I declare under penalty of perjury under the laws of the united states that the foregoing is true
and correct.
I am writing to petition a waiver for the school impact fee of $3,357.90 from an upcoming ADU
unit on my family's lot. This ADU will be a one bedroom one -bathroom 799 sq. ft. addition to an
existing home and lot that paid the school impact fee when it was built a few years back and that
pays annual taxes that include school fees. The home does not have any children attending the
schools in federal way since 2015, yet taxes are paid annually either way. The people who will
move into the ADU are already living in the main home. No one new is intended to move into
the ADU and no children will be residing in the ADU.
In the exemptions and credits of sections 19.95.060 it states that "the following shall be exempt
from the application of impact fees: (a) Any form of housing exclusively for the elderly,
including nursing homes and retirement centers, so long as these uses are maintained in
perpetuity and the necessary covenants or declarations of restrictions are recorded on the
property to ensure that no children will reside in the development;" We are willing to sign a
declaration stating that no children will reside in the development.
When speaking to Mr. Davis, the community development director, he stated that he wouldn't
approve a waiver because I could in 6 months go on and get pregnant or turn around and sell the
ADU to a family with children. I can, unlike him, state that I, as the only woman going to be
living in the ADU, will not have any children while residing in the ADU and that if by any
chance its sold, when transferring owners, the restriction will appear alerting the city of such.
Mr. David should not speculate pregnancies because he does not know if I can or cannot even
bear any children. Speculation is not part of the code, and yet that was the only reason I was
given to not waive the school impact fee.
The cost of the school impact fee is also excessive compared to the amount of money going to be
spent building this ADU and the chances that a child will reside in this one -bedroom addition. As
a member of the family living in the main home and the one who will move into the ADU we
feel robbed by the city by being imposed such fee due to that no children will live nor already do
live on the lot or ADU, and because we annually pay taxes and fees toward schools that no one
in our family attend to.
Thank you for taking time and reviewing our petition and I hope you take into consideration our
petition to waive the fee but if it's not possible to waive the fee to at least lower the amount due.
