
maintenance supervisor, was able to identify the location and length of the creek channel that runs
through the west side of your property. At that time, the weed removal had already been completed for the
year.
Although you weren't specific in your letter as to what the maintenance activity would consist of, I have
reviewed the letter sent to you by the City of Federal Way Surface Water Management Division on May
30, 2008. This letter identifies potential work the City would recommend, such as:
• Annual removal and treatment of invasive species, particularly of cattails and blackberry
brambles to eradicate them; and,
• Planting willow, and other shrubs or plants that are appropriate for a stream bank to shade and
crowd out the invasive species and help assure water flow through the channel on an ongoing basis;
and,
• Keeping woody debris, waste asphalt, soils, or other debris materials outside of the stream and
stream buffer area.
The Director of Community Development Services may permit rehabilitation of a stream by requiring
removal of non - native vegetation, and planting plans as necessary pursuant to Federal Way Revised Code
(FWRC) 19.165.060 "Rehabilitation." Your letter demonstrates that if properly conditioned, the task of
ongoing maintenance proposed to remove the invasive weeds and install native vegetation within the
channel of Bingaman Creek would meet the rehabilitation standards of the Revised Code.
Work proposed in your September 25, 2008 request, is hereby conditionally approved. This approval is
for the annual maintenance and removal of invasive species as identified above. The approval includes the
following conditions:

1. All removal of invasive species andlor planting of additional vegetation within the stream
channel or its buffer shall be done by hand unless an alternate method is approved by the
Department.
2. No dumping, stockpiling, or disposal of waste materials such as asphalt, soils, yard waste
or other waste materials shall be allowed within the stream channel or its buffer area.
3. If a planting plan is being proposed as part of the annual maintenance for the removal of
invasive species as recommended by Surface Water Management to eradicate the impact
of invasive species vegetation within the stream channel; then a copy of a planting plan,
shall be submitted to the Department of Community Development Services for review
and approved before the next scheduled maintenance project takes place.
The tasks listed above are considered maintenance and are, therefore, exempt from environmental review
under the State Environmental Policy Act (SEPA) pursuant to WAC 197 -11- 800(3).
This approval is for the on -going maintenance of the Bingaman Creek channel for the removal of invasive
vegetative species. This administrative approval does not exempt you from responsibility to perform other
tasks or obtain other permits required by other jurisdictions such.as the State Department of Fish and
Wildlife or the US Army Corps of Engineers to perform work within the channel bed of Bingaman Creek.

Dear Mr. Conlen:
I am writing to you as the General Manager of Camelot Square to confirm what we need to do to
clear and maintain the creek channel on our property.
In our meeting with the Department of Fish and Wildlife, they indicated that we do not appear to
need a permit rather they suggested we should remove vegetation and possibly cut some of the
high spots in the channel so as not to impede flow. We will follow their suggestion and are
obtaining a pamphlet permit from them to do the work. We will be removing invasive species and
possibly removing some high spots. All work will be with hand tools.
Attached is a letter from Paul Bucich, Federal Way Surface Water Manager which addresses
these issues and suggests what we and the city need to do.
If you have questions or additional concerns before you can issue your approval, please advise
me immediately.

Drainage Improvement Recommendations
Dear Ms. Ficken,
The purpose of this letter is to respond to your request for recommendations to improve the surface water
drainage system within your facility. Per your request, on March 12, city Surface Water Management Division
staff reviewed the drainage system through Camelot Square Park. I've listed a summary of work completed to
date and prepared the following recommendations and requests as discussed below.
I. Work by city, staff:
A. Removed a section of 24" diameter concrete pipe and related rock weir located on city Right of Way
immediately east of Military Road South culvert crossing which was causing sediment to accumulate
in the upstream culvert.
B. Reviewed available construction asbuilt plans for the Military Road South culvert, Camelot Square
drainage system, and the Interstate 5 W SDOT siphon culvert located near S. 288th Street to verify that
other than recommending that accumulated sediments be removed from approximately 2,170 linear
feet of channel throughout the park, no other conveyance improvements are warranted at this time.
Note that we have requested WSDOT staff to remove a minor quantity of rock spalls from the channel
downstream of the park to slightly improve flow capacity.
C. The channel dredging work would need to include removal and ongoing treatment of invasive species,
particularly cattails and blackberries, to eradicate them Note that these species restrict the flow
capacity and contribute to sediment accumulations within the channel. We recommend that native
plantings, including Willow and other trees and various shrubs, be installed to shade and crowd out
the invasive species, reduce harmful peak stream water temperatures, and improve stream corridor
aesthetics.
D. City staff will forward public education materials and city code requirements to you so you can inform
tenants and maintenance staff of environmental issues and regulatory requirements.
E. We have researched permitting requirements to verify that the city, state, and federal permit
requirements noted below will likely be required for work to remove accumulated sediments from the
channel through the park. Whoever designs this work will need to verify permit requirements.
1. City of Federal Way permits:
A Department of Community Development "AD" approval would be required for "stream
restoration" work to remove invasive species and install native plantings. Per my recent
discussions with the city's Director of CommunityDevelopment, based on the assumption that the
constructed channel through the park was designed to be regularly dredged as the original design
indicates, no further city permits would be required.

