The purpose of this inspection was to assess whether these building materials contained asbestos prior to demolition of fire-damaged areas. ASBESTOS SAMPLING—METHODS & RESULTS Mr. Martin Rose, MS, CIH, Principal Consultant with Rose is an EPA Asbestos Hazard Emergency Response Act(AHERA)-accredited Building Inspector(Certificate Number 144299, expires Oct 23, 2014). Rose Environmental collected samples of suspect asbestos-containing materials; the samples were collected full depth to the surface of the underlying substrate. Asbestos Laboratory Analysis The bulk samples collected were submitted under strict chain of custody procedures to NVL Laboratories, a qualified independent laboratory for analysis. The asbestos samples were analyzed using polarized light microscopy(PLM) with dispersion straining in accordance with US EPA method 600/R-93/116 as specified in 40 CFR Chapter I(7-1-93 edition) Part 763, Subpart F,Appendix A, pages 499-504. Polarized light microscopy quantifies asbestos concentrations at between 100% and 1% detection levels. Levels below 1% can only be stated as "trace." PAGE 1 OF 3 . . I it \ ' s ii 0 , CONCLUSIONS In summary,the results of Rose Environmental's asbestos inspection revealed asbestos- containing materials with content greater than 1%in ceiling and wall surfacing material throughout the dwelling. Because ceiling paneling has been demolished throughout the dwelling as part of the fire response,Rose Environmental recommends all materials in contact with the ceiling debris be assumed to contain chrysotile asbestos. Asbestos-containing materials are required to be removed and disposed of in accordance with Washington State Regulations prior to any demolition,renovation, or remodeling that would disturb these materials. Washington State Department of Labor and Industries and PSCAA require that the abatement be performed using Certified Asbestos Workers under the direct on- site supervision of a Certified Asbestos Supervisor. This Voluntary Correction Agreement("Agreement") is made as of this day of June, 2014, between Michael Maty("Maty"or"Property Owner"), fee title owner of the real property located at 28546 20th Avenue South, Federal Way, Washington(the "Property") and the City of Federal Way, Washington, (the"City"), (collectively,the "Parties"). 2. Description of the Property. The Property includes King County parcel number 422200-0200 situated within the City of Federal Way, King County, Washington. 3. Admission by the Property Owner. Property Owner admits that the structure on the above listed parcel was damaged by fire, so as to have become dangerous to life, safety,morals or the general health and welfare of the occupants. Property Owner admits that due to the fire damage,the structure is dangerous and unfit for human habitation. 4. Agreement. The Parties hereto agree as follows: a. Property Owner agrees to contract with a professional, licensed, and insured contractor to remove all debris and complete the cleanup of the fire damaged Property. Property Owner must provide the City with the name of the contractor(s), and subcontractor(s), if any. Debris removal and other clean-up work must be completed within two weeks of this Agreement, on June 19, 2014. b. Property Owner agrees to notify the Ci 1i fire arms are recovered during cleanup and provide documentation as to how the •i s are secured. c. Upon completion of the cleanup ' �y owner agrees to obtain a fire damage permit by 12:00pm on June 19,2014 ane c -sule an inspection by 4:00pm on June 19,2014. Right of Entry: Property Owner agrees that the City may enter and inspect the Property at mutually agreeable times to determine compliance with this Agreement. i. Property Owner agrees that if mutually agreeable times for inspection cannot be arranged due to Property Owner's unwillingness to cooperate with the City, the City may enter the Property at reasonable times and for reasonable lengths of time. Property Owner hereby releases and discharges the City and its officials, employees, agents and representatives, from any and all claims, demands, liabilities, and causes of action of every kind that have arisen from or are related to the violations on the Property,under federal, state, or local law. This release is intended to be all-encompassing and to fully resolve all claims, demands, liabilities, and causes of action between the Parties existing at this time. It is further understood and agreed that this Agreement is not construed as an admission of liability on the party of the City of Federal Way, or by its officials, employees, or agents, by whom liability is expressly denied. The Parties do not intend the release contained herein to release future claims, if any, for breach of this Agreement or any false representations herein. The foregoing release does not extend to, and in no way alters, any of the rights of the adjoining property owners. 8. Recording. Upon breach of this Agreement,the City may record the Agreement against the Property with King County. The Property Owner shall reimburse the City for all King County recording fees, within 21 days of recording. 9. Covenants Running with the Land. The conditions and covenants set forth in this agreement shall run with the land, and the benefits and burdens shall bind and inure to the benefit of the Parties. In the event of any litigation or dispute resolution process between the Parties regarding an alleged breach of this Agreement, the prevailing party shall be entitled to any award of attorney's fees. 13. Entire Agreement. The Parties each represent and warrant that they have full power and actual authority to enter into this Agreement and to carry out all actions required of them by this Agreement. All persons are executing this Agreement in their representative capacities and represent and warrant that they have full power and authority to bind their respective organizations. 16. No Presumption Against Drafter. This Agreement has been reviewed and revised by legal counsel for both Parties and no presumption or rule that ambiguity shall be construed against the party drafting the document shall apply to the interpretation or enforcement of this Agreement. 17. Legal Representation. In entering into this Agreement,the Property Owner represents that it has been advised to seek legal advice and counsel from its attorney concerning the legal consequences of this Agreement; that it has carefully read the foregoing Agreement and knows the contents thereof, and signs the same as its own free act; and that it fully understands and voluntarily accepts the terms and conditions of this Agreement.
