Dear Ms. Morales:
This letter is to inform you that the Department of Community Development Services has determined that the
Americans with Disabilities Act(ADA)ramp described and depicted in your June 11, 2010, submittal is
permissible under the reasonable modification provisions of the ADA. In researching the proposal, staff
identified that under the ADA, Subpart B of the General Requirements,Part 35, Section 130, Paragraph(b)(7),
public entities may make reasonable modifications in policies,practices, or procedures where necessary to
avoid discrimination on the basis of disability.
Due to the steepness of the driveway, your state Adult Family Home licensor has required that a wheelchair
accessible ramp be installed from the street edge to allow ADA access to the property. It has been determined
that the ramp with handrails,which extends through the entirety of the 20-foot front yard setback area,will
allow for reasonable accommodation in order for residents of the Adult Family Home to access the property. It
has been determined that the proposed improvements create the minimum necessary encroachment into the 20-
foot front yard setback area. Furthermore,the City has determined that the proposed ramp will not be
materially detrimental to the public welfare, or injurious to the property or improvements in the vicinity and
zone in which the subject property is located.
When the proposed improvements are no longer necessary, the improvements into the 20-foot front yard
setback shall be removed or modified to comply with the required setbacks.
Based on this decision,it is not necessary to process and obtain a variance for this intrusion. The City's
Building Division has determined that you are not required to obtain a building permit for the proposed
