In 2007 Council approved a red light photo pilot program which was then implemented in 2008. In 2009 school safety implemented. Collisions have dropped drastically since implementation. No motion made and no action taken. COMMUNITY CENTER POOL CHEMICAL VENDOR CONTRACT: Presented by Recreation Coordinator, Craig Feldman. This is a Request for Goods and Services Contract. King County went out to bid and secured the lowest bid. The cost is slightly higher this year; however we are using fewer chemicals since the filter realignment. The Committee made a motion to include a presentation on the chemical savings with the glass filter by Mr. Feldman at the next Council meeting. PERFORMING ARTS AND EVENT CENTER ORCHESTRA SHELL AUTHORIZATION TO BID: Presented by Deputy Public Works Director, EJ Walsh. Mr. Walsh presented a Power Point presentation outlining the request. This cost is in the approved budget, but the motion requires approval of Council for all FFE procurement. Contingency account covers FFE and construction. The shell cannot be rented and must be made specifically for the PAEC stage. Manufacturing lead time for the shell is 4-6 months. Tuesday, November 22, 2016 Page 2 3 CITY'0i Federal Allay 2017-18 HUMAN SERVICES GENERAL FUND GRANTS FUNDING RECOMMENDATIONS: Presented by Community Services Manager, Jeff Watson. Mr. Watson presented a Power Point presentation reviewing the funding recommendations and contingency plan. There were 83 applications with the total amount requested of just under $1.2 million. The recommendation is to fund 53 of the 83. The requested $75k for 2018 Day Center is not currently in the budget. This will be an additional request. The $75k can be requested in the next biennium budget and not accepted here. Committee Member Honda wants to wait until this time next year to make sure Day Center is meeting benchmarks before approving funding. Motion to fund the recommended HSGF grants in the aggregate amount of$516,000. The individual grant amounts shall be subject to the contingency that should funding for the human services general fund grants be either greater or lesser than the anticipated budget amount, there shall be a pro rata adjustment to all grants, except for those that would result in a grant amount of less than $3,000 to the December 06, 2016 business agenda for approval; motion seconded and carried 3-0. REIMBURSEMENT FOR ROW STAIRCASE: Presented by Deputy Public Works Director, EJ Walsh. Proposal to pursue reimbursement from the LIFT program for the amount that the City has already spent acquiring the land associated with the land for the right of way staircase. When the City bought the Target and Toys r Us parcels, they were not part of a ROW. The City will convert part of those parcels into ROWS and therefore, will be eligible to use LIFT funds. This is a mechanism to recoup some of the money that was spent to purchase the 2 properties. The amount would come from the 2016 allotment. The funds do not carryover from year to year. MONTHLY FINANCIAL REPORT - OCTOBER 2016: Presented by Finance Director, Ade Ariwoola. Mr. Ariwoola summarized the Monthly Financial Report for October 2016. Notable areas include: • General and street funds — Short on revenue, but still have 2 months to go. Expenditures are less than budgeted. • Dumas Bay — Expenditure and revenue are going up. • Utility Tax — Doing reasonably well. • REET— Doing very well. • Red light - Doing reasonably well. • Police — Positions identified under Prop 1. • Lakehaven — Part of the adjustment. • Prop 1 — Doing well and making sure individual police positions are covered. • Self-insurance — We have exceeded the budget in expenditure, but we are not carrying the entire risk. The City would not be exposed to the entire amount if there is a large claim. • PAEC—As of now, we still have about $8m left to fund the construction before we would need to tap into the approved inter-fund loan. There are many facets/processes that need to be addressed. An ordinance will most likely be brought to Council in January. • Transportation Benefit District (TBD) — If Council approves $15, they may have to wait 24 months before having another increase which can only be a $5 increase. You would have to wait 24 months between each increase. Desiree Winkler will check to see if we would have to wait the 24 months to increase by $5. The stop point for increases is $20. There was a consensus among Committee Members that they would like a study session prior to the first meeting in January regarding this topic. • Sustainable Funding—To have a FEDRAC subcommittee comprised of two people from Lakehaven, two from Chambers, Councilmembers and the Finance Director. The subcommittee would work on the long term revenue source for the City. This would be an "open" meeting. An authorization to form a subcommittee