Dear Mr. Sharpe:
This letter responds to your request for a shoreline exemption for a replacement of an existing CMU
retaining wall that abuts the south side of the residence at 32817 38th Avenue South, on North Lake. The
CMU retaining wall to be replaced has been damaged by a recent water main break near the residence.
You have also requested a determination as to whether this activity is exempt from State Environmental
Policy Act(SEPA)review.
Shoreline Substantial Development Permit Exemption
Washington Administrative Code(WAC) 173-27-040 identifies actions exempt from the requirement to
obtain a shoreline substantial development permit. WAC 173-27-040(2)(b)exempts, "normal maintenance
and repair." Subsection 040(b)(2)goes on to state that normal maintenance and repair means to restore a
development to a state comparable to its original condition, including but not limited to its size, shape,
configuration, location, and external appearance, within a reasonable period after decay or partial
destruction, except where repair causes substantial adverse effects to shoreline resource or environment.
There is no evidence that this activity will result in substantial adverse impacts to shoreline resources or
environments. Therefore, the replacement of the CMU retaining wall is considered an exempt action and
does not require a shoreline substantial development permit.
State Environmental Policy Act Exemption
WAC 173-11-800 identifies actions that are exempt from SEPA review. Subsection 3 exempts repair,
remodeling, and maintenance under specific circumstances. Repair,remodeling, maintenance, and minor
alteration is considered exempt, except on lands covered by waters, in which case only minor repair or
replacement is exempt. Given that the work involves replacement of an existing CMU retaining wall that
is not covered by water, it meets the definition of minor repair. Therefore, the proposed work is exempt
from SEPA review.
Work cannot commence on this project until building permit#09-103986-00-SF has been issued.

Sechrist residence at 32817 38th Avenue S
Dear Janet,
McBride Construction Resources Inc. will be applying for a building permit to do repairs
to the above referenced house.
This letter is to request an exemption from a substantial shoreline development permit for
repairs to the Sechrist residence due to a recent water main break at the street just above
their house. The house is located on the east shore of North Lake. The water from the
broken main washed some soil away from the south side of the residence, structurally
compromising an existing CMU retaining wall. Repairs involve temporarily shoring the
south elevation of the house and replacing the damaged wall to the same configuration.
Due to the fact that the house is structurally compromised and the fact that the rainy
season is fast approaching, we are requesting an expedited review of this project as well
as an expedited review of the shoreline exemption request.
We plan to take reasonable measures to keep silt out of lake. These measures include
placing a silt fence across the site below our work as well as a straw wattle. We will also
be covering any stockpiled dirt on site with plastic sheeting. The restoration landscaping
is not part of this permit request so we will leave the disturbed area covered with straw r
until the landscapers are able to complete the restoration.
Fernando Fernandez has already promised an expedited review of the building •'