2. State permits:
a. Washington Dept. of Fish & Wildlife, Hydraulic Project Approval (HPA) is required to
perform work within waters of the state. Please contact Larry Fisher, the local WDFW
Habitat Manager, at 425- 313 -5683 for further information.
b. A Washington Dept. of Ecology, 401 Clean Water Act Permit might be required to perform
the dredging work. Please contact the state office at 425- 649 -7000 for further information.
Federal permits:
a. An Army Corps of Engineers, individual 404 Permit might not be required for the portion of
dredging work within the large wetland located northwesterly of the park depending on
whether the applicant can show that no excavated material will fall back into the channel
during dredging work. This can usually be done by specifying that water must be slowly
drained from the bucket before lifting it all the way out of the water and the bucket is covered
via a hood that drops down prior to lifting. Please note that if a 404 permit is required, and if a
naturally occurring fish blockage can be documented downstream of the site (where the
stream drops down into the Auburn valley), no time consuming notification to federal
authorities would be required.
b. An Army Corps of Engineers Nationwide No. 27 permit would likely be required to remove
accumulated sediments from the channel to provide "Aquatic Habitat Restoration ".
c. A National Pollutant Discharge Elimination System small construction site permit would not
be required if less than one acre is disturbed by the project.
F. City staff contacted WSDOT Area 4 Maintenance Supervisor Phil Kelleher at (253)372 -5681 to
confirm that Lead Tech Andre Williams has been assigned responsibility to maintain the channel and
the debris grate located on the south side of S. 288th Street. Please note that Mr. Kelleher expressed
concern that in the past, large amounts of trash, sediment and woody debris flowing out of Camelot
Square clogging the WSDOT channel and siphon culvert debris grate. Additionally, the city requested
WSDOT crews to remove the old silt fence and any accumulated sediment leftover from past sound
wall construction work, to ensure that the channel is maintained at the "design" grade. Please contact
WSDOT staff directly to notify them if any future stream charmel maintenance work is required within
WSDOT Right of Way. Please contact the city's Surface Water Maintenance Supervisor at (253) 835-
2755 if you are not able to resolve any issues with WSDOT staff.
II. Work recommended and/or requested to be performed by Camelot Square staff:
A. We recommend that the park either raise the grade of the roadway sag at "Sir Gaheris" street which
regularly floods and modify the inadequate drainage system or follow your previous consultant's
recommendations to install an adequate pump station.
Note that if the existing 8 -inch diameter drainage system is modified, city codes would require the
design to be prepared by a licensed engineer, that a SEPA application be processed, and that a city
development permit would be obtained. A permit would also be required from the Washington
Department offish and Wildlife and potentially the Army Corp ofEngineers and other agencies if the
existing 8 -inch pipe which outfalls into the creek is replaced. Note that it might saveyou considerable
permitting effort if the outfall portion of the existing outfall pipe was retained to avoid the need to
work within the stream. You could potentially also leave the existing drainage system as -is and simply
place a 12 -inch or taller riser on each of the two existing catch basins, depending on your available

budget, to allow the roadway to be raised using asphalt fill. The adjacent driveways would need to be
raised to match the raised roadway and possibly a sump pump or drain line might need to be installed
below the adjacent trailers if they were not raised.
B. We request that park maintenance staff modify their use of the stream buffer area for disposal of
woody debris materials to keep materials further from the stream to minimize the amount of material
that gets into the stream and clogs the channel resulting in additional flooding within Camelot Square.
Please also ensure that no waste asphalt, soils, or other material is placed adjacent to the stream since
this activity would violate state and federal laws.
C. During our site review, city staff verified that the easterly section of stream channel adjacent to
Interstate 5 was littered with trash. (Consisting of items such as lawnmowers, used carpet, bicycles
and garbage.) We appreciate that your staff have promptly removed the majority ofthe large items of
trash. Surface Water Management requests that Camelot Square remove any ruining trash from the
channel and document efforts to implement/enforce a requirement prohibiting tenants from placing
trash or other materials within the channel within (60) calendar days of the date of this letter. Please
note that failure to comply with Ordinance #99 -352 of the city's stormwater management code could
result in issuance of a citation for any future violation. Please notify our Surface Water Quality
Program Coordinator, Dan Smith, at (253) 835 -2756 when the site cleanup has been completed.
D. City staff verified that the stream channel downstream of the Camelot Drive crossing has been filled
with broken asphalt, soil and other fill material to within a few inches from the top of the 42" culvert.
Surface Water Management requests that Camelot Square remove rubble fill and soil materials from
the stream channel as soon as permits can be obtained. At a minimum; please remove materials within
ten feet downstream of the culvert. Please note that failure to comply with Ordinance #99 -352 of the
city's stormwater management code could result in issuance of a citation for any future violation.
Please notify our Surface Water Quality Program Coordinator, Dan Smith, at (253) 835 -2756 when
the site cleanup has been completed.

(253) 835 -2700 if you have any questions.
