Rollo 30918 - 37th Place SW Federal Way, WA 98023 Re: NOTICE OF INCOMPLETE APPLICATION-Bayview Country Estates Lot 56 Appeal of Director's Decision Regarding Geologically Hazardous Areas File Number UP499-0005 Dear Mr. Rollo: On May 20, 1999, the city received the above referenced appeal. Pursuant to requirements of Federal Way City Code (FWCC) Section 22-434(d)(1), the city has 28 days from the date an appeal is received to determine whether or not the application is complete. The appeal request has been reviewed for completeness in accordance with FWCC Sections 22- 356, 22-434, and 22-33. The application has been determined to be incomplete in regards to the following applicable items: 1. A completed Master Land Use Application(enclosed). 2. Two sets of stamped envelopes with address labels (with City of Federal Way return address) and a list containing the names and addresses of the persons receiving the property tax statements for properties within 300 feet of each boundary of the subject property. 3. A copy of the county assessor's map identifying the properties specified in item#1 above. 4. Vicinity map. 5. Two copies of a current title report for the subject property. 6. Eight complete and bound sets of drawings prepared by a certified professional licensed in the State of Washington. Minimum drawing set shall include a topographic survey, site plan, preliminary drainage and grading plan,preliminary landscape plan, and building elevations. Mr. Ian M. Rollo June 2, 1999 Page 2 Maximum plan sheet size shall be 24 by 36 inches. One plan set reduced to 11 by 17 inches is required. It is expected that the plan set submitted for the building permit application can be copied to satisfy this submittal requirement. 7. Site photographs from each compass point referenced on the site plan. 8. Four copies of all geotechnical reports and information prepared for the proposed home and site construction. It is expected that the geotechnical information submitted for the building permit application can be copied to satisfy this submittal requirement. Please be advised that a second appeal was filed on May 20, 1999, by Mr. Earl E. Wilhelm regarding the director's geologically hazardous area decision. Every effort will be made to conduct a single hearing on both appeals. Mr. Wilhelm's application has also been deemed incomplete of essentially the same list of submittal requirements. Items 5, 6, and 8 referenced above are most readily available to Mr. Wilhelm but can be obtained by you through a request for public information filed with the city clerk:In an effort to reduce duplication of application materials,the city will accept Mr. Wilhelm's submittal of items 5, 6, and 8 to complete both appeal applications. In the event Mr. Wilhelm does not proceed with his appeal, you will be responsible for providing these items to make the appeal application complete. Upon resubmittal,the city will have up to 14 days to determine if the application is complete. The 14 day review period does not begin until all items identified above have been received. Please be advised that your application will continue to be considered incomplete until such time as items 5, 6, and 8 are submitted if you defer to Mr. Wilhelm's submittal of these items. Pursuant to FWCC Sections 22-31(b)(2)(c) and(d), when the appeal application is determined to be complete,the city will have 90 days to approve, deny, or return the application, unless the applicant consents to an extension of this time period. Upon acceptance of a completed appeal application,the city will issue a notice of complete application and proceed toward scheduling a public hearing before the city's hearing examiner. I own the house on Lot 55 next to the proposed home. I built in 1996. At the time of permit application, I was told by the City of Federal Way that I must build 25 feet from the slope that is located at the front of the lot. Section 22-1221 cites this rule. Lot 56 has the same slope. Why would the City not require my neighbor to do the same? 1 now understand that there are provisions to Section 22-1221 as stated in Section 22- 1244. This section cites reasonable use. I do not understand how the owners of Lot 56 can state that the lot cannot be reasonably used to build a house and still maintain a 25- foot setback from the slope. My lot is smaller than Lot 56 and I have a 20-foot sewer easement (unbuildable) located on the south side running east to west. I was still able to build a 4,900 square-foot house (including garage). I could have built over 7,000 square feet by adding another floor. I designed my house to take as much advantage of the water view as possible and still maintain the required setbacks. If I had not been required to build 25 feet back from the slope, my view would be improved. The current design of the proposed home on Lot 56 would negatively impact my view and the value of my home.
