Dear Mr.Pederson:
This letter is in response to your December 10,2010,request for a nighttime work hour exception.You
have requested a temporary work hour exception to perform nighttime work associated with Lakecrest
Shopping Center Renovation,particularly development activity associated with the construction of a
canopy/entrance to the Market Foods Store. The store closes at 8:00 p.m. daily and in the interest of
public safety,you would like to work at night.As such,you are requesting relief from Federal Way
Revised Code(FWRC) 19.105.040 Regulation of Work Hours. Construction is anticipated to take place
the weeks of December 13,2010 to December 17,2010, and December 20, 2010 to December 24,2010.
It appears that you intend to work on December 24,2010, Christmas Eve,which is a holiday observed by
the City of Federal Way.As such,approval of this exception request will include requested work on a city
observed holiday.Work hours on these nights would be between 8:00 p.m.and 4:00 a.m.
Work Hours
Pursuant to FWRC 19.105.040,work hours are permitted outright between the following hours:
7:00 a.m. and 8:00 p.m. Monday through Friday
9:00 a.m. and 8:00 p.m. Saturday
Development activities and heavy equipment operations are not permitted on Sundays or holidays
observed by the city. However,the director of community development may grant revocable written
permission to engage in development activity other than the above permitted times, in accordance with
FWRC 19.105040(2)(a):
a) Any exception must be requested by advance written request to the director, including a
description of the specific exception(s)requested; proposed temporary construction mitigation
measures for any related impacts such as traffic,noise, and glare; and an analysis of how the
request meets the following criteria:
i. The work will not result in substantial adverse impacts to surrounding properties.
ii. The exception is necessary to avoid undue delay of project completion and/or long-term
inconvenience or disruption to the public.

Approval
It is anticipated that development activity during this limited time will not interfere with any residential
use.Furthermore, nighttime work is preferable to day time work because the shopping center is open
during the day and construction activity would impede with daily operations and cause a public safety
issue.Therefore,based on your written request,the Director of Community Development Services hereby
grants you revocable approval to engage in construction activity during the night and a holiday starting
December 15,2010 to December 24, 2010.
Notice
Pursuant to FWRC 19.105.040(3), an applicant must mail written notice,at least seven(7)calendar days
in advance of the approved work,to owners and occupants of property within 300 feet of the project
boundaries and post one or more notice boards on the project site,as determined by the director.The
notice must include the approved construction hours,general description of construction activities,
summary of mitigation measures accepted by the director, and two 24-hour project contacts for the
duration of the project.
However,pursuant to FWRC 19.105.040(4),the Director may waive the notification requirements based
on project location, scope, scale,or alternative comparable notification methods, and/or other reasonable
considerations.
The Director hereby waives the required notice requirements based on the following facts and conditions:
• Construction activity is limited and should not interfere with any residential use;no notification is
required to be sent to properties within 300 feet.
• Please provide the Department of Community Development Services a minimum of 24-hour
advance notice of the nighttime work.Also,please provide a 24-hour project contact in case any
noise complaints are received by the city.This written notice shall be provided to the City of
Federal Way by email, fax or letter, and shall reference the above city file number.Please direct
this notice to the attention of Becky Chapin.
Closing
Please be advised that the city may revoke or modify any exceptions approved under this section based on
verified complaints that the development activity or equipment operation does not meet the terms of the
approved exception, or if the activity created some unanticipated and verifiable adverse effect. If you

Hello,
This is John Pederson at Briere&Associates, Inc., the General Contractor for this project. We are requesting to work at
night temporarily in the interest of Public Safety. Specifically,the scope of work involves erecting glue laminated beams,
installing wood trusses and OSB sheathing above the entrance of the Market Foods Store,which is receiving a new
specialized canopy that will set it apart from the rest of the new mansard roof being installed over the covered
walkway. This store closes at 8 PM daily. The work hours we are requesting are 8 PM to 4 AM during the weeks of Dec