is needed from Council. Mr. Call suggested that there be a discussion with the Chair to come up with an idea and then present it. The EA provides licensing for all of the City's Microsoft software ranging from the Windows desktop operating system, Office productivity suite, Exchange/Outlook email system, SQL database and Windows Server platforms. The EA also provides many benefits to the City such as technical support and Software Assurance for licensed products which includes version upgrades to the latest release of the software, 30 days' worth of staff training (valued at almost $15k), and unlimited online training for Windows, Office and other products. This Enterprise Agreement will be purchased from CompuCom, an authorized Microsoft Reseller, which is selected based on the Washington State Department of Enterprise Services (DES) contract# T11-TSD-579. The contract with CompuCom and DES will expire in 2017, at which time DES will solicit bids again from Microsoft resellers. Each reseller provides a different price for software based on their margin with Microsoft. This is why there is a 5% inflator for the "Year-2" and "Year-3" payments, as it is unknown which reseller will be chosen based on the DES bids, and what the winning reseller's margin will be. Hopefully it will be the same or less, however, it is necessary to provide a possibility of up to a 5% increase. Budget: The EA renewal is split into three payments. The three payments are taken from 2017, 2018, and 2019 funds respectively. The "Year-1" (2017) payment will be $94,713.65. Deputy Public Works Director/PAEC Project Director�r/t SUBJECT: Performing Arts and Event Center Orchestra Shell Authorization to Award BACKGROUND On December 7, 2016 staff issued a Request for Bids for the Performing Arts and Event Center Orchestra Shell. Three bids were received and opened on January 11, 2017. After review of the three bids received, two were found to be responsive, responsible bidders. The third bid, submitted by Stage Right, did not include the required Bid Bond with their submission and additionally submitted an alternate product that by their own note on the bid form, `—does not meet the contract and bid documents in regards to the Design and Construction of Products. ' In accordance with the Reservation of Rights language within the Request for Bids package, this bid was determined to not meet the criteria set forth in the bid documents and therefore is recommended to be rejected. The lowest responsive, responsible bidder is Wenger Corporation with a total bid of $403,459.00. WHEREAS, the Society's principal function is to research, record, preserve and educate the public regarding the history of greater Federal Way; and WHEREAS, the Council desires to support the efforts of the Society to provide enhanced educational opportunities at the Cabins, and further its goals as described in its February 6, 2014 strategic planning document; NOW,THEREFORE, in consideration of the mutual agreements and covenants contained herein and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties do agree as follows: 1. The Society agrees to perform the following tasks through December 31, 2018: a. Provide light maintenance and cleaning of the Barker and Denny Cabins at Hylebos Park. b. Open the cabins to the public on the second Saturday of each month from 12:00 p.m. to 4:00 p.m. during the months of May through October. c. Ensure that docents are available to provide visitor information to the public. d. Accommodate special events at the Cabins upon request. Past examples have included school tours and Boy and Girl Scout tours. e. Enhance educational experiences by coordinating the presence of additional local groups such as the Northwest woodcarvers, Civil War reenactments, the Crazy Quilters of Federal Way, and the Old Time Fiddlers. f. Collect, document, preserve, conserve the cultural history of Greater Federal Way area. Grow the record by at least 2%. g. Educate the Greater Federal Way by making community presentations, i.e. schools, social classes at least for 5 of those shows per year. h. Obtain funds from various sources to pay for the expansion of programs and facility by increasing the private contribution by 10% over the 2014 amount in 2017. Identify fund raising activities appropriate to the Society's mission and consistent with fundraising strategies. i. Develop and implement strategies to attract a more comprehensive representation of Greater Federal Way community by increasing the membership by 5%per year. j. Expand the relationship with the business community of Greater Federal Way, and School District by increasing business community financial support and School District financial support by 5% per year. 18 k. Provide annual report to the Finance director on the accomplishments of the stated goals and services. 