Does the tenant improvement work proposed by a church constitute a "Change of Use" in the
space previously occupied by a retail store at 2020 South 314th Street?
ANALYSIS
The permit applied for on March 10, 2010,is for tenant improvement work which is typically exempt from land
use processes,unless there is a change of use as noted below:
Per FWRC 19.15.020 Exceptions(in part).Permits for the following are exempt from the provisions of process I
through IV:: . . .
(2) Any tenant improvements or normal maintenance on the subject property necessary to meet the varied
requirements of continuing or succeeding tenants. . . . "
Per Federal Way Revised Code(FWRC) 19.15.030 "Review processes for improvements and additions to
developed sites. Improvements and/or additions to existing developed sites shall be subject to land use review
processes as follows:
(1) "Process I. Improvements and/or additions to an existing developed site that are exempt.from SEPA shall
be processed using process I,provided the improvements and/or additions do not exceed any of the following
thresholds:
(a) There is no change of use.
(b) There is no reduction in the amount of required landscaping, buffering, open space, or public areas.
(c) There is no material change or reduction in the amount of required parking.
(d) There is no material change in the location of utilities, easements, or pedestrian connections.
(e) There is no material change to the approved architectural design.
j) There are no additional adverse impacts to sensitive areas or significant trees."
Per FWRC 19.15.030(2) as noted above,the proposed work for improvements to the tenant space may exceed the
threshold for process I, as there may be a change of use.
Per FWRC 19.05.030 C Definitions. Change of use means the general character of a use has been modified. The
following is an item-by-item analysis of this definition.

(1) Hours of operation;
The hours of operation differ from the previous tenant in this space.

The hours of operation for church are similar to the hours of the previous retail tenant.There is a minor change to
the evening hours; however,with an active 24-Hour Fitness in this same building that operates 24 hours a day any
additional impact should be minimal. The zoning is City Center-Frame and the site is surrounded to the south and
west by other commercial uses and multifamily uses to the east and north.
(2) Required parking;

of parking stalls on site is 541.

(2A) Required parking;
The size of this multi-tenant building in which the tenant space is located is 114,293 square feet and the
total number of parking stalls on-site is 541. Currently, there are 200 members of the congregation. This
number was used to calculate the number of parking spaces.
Existing Retail/Office use 80,471 sqft ± 300= 269 spaces
Existing Recreation use 18,000 sqft _ 100= 180 spaces
Proposed Church use 15,643 sqft
Current congregation size 200 members -2.5 per vehicle= 80 spaces
Total= 529 spaces
The current number of parking stalls appears to be sufficient to support the addition of a 200-member
church at this site. If the church membership, plus up to 10 church staff, increases the occupancy by 31
or more,the parking at this site will no longer be sufficient.
(3) Traffic generation;
Summary of the analysis submitted by Sarady Long, Senior Transportation Planning Engineer is since the
proposed church will not generate more trips than the previous retail use during the weekday peak hours,
the Traffic Division will have no comments on this project.
(4) General appearance;
No change in exterior appearance.
(5) Type, extent or amount of indoor or outdoor storage;
No proposed change or impact.
(6) Constituents of surface water discharge or runoff.
No proposed change or impact.
CONCLUSION
Upon review of the tenant improvement application and pertinent decisional criteria as noted above, the location
of a church in this former retail space does not constitute a change of use. The tenant improvement work will
not require further review or process at this time. Therefore this permit is conditionally approved for a
congregation membership not to exceed 220 members plus up to 10 church staff(230 in total). If the
membership exceeds this number, further review by city staff may be required.

Subject: Parking standard for churches in former commercial space
Kari,
I checked with Matt and he has done some research on this and also discussed it with Sarady in the past. What they
have come up with is a standard of one stall per every 2.5 people in the congregation. This is because on average church
attendees come in groups of 2.5 average per vehicle. It seems you could apply this standard with the caveat that the
applicant should consider whether their congregation might grow in the future and whether or not they would have
enough parking if it does grow. Assuming we issue the permit, it would be good to specify that the use is allowed based
on the X number of people they say are attending and the X number of stalls available on site. That way, if the
congregation does grow beyond what is approved and there is a resulting parking problem on site then we are on record
as to what was approved and that it was based on the info the applicant submitted.
This is a different approach to my first take on this which would be to calculate the potential assembly numbers based
on size of facility. Obviously, if we base it on size, the result would be much greater number of parking stalls needed. So
if they want to base it on the estimated congregation size, and we allow this, then we will need to be very clear with
them as to what is being approved and possible ramifications if they outgrow the parking available on site.

have calculated the occupan load as . Seating area; 8665 sq ft divide by 7 = 1238 occupants,
stage area 596 sq ft dived by 7 = 85, class rooms 88 and office area as 2. The total occupant load
