Your inquiry had a couple different questions/comments you asked City staff to reply to in regard to multiple dwelling units on one property. Question/comment: The shop I am planning to build is going to have a temporary living space on the second level, including one bedroom, living room, bathroom and a kitchen. Currently there is a house on the property that will be demolished. Staff reply: Your letter was unclear regarding the timing of demolishing the existing single-family residence on the site. However, if the existing residence is going to be demolished before issuance of the garage with the residential unit above,then this is permissible by Federal Way City Code. If the existing residence is to remain on-site during construction of the new shop with residence above,then you would need to complete and sign a"Voluntary Compliance Agreement"(VCA)with the City in regard to the presence of two dwelling units on site.The VCA would outline the requirements and provisions to allow occupancy of one dwelling unit while another is being constructed on site,and identify requirements and timing for removal of one of the dwelling units. Question/comment:In the future I'm going to build a house on the lot, and the living area on the second level of the shop will be converted to storage space. Staff reply: As generally discussed above,the City may temporarily allow two residences on a single- family zoned parcel during construction of a new residence,provided the property owner signs a VCA as discussed above.I have enclosed a draft VCA for your review.The sample VCA is not specifically for your proposed action; however, I have enclosed this copy as a sample for you to consider for your future actions. During evaluation of your proposal,I identified that the site may qualify for an accessory dwelling unit. If you want to permanently retain two dwelling units on the property,one of the dwelling units may qualify as an accessory dwelling unit(ADU) under Federal Way City Code requirements.For your convenience, I have enclosed a handout on ADU requirements. Given the preliminary nature of the proposal,I cannot determine if one of the unit(s)would meet all of the design and size requirements for an ADU,but it may V • • ` 'Mr.Manchik fi October 30,2007 Page 2 be feasible for the subject site.If not,you could enter into a new VCA in the future when you build another new house on the property. This correspondence does not constitute project approval and does not waive compliance with any applicable existing or future codes or regulations.A complete review of the site plan was not conducted. Any proposal must comply with all applicable local,state and federal regulations.Building permits are required for any structures unless exempt by the International Building Code. Currently on the property there is a one-story house, which is going to be demolished. The shop I am planning to build is going to have a temporary living space on the second level, including one bedroom, living room, bathroom and a kitchen. This temporary shop/apartment will be hooked up to the new three bedroom septic system. In the future when I'm going to build a house (north of the lot), the living area on the second level of the shop will be converted to a storage space and all plumbing fixtures will be removed and permanently plugged. Attached with this letter is a preliminary site plan with the location of the proposed shop house, and a septic system (has been approved for 3 bedroom). Please take a moment to look over the proposed structures. Your written approval would be greatly appreciated.