1. The Society will provide a quarterly invoice with interim progress report on the activities identified. 2. In exchange for the services provided by the Society, the City agrees to pay the Society annual sum of twenty thousand and 00/100 dollars ($20,000.00) in 2017 and an annual sum of twenty thousand and 00/100 dollars ($20,000.00) in 2018, for a total of forty thousand and 00/100 dollars ($40,000.00) over the life of the contract. 3. The terms of this agreement will commence upon execution and continue until December 31, 2018. The parties may agree in writing to extend the term of this Agreement. 4. Indemnification. The Society agrees to indemnify, defend and hold the City, its elected officials, officers, employees, agents, and volunteers harmless from any and all claims, demands, losses, actions and liabilities (including costs and all attorney fees) to or by any and all persons or entities, including, without limitation, their respective agents, licensees, or representatives, arising from, resulting from, or connected with this Contract to the extent caused by the negligent acts, errors or omissions of the Society, its partners, agents, employees, or by the Society's breach of this Contract. The City agrees to indemnify, defend and hold the Society, its officers, directors, shareholders, partners, employees, and agents harmless from any and all claims, demands, losses, actions and liabilities (including costs and attorney fees) to or by any and all persons or entities, including without limitation, their respective agents, licensees, or representatives, arising from, resulting from or connected with this Contract to the extent solely caused by the negligent acts, errors, or omissions of the City, its employees or agents. 5. Insurance. The Society agree to obtain and maintain general liability insurance covering liability arising from premises, operations, personal injury, bodily injury, death, and property damage with limits no less than $1,000,000 for each occurrence and $2,000,000 general aggregate. 6. This Agreement contains all of the agreements of the City and the Society with respect to any matter covered by this Agreement. No provision of this Agreement may be amended or added to except by written agreement signed by both parties. The Contractor shall perform the services more specifically described in Exhibit "A", attached hereto and incorporated by this reference("Services"), in a manner consistent with the accepted professional practices for other similar services within the Puget Sound region in effect at the time those services are p erl'onned, performed to the City's satisfaction, within the time period prescribed by the City and pursuant to the direction of the Mayor or his or her designee.The Contractor warrants that it has the requisite training,skill,and experience necessary to provide the Services and is appropriately accredited and licensed by all applicable agencies and governmental entities,including but not limited to obtaining a City of Federal Way business registration. TERMINATION. COiVIP1 NSA'TION. 4.1 Amount. In return for the Services, the City shall pay the Contractor an amount not to exceed a maximum amount and according to a rate or method as delineated in Exhibit"B",attached hereto and incorporated by this reference. Except as otherwise provided in Exhibit"B",the Contractor shall be solely responsible for the payment of any taxes imposed by any lawful jurisdiction as a result of the performance and payment of this Agreement. 4.2 Method of Payineiii. The Contractor shall submit an invoice upon completion of each audit as described in the Services. Payment shall be made by the City only after the City actually receives the tax revenue and within thirty (30) days after receipt and approval by the appropriate City reprc.9ontative of the invoice. INIDEMNIFICATION. 5.1 Contractor Indemnification. The Contractor agrees to release, indemnify, defend, and hold the City, its elected officials, officers, employees, agents, representatives,insurers,attorneys,and volunteers harmless from any and all claims, demands, actions, suits, causes of action, arbitrations, mediations, prcx eedings, judgments, awards, injuries, damages, liabilities,taxes,losses, fines, fees,penalties expemes, attorney's fees, costs, and/or litigation expenses to or by any and all persons or entities, including, without limitation, their respective agents, licensees, or representatives; arising from, resulting from, or in connection with this Agreement or the acts, errors or omissions of the Contractor in performance of this Agreement,except for that portion of the claims caused by the City's sole negligence. Should a court of competent jurisdiction determine that this Agreement is subject to RCW 4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Contractor and the City, the Contractor's liability hereunder shall be only to the extent of the Contractor's negligence. Contractor shall ensure that each sub-contractor shall agree to defend and indemnify the City, its elected officials, officers, employees, agents, representatives, insurers, attorneys, and volunteers to the extent and on the same terms and conditions as the Contractor pursuant to this paragraph. The City's inspection or acceptance of any of Contractor's work when completed shall not be grounds to avoid any of these covenants of indemnification. 