Dear Mr.Appleton:
The Department of Community Development Services has reviewed the Surface Water Management(SWM)
Division request for stream reclassification of a portion of Cold Creek,a major stream,located at the southern
portion of 29607 8th Avenue South(APN 052104-9011).As referenced in your request, SWM staff identified a
possible permanent natural fish blockage on a segment of the subject property.Federal Way Revised Code
(FWRC) 19.05.130 defines major streams as any stream,and the tributaries to any stream,which contains or
supports,or under normal circumstances contains or supports resident or migratory fish.The definition further
states that"[i]f there exists a natural permanent blockage on the stream course which precludes the upstream
movement of anadromous salmonid fish,then that portion of the stream which is downstream of the natural
permanent blockage shall be regulated as a major stream."
Cold Creek was identified as a major stream(fish-bearing)by the city's stream inventory consultant,URS,in
2001.URS inventoried streams throughout the city in accordance with the city's Environmental Site
Analysis/National Pollutant Discharge Elimination System Gap Analysis.Due to limited resources,URS was able
to only classify streams at road crossings and was not authorized access onto private property;therefore,stream
classifications are not precise and any development near an identified stream must be independently verified.
Following review of SWM staff's findings and this department's prior on-site review of stream conditions,the
Department of Community Development Services has identified the culvert opening located on the northern
portion of APN 052104-9036 as the point of permanent blockage due to natural gradient that was present prior to
installation of the culvert. This area is approximately 100 feet upstream from the area identified by SWM staff.
Pursuant to the above-referenced findings,Cold Creek will be classified a minor stream from the point of the
culvert opening on the northern portion of APN 052104-9036 and continuing upstream to Easter Lake.
As required by FWRC,the portion downstream(north)of the identified blockage will remain a major stream
through its eventual outfall into Puget Sound unless determined otherwise.The city's critical areas inventory map
will also be modified to reflect the above-referenced findings.

Request Re-classification of Stream No. 0385-2 from Major to Minor
The purpose of this memo is to request a reclassification of Major stream No. 0385-2,known as
Cold Creek, from a Major to Minor rating commencing at Tax Parcel No. 052104-9036 (aka-
Powell Woods) and continuing upstream, as discussed below.
While conducting field investigations on parcel No. 052104-9011 to determine the condition of the
stream channel(related to a pending City of Federal Way Surface Water Management Division
Cold Creek stream restoration project), city engineering staff utilized survey equipment to
document a naturally occurring fish blockage located approximately 1/8 mile upstream of the Des
Moines city limits. Specifically; the non-fish passable area is an area of incised native hardpan
native material located approximately 100 feet downstream of the existing tightlined portion ofthe
stream channel as depicted on the attached map titled "Exhibit A".
The justification for this request is that this portion of the natural forested ravine stream system,
at12%gradient, exceeds the Washington State Department of Fish&Wildlife allowable maximum
longitudinal channel slope criteria of 10%within a 50-foot section to accommodate fish passage.
Additionally, several smaller two to three foot height natural streambed blockages consisting of
combined woody debris and steep natural streambed areas exist downstream of the documented
steep area, further precluding fish passage. We are requesting approval for this change based on
the definition of a Major Stream, as listed below, under section 19.05.130 of the city code.
Major stream means any stream, and the tributaries to any stream, which contains or supports, or
under normal circumstances contains or supports,resident or migratory fish.If there exists a natural
permanent blockage on the stream course which precludes the upstream movement of anadromous
salmonid fish, then that portion of the stream which is downstream of the natural permanent blockage
shall be regulated as a major stream.
Please reference the attached copies of photographs of the fish blockage taken on the date of this
correspondence and Exhibit A map which documents the location of the natural fish blockage.
