I have completed a preliminary review of your application, and there is one issue that must be addressed before my review can continue. In-home daycares are permitted as class II home occupations. According to Federal Way City Code section 22-1069 (enclosed), in home daycares must meet certain requirements. One of these is that the lot size must conform to that of the applicable zoning district. The subject property is zoned Residential Single Family 7.2, which requires a minimum lot size of 7,200 square feet. Your lot size is 6,675 square feet. It is therefore legally nonconforming as to lot size. An in-home daycare may be approved for a legally nonconforming lot through a process III review. Process III review is an administrative review that is more extensive than the regular in-home daycare review. I have enclosed handouts discussing submittal requirements for process III. The fee for process III review is $1614. I have also enclosed handouts on our Preapplication Conference process. A Preapplication Conference would not be required for your project, but we do recommend it in situations such as yours. The Preapplication Conference is a feasibility meeting, where staff from various departments would have a chance to comment on your proposal and provide more information on the formal review process. The cost for the Preapplication is $321.00. This fee would apply toward your formal application fee if you decide to proceed with your project. Please be aware that you may not legally operate your daycare until you have completed the process III review. If you do operate the daycare without City approval, you may be subject to code enforcement action. If this occurs, the City may notify the Department of Social and Health Services that you are operating without City approval.