5.2 Industrial Insurance Act Waiver. It is specifically and expressly understcxxl that the Contractor waives any immunity that may be granted to it under the Washington State industrial insurance act, Title 51 RCW, solely for the purposes of this indemnification. Contractor's indemnification shall not be limited in any way by any limitation on the amount of damages, compensation or benefits payable to or by any third party under workers' compensation acts, disability benefit acts or any other benefits acts or programs.The Parties acknowledge that they have mutually negotiated this waiver. 5.3 City Indemnification. The City agrees to release, indemnify,defend and hold the Contractor, its officers, directors, shareholders, partners, employees, agents, representatives, and sub-contractors harmless from any and all claims, demands, actions, suits, causes of action, arbitrations, mediations, proceedings, judgments, awards, injuries, damages, liabilities, losses, fines, fees, penalties expenses, attorney's fees, costs, and/or litigation expenses to or by any and all persons or entities,including without limitation,their respective agents, licensees,or representatives,arising from, resulting from or connected with this Agrenient to the extent solely caused by the negligent acts,errors, or omissions of the City. 5.4 Survival. The provisions of this Section shall survive the expiration or termination of this Agreement with respect to any event occurring prior to such expiration or termination. 6. INSUIUNCE, The Contractor agrees to carry insurance for liability which may arise from or in connection with the performance of the services or work by the Contractor, their agents, representatives, employees or subcontractors, as provided in Exhibit "C", attached hereto and incorporated by this reference, for the duration of the Agreement and thereafter with respect to any event occurring prior to such expiration or termination. The provisions of this Section shall survive the expiration or termination of this Agreement. 7. CON-RI DENTIALTTY. All information regarding the City obtained by Contractor in performance of this Agreement shall be considered confidential subject to applicable laws. Breach of confidentiality by the Contractor may be grounds for immediate termination. All records submitted by the City to the Contractor will be safeguarded by the Contractor. The Contractor will fully cooperate with the City in identifying, assembling, and providing records in case of any public records disclosure request. & WORK PROIDUC�. All originals and copies of work product, including plans, sketches, layouts, designs, design specifications, records, files, computer disks, magnetic media or material which may be produced or modified by Contractor while performing the Work shall belong to the City upon delivery. At the expiration or termination of this Agreement, all originals and copies of any such work product remaining in the possession of Contractor shall be delivered to the City. 9. BOOKS AND RECORDS. The Contractor agrees to maintain books,records,and documents which sufficiently and properly reflect all direct and indirect costs related to the performance of the Work and maintain such accounting procedures and practices as may be deemed necessary by the City to assure proper accounting of all funds paid pursuant to this Agreement_ These records shall be subject, at all reasonable times,to inspection, review or audit by the City, its authorized representative,the State Auditor,or other governmental officials authorized by law to monitor this Agreement. 