I 2/23/01 5:25PM - - Spoke to Zaryn Sayer. He asked how could be appeal Heather's letter denying the business to have a freestanding sign reviewed as a multi-tenant complex. I review her letters with him, reminding him of the options noted, (1) Remove, (2) Apply for a sign variance or (3) revise permit to propose sign for single tenant occupant. He said that was unfair because he believed his site is multi-tenant. I explained how it was determined that the site would be categorized as multi-tenant, The city looked at entrances, employees, location of the research office vs. the real estate office, exterior identification, etc. I said that I went to the site with Heather to review those criteria and the manager in charge stated that she managed both the rental and the real estate offices and that she interchanged from one to the other. She said there was no real physical separation for the two businesses, however, she did point to the back of the office where there was a pile of paper work stacked on a desk and she said that she kept the rental research information back there. There was no visible distinction on the interior of the office showing where the real estate business end and where the rental research began. Furthermore, there was no indication on the exterior that there are 2 businesses being operated at that building. Furthermore, the both businesses are operated by the same person. Mr. Sayer stated that it was not a code requirement that separate employees be required to operate separate businesses. I stated that the code may state such a fact, however, the Director interprets and implements the code, as such, it was decided, that these are the type of criteria we look at, in order to determine whether a business should qualify for a bigger sign. Otherwise, all single tenant businesses may get 2nd business licenses just to get larger signs. Mr. Sayer stated that his next option would be to file lawsuit. I asked then, if he was going to just keep the sign in place and ignore Heather's letter which gives a deadline to take one of three actions to avoid the monetary penalty from being assessed. He asked what other choice did he have. I stated that he could appeal the denial in a sign variance to the hearing examiner. He said that he wanted to appeal without having to pay the appeal fee. I said the fee could not be waived. He said he thought this was very unfair. I told him that I understood his frustration, but reviewed his site again, asking him, why, "if it is two different businesses, aren't there separate employee's, separate entrances identifying which business is where, a distinction inside that separates the two?". He said there were two different businesses there, but that he didn't believe there has to be 2 different entrances, etc. I stated that he had until March 7, 2001 to make a decision. Please refer to my previous letter for the reasons for this decision. As I am not able to approve your application for a multi-tenant sign, there are three options open to you: (1)Revisions may be submitted to reflect that this is an application for a single tenant sign, according to the requirements set out in my previous letter; (2) The existing nonconforming - - sign may be removed; or(3) You may submit an application for a variance from the sign code. Please be aware that staff will most likely not support a variance, based on the criteria established by the zoning code. Please refer to the handouts on the variance process enclosed with my previous letter. You must act upon one of these three options prior to March 7, 2001. Dear Mr. Lee: The above referenced permit was submitted to the City on October 3, 2000. I notified you by phone on October 18, 2000 that the permit had been placed on hold because the sign area proposed for the freestanding sign exceeds the sign area allowed. The sign area proposed for the freestanding sign was 128 square feet for the total of all sign faces. The maximum sign area permitted for a single tenant sign in this zone is 80 square feet for the total of all sign faces, with no one face exceeding forty square feet. Your request to have the site reviewed as a multi-tenant complex to be eligible for a larger sign is hereby denied. The site does not meet the definition of a multiuse complex per Federal Way City Code (FWCC) Section 22-1 (enclosed). A site inspection conducted on January 4, 2001 showed that there are not specific exterior entrances for different uses on the property. Additionally, both Zaran Sayre& Associates and Rental Research, Inc. share office space and have the same employees. Until last month, both Rental Research, Inc. and Zaran Sayre & Associates were listed on the same business registration. Additionally, there is nothing on-site which would indicate to the public that there are two separate businesses on the property. This information was presented to Kathy McClung, the interim Director of Community Development, and it was agreed that for the purposes of sign permit review this site is single tenant. Please submit revised plans that reflect that the maximum sign area allowed is 80 square feet for the total of all sign faces. Alternatively, you can apply for a variance to the sign code through Process IV (handouts enclosed). To be eligible to apply for a variance, you would need to demonstrate that the sign meets all six criteria in FWCC Section 22-1603 (enclosed).
