The following items must be addressed prior to receiving a building permit: 1. Street improvements, in accordance with Federal Way City Code (FWCC) Section 2-1473- 1474 standards, are required in conjunction with this permit pursuant to FWCC Article XVI "IMPROVEMENTS", as your proposed improvements exceed 25 percent of the assessed value of the structures on your property. Pursuant to FWCC Sec. 22-1477, the Public Works Director may modify, defer or waive the requirements of this article only after consideration of a written request from the owner for the reasons stated in the enclosed handout, "Right of Way (ROW) Improvement Modification Request." If you wish to seek modifications to required ROW and road standards, a written request should be sent to Ken Miller, Deputy Public Works Director, at the address above. Box 1327 Issaquah, WA 98027 RE: Permit #00-102395-000-00-SF; Peterson (NSF) 830 Eighth Ave South; Modification of Street Improvements Dear Mr. Jensen: This letter responds to your request to waive required street improvements along Eighth Ave South associated with your proposed development. After evaluating the existing conditions along Eighth Ave South, review of Federal Way City Code (FWCC) provisions (Sections 22-1496, 22-1477), and direction provided by the City Council, the Public Works Department hereby waives the requirements for street improvements applicable to your permit application, as discussed below. FWCC Section 22-1477 Modification of Improvements Along Property Frontage: This code section allows the Public Works Director to grant a request to modify, defer, or waive the required street improvements only after consideration of four specific reasons. The reason most applicable here is contained in FWCC 22-1477 (1) "Improvements as required would not be harmonious with existing street improvements." Eighth Ave South is classified as a local access street corresponding to Federal Way roadway section "U". This roadway section requires a 32-foot wide paved street with vertical curbs, four-foot planter strip, five-foot sidewalk, and a three-foot utility strip all within a 56-foot right of way. Application of the required street improvements would result in an improved roadway section that is not harmonious with existing street improvements which consist of a 36-foot paved road, vertical curbs, five-foot sidewalk, six-foot utility strip all within a 58-foot right of way. As a result, the required street improvements will be waived. The applicant must also execute a No Protest Local Improvement District (UD) Covenant in the event that a future LID is formed to make street improvements. A copy of the LID agreement is enclosed for the owner's signature, and must be notarized and returned to the City with a $9.00 check for recording fees made payable to King County Records and Elections, prior to issuance of a building permit. The conditions of this right of way modification will be applicable for one year from the date of this letter. If a building permit is not issued within the one-year time limit, the right of way modification will be void, and a new request for modification must be submitted.