10. INDEPENDENT CONTRACTOR. The Parties intend that the Contractor shall be an independent contractor and that the Contractor has the ability to control and direct the performance and details of its work, the City being interested only in the results obtained under this Agreement. The City shall be neither liable nor obligated to pay Contractor sick leave,vacation pay or any other benefit of employment, nor to pay any social security or other tax which may arise as an incident of employment. Contractor shall take all neccssary precautions and shall be responsible for the safety of its employees,agents,and subcontractors in the performance of the contract work and shall utilize all protection necessary for that purpose. All work shall be done at Contractor's own risk, and Contractor shall be responsible for any loss of or damage to materials, tools, or other articles used or held for use in connection with the work. The Contractor shall pay all income and other taxes due except as specifically provided in Section 4. Industrial or any other insurance that is purchased for the benefit of the City, regardless of whether such may provide a secondary or incidental benefit to the Contractor, shall not be deemed to convert this Agreement to an employment contract. if the Contractor is a sok proprietorship or if this Agi-mment is with an individual, the Contractor agrees to notify the City and complete any required form if the Contractor retired under a State of Washington retirement system and agrees to indemnify any losses the City may sustain through the Contractor's failure to do so. 11. CONFLICT OF INTEREST. Itis recognized that Contractor may or will be performing professional services during the Term for other parties; however, such performance of other services shall not conflict with or interfere with Contractors ability to perform the Services. If a violation of the City's Ethics Resolution No. 91-54, as amended, occurs as a result of the formation or performance of this Agreement,this Agreement may be rendered null and void,at the City's option. 13.4 Enforcement. Time is of the essence of this Agreement and each and all of its provisions in which performance is a factor. Adherence to completion dates set forth in the description of the Services is essential to the Contractees performance of this Agreement. Any notices required to be given by the Parties shall be delivered at the addresses set forth at the beginning of this Agreement. Any notices may be delivered personally to the addressee of the notice or may be deposited in the United States mail,postage prepaid,to the address set forth above. Any notice so posted in the United States mail shall be deemed received three (3) days after the date of mailing. A RESOLUTION of the City Council of the City of Federal Way, Washington, amending the fee schedule for 2017 and repealing the fee schedule adopted in Resolution No. 16-711. WHEREAS, the City is authorized under RCW 35A.11.020. 35A.63.100(2), and RCW 19.27.040 to require licenses for the conduct of business, permits for the construction of structures and improvements, and to impose fees to recoup the costs of processing and/or providing services; and WHEREAS, the Federal Way Revised Code establishes the basis for the assessment and/or collection of such license, permit fees, and service charges; and WHEREAS, the City Council deemed it is advisable and necessary to provide gradual annual increases in Land Use, Mechanical, Plumbing, Public Works, Electrical, and Building permit fees and to establish the mid-year Consumer Price Index for All Clerical Workers (CPI- W) for the Seattle-Tacoma-Bremerton area as the basis for such adjustments in Resolutions 98- 281, 01-351, 02-377, 03-406, 04-435, 05-462, 06-490, 07-513, 08-537, 09-567, 10-585, 10-599, 11-612, 12-626, 13-654, 14-673; 15-699; 16-711; and WHEREAS, the City Council has historically adjusted development services and permit fees under the Land Use, Mechanical Code, Plumbing Code, Public Works, Electrical Code, and International Building Codes in accordance to the percentage of inflation measured by the mid- year CPI-W for the Seattle-Tacoma-Bremerton area; and WHEREAS, the Transportation Impact Fees is indexed to provide for an automatic increase each year based on a three-year moving average of the Washington State Department of Transportation Construction Cost Index; and Resolution No. 17- Page I of 21 Rev 1115 59 WHEREAS, the City Council finds it necessary to provide for an annual inflationary adjustment as the basis for an increase; and WHEREAS, the City Council finds it necessary to revise building-related permit fees in order to ensure that fees reflect changes in the types of permits issued, more accurately recover costs associated with permit issuance, to remain consistent with surrounding jurisdictions, and to correct inconsistencies and errors; and WHEREAS, the City Council finds it necessary to revise the City fee schedule upon review of the fee table. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, HEREBY RESOLVES AS FOLLOWS: Section 1. Fee Schedule. The City of Federal Way hereby adopts the Amended 2017 Fee Schedule as attached hereto, identified as Exhibit A and hereby incorporated in full by this reference, for fees associated with the various licenses, permit processes, and other business activities of the City. Section 2. Sevcrabilit . If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this resolution. Section 3. Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto.
