SUBJECT: OAKES - #10 -102142 -00 -SF; 2811 SW 3001h Place
The following is a list of the findings for the 32' x 16' outdoor in -ground swimming pool proposed
on a lot with an existing single-family residence.
The property is zoned RS -15.0 and comprehensive plan designation is Single -Family medium
density. It is located in the Lakota Addition plat which was created in 1915.
City of Federal Way GIS mapping, King County IMAP, the Department of Ecology mapping, and the
USDA NRCS indicate this property contains potential landslide, steep slope, and erosion hazards.
This was confirmed by a submitted geotechnical report and subsequent clarification prepared by
GeoResources, Inc. Therefore, this project falls within a critical area as identified in Federal Way
Revised Code (FWRC), 14.30.010.
Consultation with the Washington State Department of Fish and Wildlife (WDFW) indicates that
this project is located 660 feet from a known eagle nest. WDFW has identified this project to be
within Washington State eagle buffer management plan Zone 2, as bald eagles are still listed as a
sensitive species by the WDFW. Zone 2 or the Secondary zone is defined as 400'— 800' feet from
an eagle nest, or 1/2 mile from a nest and within 250' of a shoreline.
FWRC, 14.05.030 states, in part, 'Fish and wildlife habitat conservation area"means the
management of land for maintaining species in suitable habitats within their natural geographic
distribution so that isolated subpopulations are not created. Habitat conservation areas include
but are not limited to such areas as:
(1) Areas with which endangered, threatened, and sensiti ve species have a primary
association. "
It is the City of Federal Way's determination that the area with which endangered, threatened and
sensitive species have a primary association is only within Zone 1 of an eagle buffer management
plan. Zone 1 or the Primary zone is defined as 0 — 400' from the nest. Therefore, the
redevelopment project on this site is outside a fish and wildlife habitat conservation area.
During the review of the proposed project, it was discovered that the original residential
development of this site in 2001 was approved and built without the benefit of geotechnical
analysis or environmental review.

Given the above-mentioned ARngs, the Planning Manager, in consult 'On with the Director of
Community Development Services and the Permit Center Supervisor made the following
determination.
The City of Federal Way had the opportunity to conduct environmental review on the development
of a property or portion of a property when the initial development occurred.
This property was developed atterthe City of Federal Way incorporated and when City staff had
the opportunity to require environmental assessments. Staff relinquished this option at the time of
initial development of this site although it may have been an unintentional oversight. The
property, including the area where the pool is proposed, has been improved and altered from a
natural state. Therefore, environmental review will not be required for the redevelopment of this
section of the property that has already been improved.

and the associated Bald Eagle Protection Rules (WAC 232-12-292)

All known nest tree sites (active or alternate) are protected. Any construction or vegetation removal within 400
feet of a nest tree requires a bald eagle management plan specific to the proposed land use (a site-specific
plan). The landowner(s) must contact and consult with Washington Department of Fish and Wildlife at (425)
775-1311 prior to any clearing or construction.
The following conditions apply to portions of the parcel that fall within the below distance guidelines:
❑ Any lot located between 400 and 800 feet of a nest tree: retain all known perch trees, all native
conifers >24 inches diameter at breast height (d.b.h), and all black cottonwoods >20 inches d.b.h. Also
retain >50% of pre -clearing or pre -construction native conifer/black cottonwood stand with diameter
distributions representative of the original stand (applies only to trees >6 feet tall). Pruning of the
above is acceptable provided < 30% of the live crown is removed. Topping of the above is not
permitted.
❑ Any lot located within < 1/2 mile of a nest and within 250 horizontal feet of the shoreline or top of
high bank bordering a shoreline: retain all known perch trees, all native conifers >24 inches diameter
at breast height (d.b.h), and all black cottonwoods >20 inches d.b.h. Also retain >50% of pre -clearing
or pre -construction native coniferlblack cottonwood stand with diameter distributions representative
of the original stand (only trees >6 feet tall). Pruning of the above is acceptable provided < 30% of the
live crown is removed. Topping of the above is not permitted.

landowner circumstances. Failure to comply with this plan constitutes a misdemeanor as set forth in RCW
77.15.130. Compliance with this plan does not ensure compliance with other federal, state or local laws.
