The City's Planning Division has completed an administrative land use review of the proposed exterior
renovations to Tao Restaurant&Lounge located at 30333 Pacific Hwy South.The Comprehensive Plan
and zoning designation for the subject property is Community Business(BC).The subject property's
restaurant use is a permitted pursuant to Federal Way City Code(FWCC)§22-752.Formal plans were
submitted on September 29,2008,and a resubmittal made on October 27,2008.The Department of
Community Development Services hereby conditionally approves the Process I application as noted
below.
CONDITIONS
Additional landscaping is needed along the West Elevation.The proposed site plan does not show any
shrubs or groundcover along the West Elevation.A significant screen of trees,shrubs,and groundcover
appropriate for the site shall be incorporated to screen the blank wall.Please modify the proposed
landscape plan,to add number and type of trees,groundcover and shrubs,along the entire West Elevation
when resubmitting plans for the building permit.
FINDINGS
I. As shown in the Process I resubmittal,stucco will be applied to three sides of the building.The West
Elevation will get re-sided and a landscaping buffer will be added to screen from the right-of-way.
The plans also show an awning above the entrance with side windows and a single window located
next to the egress door.
2. Other renovations will include architectural details/lighting on the South Elevation,new entry door
and windows,trellis with rockery and fountain,decorative concrete walkway along the front façade,
and a concrete apron around the entire building.The parking lot will get re-striped and landscaping
will be added.
3. The proposed improvements do not reduce required parking,landscaping,buffering,open space,or
public areas;do not change the location of utilities or easements; and create no impacts to sensitive
areas or significant trees;and does not require the entire site to be brought into conformance with
current development regulations.

4. The City's Building Division is currently reviewing the associated building permit(File#08-
104840-00-CO).Construction of the proposed improvements may not begin until the building permit
is approved. 1
APPEALS
The effective date of this decision is November 1,2008,or three days from the date of this letter.
Pursuant to FWCC §22-368,any person who received notice of this administrative decision may appeal
the decision to the Federal Way Hearing Examiner by November 17,2008.Any appeal must be in the
form of a letter delivered to the Department of Community Development Services with the established
fee.The appeal letter must contain a clear reference to the matter being appealed and a statement of the
alleged errors in the Director's decision,including the identification of specific fmdings and conclusions
made by the Director disputed by the person filing the appeal.No work on the proposal may begin until
the end of the appeal period.
In that you are the only party of record,you may waive your right to appeal by submitting a letter to this
effect to the City of Federal Way,Department of Community Development Services.If you waive your
right to appeal,you may begin work once you have obtained the necessary building permit approvals.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes,policies,and
standards relating to this development.This Process I approval does not constitute approval of a building

Dear Ms. Shannon:
The City of Federal Way's Department of Community Development Services is in receipt of your
request to modify the West elevation landscaping plan. You have requested to plant Leyland Cypress
in place of the groundcover and shrubs required per the conditional approval of the Use Process I
application. The Department of Community Development Services hereby approves this
modification of the landscaping requirements.
As part of the conditional approval you still must submit modified landscape plans with the building
permit(File#08-104840-00-CO). The landscape plans shall now include the proposed Leyland
Cypress every five feet for the West elevation to screen the blank wall. Please indicate the size of the
trees as well.
