Sound Transit Status. The technical team for the Station 3 has decided to meet every other week to work out issues and details related to the completion of the station. The last meeting was June 20th to discuss four items of concern including: • Crosswalk options crossing 320th between the station and the Commons area are still being examined. Options reviewed include special lighting, speed bumps, identification of City entry expecting slowdown, differing intersection material highlighting the crosswalk, and shuttling passengers from parking areas. • Based upon the wetland report that was submitted, there is only one wetland existing outside the WSDOT right-of-way potentially affected by the construction of Sound Transit. It will be reviewed for accuracy of the report. Consultant is being contracted for this service at this time. • Parking for persons using the Light Rail is still being discussed and will probably remain an item for discussion. and what are options that exist including the parking garage? • What other impacts will Transit Oriented Development (TOD) have on retail, road systems and housing in the City? 2. Full Year. Due the large number of activities we have been charged by Council to completing, I anticipate a large number of informative meetings and public hearings to be held this year. First projection shows that we could have eight informative meetings for three major projects on our schedule and a number of informative meetings to discuss docket items. I also expect four public hearings, some of which may take several nights. For the benefit of all, I would like to know any planned absences that you may have for the year. This information will allow us to efficiently plan for such meetings, and insure that we have a majority when voting on particular issues. 3. Council Passim the Work Program Largely as Presented to You. Within your packet is the Planning Commission Work Program passed by the Council on January 2nd and signed by the Council on January 6. The program notes which items are indicated for consideration through the "Docket" procedure and which ones will most likely be addressed as separate projects. There may be some noted now as being within the "Docket" procedure, but if complex, that would be considered as a separate item for consideration outside the docket. This new procedure is intended to allow for more updates to the plan and regulations requiring a less number of public hearings. The docket procedure is used throughout the region by various jurisdictions and has been accepted as an appropriate means of updating plans and regulations implementing the plans by the Growth Management Hearings Board. H .N -i N ci C1 Q7 a) Ol ci Ln m V Ln LO n 00 .� Docket Comparison and Questions to Discussed • Choice: Federal Way's City Council, through public hearing in June, makes a choice as to what items will be reviewed for docket and which ones will not. Other jurisdictions often require the staff to submit a list based upon the workload to the Council or the Planning Commission to determine final considerations. None of the other jurisdictions examined use a hearing method to determine what or what not to consider within their docket. Sometimes a list is required for review by the public before the council makes its decision as to what to consider within the annual docket. • Deadline for submittal: Federal Way has within its code that submittals requesting amendment to the Comprehensive Plan must be made by September 30th to be considered the following year. Some jurisdictions have no time indicated, two with dates similar to ours and one with a deadline in the spring of the year to be considered. Tacoma has a deadline of May 30, after which items still may be considered, but "may not be considered until the following annual docket." • Who can initiate a change. In all jurisdictions examined any person, organization or the jurisdiction can request an item for docket review. In one jurisdiction, the Hearing Examiner can make the request and several of the jurisdictions specifically name the Planning Commission and the Director as ones who can make the request. Applications and fees are often associated with private requests. • Time for decision and review. Federal Way, the same as all the other jurisdictions examined, has an "annual review" known as docket, which, as required by the State, happens no more than once per year. But jurisdictions indicate no time when decision on the annual review, or docket, has to be made. Most jurisdictions make decisions at the end or the beginning of a year. There is no requirement by State when this has to be done. There is also no time required within other jurisdictions to when decisions are made determining which items will be considered for the annual docket. Only Federal Way establishes a timeline for deciding which items will be heard for docket through its hearing process which occurs in the middle of the year. • Who Makes the Decision for Items to be Considered. In Federal Way, like in many jurisdictions, the decision is made by the Council. In Tacoma, after items are presented to the public for discussion, a report from staff is presented to the Planning Commission who makes the determination of which items to be considered. In several cases, the items considered depends upon the complexity of the issue and the amount of staff time necessary to complete review of proposed amendments. The question is asked, "How much can we accomplish?" and can be a "first come first serve" agenda. • Regulation Review. The City of SeaTac has adopted a "Regulation Review' procedure within their code which allows them to make changes to their code, without it being tied to the docket procedure and when it does not deal directly with their comprehensive plan. Questions to Consider in Review of the Docket Process. 1. Do we need a hearing to make determination of items to be considered on the annual docket? 2. Should there be a deadline for application for amendment to the Comprehensive Plan or regulation, and if so, what should that deadline be? 3. Who makes the decision on what is to be considered on the annual docket? 4. Should there be a date when the docket item decision is made, and if so, what date? 5. Should there be a date when final docket is decided upon, or a date when it is presented to Council? 6. Is "regulation review" a process that should be explored? Staff will be preparing a legislative proposal to increase density of all parcels in this area as part of the 2018 Planning Commission Work Program. This will include environmental review and analysis and evaluation of how the amendments comply with the Federal Way Comprehensive Plan, the King County Countywide Policies, and the Puget Sound Regional Council's VISION 2040 Plan. Staff will then bring the amendments with the Mayor's recommendation back to the Planning Commission for a public hearing. However, because the Growth Management Act (GMA, RCW 36.70A.130 [2] [a]) limits comprehensive plan updates to no more than once per year, except under certain circumstances, the earliest action could be taken on these updates is January 2019. 2
