In considering your request, Public Works' staff has evaluated the existing conditions along SW 293rd Street, reviewed Federal Way City Code (FWCC) Sections 22-1496, 22-1477, and considered past direction provided by the City Council. FWCC Section 22-1477 "Modification of Improvements Along Property Frontage" allows the Public Works Director to modify, defer, or waive required street improvements only after consideration of four specific reasons. The reason most applicable to your request is FWCC 22-1477(1)which states: "Improvements as required would not be harmonious with existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or city as a whole The proposed development provides an addition to an existing, single family house, with 50 feet of frontage on SW 293rd Street. Currently SW 293rd Street consists of a 21 foot paved roadway, and an 80 foot right of way. Due to the limited frontage width and steep topography, installation of all required improvements, such as streetlights, street trees, curbs and sidewalks, at this time would not create improvements that are harmonious with the existing street system, and would not serve the neighborhood in an advantageous manner. • 6 The City hereby grants a waiver of the required improvements . The property owner must sign a No Protest Local Improvement District Agreement (LID) covenant, in the event that a future LID is formed to make street improvements. A copy of the LID agreement is included for the owner's signature and must be notarized and returned to the city with a$9.00 check for recording fees made payable to King County Records and Elections, prior to the issuance of a building permit.
