Section 22-1453 of the Federal Way City Code requires that the first 40' of the driveway be paved. You have told me that you have a gate approximately 40' away from the, road and are willing to use pavers up to this point. I have discussed this with Ken Miller, Deputy Director of Public Works. He has no objection to using pavers from the property line to the gate, but the option of the driveway in public right of way must be asphalt to match the existing road. If this is a workable solution to you, please contact Kathy Messinger, Engineering Technician at 253.661.4127 to get the specifications for the portion in the right of way. No additional permit is required for this work as long as it is only adding the apron adjoining the driveway and sealing the right of way. To complete your permit application, please submit two copies of a revised site plan with a notation of how the driveway will be paved and the location of the gate to Kari Cimmer. Per Federal Way City Code(FWCC) Section 22-334(3)(enclosed), if an applicant proposes to increase the gross floor area of any use on the subject property,then the applicant shall comply with all development regulations currently in effect.Any existing improvements on the property that are nonconforming must be brought into compliance.A nonconforming improvement on this property is that the existing driveway is gravel.Per FWCC Section 22-1453(enclosed),parking areas and driveways must be surfaced with a material comparable or superior to the surfaces material of the right-of-way providing direct vehicular access. For residential uses with a driveway exceeding 40 feet in length,only the first 40 feet must be paved. In front of the subject property, South Dash Point Road is paved. Therefore,the first 40 feet of the driveway(starting from the edge of the paved right-of-way and extending towards the property)must be paved.However,this requirement may be modified per FWCC Section 22-1403 (enclosed).If you wish to request a modification from the driveway paving requirements,please explai in writing how all criteria under this section are met.However,because of the conditions on this site,it s unlikely that the modification will be granted.I confirmed with staff in the Public Works department thit you would not need to obtain a permit to pave up to South Dash Point Road. Please revise your site plan to reflect the above requirements and resubmit two copies of your revisions Or submit a request for modification.
